EXECUTIVE SUMMARY
The Democratic Socialist Republic of Sri Lanka is implementing the Second Integrated Road
Investment Program (iRoad 2 Program) to improve the connectivity between rural areas and socio-
economic centers by means of a Multitranche Financing Facility from the Asian Development Bank.
(ADB). The program is implemented by the Road Development Authority of the Ministry of Highways,
Road Development and Petroleum Resources Development and includes the engagement of an
International Consultancy Firm as Project Implementation Consultant (PIC). For the Eastern
Province Package PIC 05, composing of Trincomalee-, Batticaloa- and Ampara Districts, the Joint
Venture Egis International and Greentech Ltd was engaged as the PIC through a Service Contract
signed on 18.02.2019. The Notice to Proceed with the Supervision Services was issued to the
Consultant by RDA-letter dated 15.05.2019 after which the team mobilization commenced. The
works, to be executed by 6 Contractors, are packaged into 11 Works Contracts which were signed
from 31.07. – 23.08.2019. After fulfilment of the relevant contractual prerequisites, the
Commencement Date for the works in respect of Cl. 8.1 GCC / PCC was set to be the 25.09.2019
for all contracts.
Since August and through September until the present reporting month of October 2019, the
Engineer and the Contractors have gradually resourced- and mobilized staff and facilities to the
locations of offices and site installations in the 3 Districts of the Eastern Province. The survey- and
design works have commenced already during the mobilization phase, have proceeded until this
reporting month and the current status achieved is summarized in the table below:
The Contractor´s submitted proposals for the execution of Initial Road Maintenance works were
approved and commenced under the the budget of Provisional Item No. 103.2.1 in all Contracts
Packages and the works are in progress..
A contractual issue has arisen, since certain sections of roads to be executed under the various
Contract Packages were found to have been constructed by others and several sections have been
double-allocated to different roads, leading to a potential reduction or amendment of scope of works.
During the reporting month, the internal evaluation of the situation by the Engineer and Employer
with regards to determine the way forward in consultation with Contracts Experts was still ongoing.
Mitigation measures by determination of substitution sections are envisaged to be implemented and
will be communicated to the affected Contractors shortly.
At the end of the reporting month, the Engineer´s observation is, that the 11 Contractors are
reasonably mobilizing the required resources to the project and after initial delays to fulfil the
prerequisites to declare the Commencement Date, are now actively engaged in the survey- and
design works, the preparation and submission of the necessary deliverables and are implementing
the required preparatory Social- and Environmental Safeguard measures. The activities by the
Contractors are however progressing to different extent and different rates of progress. Despite
partially slow mobilization, the Contractors presently appear committed to the project and are
preparing to commence the permanent works after finalized designs for execution will become
available. Any other grave shortcomings or non-conformities on the part of the Contractors, bearing
the risk to lead to substantial delays or failure, have not been identified by the Engineer until present.
It is currently expected by the Engineer, that the degree of mobilization, technical preparations and
provisions of contractual deliverables and acceptable designs by the Contractors of several
Packages will be sufficiently advanced to enable a start of the Permanent Works as from late
November or December 2019. However since the Eastern Province has entered into the rainy
season during the reporting month, the weather conditions will have to be observed in order not to
jeopardize the quality and soundness of the works.
Based on the above, the Engineer´s outlook on the technical perspectives of the project
implementation is currently mainly positive, provided that the risk of a substantially amended scope
of works for several Contract Packages potentially giving rise to Contractor´s Claims or disputes,
can be mitigated or eliminated.

Section 1 – INTRODUCTION
Project Background
The Democratic Socialist Republic of Sri Lanka has received a loan from the Asian Development Bank
(ADB) for the Second Integrated Road Investment Program (i-Roads 2) which will be utilised for the
rehabilitation, improvement and maintenance of rural roads and access roads between rural areas and
socioeconomic centres. Part of these funds are utilised for providing “Implementation Consultancy Service
for Construction Supervision, Contract Management and other implementation activities” of these roads.
The project roads to be rehabilitated / improved and maintained are of varying length and are partly isolated
sections of roads dispersed across the 3 Districts of the Eastern Province. In total 845.83 km of roads,
divided into 11 Contract Packages are to be executed under the project and following the completion of
execution, Performance-Based Maintenance is to be carried out by the Contractors for a period of 3 years
for rural roads and 5 years for National (RDA) Roads as specified in the individual Works Contracts. The
geographic location of the project is shown on the maps below

Project Objectives
• To improve the road condition between rural communities and socioeconomic centres of the Eastern
Province.
• To upgrade and maintain 845.83 km of rural access roads connecting rural communities to all weather
standard
• To improve connectivity between production centres and market places and improve linkage with the
other districts and provinces
• To facilitate the increase of mobility by improving road network which link up with other provinces
• To open up rural areas for development
• To facilitate to generate efficiency gains by lowering the unit cost of individual producers through
transport efficiency which will lead to increase their margins and profits
• To reduce rural poverty through improved access to markets and economic centres social, health,
and education infrastructure and through new employment opportunities
By amplifying the benefits of the country’s rural road network, the project will contribute to one of the
Government of Sri Lanka’s key development goals, which is to reduce all constrains for rapid economic
growth and to lower poverty in the country. It will also improve access to economic opportunities, as well as
basic social, health and education facilities.
In addition, the project goal is to ensure that improved opportunities for employment of women are created
and women are increasingly involved in the design, improvement and maintenance of the rural access roads.

There are four key contractual parties in the Contract Management Framework:

The subject and contents of the Engineer´s Monthly Reports is outlined as follows:
▪ Provision of a brief yet comprehensive overview regarding the general project status, both
historically and at present
▪ Summarizing the implementation and financial disbursement status of the 11 contract packages
under the PIC05 project. This includes the following:
o Description of the main contractual issues as status of variations, claims and disputes
o Description of the financial status and progress of the project, summary of payments
made to the Contractors
The contents of the Engineer´s Monthly Report will be evolving over implementation-time as per the
events and developments encountered and the progress of the project experienced. During the present
Commencement phase of the project, emphasis will be on the monitoring and reporting of the essential
contractual milestones for the start-up activities as survey, establishment of designs, social- and
environmental baseline survey, whereas at a later stage this initial information will be shown in shorter
historical summaries and emphasis will shift to the detailed monitoring and reporting of contemporary
events, execution of permanent works and progress parameters.

The scope of works of the road component comprises the rehabilitation and improvement of a system of
rural- and National Roads under 11 Contract Packages located in the 3 Districts of the Eastern Province.

This objective shall be achieved through execution of extensive Training, Seminars and Workshops on
Environment, Social Safeguard, Road Safety, Rural Road Design and Performance-based Maintenance
for specified target groups of the Stakeholders.
Performance Based Maintenance is to be carried out by the Contractors for a period of three (3) years for
Rural- and Municipal Roads and for five (5) years for major roads and RDA-Roads as specified in the
Works Contracts after completion of the works in order to ensure the sustainability of the project.

Following the submission of a general Environmental Management Plan (EMAP) by the Contractor
for the whole of the Contract Package, the preparation of the Site-Specific Environmental
Management Plan (SSEMAP) is stipulated by Part II of the Contract, Section 6.2, (Particular
Technical Specification), Cl.108.1.
The SSEMAP shall be based on the general EMP, (Part II, Section 6.6, Appendix A1, which is
actually attached to the IEE, App.VI.1)
According to Part II of the Contract, Section 6.6, Table 3, no start of physical works shall be allowed
before approval of the SSEMAP by the Engineer. The SSEMAP is usually prepared by the
Contractors separately for each larger area of works as a Cluster.
Site-Specific Environmental Monitoring Checklists (EMC) shall be prepared for each road to be
executed under the contractual scope and shall be based on the general Environmental Monitoring
Plan (EMOP) which is stipulated by Part II of the Contract, Section 6.6, Appendix A2 and which is
actually attached to Initial Environmental Examination (IEE) App.VI.2.
According to the IEE, Part VI, Chapter B: A minimum of 1 EMC for each road prior to execution is to
be completed and at least 1 – 3 EMC are to be filled out during the construction phase.
The progress achieved in each Contract Package for the establishment, submission and approvals
of the above Environmental Plans until the reporting month is shown in the Chapter below. The
records show that until the end of the reporting period, only Contract AM 1 (NEM) has achieved the
adequate preparation and conditional approval of the general Environmental Management Plan
(EMAP) for the whole of the project. The Site-Specific Environmental Management Plans (SSEMAP)
for each Cluster of the Contract was similarly submitted by Contractor AM01 only for parts of the
Clusters and needs to be completed.
All other 10 Contractors had to be instructed to revise their submitted Environmental Management
Plans in order to comply with the contractual requirements and to resubmit for the Engineer´s
approval. At the end of the reporting month October 2019, the status of preparation, Contractor´s
submission and Engineer´s approval of the Environmental Plans and Deliverables is recorded as
shown on the table below:

The detailed tables showing the current status of delivery and submission of the Environmental
Management Plans for the whole of the respective Contracts, the site-specific SSEMAP for each
Cluster and the Environmental Monitoring Checklists for each road for checking prior- and during
construction is attached in Appendix 2 to this report.
In accordance with Part II, Section 6.4, Cl.2.1 of the Contract, the Contractor shall prepare and
submit Health- and Safety- and Traffic Management Plans (TMP), prior to construction. As per Part
II, Section 6.2, (PTS) Cl.103.1, the TMP shall be submitted together with the no-objection by the
relevant authorities at least 30 days before starting the permanent works and shall refer to the RDA
Manual on Traffic Control Devices. The Table below records the status of achievement until the end
of the reporting month, which shows that the process of establishment, submittal and approvals of
the HS-Plan and Traffic Management Plan is not completed.

This Chapter provides the information on the establishment of Social Baseline Data in accordance
with Part II of the Contract, Section 6.6, Table 3 by the conducting of an Update-Transsect Walk
and the formation of Grievance Redress Committees during the commencement phase prior to
start of physical activities. The completed Formsheets of the Updated Transsect Walks are certified
by the participants of each contractual party and are subsequently transmitted to the Design-
Engineers of both Contractor and Engineer in order for the findings to be incorporated into the
designs.
The undertaking of the updated Transsect Walks by Employer´s, Engineer´s and Contractor´s
representatives, together with selected members of the local authority and the communities has
commenced during the month of August 2019 and has continued throughout the reporting month.
During the updated Transsect Walk, a written record is made, listing the findings, recommendations
and requests by the local community and is signed and certified by the participants. This signed
and certified document is then transmitted to the Contractor´s designers for incorporation into the
proposed final designs submitted for the Engineer´s approval.
The formation of Grievance Redress Committees for each Divisional Secretary Division (DS) and
each Contract Road (Grama Niladhari Level - GND) by Employer´s, Engineer´s and Contractor´s
representatives, together with selected members of the local authority and the communities has
commenced during the month of August 2019 and has continued throughout the reporting month.
The summary status of the progress achieved on updated Transsect Walks undertaken and
certified and of the formation of Grievance Redress Committees until the end of the reporting month
is shown in the table below.
Based on the above, the Engineer considers that reasonable progress on the establishment of
Grievance Rederess Committees and Updated Transsect Walks has been achieved in most
Contracts until present and the activity is expected to be completed well before the end of this year
and timely before construction of the Permanent Works commences.
The individual progress achieved in each Contract Package on the undertaking of the updated
Transsect Walks and the formation of Grievance Dresss Committees until present, is attached in
Appendix 3 to this report.
As per Cl.4.9 of the General- and Particular Conditions of Contract, the Quality Management
Assurance Systems (QMAS) are to be prepared and submitted by the Contractor within 28 days
from the Commencement Date.
The current status of preparation and submission of the Contractor´s QMAS´s and their review and
approval by the Engineer until the end of the reporting month is recorded as shown in the table
below.

In summary it can be stated that all of the Contractors have initially submitted the Quality Assurance-
and Quality Control Plans within the time limits of Cl. 4.9 of the Conditions of Contract. The submitted
QMAS´s were however mainly found to be of general nature, presumably copied from other projects and
generally lacking the required site-specific details. Several rounds of Engineer´s reviews, commenting
and Contractor´s resubmissions were necessary, the process of which is not completed until present.
It is currently expected that approved Quality Management Assurance Systems for all Contract Packages
will be available as from November 2019.
The current status of obtaining the required Contractor´s Construction Permits as per Part II, Section 6.6, Table 3 of the Contract Document is reported
as shown in the table below. According to the cited Contract Condition, the relevant permits are to be obtained by the Contractor during the pre-
construction phase and the permanent works are not to start until these permits have been submitted to the Engineer.

The minimum requirements for the mobilization of the Contractor´s mobilization of key resources,
personnel and plant and equipment in each Contract Package are specified in Part II of the Contract
Documents, Section 6.4, Cl.5 and 6. The Engineer monitors and records the deployment to site of the
specified- and necessary key resources after the Access to Site in accordance with Cl.2.1 GCC and PCC
has been granted by the Employer.
A description of the Contractor´s actual site installation- and mobilization activities until the end of the
reporting month is provided in Chapters 3.7.1.1 to 3.7.1.11 below. The detailed records of the
Contractor´s mobilized key resources, personnel and plant and equipment are listed and attached in
APPENDIX 1 for each Contract Package.
3.7.1 Description of Contractor´s Mobilisation- and Site Installation Activities per Contract

Asphalt Plant – Initial source approval has been given to contractor’s own plant established
and operated at Kovilyaya, Mahiyanganaya.
• Batching Plant – Initial Source approval has been given to Tokyo Supermix (Pvt) Ltd,

one location not finalized yet.
• Production Facilities (Crusher, Asphalt- & Batching Plant): Provision and establishment in
progress at ABC crusher Plant at Wadakada.
• Submittal and Approvals of Main Materials and Stockpile Areas: Reinforcement Steel, Cement,
Aggregate Base Course and Cold mix are conditionally approved for Initial Maintenance Works.
• Submission of Major Works Method Statements for Engineer’s review and approval.
• Commenced the Initial Maintenance works on stipulated roads.
At the end of the current reporting month, October 2019, the Permanent Works have not yet
commenced.
In future Engineer´s Monthly Progress Reports the progress of Permanent Works will be reported
in this chapter by means of detailed tables showing the percentage completion of the main work
items and achievement of the main works quantities.
At the end of the current reporting month, October 2019, the Permanent Works have not yet
commenced and the Contractor´s Works Programs, needed for the establishment of a system of
monitoring of progress are still under process of being finalized and approved. The process of
preparation and submission of Contractor´s Works Programs and review and commenting by the
Engineer is shown in detail in Chapter 4.2 below.
In future Engineer´s Monthly Progress Reports, the progress of Permanent Works will be reported
in this chapter by means of graphical S-Curves monitoring and evaluating the progress planned
versus actual.
The current situation with regards to Possession of Site and Access granted by the Employer in
accordance with Cl. 2.1 of the Conditions of Contract and actual movement to site by the
Contractor, as well as any exclusions to access or obstructions encountered, is summarized in the
Table below:
As shown in the information above, access to all of the sites of all Contract Packages was granted by
the Employer within the time stipulated by the provisions of Contract as the Commencement Date for all
Contract Packages is the 25.09.2019. As per PCC, Part A, Cl.2.1 - Access has to be granted by the
Employer within 7 days from the Commencement Date which is the 02.10.2019.
The Contractors have moved to site already before and directly after the granting of access has been
formalized. During the movement to site and the preparatory activities, it was discovered that sections
of roads and various works by Others have been executed in all of the Contract Packages of PIC-05
Project.
Addionally obstructions were encountered in Contract Package AM-02 in form of wildlife-fences erected
over one of the Contract Roads by the Wildlife-Authority, closing off several kilometers.
It must therefore be recorded that the Contractor´s access to site has been restricted in all Contract
Packages to different extent, which potentially gives rise to Claims and disputes and requires to be
addressed, mitigated and resolved. This issue is described in detail in Section 11 and Chapter 4.4 of this
report.

According to the Particular Conditions of Contract (PCC), Part B, Cl.8.1 and 8.3 of the PIC05 Project,
the submission of the Contractor´s Works Programme, Cash Flow and Method Statements is a
prerequisite for the declaration of Date of Commencement and has therefore to be prepared at a very
early stage of the project with several assumptions to be made. In the event, the Works Programs had
to be prepared and submitted by the Contractors in several stages as described in this Chapter.
In the first stage of submission the Contractors had to assume a Commencement Date and had to
prepare the Works Programs tentatively due to the absence of detailed designs and the estimated final
quantities for execution. During the preparation phase the road sections already constructed as well as
several sections of overlap were detected, the Contractors were however instructed to prepare the WP
based on the quantities for execution as per the Original Contract, for future reference. The Contractors
submitted the Initial WP´s during the month of August 2019 showing the main data as displayed in the
table below:

The Engineer acknowledged the submissions to be of initial- and tentative nature and issued his
comments to all submitted WPs by correspondences issued from 12.08. to 05.09.2019, instructing
several technical- and formal amendments.

In the second stage of submission of revised Works Programs, the Contractors had gained some
knowledge regarding the site conditions and had received the Engineer´s comments for revision,
however several Contractors resubmitted before the Commencement Date was ascertained on
25.09.2019 and detailed designs and estimated final quantities for execution were still not available.
Additionally, faced with an unclear situation caused by several road sections having been constructed
by others, several double-allocations of road sections and thus the anticipation of considerable
amendments and changes to the scope of works to ocurr to several Contract Packages, the questions
of suitability and applicability of the Intial Works Programs had been raised. After consultations between
all parties, the Employer´s Representative (Project Director Eastern Province) directed to adopt the
following approach, which was formalized by issue of the Minutes of the Kick-Off Meetings held for the
11 Contract Packages on 09.10.2019 and 11.10.2019, as stated below:
(i) The initial Contractor´s Works Programs (WP) , submitted prior to the Commencement Date and
based on the contractual works quantities are to be left intact and are only to be revised to
incorporate the Engineer´s earlier technical comments. Reductions of roads already constructed
or deleted are not to be effected at this stage.
(ii) After incorporation of the Engineers technical comments, the revised WP are to be approved and
to be used for temporary monitoring of progress.
(iii) The Road designs are to be established and costs to completion are to be determined for the
remaining scope of works not constructed by others and not deleted due to overlap.Some
sections constructed by others found to be in unacceptable quality may be instructed to be
removed and this activity thus to be added to the scope of works.
(iv) Upon availability of the final BoQ and costs to Completion of the remaining scope, the Employer
shall decide on whether the reduced scope shall be substituted.
The above directed approach was confirmed by the Engineer´s letter ref-S-9-0296/JR dated 14.10.2019
to the Employer, also stating that the use of the Works Programs so established for monitoring will
constitute only a temporary solution and might in many cases not reflect the actual situation in several
Contract Packages due to anticipated changes.
A technical meeting was then held by the Engineer with the Representatives and Planners of the
Contractors on 16.10.2019, to describe and achieve agreement on the intended methodology of
establishment of the S-Curves from the Initial Works Programs for monitoring and reporting. During this
meeting it was again agreed to use the submitted Initial Works Programs for temporary monitoring until
the designs are completed and the way forward on the road sections constructed by others and potential
reductions are determined. The Contractors were requested to finalise and resubmit the Initial Works
Programs as per the Engineer´s comments issued before the Commencement Date for the
establishment of agreed S-Curves for Monitoring. At the end of the reporting month of October 2019, this
process of Contractors finalizing the revised Initial Works Program, resubmission, review and approval
was still ongoing, not completed and the latest status is shown in the table below.
It is expected that accepted Revised Initial Works Programs for temporary monitoring of progress will
become available during the coming month, November 2019, for all Contract Packages. However the
Permanent Works have not commenced to be monitored until present and measurement of Contractor´s
progress is currently being undertaken in terms of mobilisation and of achievement of preparatory
activities as topographical survey, establishment and submission of designs and the achievement of the
required Environmental- and Social Safeguard milestones as shown in Chapters 3.2 and 3.7 of this
Report.

have not formally been issued to date in any of the Contract Packages.

Contractor´s final Claims in respect of Cl.20 of the General- and Particular Conditions of Contract have not
formally been submitted to date by any of the Contractors of the 11 Contract Packages, however several
notices to Claims have been received.
Several Contractors have additionally issued correspondences on queries mainly related to the issue of
the road sections in their contractual scopes having been found constructed by others and obstructions
encountered within the areas of possession of site given. The Engineer considers that those
correspondences might be used by the issuing Contractors as Notices to Claim in the future and is
recording them separately, however for the sake of contractual clarity, only those Contractor´s
correspondences are recorded in the Claims Register of this Monthly Report below, which directly express
a Notice to Claim.

The Contractor´s Performance Guarantees in respect of Cl.4.2, the Contractor´s Advance Payment

In summary it can be stated that all Contractors have provided valid Securities and Guarantees in respect of
Clauses 4.2 and 14.2 (Performance Guarantee and Advance Payment) as per the requirements of the
Contract.
Regarding the Contractor´s Insurances in respect of Cl. 18 GCC & PCC, valid Insurances have been provided
by all Contractors, covering the stipulated risks, but stating several limitations and exclusions not foreseen
by the provisions of the Contract. This circumstance and how to address these partial non-conformities in the
Interim Payments to the Contractors, is currently under discussion between the Engineer and the Employer.

The Consultancy Service Contract for the Construction Supervision, Contracts Management and
Other Implementation Activities between the Joint Venture and the Road Development Authority of
Sri Lanka (RDA) as the Employer was signed on 18.02.2019 and the Consultant received the Notice
to Proceed with the Services by letter dated 15.05.2019 issued by the Road Development Authority.
The Team Leader / Chief Resident Engineer Mr. Jens Roemer arrived in the country and
commenced his assignment on 16.05.2019 in Egis International´s Office in Colombo. During May
2019, the Resident Engineer Mr. M. Ravindralingam and one Adstrative Staff / Secretary were also
mobilised to assist the TL with the preparatory activities.
On 02.08. 2019, the Team Leader´s Main Project Office for the gradually arriving staff members has
been opened and made operaional in Kallady District, Batticaloa. The Resident Engineer´s Office in
Ampara has been opened on 05.08.2019 and the Resident Engineer´s Office in Trincomalee has
been opened on 16.08.2019 each with several senior staff members and gradually staffed as the
related supervision tasks commenced.
The Construction Engineer´s Offices for the site supervision have been provided by the Contractors
and staffed and activated by the Engineer during September and October 2019 as described in
detail in Chapter 6.4 of this report.
The Engineer´s technical and administrative activities undertaken during the reporting month in the
11 Contract Packages are summarised as follows;

update the TWS report for a context sensitive design

The mobilization and turnover of the Engineer’s personnel´s mobilization is reported to the Employer
by regular weekly correspondence as the mobilization ocurrs. The monthly and daily attendance on
site of each staff member is recorded in Monthly Time Sheets submitted by the Engineer and
reviewed and signed by the Employer.
The Engineer´s entire current site staff assignment and the supervision-team’s set-up and
distribution over the Main- and Sub-Offices is shown in Chapters 3.2 and 3.4. The supervising
Engineer´s general organisation is shown on the Organisation Chart in Chapter 3.3.
The Engineer considers his current status of mobilization of staff and facilities to be adequate to
cover the current supervision tasks at hand.
The Engineer´s supervision staff mobilised to the project and the auxiliary personnel allocated to the
Engineer´s offices provided by the Contractors are listed in the table below:

The provision of the Engineer´s Type 1 and Type 2 main- and site offices by the Contractors, as
specified in Section 6.2 of Part II of the Contract (Employer´s Requirements) Appendices 2 and 3.
Provision by the Contractors has begun in August 2019, has continued through September and early
October 2019 and was largely accomplished during the reporting month.
The number of Main- and Construction Offices vary in the Contract Packages, depending on the
scope of works and the geographical locations of works activities. In order to cover the supervision
of works in the possibly most favorable- and economical manner, the locations of the Engineer´s
Main Offices and Construction Offices, Residential Accommodation and the staffing by the
Engineer´s supervision staff were chosen and staffed until the end of the Inception Phase as shown
below. From the offices provided, office space was also allocated to the Employer´s Project
Engineers in the Resident Engineer´s Offices Ampara and Trincomalee, as per the requirements of
the Road Development Authority.
The details and addresses of the locations of the Engineer´s Main Office, Resident Engineer´s and
Construction Engineer´s offices, information on provided by which Contractor and on the Engineer´s
staff occupying it, is shown in the tables below:

This Chapter provides the information on the weather conditions prevailing in the project zone during
the reporting month.
The weather conditions reported are selected from the 3 Contractor´s laboratories near the Resident
Engineer´s Offices in Ampara, Batticaloa and Trincomalee, where the daily rainfall is jointly recorded by
Contractor and Engineer and which are considered representative for the 3 Districts (Ampara, Batticaloa
and Trincomalee) of the PIC-05 Project and for the purpose of the Monthly Report. The rainfall records
are however jointly taken also from all other Contractor´s laboratories near the Construction Engineer´s
Offices, for future reference.
The 3 main records displayed in this Monthly Report uniformly show increased rainfall as from the middle
of the month. This was observed to have impeded the ongoing site survey, soil investigations, other
preparatory works and the Initial Road Maintenance. Although rainfall as from the month of October is a
usual occurrence in Sri Lanka´s Eastern Province, the Contractors of Packages AM05 (Nawaloka), BT01
and BT02 (CICO-Sun) have issued Notices to Claim for EOT, pursuant to Cl. 8.4 of the Conditions of
Contract however without providing any evidence to the exceptionality of the rain events. The Claims will
be evaluated by the Engineer if and when detailed particulars will be received.
ROAD DEVELOPMENT

This Chapter provides the information on the execution of the regular monthly environmental monitoring
as well as the Health- and Safety activities and HIV activities undertaken on the project site during the
reporting month.
This Chapter further provides the information on the execution of the regular monthly social monitoring
activities and the activities of the Grievance Redress Committees, undertaken on the project site during
the reporting month.
During the reporting month of October 2019, the preliminary activities as preparation and delivery of
Environmental Plans by the Contractors and the establishment of Environmental- and Social Baseline
Data by undertaking of Updated Transsect Walks and the formation of Grievance Redress Committees
as well as the obtaining of Environmental- and Construction Permits were still ongoing and not completed
as described in Chapters 3.2, 3.3 and 3.4 of this report. Likewise, the provision of related personnel, as
Contractor´s Environmental- and Social Officers and the auxiliary environmental- and social monitoring
personnel to be provided by the Contractors to the Engineer was still ongoing in some Contract Packages
and not fully completed. The permanent works activities on site have also not commenced as yet.
Therefore, monthly regular environmental-, health & safety activities, HIV-awareness and social- and
environmental monitoring, checking and redress-activities were not yet undertaken during this reporting
month.
The Performance Based Maintenance (PBM) is to be executed by the Contractors in each Package
as specified in Part II, Section 6.7 of the Contract. The period of maintenance after the handing over
of the completed roads, is stipulated in Cl.1.1.3.3 of the Particular Conditions of Contract to be:
During the current reporting period month, October 2019, the project is still in the commencement
phase and no Performance Based Maintenance is yet to be executed. Upon commencement of the
PBM, reporting and monitoring of the activity will be done in this Chapter in tabular format and the
relevant information and events will be presented and highlighted as necessary.
During the reporting period, the following problematic issues occurred or continued to persist, requiring
to be addressed by the contractual parties:
Access to- and possession of site without any exclusions or restrictions was granted by the Employer on
26.08.2019 and 02.09.2019 however during their preparations and survey works, all Contractors
encountered sections of roads already constructed to various degree of completion and varying lengths
ranging from 2.4 km (AM-02) to 22.1 km (TR-02). It was further discovered that several parts of roads
were allocated to different road numbers which results in an overlap of chainages and thus partially
necessary deletion from the scope. The Engineer prepared an inventory of the already constructed and
overlapping road sections and issued a report to the Employer by letter dated 16.09.2019, summarizing
the findings as shown on the table below:
The Contractors have issued queries to the sections found to be constructed by others and related partial
obstructions encountered as well as to the overlaps and resulting potential reductions of scope by various
correspondences to the Engineer. Although no formal Claim has been issued until present, the potential
risk of Contractor´s Claims for EOT, costs or new rates exists in several Contract Packages, due to
various anticipated amendments to the tender conditions. The RDA Project Director (EP) has notified the
Employer´s Senior Management of the situation and has recommended for solutions to be adopted
mitigating the effects of the findings. The Engineer was tasked by RDA to investigate and submit a
mitigation-proposal to substitute the reduced road lengths if reasonably possible on the same road.
This investigation and preparation of a proposal by the Engineer was in progress at the end of the
reporting month, October 2019.
