RESUMO | O presente artigo analisa a reprodução humana assistida sobre a ótica dos três dispositivos que a regu-lam: a Resolução CFM nº 2.168/2017, o Provimento nº 63/2017, do CNJ, e o Código Civil. Com base neles, se ex-trai as principais implicações jurídicas que interessam ao direito de filiação. Assim, através de um diálogo entre di-versos doutrinadores e pensadores do tema, se estuda a questão do direito à origem genética, da socioafetividade e da multiparentalidade, tendo como finalidade demonstrar a possibilidade de conexão entre eles e os efeitos jurídicos decorrentes. Em relação a metodologia, tem-se que, quanto: a área de conhecimento, é relativa as Ciências Sociais Aplicadas; aos fins, é exploratória; aos meios, é documental e bibliográfica; a abordagem, é qua-litativa; a natureza, é aplicada e, ao método, é dedutiva. ABSTRACT | This article analyzes the assisted human reproduction by the three devices that regulate it: CFM Resolution No. 2.168/2017, Provision No. 63/2017, of the CNJ, and the Civil Code. Based on them, the main legal implications of the right of filliation are extracted. Thus, through a dialogue between several indoctrinators and thinkers of the subject, we study the question of the right to genetic origin, socioaffectivity and multi-parenthood, with the purpose of demonstrating the possibility of connection between them and the resulting legal effects. Regarding the methodology, we have that: the area of knowledge is related to Applied Social Sciences; the purpose is exploratory; the means are documentary and bibliographical; the approach is qualitative; the nature is applied and, the method is deductive.

Abstract:
The objective of this study is to analyze patients' right to life and obtain treatment for their pathologies through judicial channels. The right to medicines, many of them of high cost, are not provided by the Unified Health System – SUS. It is emphasized that, one of the difficulties of carrying out the treatment is to achieve the same by administrative means. In addition, another negative point is the lack of compliance of the Brazilian Government, even with injunctions in legal proceedings. With this, the institute of the judicialization of health arose, which is being much discussed by both the Brazilian
Federal Supreme Court (STF) and the Brazilian Superior Court of Justice (STJ). Even with some legal proceedings being provided in favor of the patient, the process of purchase and delivery of the medication is still very time consuming, which can cause worsening and even death of patients. It is necessary, therefore, a more effective action of the Brazilian Government in this health issue.

RESUMO Atualmente, as famílias podem ser constituídas por diversas formas jurídicas. Em decorrência disso, as técnicas de reprodução humana assistida ganharam grande destaque a nível mundial, possibilitando o surgimento de famílias por métodos artificiais e fornecendo aos casais com distúrbios na fertilidade a possibilidade de terem filhos que não os adotivos. Uma das técnicas de reprodução assistida é a maternidade de substituição. A maternidade de substituição é um acordo no qual uma mulher gesta para um outro casal ou outra pessoa diversa da que o gestou. O objetivo deste trabalho é esclarecer os principais conceitos decorrentes desta prática de reprodução assistida que é fecundação in vitro utilizada para a consecução da maternidade de substituição e analisar as normas pertinentes que tratam das questões de maternidade substitutiva em nosso ordenamento jurídico e na legislação estrangeira. The main goal of this essay is to discuss the aspects of the paternity denial in relation to the principle of affectiveness. Initially, the essay deals with the transformations of family law and the current notion of the concept of this right, introducing the basic principles to understand the correct judgment in the procedural demands of paternity denial. It is necessary to study the present theme as judicial demands are increasing, whose pretension is the prevalence of the socio-affectiveness bond before the biological one. It is important, however, to address the criteria of the paternal-filiation bond highlighting the legal, biological and affective reality. Because it is fundamental for the constitution of socio-affective paternity, therefore, it is imperative to study the elements to prove the possession of state of a son (daughter). Thus, the study and delineation of affective circumstances are important so that the best interest principle for the child is not harmed. Thus, we must analyze each concrete case in the sense of establishing the best alternative to preserve the best interest for the child.

In the Family Law autonomy has been guaranteed to parents for the realization of free family planning based on responsible parenthood and the dignity of the human person. With advances in assisted human reproduction techniques the possibility of embryo selection has emerged, one of the techniques used in assisted human reproduction is called "siblings savior", a procedure by which the embryos are selected through a double pre-implantation genetic diagnosis, to be free from genetic failures and at the same time compatible with older siblings who need haematopoietic stem cell transplantation. Thus, this article aims to analyze the controversy surrounding the "baby drug" and the physical and psychic impacts of this procedure and its ethical limits, especially because it involves controversial topics such as eugenics, the issue of organ and tissue transplantation by minors and, on the other hand, represents a healing opportunity for siblings who have a serious illness. For that, the theoretical method of approach was used, opting for the bibliographical review and the legislative analysis.

This paper considers the potential impacts of completely self-driving vehicles on vehicular liability and provides an up-to-date information about legal regulation of autonomous vehicles (AVs) in Europe, USA and Brazil. Potential benefits of self-driving cars are increased mobility for people who can’t drive, the promise of safer roadways, and hours of driving time dedicated to a more productive use.  Technical professionals have to be aware of legal regulation of AVs as well in order to get the opportunity to discuss the feasibility of different legal statements. Liability questions is investigated as it might cause today’s main legal obstacle for the wide spreading of autonomous cars. The authors stress reasonable recommendations from the perspective of technological regulation and law, in order to deal with the main problems that might hamper the development of autonomous transport technology. Finally, the authors draw attention to the most significant legal challenges that AVs address to lawmakers, insurance companies, consumers and car manufacturers.

The Brazilian law does not support, nor forbid, adoption of children by same sex couples. This research aims to clarify the legal possibilities of adoption by homoaffective couples, through a search and examination of legal literature, analysing the principles of Dignity of the Human Person, Equality or Isonomy, the Best Interest of the Child and Adolescent, as well as the legal value of affection, Human Rights, and other constitutional principles. The theme is current and controversial due to resistance in admitting the rights of adoption to homoaffective couples, as our society is marked by a prejudiced and discriminatory cultural and legal consciousness. The Brazilian Statute of the Child and Adolescent does not include any rules restriction on sex, marital status, or sexual orientation of the adopter. The child’s best interest principle should be analysed, being the basic criterion for courts’ decisions, to consider what is best for child and the adolescents. Studies in Law and Psychology show that the lack of parents of both sexes does not influence or affect the development of the sexual and psychological identity of the child. Thus, the most reasonable position is the one which understands the viability of adoption by homoaffective couples for meeting the principle of human dignity, because it is the fundamental right of personality and the true measure of social justice.

The anonymous childbirth and the protection of personal right will be the subject of this course conclusion work. The theme of anonymous birth motivated the proposal of two law projects in the National Congress, in order to regulate this statute in Brazil. There is much doctrinal discussion on the matter, since the adoption of the law already provides for the possibility of the mother to give her child up for adoption, which would generate a legal contradiction approval of Anonymous Childbirth Act. It is also discussed the right to genetic origin and the right to state membership, since to deny the right to genetic origin to the child is to violate a right since the title belongs only to her.

The purpose of this paper is to present and discuss the implementation of public policies to eliminate dioxin, a highly toxic substance found in the environment, that in recent years has negatively affected the general health
of human beings, focusing on women’s reproductive health. This discussion entails the necessary approach to apply the following environmental principles; precaution, prevention and a good quality of life, as these are the necessary components to ensure a better quality of life regarding the health of women, highlighting the need to
focus on women’s reproductive health. Noting the importance of ecologically preserving the environment’s health for present and future generations, since this directly relates to human health.

Societal changes and technological advances have triggered evolution in mobility, including the electric mobility. Electric mobility could help the EU and other countries in reducing greenhouse air pollution, gas emissions, dependence on oil and noise. In recently years global sales of new electric road vehicles is growing fast. In Europe and Brazil market for such vehicles is still small and dependent on support policies. National-level incentives such as lower taxes or provision of free public parking are promoting electric mobility in Norway, and Brazil, since electric vehicles are more expensive than internal combustion vehicles. Care is needed to design laws and measures that will be effective from those different policy points of view, and that will promote social equity at the same time.

Este trabalho estuda o diagnóstico genético pré-implantacional (DGP) de embriões realizado em clínicas de reprodução assistida nos programas de fertilização in vitro e injeção intracitoplasmática, comportando certa complexidade legal; consequentemente, podendo apresentar diversos conflitos entre o casal e a clínica de reprodução. Talvez sejam as técnicas de reprodução assistida o ramo da medicina que comporta mais implicações sociais, éticas e morais. Somente na América do Sul foram realizados 18.500 casos de fertilização in vitro em um intervalo de quatro anos. No Brasil, entretanto, ainda não existe uma lei que regulamente o embrião e as técnicas de reprodução assistida, cabendo ao Conselho Federal de Medicina a regulamentação através de resoluções. É analisado também a responsabilidade civil da clínica de reprodução humana e do médico esterileuta, uma vez que o diagnóstico genético préimplantacional pode apresentar falsos positivos ou negativos. Por fim, é discutida e diferenciada a eugenesia terapêutica da eugenesia liberal.

The right to basic sanitation, was elevated to the category of fundamental right by the Constitution of 1988 to protect the ecologically balanced environment, ensuring social rights to health and adequate housing and put the dignity of the human person as the foundation of the Brazilian Democratic State. Before their essentiality to humans, this article seeks to understand why universal access to basic sanitation is a goal so difficult to achieve in Brazil. Therefore, this research uses the deductive and analytical method. Given the nature of the research literature, research techniques were centered in specialized books on the subject, journals, theses and dissertations, laws, relevant law case and raising social indicators relating to the theme. O desastre ambiental em Mariana, Minas Gerais, decorrente do rompimento das barragens de rejeitos da Mineradora Samarco, é uma catástrofe sem precedentes face à magnitude de seus efeitos devastadores, quer sejam eles incidentes sobre o conjunto de bens da sociedade civil vitimada, quer sobre o bioma. O fato atrai a responsabilização por dano de todos que, de alguma forma, colaboraram para o evento, sendo necessário demonstrar os agentes, o nexo de causalidade e a legislação aplicável ao caso. Assim, pretende o presente artigo colocar em evidência a responsabilidade civil da mineradora e dos entes estatais envolvidos, cujas condutas, comissivas ou omissivas, contribuíram de alguma forma para o evento que, em 5 de novembro de 2015, culminou no desastre, destruindo por completo o distrito de Bento Rodrigues e impactando, de forma negativa, as populações ribeirinhas, a fauna e a flora do Rio Doce, desde a área de sua eclosão até o Oceano Atlântico.

Pela presente pesquisa procura-se investigar se a normatização do Sistema Nacional de Educação (SNE) - conforme determinado pela lei instituidora do Plano Nacional de Educação (PNE) 2014-2024 e pela atual redação do artigo 214, da Constituição da República Federativa do Brasil de 1988 (CF/88) -, poderá contribuir para a institucionalização de um regime de colaboração e cooperação federativa, sem violar a autonomia constitucional dos entes federados. The article deals with the processes of internationalization and feminization of law which, in Brazil, occurred simultaneously with the stratification of the profession. The massive entry of women into law firms could not reverse the male logic on which it was built, in the early 20th century, as women were concentrated in the early stages of the career. This study examined the main obstacles and the strategies used by women to rise professionally in ten of the twenty largest law firms in the city of São Paulo.
