The pre – Spanish

government
Unit of government
BARANGAY – settlements or villages, consisting of more or less 100
fam.
- balangay – a Malayan word meaning “boat”
- confirming the theory that the early Filipinos came to
the phil. In boats.
Confiderations – some barangays joined together, for the purpose of
mutual protection against common enemies.
Datu
- Each barangay was ruled by a chief called DATU.
- rajah, sultan or hadji in others.

- Chief executive, Law giver, Chief judge,


and Military head
Maginoos – council of elders served as his
advisers.
Monarchy with datu as monarch.
- which the supreme and final authority is in
the hands of a single person w/o regard to the
source of his election.
One could be a datu chiefly by INHERITANCE,
WISDOM, WEALTH, or PHYSICAL POWERS.
SOCIAL CLASSES IN THE BARANGAY

People in the barangay were divided into 4


classes.
1. Nobility ( maharlika) – datu belongs to the
group.
2. Freemen ( Timawa) refers to an
intermediate social class among the various
cultures of the Philippines before the arrival of
the Spanish in the 16th and 17th centuries.
These groups of people do or make things
according to their will. They were not paid
they work for themselves. They cannot be
sold.
3. The Serfs (Aliping namamahay) – it is
the slave with a higher status. They were
slaves but then they were ale to live on the
house. They can’t be sold.

4. The Slaves (Aliping sagigilid) –it is a


slaves with a lower status. They were paid
and they can be sold.
Early laws
- Had both written and unwritten laws.
- Written laws were promulgated by the datus.
- Maragat codes – was written about 1250 A.D. by Datu
Sumakwel of Panay
- Kalantiaw codes – was written about 1433 A.D. by
Datu Kalantiaw of Panay.

- The Unwritten Laws consisted of customs and


traditions which had been passed down from
generation to generation.
Comparison with other ancient governments
- generally fair
- the system of government, although defective was not
so bad considering the conditions in other lands in the age
during which is flourished.

An ancient scholar has written: “The Filipino people, even in


prehistoric times had already shown high intelligence and
moral vitrues; virtues and intelligence clearly manifested in
their legislation, which, taking into consideration the
circumstances and the epoch in which it was framed, was
clearly as wise, as prudent, and as humane, as that of the
nations then at the head of civilization.
