Dopo tre anni di battaglia legale, i rider di Foodora ottengono finalmente giustizia: sono lavoratori subordinati, e non autonomi come vuole la piattaforma. Si tratta di una vittoria significativa, di un segnale importante per il capitalismo digitale e per la voracità con cui punta allo sfruttamento del lavoro. È però un segnale debole, perché al coraggio dei giudici corrisponde l'inadeguatezza della politica, se non la sua complicità con i nuovi padroni, a beneficio dei quali ha edificato e presidiato il quadro delle regole entro cui hanno potuto prosperare. Regole che si avviano a divenire il punto di riferimento per una complessiva riforma del lavoro sempre più ridotto a merce.

Sebbene l'archeologia subacquea mantenga presso il grande pubblíco un'aura di mistero e di diversità, i dibattiti teorici che hanno caratferizzato l'ultimo trentennio sono serviti, in definitiva, anche a sgomberare il campo dalle sovrastrutture dí caîattere psicologico che tendevano a vedere nell'attività di ricerca subacquea un terreno quasi privo di regole ed aperto alle improwisazioni e ali'awentura.

The food marketing and distribution methods in the restaurant business shifts from traditional purchase methods to online food delivery systems where many alternative systems are offered by business owners such as online shopping, phone-based ordering, home delivery, pick-up, and drive-through services in the food businesses. The struggles of this setup due to pandemic are needed to investigate to know the lived experiences of the food delivery riders. Foodpanda riders are the ones who deliver the food in front of the customers' houses. Researchers’ used phenomenology as their research design, and aimed to explore and understand the lived experiences of FoodPanda Delivery Riders in Capas, Tarlac. Five (5) participants were interviewed through an online interview utilizing a semi-structured questionnaire in order to gather qualitative data.

Transcribed data from the researchers’ interviews were carefully organized and analyzed to be shown in this paper. Findings have presented that the participants love their work because of the nice profit or salary but also had struggles. Findings revealed that the delivery experiences of every FoodPanda rider can be described through a) waiting for order; b) preparing; c) en route. While employee experiences include: a) Challenges; b) Motivations; c) Employment; d) Work Arrangement.

"Ces Actes des Journées d’étude internationales (Strasbourg, 6-7 novembre 2009) sont l’aboutissement d’un programme de recherche (2007-2009), mené au sein de l’UMR 7044 (Étude des civilisations de l’Antiquité : de la Préhistoire à Byzance), sur la place du cheval dans l’empire byzantin. Les 14 contributions qu’ils réunissent sont consacrées au cheval de guerre et de loisir dans l’Antiquité et au Moyen Âge.

L’ouvrage est divisé en trois sections. Dans la première, les contributeurs analysent la naissance du corps de cavalerie dans l’armée romaine et ses emplois. Sont également étudiés les différences régionales du pourtour méditerranéen dans l’élevage du cheval, les prix pratiqués ou encore les connaissances hippologiques des Anciens. Les travaux qui composent la deuxième partie proposent des synthèses sur le cheval médiéval, byzantin et occidental. Ils abordent le sujet à travers les textes, les sources archéologiques, les représentations et les us et coutumes des civilisations étudiées. Enfin, la dernière partie s’intéresse aux instruments hippiques, aux armes et à l’hippiatrie. Y sont ainsi réexaminées les innovations, adoptions et adaptations, dans l’Antiquité tardive, des pièces de l’équipement équin essentielles pour le combat, telles que l’étrier et le mors. Les armes des cavaliers sont réévaluées, ainsi que les changements dans leurs techniques de combat suite à la diffusion de l’étrier. On trouvera aussi l’analyse du vocabulaire employé pour l’anatomie du cheval dans la littérature hippiatrique grecque, qui connaît à cette période un essor sans précédent, lié au développement de la cavalerie romaine et protobyzantine."

Abstract— A successfully designed bike should possess safety and comfort for the riders. A safe bike means that its structure must be strong enough to prevent from damage due to various external loads and a comfortable bike means that its suspension systems must be excellent enough to reduce the transmissibility of disturbance coming from the uneven roads to the rider. In order to achieve the above goals, various methods have been presented; however, most of them assumed that each part of a bike is a “rigid body” except the helical (coil) springs. For the last reason, this paper tries to use more versatile finite element method (FEM) to perform the static and free vibration analysis of a bike. It is believed that a finite element model with all parts of a bike replaced by the “elastic” elements or lumped masses should be more realistic. In this paper, the entire bike structure is modeled by using three kinds of beam elements: pinned-pinned (P-P), pinned-clamped (P-C) and clamped-clamped (C-C) beam elements. Among the main parts of a bike structure, the main frame and rim are modeled by the C-C elements, the elastic effect of each tire is modeled by using a P-C element, and each spoke or each “spring-damper unit” is modeled by a P-P element. The key point of this paper is to study the influence of some pertinent parameters on the lowest several natural frequencies and mode shapes of the bike. It is found that the radius of the hub (disks), the pretension of each spoke, the mass of various attachments or rider, and the riding gesture of a rider have significant influence on the free vibration characteristics, the static deformations and internal forces (and moments) of the pertinent structural members of a bike. Because the mass of a rider is much greater than that of the bike structure itself, the static and dynamic characteristics of a bike with and without a rider on it must be studied, separately.

Pensare la pandemia è dunque un tentativo di analizzare criticamente il nostro presente a partire e al di là del Covid-19. Da una parte, questo evento condizionerà non poco gli anni a venire da molteplici punti di vista. Dall’altra, non si verifica in un vuoto pneumatico ma in un pieno di cui rivela in parte le caratteristiche delle forze in campo. Guardare al medio-lungo periodo ci pare dunque utile non solo perché i contorni della situazione globale sono ancora incerti ma anche e soprattutto perché permette di considerare il Covid-19 come una variabile all’interno di un insieme di operazioni strutturali del capitale.

La lettura del fenomeno dell’uberizazzione della prestazione lavorativa rappresenta l’esempio emblematico per approfondire le considerazioni di diritto sulla fenomenologia del lavoro on demand.

L’archetipo del lavoro digitale tramite la piattaforma Uber si è distinto per una pianificazione inedita dell’organizzazione di tradizionali prestazioni lavorative. A ben vedere, il decentramento produttivo, tecnologizzato e informatizzato e la ‘smaterializzazione’ del datore di lavoro hanno prospettato visuali inedite sull’assoggettamento ai poteri datoriali. Nei rapporti di lavoro così instauratisi si è reso possibile cogliere un sostanziale rapporto di subordinazione alla stregua del parametro normativo ex art. 2094 c.c. Gli indizi valorizzabili e apprezzabili dal legislatore e dal giudice italiano al fine di qualificare correttamente la prestazione di lavoro in questione si ricavano dalla conformazione del ruolo della società, dall’esercizio di un potere di ‘comando’ che si estrinseca in dettagliate indicazioni da seguire, dal meccanismo tramite il quale sono effettuare le recensioni, ossia nell’esercizio del potere di controllo e dalle sanzioni disciplinari irrogate agli autisti che disattendano le direttive imposte dall’app.

This article explores the notion of logistical connectivity as a twofold and ambivalent lens. On the one hand, connectivity can be seen as a pervasive logistical tool for labour exploitation and surveillance. On the other, it opens up opportunities to establish new kinds of social relations and workers organising. The analysis draws on empirical data gathered during 2016 in Turin, a city in northern Italy, during mobilisations by Foodora workers. The findings show that logistical connectivity constitutes an unprecedented form of pervasive control, but-under certain conditions-it can be shaken and reversed by the workers and become a mode of mobilisation and self-organising.

Archaeological excavations were carried out in the vaulted room that lies inside the northern fortifications of Cumae. In particular
this paper discusses the animal remains from the area located in front of the huge walls dated to the 6th-5th cent. BC. The assemblage mostly includes remains of Equus caballus and Canis familiaris with an occasional presence of cattle, pigs and sheep/goat. Evidence of marks caused by trauma at the death was found on the horse remains, suggesting the involvement of these animals in a war action. Other traces on the horse remains testify actions of dismemberment and slaughtering of the carcasses for eating purposes, suggesting a never reported siege of the city.

The main objective of this present work is to
present a systematic approach to representing
the interaction between the parameters
comprising both primary (tires) and secondary
(fork/linkage) suspensions of a Mountain
Bike and its rider, over rough terrain. Proper
dimensioning of the system allows for an
ergonomically suitable riding position without
penalizing the general compliance of the
system or concentrating muscle efforts on one
single region of rider´s body. In-plane
kinematics is used to determine instant frame
linkage leverage ratio, which in turn interacts
with the spring-damper unit´s rheological [1]
parameters, resulting in frame rate, which is
then associated in series with tire´s properties
to determine reduced suspension characteristic
values. Rider position is considered to be
standing and not pedaling, and its variation
from initially determined posture is here
named as rider offset. Maximum rear, front,
up and down variation with respect to zero
offset position define the space within which
the rider is allowed to position with respect to
the front triangle. By neglecting nonsuspended masses, the model aims to maintain
the uncoupled condition (1) between front and
rear suspensions so that both work
independently [2] and vehicle pitch motion is
ruled by the phase between front and rear
vertical motions. Such aim is tracked by
means of variation in rider posture.
Differently from previously presented rider
models [3], rider body´s stiffness is
represented by 4 torsional springs positioned
at the rider´s knees, hips, shoulders and
elbows. Variations on angular position
between rider´s body segments are obtained,
according to the maneuvers being performed,
and serve as input for a muscle-skeletal model
[4], used in the determination of activation
level on muscles in the human body. Such
information allows the development of
Mountain Bike Rider specific exercises that
prioritize determined muscles and optimize
training. Rider is here named semi-active for
being able to vary only posture with respect to
the bicycle, but no rider-input forces are
considered. Though, rider-joint optimal
stiffness distribution can be evaluated for each
instant of a determined maneuver, so that a
rider´s optimal posture and muscle activation
level can be obtained for either comfort and/or
endurance purpose or for minimal time riding
performance evaluation. Besides, once the
rider´s inertial and compliance data is added
to the formulation, a complete integration of
vehicle´s and rider´s compliances can be
obtained, and the same previous condition (1)
for uncoupling front and rear suspension
behaviours can be evaluated, so that mass
distribution is complemented by rider posture
and suspension parameters can be integrated
to the corresponding desired rider stiffness
distribution. By ignoring rider input forces,
we conclude that further optimization of
riding performance can be done, as well as
higher level of specific training is required to
fully understand the behaviour and output of
top-level riders.

L’economia di mercato globalizzata, nel contesto urbano, ha visto l’emergere di una folta schiera di lavoratori subalterni a supporto delle attività produttive concentrate nel cuore della città; alla perduta centralità del lavoratore, inoltre, nelle città globali si accompagna una mancata valorizzazione del cittadino: esse sono infatti rivolte piuttosto agli utenti, fruitori di servizi e destinatari di specifiche garanzie in quanto consumatori, più che lavoratori o cittadini. La città, però, può reagire alla sua oggettivazione quale centro di interessi economici privati, riscoprendo una rinnovata partecipazione democratica che si manifesta in due aspetti complementari: quello istituzionale e quello dell’autorganizzazione.

La parcellizzazione della prestazione lavorativa nella digital economy e la ‘smaterializzazione’ del datore di lavoro dell’Industry 4.0 hanno inesorabilmente sancito la crasi fra le categorie classiche del diritto del lavoro e la fenomenologia del lavoro on demand. La gravitazione nell’economia digitale di fenomeni contrattuali che a fronte di una veste formale “privatistica” occultano un rapporto di lavoro sovente sostanzialmente riconducibile all’area della subordinazione pongono diversi interrogativi che questo articolo si propone di evidenziare. Il saggio traccerà, brevemente il contesto giuridico in cui è si è sviluppato il diritto del lavoro e l’amalgamarsi degli input giuridico-dottrinari, in una prospettiva attenta a cogliere dove la “rivoluzione” digitale abbia disarticolato il prisma dell’autonomia della materia e quali effetti ha determinato questa inversione di prerogative.
