1 80% payment shall be made on receipt of the items in satisfactory condition, against suppliers challan
certified by consignee gazetted officer, and inspection certificate issued by the nominated inspection
agency. Balance 20% payment shall be made after successful installation, commissioning and acceptance
of the equipment by consignee subject to submission of Bank Guarantee for 10% of the contract value for
warranty obligations, valid beyond 6 months period of warranty.

1 Statutory Variation in taxes and duties, or fresh imposition of taxes and duties by State/ Central
Governments in respect of the items stipulated in the contract (and not the raw materials thereof), within
the original delivery period stipulated in the contract, or last unconditionally extended delivery period
shall be to Railways' account. Only such variation shall be admissible which takes place after the
submission of bid. No claim on account of statutory variation in respect of existing tax/duty will be
accepted unless the tenderer has clearly indicated in his offer the rate of tax/duty considered in his quoted
rate. No claim on account of statutory variation shall be admissible on account of misclassification by the
supplier/ contractor.

SCR/IR/PUs, the supply performance data
available in iMMIS with SCR shall be taken
into consideration while evaluating the
offers of the tenderers.

2 Security Deposit (SD)/Performance Normal Applicable to No No Not Allowed

Security for Stores Contracts will be all bidders
applicable as under: (a) The Security
Deposit amount for this tender shall be
5% of the value of the contract subject to
Max. Rs50Lakhs. (b) There shall be no
exemption from submission of Security
Deposit (SD) for any tender or by any
tenderer except exemptions as per tender
conditions attached with this tender: (c) In
case of failure by contractor to meet
deliveries for any lot, Railways may cancel
the contract for defaulted part by
forfeiting SD commensurate to that lot.
(d) Wherever SD has been exempted, for
any reason, and the supplier fails to
supply goods as per conditions of
contract, as amended from time to time,
Purchaser shall have right to levy
damages from the supplier for failing to
comply with the contractual conditions,
not by way of penalty, an amount equal to
SD amount, as would have been
applicable if the contract was with a non-
exempted vendor. These damages shall
be treated as recoveries outstanding
against the vendor and dealt with
accordingly.

The tenderers in their bid shall indicate the details of their GST Jurisdictional Assessing Officers (Designation,
Address & email id). In case of a contract award, a copy of Purchase Order shall be immediately forwarded by
Purchaser to the GST Jurisdictional assessing officer mentioned in Tenderer's bid

This tender complies with Public Procurement Policy (Make in India) Order 2017, dated 15/06/2017, issued by
Department of Industrial Promotion and Policy, Ministry of Commerce, circulated vide Railway Board letter no.
2015/RS(G)/779/5 dated 03/08/2017 and 27/12/2017 and amendments/ revisions thereof.

As a Tender Inviting Authority, the undersigned has ensured that the issue of this tender does not violate
provisions of GFR regarding procurement through GeM.
