Lo scopo del contributo è quello di introdurre la sezione monografica, frutto del convegno Poteri patrimoni scritture. L’abbazia di Pomposa tra esarcato e regno (secoli IX-XI), organizzato nell’ambito del progetto scientifico ‘Cantiere Pomposa’. Gli autori, dopo aver tracciato un breve bilancio degli studi sul patrimonio manoscritto di Pomposa, che affondano le radici nell’erudizione ecclesiastica del secolo XVIII, sottolineano l’importanza del cambio di prospettiva, da locale a sovralocale, e dell’attenzione all’assegnazione dei beni fiscali ai monasteri regi per comprendere le vicende politico-istituzionali e culturali dell’importante abbazia del delta padano nei secoli centrali del medioevo.

There appears to be a constantly incontrovertible, yet delicately inseparable cord, between land resource as an all-time invaluable asset, and meaningful socioeconomic growth and development. Much as this assertion holds, what enigmatically remains almost unsolvable is the seeming unending mystery that surrounds 'wilful' prevention of access to this very non-substitutable resource, in spite of its tangentiality to virtually all endeavours, around which the survival of all human beings revolves. Thence, it is compellingly tempting to reason that, some 'unseen' factors are decidedly making the delivery and accessibility of land, especially within urban milieu, extremely difficult, so much that, enviable growth and development might be so perennially elusive, particularly to the poor segment of the populace, which unfortunately forms the largest proportion of any country's citizenry, Nigeria inclusive. Although, the trend facades itself to be solely caused by economic and other attendant pecuniary factors, but as all the economically-defined strategies seem not too effective over the years, to finally nail several challenges associated with formal land delivery and accessibility; it behoves upon researchers and policy-makers alike, to look beyond the ordinary. Hence, the demystification exercise such as this, which is geared towards unravelling this mystery, reveals more factors that are indeed non-pecuniary, this is the crux of this study.

Als Informations-und Planungsgrundlage für eine regional differenzierte, quartiersnahe Versorgungsgestaltung werden kleinräumig Daten zum Versorgungsbedarf und-angebot benötigt. Vor diese Herausforderung sind auch die Kooperationspartner des von der Stiftung Wohlfahrtspflege des Landes NRW geförderten und vom Alters-Institut getragenen Modellverbunds "Pflege stationär-Weitdenken!" gestellt. Intention des Verbunds ist eine bedarfs-und bedürfnisgerechte Versorgung älterer, chronisch kranker, hilfe-und pflegebedürftiger Menschen im Stadtteil und Quartier durch die Weiterentwicklung stationärer Pflegeeinrichtungen hin zu sektorenübergreifenden, multiprofessionellen Pflege-und Gesundheitszentren in vier unterschiedlichen städtischen Quartieren.

Bài báo này trình bày một phương pháp bù co tối ưu để giảm thiểu sự vênh co giữa các cấu kiện thẳng đứng trong nhà cao tầng. Phương án bù co tối ưu theo từng nhóm tầng được xác định thông qua việc giải tuần tự một chuỗi các bài toán tối ưu. Phương pháp đề xuất có tên gọi là Bù co di chuyển tối ưu được áp dụng để tính toán bù co cho công trình Tòa nhà Lotte Center tại Hà Nội. Các kết quả của phương pháp này được so sánh với kết quả tính toán theo hai phương pháp khác bao gồm phương pháp Bù co gộp nhóm đều và phương pháp Bù co gộp nhóm di chuyển. Kết quả phân tích cho thấy, phương pháp đề xuất có thể cho ra số nhóm bù co ít hơn so với hai phương pháp còn lại. Từ khóa: nhà cao tầng; co ngắn cột; bù vênh co; tối ưu hóa; bù co di chuyển tối ưu.

D as ökonomische, ökologische und soziale Gleichgewicht einer Stadt steht bei einer schnell wachsenden Bevölkerung unter hohem Druck. Dies trifft insbesondere in Kombination mit den Auswirkungen der Wirtschafts-und Finanzkrise sowie den Folgen des Klimawandels zu. Akteure vor Ort sehen sich großen Herausforderungen und Zielkonflikten gegenüber, wenn sie diesem Druck begegnen wollen. Este livro é sobre os habitantes da região do lago Niassa, os Nyanja, e suas experiências de viver em um território marcado por várias historicidades de territorialização, sendo a mais recente a delimitação das chamadas terras comunitárias. Por detrás deste marco de historicidade estão as transformações nos modelos, sistemas e processos de governação da terra em Moçambique nos últimos 30 anos. O livro procura situar as noções de comunidade e de normas e práticas costumeiras no domínio da posse da terra rural, ao questionar a perpetuação de modelos intervencionistas coloniais e pós-coloniais que colocam na condição de marginalidade noções e direitos costumeiros de uso da terra. Ao mostrar que a delimitação de terras comunitárias despoletou o debate sobre os critérios de pertença, argumento que a perpetuação de modalidades de territorialização assentes na reprodução de desigualdades transformou as categorias de inclusão em critérios de exclusão na reivindicação da posse da terra que, consequentemente, afectaram o estatuto das unidades sociais e de residência, seus representantes e hierarquias. Desta forma, o livro contribui para o debate antropológico sobre o lugar das territorialidades na construção do sentido de ser e estar no mundo, ao colocar ao mesmo nível as historicidades do território e dos seus habitantes para pensar especificamente a apropriação, os usos e pertença da terra numa dimensão de longo termo, ao mesmo tempo que analisa a posse e propriedade da terra incorporando as dimensões da pertença e as dinâmicas territoriais históricas.

Auf den Punkt • Präventive Strukturpolitik leitet einen regionalwirtschaftlichen Pfadwandel ein, ohne dass dazu aktuell die sozioökonomische Notwendigkeit besteht. • Neben diversen Dilemmata, z.B. dass Ressourcen für eine Region aufgebracht werden müssen, die zurzeit (noch) nicht bedürftig ist, stellt sich das Problem der Prognosefähigkeit.

Die Stadtgestalt ist eine wesentliche Komponente der Stadterneuerung, auch wenn sie als solche nicht unmittelbar in den Umbau-und Erneuerungsprozessen der Städte thematisiert wird. In den letzten Jahren ist der Stellenwert von Stadtgestalt gestiegen; es ist sogar eine Art "Renaissance" im Sinne einer erhöhten Wertschätzung des Begriffes und seines Inhaltes erkennbar. Dieser Beitrag will einigen Fragen im Spannungsfeld zwischen der "Einfügung" bzw. dem Weiterbauen der vorhandenen Stadt und der "Zeichenhaftigkeit" bzw. Akzentuierung von Stadträumen nachgehen, die sich in diesem Zusammenhang stellen: Wieviel neue Akzente benötigt die Stadtgestalt und wieviel Konstanz braucht eine Stadtstruktur? Gibt es in dem Prozess der Stadterneuerung eine Art "Rezept" oder gar eine "Roadmap", wie Gestaltqualität gefördert werden kann? Brauchen wir mehr bauliche und architektonische Leuchttürme mit Ausstrahlungswirkung und Stararchitekten? Oder benötigen wir lediglich ein stärkeres Gerüst, das einen Rahmen für eine behutsame integrierte Stadterneuerung mit dem Ergebnis einer hohen Gestaltqualität liefert? Anhand aktueller strategischer Ansätze im Umgang mit der vorhandenen Stadt sowie konkreter Beispiele aus der Praxis der Stadterneuerung werden unterschiedliche Haltungen zur Stadtgestaltung in der Stadterneuerung deutlich. Diese Beobachtungen und Schlussfolgerungen aus der Praxis sollen mit dem vorliegenden Beitrag in kompakter Form aufgezeigt werden, um den Blick auf dieses bislang noch unzureichend diskutierte Themenfeld zu richten.

Regulating land use and the biodiversity of a region requires lasting accords between those who make the decisions and those who are affected by the rules and regulations. In Africa, these accords depend on the effectiveness of the collective efforts of the representatives of the legal authorities and the civil society (the traditional leaders in the tribal system). In this study, we investigated the role of tribal leaders in conserving biodiversity (which is a base for obtaining accords with statutory regulations), the value of biodiversity for the tribal communities, and the role of the interaction between tribal leaders and legal authorities in successfully implementing the objectives of biodiversity. Successful collaboration requires indigenous regulatory systems to be merged with existing modern or statutory laws to ensure sustainable land use, the conservation of natural resources, and the promotion of biodiversity. To examine this relationship, we conducted in-depth interviews with key stakeholders of the Gurune-speaking people in the Upper East Region of Ghana. We found that the indigenous

The use of land value capture (LVC) tools has been advocated by many authors as way of financing public investments in urban interventions. The rationale behind these tools is to capture part of the capital gains on land derived from public sector interventions in urban development, such as implementing infrastructure or changing land use regulations. They may be of great significance in very limited budget environments such as in countries undergoing rapid urbanization that need to provide a great amount of infrastructure and urban services in order to accommodate urban growth. Since the 1980s, the City of São Paulo, Brazil, has been implementing LVC through a wide range of different tools. Pressures on land have been on the rise over the past two decades across sub-Saharan Africa, notably due to increasing commercial interests fuelled by global demand for agricultural commodities. In Tanzania, Ghana and Senegal, such pressures have exacerbated tenure insecurity for rural populations and resulted in numerous cases of dispossession and displacement. 1. Customary land rights are legally recognised in Tanzania and Ghana, but not in Senegal.

Tulisan singkat ini bermaksud meringkas apa yang terjadi pada Kabupaten Dairi, Sumatera Utara, terutama pada wilayah Silima Pungga-Pungga dan sekitarnya, dalam kaitannya dengan pertambangan yang sedang diusahakan di sana. Mengikuti Franco dan Boras (2008) dan Franco et al (2015) tulisan ini mengajukan dua argumen utama: (1) hak atas tanah sebagai bagian tak terpisahkan dalam pembicaraan hak asasi manusia dan karena itu terhubung sepenuhnya dengan pembicaraan mengenai kebijakan dan tata kelola pertanahan (land policy and governance) di tingkat negara. Senafas dengan itu, perampasan tanah atau penyingkiran orang dari ruang hidup mereka adalah pelanggaran hak asasi manusia paling mendasar. (2) problem kemiskinan di sektor perdesaan, terutama di negara-negara Selatan, dewasa ini terhubung langsung dengan akses terhadap tanah. Maka perampasan tanah dan atau penyingkiran orang dari tanah mereka akan berkontribusi langsung pada pelanggaran-pelanggaran hak asasi manusia di bidang hak ekonomi, sosial, dan budaya seperti hak atas pekerjaan, hak atas penghidupan yang layak, dan hak atas lingkungan hidup yang sehat; serta hak-hak sipil politik seperti hak untuk beribadah, hak untuk berkumpul, berserikat; dan seterusnya, sebagaimana telah dijamin dalam konstitusi Indonesia, instrument hukum hak asasi manusia, serta aturan hukum terkait lainnya. The Tharus have their own sort of traditional governance system for dealing with their conflicts in each village throughout the western Tarai part in twenty two districts of Nepal. This paper attempted to answer how the perspectives and experiences of Tharu people provide an insight into the perception of indigeneity and modernity in the context of Tharu Barghar/Bhaalamansa (Village Chief) system in western Nepal, and what type of confrontation between indigeneity and modernity in Barghar system of the Tharus are practised. I employed interpretivism as a research paradigm and critical ethnography as a research design which includes focus group discussion and interview with Barghars and social elites of Kailali district of Far western Province, Nepal. Human Needs theory, Marxist theory, Subaltern theory, Modern theory and Hybridity theories were reviewed and examined in this study to analyse the Barghar System. The political influence in the customary and traditional Barghar system has caused an imposition that has modified the system in the essence and greed of political leaders. The ethno-hybridisation seen in the existing Barghar system at present is the byproduct of globalisation and political sensibility which has indirectly given the sense of pillage of the system. The findings support policy making in the local as well as federal government level and the policy on local curriculum designers at school level. The Barghars and the social elites were empowered regarding the cultural identity in the continuation of the system in future.

Purpose-This study examined the nexus between land tenure security (LTS) and food security (FS) in female-led households of Tula agrarian settlements. Design/Methodology-The study used a qualitative research design, which was based on the constructivist paradigm. The researchers conducted in-depth interviews with female household heads cutting across the three 'yaati' (villages) of Tula Baule. Analysis of data collected from the interviews was done employing transcriptions, creation of semantic networks and employing thematic content analysis. Findings-The study revealed that all but few respondents believed that they had LTS based on "Feloh's" (ancestral gods) supremacy without recourse to documentary evidence of ownership. Similarly, all but few participants do not have access to three square meal per day throughout the study period. The study also found a strong relationship between LTS and FS in the study area. Practical Implication-It provides an empirical base to equip policymakers with valuable information for making policies relating to female's access to land and food in agrarian settlements. Originality/Value-This study is one of the first to empirically analyse in an eclectic context land and food security in female-led agrarian households of Tula, Nigeria.

Rectifying land rights in war-torn settings are among the most daunting challenges of peacebuilding. War-torn land tenure situations are unique settings in their combination of a weakened and chaotic formal (statutory) system, vigorous but very fluid informal tenure activity, along with the presence of political demands regarding land, and international actors that have a large interest and influence in the success of any improvement or recovery. While this combination carries risks, it also represents real opportunity for practical and policy reform in the formal and customary land tenure sectors of countries recovering from armed conflict. In this regard the statutory tenure reorganization and reform efforts supported by the UN need to assess how the development of informal tenure institutions, problems, and processes are proceeding 'on the ground,' so as to draw legitimacy from these processes into reformulating national tenure structure, policy, law, and enforcement; thereby contributing to durable peace. This has the advantage of working 'with the grain,' and building on what has already been learned, disseminated, and accepted within the informal tenure system as the formal legal system is being reformed and implemented-as opposed to expecting people to disengage from binding customary obligations involving land when improved formal laws are finally enacted and enforced. Without this purposeful connection, tenure institutions at different levels risk evolving in different directions, with considerable difficulty and volatility later on for any attempts to reconnect them. With such a connection however, new policy can support what people are already doing, and engage in ongoing issues of disputing, resettlement, restitution, proof of claim, and the role of land and property in economic development. In post-crisis settings, new laws have the opportunity to address land and property issues in the context of what people are already doing 'on the ground', with a view to moving from the fluidity of crisis situations to a more solidified and peaceful social and legal environment as an outcome. Positive examples exist, and several of them are presented in this paper. The article discusses the primary challenges regarding land rights in war-torn settings and then includes both practical and policy options for overcoming them. The paper draws on the author's land tenure experience in 15 war-torn countries.

Globally, corruption poses a major challenge because it is at the heart of all other crimes, serious or petty. Kenya's commitment in the fight against corruption has severely been tested. In spite of many laws to address the scourge of corruption, the perception ratings have persistently remained high. While there is corruption in every sector, and in every nation as the Perception Corruption Indices indicates, land related corruption appear to have been given little focus by the media. We have a number of counties in Kenya where land adjudication has never been finalized since 1963 when the country attained independence. The reasons for this slow pace are probably a direct consequence of corruption. A review of literature on land related corruption indicates a paucity of studies on this sector in the country. However, there are many studies on corruption generally around the world. This desktop study set out to establish the types of land related corruption covered by the media around the world. Findings indicate that the governance challenges in land administration are the same even though their magnitudes vary. The typology includes bribes for various services; malpractices extend to preparing parallel titles for registered and unregistered parcels and titles issued outside the Government system among others. Other areas prone to corruption are transfer of property, valuations, buying and selling land, land registration, mutation, Surveying and land revenue officers. Land use planning divisions are amongst the very corrupt institutions. This study supports Borner, Brunetti, and Weder (1995) in calling for the restoration of watchdog journalism who argue that watchdog reporting is ‚potentially a highly effective mechanism of external control‛ against corruption.

Agricultural dominant societies in India are slowly shifting from traditional agricultural practices to modern infrastructural development. The Recent trends of developing high-tech cities are some efforts being taken by Punjab government to bring additional investment in the state and boost up its economy. But to do that at the expense of highly fertile agricultural land is a debatable proposition. One of the most recent ventures toward this objective is kind of development being initiated in the vicinity of Chandigarh and Mohali by GMADA (Greater Mohali Area Development Authority) is an Aero City Expansion project. The study will focus on only 3 villages Patton, Kurai and Seon out of 14 villages, where 1305 acres of land have been proposed to be acquired. This research paper attempts to explore the blatantly used land grab practices by the state authority in the name of development which turn out to be a great threat to the food security and loss of livelihood options for those whose land will acquired in the near future. The study will further focus on people's perception regarding new development project initiated by GMADA.

In recent decades, a new generation of greenbelts has developed that are embedded within dynamic regionalism processes. Governance of these greenbelts is increasingly being challenged by institutional arrangements requiring coordination across multiple policy fields, territorial jurisdictions and policy levelscomplexities that are not yet reflected within the literature. The paper explores how vertical, horizontal and territorial coordination problems shape the development of greenbelts in southern Ontario (Canada) and the Frankfurt region (Germany). It is concluded that regional greenbelts need new policy approaches and institutional reforms to manage the governance challenges facing this new generation of greenbelts.

ICEC: Die MacherInnen einer Stadtteilinitiative sind so etwas wie ein Glücksfall für einen Bezirk. Aus der Sicht einer sogenannten Stadtteilinitiatorin: Wie kam es zur Gründung des Gemeinschaftsgartens "Matznergarten" im 14. Bezirk? Stadtteilinitiatorin: Ich bin eine der InitiatorInnen, wir waren ursprünglich ein Kernteam von vier Personen. Mein persönlicher Zugang war, dass ich selbst noch nicht lange im Matznerviertel gewohnt habe, ursprünglich vom Land komme und mir das Nichtkennen und Sich-im-Lift-Anschweigen nicht gefallen haben. Ich studiere Landwirtschaft und wollte gerne den öffentlichen Raum netter gestalten. Das war die Idee, die zu Beginn stand. Der Glücksfall war der, dass ich über ganz viele Ecken einen Ansprechpartner der lokalen Gebietsbetreuung 9 kennengelernt habe, die auch die Idee verfolgten, einen Nachbarschaftsgarten im Bezirk zu initiieren. Dieses Kennenlernen war der Initialpunkt, um die Gründungspersonen des Gemeinschaftsgartens zusammenzubringen. Wir waren keine Einzelpersonen mehr, sondern ein Team von vier motivierten Personen, die sehr verschieden sind und sonst vermutlich gar nicht zusammengefunden hätten. Das war der Beginn. ICEC: Wie lange hat es letztlich von der Idee bis zum tatsächlichen Projektstart gedauert? Stadtteilinitiatorin: Es hat über ein Jahr gedauert. Wir haben uns 2014 kennengelernt, danach hat die Vereinsgründung fast ein Jahr gedauert. Die ersten Hochbeete sind 2015 gestanden.

In recent years, cultural, social, community and educational spaces have become laboratories of new forms of living, working, learning and collective exchange. However, these civic spaces face many difficulties in establishing stable economic structures, or lack financial buffers to secure their long-term operations and relative autonomy. This book brings together a variety of actors, practices, models, mechanisms and opinions that address these difficulties: our intention is to use these experiences to help and inspire civic space initiatives in accessing community capital, building stable financial models, strengthening local economies by keeping profits in neighbourhoods and ensuring spaces against public oppression or the extraction economy.

El objetivo de la investigación es analizar el instrumento para la medición de capacidad institucional mediante el uso de la metodología cualitativa con énfasis en su aplicación para el ordenamiento territorial. La investigación tiene como objetivos específicos analizar la validez de contenido del instrumento metodológico de medición de capacidad institucional normado por el Ministerio del Ambiente mediante la RM N°159- 2015-MINAM y también su coherencia con los principios de la Política Nacional de Modernización de la Gestión Pública Peruana al 2021. Los resultados evidencian que, a juicio de los especialistas, no se valida el contenido del instrumento de medición de capacidad institucional. Se detallan elementos que podría encaminarlo con los principios de la Política Nacional de Modernización de la Gestión Pública Peruana al 2021. Asimismo, se evidencia, a partir de la exploración a Pampacolca, el déficit de capacidad institucional para la implementación de políticas de gestión del territorio.

Este estudio se desarrolló como resultado del XIX Concurso Anual de Investigación CIES 2017, con el auspicio de Global Affairs Canada (GAC), el Centro Internacional de Investigaciones para el Desarrollo (IDRC, por sus siglas en inglés), la Fundación Manuel J. Bustamante De la Fuente, la Superintendencia Nacional de Aduanas y de Administración Tributaria (SUNAT) y el Consorcio de Investigación Económica y Social (CIES).

This paper consists of a review of existing literature relating to Incorporated Land Groups in Papua New Guinea (PNG), followed by a case study of two urban incorporated land groups (ILGs) in the city of Lae. The paper is an attempt at assessing the sustainability of ILGs in the country. The challenges facing the ILGs have heightened public fears that the land groups may not be sustainable. Based on the argument in previous studies that the ILGs are not sustainable, the paper used primary data from two separate questionnaire surveys of randomly selected ILG landowners (including legal settlers) and ILG stakeholders to investigate the problem. The combined sample size of 129 respondents (32.7%) was representative of the total ILG population, while a total of 25 indicators were used to test the respondents' perceptions regarding ILG sustainability. Findings reveal that only one of the indicators received the positive support of the stakeholders, while no indicator was supported by the landowners. This suggests that the ILGs in PNG are not sustainable legal entities. This dilemma is a consequence of the challenges facing the ILGs, including the issues of corruption in the Lands Department, illiteracy among landowners, poor publicity given to ILGs' functions, and the dysfunctional ILG legal framework.

Current contestations over land as a public or private good revolve around the issue of who owns, controls and manages it. Particularly, after the second April uprising of 2006, indigenous people, have emerged as a new actor in land policy demanding equitable rights for state’s power and resources. However, these claims have been countered by non-indigenous people. The disagreements are strong and the institutional bargaining for a share in land ownership has been tough. Currently, the Ministry of Land Reform and Management is in the process of drafting the National Land Policy. While this draft land policy has addressed the issues of the indigenous people to some extent, the larger approach has been piecemeal and short sighted. If we were to look for a long-term solution, it would be essential to think about major concerns of the marginalized and indigenous group and develop a coherent strategy to address their demand. Analysis of Chinese real estate market shifted from eco nomic fundamentals to non-fundamentals, but consensus conclusions are still rarely reached. This is because institutional perspectives and national subjects are still lacking. Based on critical realistic approach, this paper integrates a state–society relationship and institution provision, constructing an analytical framework for the role of state capacity in the institutional construction of the real estate market. In terms of the intervention of the state on actors in the Chinese real estate market, the central government influences local governments, interest groups, and society at large through its administrative, extracting, and market service capacities, respectively, forming a chain of interests that serves the state–society relationship.

Im vorliegenden Leitfaden finden Sie Anregungen für ein sektorenübergreifendes, interkommunal abgestimmtes Entwicklungsmanagement zur Sicherung der Daseinsvorsorge im Verbund der Städte und Gemeinden in Ihrer Region. Welches Verständnis von Daseinsvorsorge liegt diesem Leitfaden zugrunde? In Deutschland werden zahlreiche Infrastrukturen als Basisdienstleistungen der sogenannten "Daseinsvorsorge" angesehen. Die Bereitstellung von Leistungen der Daseinsvorsorge dient dazu, die Bevölkerung und die Wirtschaft mit grundlegenden bzw. existenziellen Gütern und Dienstleistungen durch das Gemeinwesen zu versorgen. Prinzipien kommunaler Daseinsvorsorge sind ein gleichberechtigter Zugang, akzeptable Preise, Kontinuität und Universalität der Dienstleistung, angemessene Qualität sowie politische Kontrolle und Steuerung 1. Neben der technischen Infrastruktur, also Energie, Wasserversorgung, Abwasserbeseitigung, Abfallentsorgung und Verkehr, sind die sozialen Infrastrukturen, das heißt Gesundheits-, Pflege-, Bildungs-und Jugendhilfewesen einschließlich kultureller Dienste, klassische Bereiche der Daseinsvorsorge 2. Neben den genannten Bereichen können im weiteren Sinne auch eine angemessene Wohnraum-und Nahversorgung als Teil der Daseinsvorsorge begriffen werden. Daseinsvorsorge ist eine Kernaufgabe der Kommunen, auch wenn sich die Rolle der Kommunen mit den Formen der Leistungserbringung wandelt, sich der Kreis der kooperierenden Partner zur Erbringung der Leistungen weitet und neue Themen jenseits der "klassischen" Aufgabenfelder der Daseinsvorsorge hinzukommen.
