2. Which type of valves requires approval from PESO under Gas Cylinder Rule 2016 for
import to India?
Ans: Approval from PESO under Gas Cylinder Rules 2016 shall be applicable to valves which are
directly connecting to gas cylinders.
3. Whether foreign manufacturer can manufacture and export gas cylinder/valves as per
standards other than Indian Standards?
Ans: Yes, foreign manufacturer can manufacture and export gas cylinder/valves as per any
internationally accepted standards approved by Chief Controller of Explosives.

8. Who will be responsible for appointment of Indian distributors of Foreign Cylinder and
valve manufactures?
Ans: The foreign manufacture shall be responsible for appointment of their Indian distributors in India.
The foreign manufactures shall submit copy of agreement made between manufacturer and their
Indian distributor along with application for approval.
9. How the foreign cylinder /valve manufacturer can get extension of validity of approval?
Ans: The manufacturer shall submit application as per Rule 55 of Gas Cylinder Rules 2016 for
extension of validity of approval.
10. Is manufacturer eligible for extension of validity even after expiry of approval?
Ans: The manufacturer can submit application for extension of validity up to one year of date of
expiry of approval with required late fee as Rule 55(7) of Gas Cylinder Rules 2016. No approval
shall be extended if application is submitted after one year of the date of its expiry.

Ans :Design drawings shall show manufacturing code, all necessary design parameters as per code,
raw material details, company name & site address, valve & thread details, gas service, water
capacity etc.Design drawings shall be duly signed and stamped by BIS/TPIA.
8. Whether Indian manufacturer can manufacture gas cylinder/valves/regulators as per
standards other than Indian Standards?
Ans :Yes, Indian manufacturer can manufacture rt gas cylinder/valves as per any internationally
accepted standards accepted by Chief Controller of Explosives.
9. What is the fee structure applicable to approvals?
Ans :Fee as per Schedule V of Gas Cylinder Rules 2016.
10.How to make payment for approvals of Foreign manufacturers?
Ans :Fee for approvals of gas cylinders shall be paid online under FPS moduleand for valves and
regulators shall be paid through Bharatkosh portal as their online modules are under development
and receipt of payment shall be submitted along with application. Detailed direction for fee
payment through Bharatkosh is available under „Misc. info‟ in PESO website www.peso.gov.in.
III. FAQ on Import of Gas Cylinders(Filled and empty ) under Form –D Licence
1. Whether foreign origin empty gas cylinders that are not approved by PESO are allowed to import
and refilling of compressed gas and use in India.
Ans: No. Only PESO approved cylinders are allowed to import by an authorized Indian
agent/representative of the foreign manufacturer who has got approval from PESO for
manufacture of such cylinders and export to India to his agent/representative.
2. What are the documents required to be submitted for import of filled /empty cylinders.
Ans:
a) Application in Form –D
b) License in form E&F or F of Indian Firm
c) Cylinder valid Test certificate as per code of fabrication
d) Filler certificate for the specific cylinder and specific gases.
e) MSDS of the gas filled in the cylinder
f) Details of infrastructure/ handling equipments and storage facility including emergency
action plan and qualified and trained technical manpower details.
g) PLI details if import of empty cylinders/ valves from foreign manufacturers covering India
h) Agreement for returning back the empty cylinder to country of origin in case of import of
filled cylinders.
2. Whether empty cylinders of foreign origin (from PESO approved companies) are imported with
valves.
Ans: Separate License for import of Cylinder/ Valves shall be obtained from PESO.

provision is not applicable for valves to be imported for fitting on gas cylinders approved by
PESO, manufactured by the Indian importer at his manufacturing premises in India and the same
to be exported to foreign countries for bonafide purpose. In this regard the Indian importer shall
submit relevant documents to PESO to establish that the valves are fitted in Indian origin
cylinders at his premises for export purpose. Besides, all rules and procedures of the respective
Customs and Port authorities shall be followed.
5. Who is authorized to import foreign origin empty & new cylinders /valves approved by PESO?
Ans: Only the Indian distributor with whom the manufacturer had made MOU and details submitted to
O/o, CCE, Nagpur is permitted to import empty & new cylinders /valves of foreign origin.
However, this provision is not applicable for valves to be imported for fitting on gas cylinders
approved by PESO, manufactured by the Indian importer at his manufacturing premises in India
and the same to be exported to foreign countries for bonafide purpose. In this regard the Indian
importer shall submit relevant documents to PESO to establish that the valves are fitted in Indian
origin cylinders manufactured at his premises for export purpose. Besides, all rules and
procedures of the respective Customs and Port authorities shall be followed.
6. Whether foreign origin gas cylinders that are not approved by PESO are allowed to import and
refill compressed gas at the licensed premises and re-export to the country of origin.
Ans: As per rule 3(5) of Gas Cylinder Rules 2016, such cylinders are allowed to import by a licence
holder having licence in Form –E and F for filling such gas under the said rules for re-exporting
to the country of origin provided all rules and procedures of the respective Customs and Port
authorities shall be followed. In this regard, the importer shall submit relevant documents to
PESO to establish that the filled cylinders will be exported to the country of origin and vice
versa.
IV.FAQ for obtaining Approval, Prior Approval for Amendment and License in E&F
1. What are regulations for licence for filling and possession of Gas Cylinders in India?
Ans :Licence for filling and possession gas cylinders are covered under Gas Cylinder Rules 2016.
4. Which form of licence needs to be obtained for filling and possession of Gas Cylinders?

Ans :Form-E and Form-F of the Gas Cylinder Rules 2016 is issued for filling and possession of Gas
Cylinders. In this regard, please refer to rule 50, 51, and 54 of Gas Cylinder Rules 2016 for
details.
5. Where can we find the format of application for the licence under Form-E and Form-F of Gas
Cylinder Rules 2016?
Ans :Application for the grant/amendment/renewal/ duplicate copy of a licence to fill and/or store
compressedgas/gases in cylinders can be submitted after duly filling in Form-C of the Gas
Cylinder Rules 2016. Please refer to rule 49, 54 and 55 of Gas Cylinder rules 2016.
6. How can I submit application for licence under Form-E and Form-F of theGas Cylinder Rules
2016?
Ans :All the applications under Gas Cylinder Rules 2016 have been made online. You can upload the
application through online module of National Single Window System on
https://www.nsws.gov.in/. For help regarding submitting of online application technical support

7. What are the documents required for filing an application for grant of licence for filling and
possession of Gas Cylinders.
Ans :Application for the grant/amendment/renewal/ duplicate copy of a licence to fill and/or store
compressed gas/gases in cylinders can be submitted after duly filling in Form-C of the Gas
Cylinder Rules 2016. Refer rule 49, 54 and 55 of Gas Cylinder rules 2016. List of documents is
mentioned along with the Form-C of Gas Cylinder Rules 2016 and under Rule 49 of Gas Cylinder
Rules.
8. Who is the authority to issue No Objection Certificate for Land for obtaining licence under these
rules?
Ans :Please refer to Rule 48 of Gas Cylinder Rules.
9. What is the fee required under these rules.
Ans :Fee under gas cylinder rules 2016 has been tabulated in Schedule V of Gas Cylinder Rules 2016.
10. Please explain how many filled gas cylinders are not required licence in Form-F for possession
and sale under Gas Cylinder Rules 2016?
Ans :Please refer Rule 44 of Gas Cylinder Rules 2016.
11. Is prior approval necessary for construction of premises proposed to be licenced.
Ans :Yes.Prior approval necessary for construction of premises proposed to be licensed. You may
refer to rule 47 of Gas Cylinder Rules 2016 for details.
12. Please inform the period of validity the licence under these rules in Form-E and Form-F.
Ans :Licences under these rules may be obtained for a minimum period of one year and
maximum period of 10years as specified in rule 51 of Gas Cylinder Rules 2016.
13. Can the licenced premises be altered after grant of licence?
Ans :No.Prior approval from licencing authority is necessary for alteration in the licensed premises.
Please refer to rule 53 and 54 of Gas Cylinder Rules 2016 for further details.
14. What is the procedure for transfer of licence?

Ans: Please upload online application on National Single Window System portal on
https://www.nsws.gov.in/ along with requisite documents as mentioned in rule 54 of the Gas
Cylinder Rules 2016.
15. For how many years licence under Form-E and Fof the Gas Cylinder Rules 2016 for filling and
possession of Gas Cylinders be renewed?
Ans : Licence can be renewed for a minimum period of one year and maximum period of 10years.
16. Is application of endorsement of the premises available in the online module?
Ans : Yes. Application for endorsement of licence can be made through the online licencing module
available under National Single Window System.
V.FAQ for obtaining Approval, Prior Approval for Amendment and License in Form G
1. What are the details to be mentioned in the application form- Form C .
Ans :The Form C should contain name of the licencee, proper correspondence address, location of the
premises clearly specifying Survey no., town/village, district, state, Pincode etc.
2. What are the particulars of NOC issued by District Magistrate (in case of standalone CNG
station)
Ans: Complete particulars of NOC issued by District Magistrate clearly specifying Sy.No. of the site
and PESO approved plan duly endorsed by DM shall be submitted.
3. What is the requirement of District Magistrate NOC for CNG stations forming part of Form XIV
(retail outlet), LNG stations.
Ans :No fresh DM NOC is required. DM NOC of existing retail outlet/LNG station shall be submitted
in this case.
4. What are the details of CNG cascades, compressors, CNG dispensers shall be submitted
Ans :All details such as CNG cascades total water capacity along with no of cylinders in the cascade
and individual cylinder water capacity, details of latest hydro test of cylinders in the cascade,
details of compressor including capacity in SCMH, CCE approval for compressor&dispensers
shall be submitted. The structural adequacy with respect to the superstructure with reference to
static and dynamicload/vibrations on full operation of all the equipment shall be carried out by a
reputed structural engineer and its report shall be enclosed along with other documents.
5. What are the Documentary evidence towards legal possession of land? .
Ans : Copies of lease agreement, partnership deed/memorandum and article of association,
approval/clearance/permit as applicable from local authorities may be submitted.
6. Whether submission of HAZOP study is mandatory?
Ans : The requirement of submission of HAZOP study arises as per the criteria covered under MSIHC
Rules 1989. In this regard, the points appearing in the prior approval shall also be considered.
7. What is the requirement of NOC in case of land addition in existing retail outlet for CNG
installation?
Ans :District Magistrate NOC as applicable for standalone CNG station is required.
8. From where Safety distances details of CNG installation can be obtained.
Ans :Please refer to Table IA , IB & Table II.
Renewal of licence:

Ans :Original licence, documentary evidence towards legal possession of land, latest hydrotest details
of CNG cascades.
2. Whether licence is valid if not renewed in time?
Ans :Every application for the renewal of a licence or revalidation of approval shall be made so as to
reach the licensing authority on or before the date on which it expires and if the application is so
made, the licence shall be deemed to be in force until such date as the Chief Controller or
Controller renews the licence or until an intimation that the renewal of the licence is refused has
been communicated to the applicant.
3. What is the procedure for late submission of renewal application?
Ans :Please refer Rule 55 (7)& 55 (8) of Gas Cylinder Rules, 2016.
4. Whether renewal fees will be refunded if renewal is refused by PESO?
Ans :Where the renewal of a licence or approval is refused, the fee paid shall be refunded to the
licensee after deducting there from the proportionate fee for the period beginning from the date
from which the licence or approval was to be renewed up to the date on which renewal thereof is
refused.
Amendment of licence:
a.For prior approval of amendment, Plan showing clearly the changes proposed shown in proper
colour coding (Yellow for deletion, Red for addition) shall be submitted.
b.For amendment prior approved plan (facilities approved but not installed shown in green)
shall be submitted.
c.Completion certificate with regards to completion all works shall be submitted for amendment
of licence.

5. How LPG cylinder is stored?
Ans :Liquefied petroleum gas cylinder and cylinders containing liquefiable gases shall always be kept
in an upright position and shall be so placed that they cannot be knocked over.

1 How to apply to obtain new approval for Cylinder Testing Station?
Ans : Provision for submitting online application for new Approval for Cylinder
Testing Station is available in National Single Window system portal (NSW)
2 To Whom I have to apply to obtain new approval for Cylinder Testing Station?
Ans : Online application shall be submitted to respective Circle office of PESO under
whose jurisdiction the premises is situated.
3. What is the fee for new approval for Cylinder Testing Station?
Ans : Scrutiny fee with one year validity fee for the first time new approval for
Cylinder Testing Station is Rs 10000/-
4 What are the documents required to submit for new approval for Cylinder
Testing Station?
Ans : The following documents shall be submitted in duplicate to the licensing
authority for grant of approval for cylinder testing station namely:-
( 1 ) Fee as per Schedule V of Gas Cylinder Rules, 2016. (i.e. Rs 10000/-)
( 2) Ownership proof for legal and physical possession of the land, where such
facilities are proposed to be set up;
( 3 ) Applicant's name and full address with telephone numbers and E-mail address;
( 4) Proposed location of cylinder testing station.
( 5) Six copies of each site and layout plan showing the area for degassing in case of
flammable gas cylinder testing station and details of neutralisation facilities in case of
toxic gas cylinder testing and location of various testing equipments in the cylinder
testing shop;
( 6) Specification or code proposed to be adopted for the testing and examination of
cylinder
( 7 ) Organisational set up of the applicant with specific reference to qualification and
experience of the personnel engaged in the testing of cylinder
( 8 ) Quality control check or test carried out at each stage of testing and examination
of cylinders
( 9) Details of template or gauge provided to check or test;
(10) Steps taken to check the accuracy of testing and checking equipment and
frequency of such checking.
( 11) Equipment available for carrying out non-destructive examination such as Gama
ray or X-ray equipment, viewer, etc., for radiographic examination, ultrasonic flaw
detector, equipments for dye penetration and magnetic particle tests, etc;
(12) Performa of the record and certificate for various test carried out by the cylinder
testing station.
( 13) ISO accreditation certificate issued by any nationally or internationally
recognised agency within a period of one year from the date of approval.
( 14) List of relevant code, specification and technical literature available;

6 What is the validity of approval for a cylinder Testing Station?
Ans : Approval/ Permission for cylinders testing station shall initially be granted for a
period of one year. First approval granted shall remain in force till the 30th day of
September of the current year.
Approval may be revalidated to a maximum period of ten years subject to the
production of valid ISO accreditation certificate issued by any nationally or
internationally accredited agency, testing records for the period of validity and on
payment of fee as specified in Schedule V of Gas Cylinder Rules, 2016.
7 What is the fee for renewal/ revalidation of approval for Cylinder Testing
Station?
Ans : Fee for renewal/ revalidation of approval for a Cylinder Testing Station is Rs
2000/- per year. Application for renewal/ revalidation of Approval may be submitted
for maximum period of ten years.
9 What is the last date for submission of online application for revalidation of
approval ?
Ans : (i) In general online application for revalidation of approval with required
documents shall be submitted on or before expiry of approval.
(ii) If the application for revalidation with required documents is not received
within the time as specified in above, but received not later than three months the
approval shall be revalidated only on payment of a fee amounting to twice the fee
ordinarily payable.
(iii)If application for revalidation with required document is received by the Chief
Controller or Controller after three months from the date of expiry but not later than
one year from the date of expiry, the approval may, without prejudice to any other
action that may be taken in this behalf, be revalidated on payment of late fee at the
rate of one year approval fee for every delay of three months or part thereof:

(iv) No approval shall be revalidated if the application for renewal or revalidation
is received by the Chief Controller or Controller after one year of the date of its expiry.
