Kaitan Ilmu Falak Dengan Usul Fiqh

Puji syukur atas kehadirat Allah SWT yang telah melimpahkan berkah, rahmat dan hidayah-Nya, sehingga kami dapat menyelesaikan makalah ini yg berjudul "Jinayah Tentang Jarimah Hudud dan Tazir", Tak lupa juga kita sampaikan serta salam kepada junjungan kita Nabi besar Muhammad saw yang telah mengayomi kita semua dengan cinta, kasihsayang, serta perjuangan beliau sehingga kita bisa mengirup udara segar ini penuh dengan nokmat yang tak akan mampu kita hitung.

Metode penentuan awal bulan hijriah yang mengacu pada regularitas hilal adalah rukyat.
Isu sentral gangguan rukyat adalah masalah kontras visual cahaya syafak yaitu perbedaan terang
atau warna antara objek dengan latar depannya. Hilal yang redup, tipis, dan warnanya hampir sama
dengan langit di sekelilingnya menjadikan mata manusia dalam keadaan normal tidak sanggup
melihat hilal tanpa alat bantu rukyat. Teknologi rukyat mengalami lompatan yang cukup signifikan
dengan munculnya teknologi optik seperti teleskop rukyat. Teleskop tidak sanggup mengidentifikasi
hilal yang sangat redup, karena ketika cahaya hilal diperkuat cahaya syafak pun diperkuat. Akibatnya
cahaya hilal pun tetap sulit dikenali. Teknologi rukyat yang memungkinkan untuk dipakai adalah
digital imaging, dibantu dengan perangkat lunak dapat berfungsi meningkatkan kontras agar hilal
terlihat secara kasat mata. Teknologi digital imaging memiliki peran penting sebagai media verifikator
atas kesaksian seseorang melihat hilal tapi diragukan validitasnya. Dalam menyikapi perkembangan
teknologi yang dipakai untuk rukyatulhilal, ulama fikih baik klasik maupun kontemporer memberikan
respon positif terkait penggunaan alat bantu rukyat yang bertujuan untuk memudahkan proses
rukyatulhilal, terutama dalam hal memperjelas objek pandang hilal agar hilal dapat dilihat dengan
mata visual.

The movement of the sun, the earth, and the moon on their each orbites have caused a natural fenomenon called an eclipse. Rasulullah SAW taught his followers to take a pray when this situation comes. Many'ulamas have a different opinions in one or two case order to do the eclipse prayer, for example when the eclipse couldn't be seen because it hindered by clouds or if it's cloudy. One of the ulama's opinion which will be reviewed is the opinion of Ibnu Hajar al-Haitami. The aim of this research is to find out the fiqh of eclipse prayer in the study of Islamic Law, later Haitami's opinion concerning the implementation of eclipse prayer when it's cloudy. Qualitative approach used in this research with concept analysis, where researcher acumulate literatures that relates with the topic. The result of this reseach known that there are no significant differences in fiqh of eclipse prayer in the study of Islamic Law, but if it's cloudy when the eclipse happening, Haitami's argue that eclipse prayer keeps held when the eclipse happens before the cloudy. Meanwhile, if the cloudy happens from the begining to the last seconds of eclipse, the eclipse prayer not applied.

Unification of the Islamic calendar was much needed and is a major requirement for Muslims today in the running of worship. Uniformity in to worship and celebrate Islamic holy days is something that has been long awaited. An expectation of the Islamic calendar is determining who has the certainty that a better and more organized for various purposes. However, it is in conflict with a different concept of the new moon from several groups paradigm respectively, both from the perspective of science and religion. Hilāl is one of the main sources in the preparation of the Islamic calendar. Currently, the definition of the new moon is very diverse. Which definition is used for the initial determination new month of hijriyah, both from the perspective of astronomy or fiqh, or combination of them. Therefore, the article is devoted to the redefinition of the concept of the new moon from the perspective of science and fiqh, that synergy occurs between fiqh and the astronomical new moon to determine new month of Islam. So that the unity of the Islamic calendar can be realized well. [] Penyatuan kalender Islam sangat dibutuhkan dan merupakan syarat utama bagi umat Islam saat ini dalam menjalankan ibadah. Keseragaman dalam beribadah dan merayakan hari besar Islam adalah sesuatu yang telah lama ditunggu. Harapan atas kalender Islam adalah sebuah kalender yang memiliki kepastian (akurasi) lebih baik dan lebih terorganisir untuk berbagai keperluan. Namun dalam realitas terdapat perbedaan pandangan tentang konsep bulan baru oleh beberapa kelompok, baik dari perspektif ilmu pengetahuan maupun agama. Hilāl adalah salah satu sumber utama dalam penyusunan kalender Islam. Saat ini definisi bulan baru sangat beragam, padahal definisi inilah yang digunakan untuk penentuan awal bulan baru Hijriyah, baik dari sudut pandang fikih astronomi atau kombinasi dari mereka. Artikel ini difokuskan untuk mendefinisikan kembali konsep bulan baru dari sudut pandang ilmu pengetahuan (astronomi) dan fikih. Sinergi antara fikih dan astronomi sebagai pendekatan untuk menentukan bulan baru Islam perlu diupayakan sebagai sebuah ikhtiar untuk me-rumuskan kesatuan kalender Islam.

In Indonesia, frequently occured the differences on initial determination of islamic lunar month such as Ramadhan, Syawal and Zulhijjah. This difference can not be separated from the two major methods of determining begining of lunar month namely ḥisāb (calculation) and ru'yat (observing hilāl). Apart from debate between ḥisāb and ru'yat, another issue that is also often raises is applicability rukyah and ḥisāb, known as validity of maṭlā'. Meaning of the maṭlā's concept now seen no longer adequate and unable to overcome that differences. For that reason, reinterpretation of the maṭlā's meaning is something that is very important. However it should be noted that reinterpretation should not be out of bounds from Shar'i limitation and on the other hand must involve basic science of astronomy so can make it more up to date and more easily accepted rationally. [] Di Indonesia seringkali terjadi perbedaan dalam penentuan awal bulan Qamariyah khususnya Ramadhan, Syawal dan Zulhijjah. Perbedaan ini tidak bisa terlepas dari dua metode besar penentuan awal bulan Qamariyah yaitu ḥisāb dan ru'yat. Terlepas dari persoalan perdebatan antara penganut metode ḥisāb dan ru'yat, sesama penganut ḥisāb ataupun sesama penganut ru'yat, persoalan lain yang juga sering menimbulkan persoal-an adalah tentang keberlakuan ru'yat dan ḥisāb atau yang dikenal dengan keberlakuan maṭlā'. Pemaknaan konsep maṭlā' telah dikaji dalam perspektif fikih. Namun pemaknaan konsep maṭlā' saat ini dipandang tidak lagi memadahi dalam mengatasi perbedaan ter-sebut. Untuk itu rekonseptualisasi (pemaknaan ulang) terhadap makna maṭlā' me-rupakan sesuatu yang sangat penting. Namun yang perlu dicatat bahwa rekoseptualisasi tersebut tidak boleh keluar dari batas-batas ketentuan syar'i dan di sisi lain harus melibatkan dasar-dasar ilmu astronomi sehingga lebih up to date dan lebih mudah diterima secara rasional.

Any subject relating to religion is usually under the jurisdiction of the Sultan or ruler. Every
country has a religious institution in executing religious matter. Among the subjects considered
as religious matter is the determination of the arrival of Shawwal. In determining the beginning
of Shawwal in Brunei Darussalam, there surely is a predetermined SOP. The question is what
is the SOP in determining the arrival of Shawwal in Brunei Darussalam? Under which
enactment is it allocated? Who is involved in executing the SOP? To answer all of these
questions, this study has two main objectives. First, to identify the SOP of determining the
arrival of Shawwal in Brunei Darussalam; second, to analyze the application of the SOP in
determining the arrival of Shawwal in Brunei Darussalam. In order to achieve these objectives,
this qualitative study adopted the method of literature review and interview of experts in
collecting data. All data were analyzed using content analysis method. Finally, this paper
concludes that the determination of the arrival of Shawwal is based on Mimbar Fatwa 5 Negara
Brunei Darussalam, and allocated under 29 of the Syariah Courts Act 1998. The Chief Syari’e
Judge is responsible in the rukyah of the new moon with the help of the Syariah Judges, Officers
of the Survey Department, Ministry of Development and the Officials of the Ministry of
Religious Affairs. Because Brunei Darussalam used the rukyah method solely, it has its own
SOP in accordance to the principle of fatwa and the allocated act.

Islam is very scientific. One of the compulsory studies of falak. The study discussed islamic law relating to astronomy. Regarding falak information. Studies show that falak was closely related to god's commands. Associated with human worship included the direction of the eith, cruciate, hijriyah calendar, lunar and solar eclipses. Based on this, then, learning the falak was a fardhu kifayah for muslims to help the perfection of the execution of worship to god almighty.

Facing Ka"bah is one of the requirements for the validity of prayer. Problem in straightening saf in mosques had become a heavy topic, Some Council of Mosque Prosperity (DKM) assumes that straightening direction qibla means rebuilding the mosque, whereas what should be changed is only the direction of the saf prayer). Some mosques in the village of Rancabango Sub-Distrik Tarogong Kaler and village of Wangunsari Kampung Areng Lembang, the direction of qibla should be re-verified by the institutions that have the force of law. Therefore, this research aims to know the opinions of the muftis in determining the qibla direction and the factors that influence the inaccuracy of the qibla direction. The methods used in this research is descriptive-analysis, that is describing systematically and factually about facts, conditions, and situation of the mosque building. It can be concluded that the muftis agree about the condition of facing the qibla for people who looks the Ka"bah, then the prayer faces/overlooks "ainul Ka"bah, whereas for people who cannot see the Ka"bah, then the prayer faces towards jihatul Ka"bah. As for the direction of mosques showed that some mosques still have an accuracy that is less accurate to the price of the specified angle. Abstrak: MenghadapKàbah adalah salah satu persyaratan untuk validitas doa. Masalah dalam meluruskan saf di masjid telah menjadi topik yang berat, Beberapa Dewan Kemakmuran Masjid (DKM) menganggap bahwa meluruskan arah kiblat berarti membangun kembali masjid, padahal apa yang perlu diubah hanyalah arah saf sholatnya saja. Beberapa masjid di desa Rancabango Kecamatan Tarogong Kaler dan juga desa Wangunsari Kampung Areng Lembang, arah kiblat perlu diverifikasi ulang oleh institusi yang memiliki kekuatan hukum. Oleh karena itu, penelitian ini bertujuan untuk mengetahui pendapat para mufti dalam menentukan arah kiblat dan faktor-faktor yang mempengaruhi melencengnya arah kiblat. Metode yang digunakan dalam penelitian ini adalah deskriptif-analisis, yaitu menggambarkan secara sistematis dan faktual tentang fakta, kondisi, dan situasi bangunan masjid. Dapat disimpulkan bahwa para mufti setuju tentang kondisi menghadapi kiblat bagi orang-orang yang melihat Ka'bah, maka doa menghadap / menghadap 'ainul Ka'bah, sedangkan bagi orang-orang yang tidak dapat melihat Ka'bah, maka doa menghadap ke arah jihatul Ka'bah.
