DEED OF PARTITION

This DEED OF PARTITION, made and entered into by and among:

Spouses GAUDENCIO P. JARO and ISABELITA O. JARO, of legal age,


Filipino, and with residence and postal address at Southbound National Highway corner
Burgos St., Purok 4, Poblacion, Zamboanguita, Philippines, hereinafter referred to as the
FIRST PARTY;

-AND-

ELEUTERIO E. ELNAR, of legal age, Filipino, married to LYDIA V. ELNAR,


and with residence and postal address at McKinley St., Purok 2, Poblacion,
Zamboanguita, Negros Oriental Philippines, hereinafter referred to as the SECOND
PARTY;

WITNESSETH:
WHEREAS, the above-named parties are the co-owners through sale as evident in
the Deed of Absolute Sale of a portion of land duly recorded and notarized as Doc No.
451, Page 92, Book No. XII, Series of 2020, dated July 15, 2020 in the Notarial Registry
of Atty. Achilles Arturo S. Umbac Jr., -AND- Deed of Absolute Sale of a portion of land
duly recorded and notarized as Doc No. 498, Page 101, Book No. I, Series of 2023, dated
June 06, 2023 in the Notarial Registry of Atty. Jerome T. Arado, of that certain parcel of
land situated in Calango, Zamboanguita, Negros Oriental and more particularly described
as follows:

WHEREAS, it is to the convenience and advantage of the said parties that the
existing community of ownership between them be terminated, and their respective
shares and participation determined by mutual agreement and adjudication;

WHEREAS, for purposes of this partition agreement, the parties hereto have
caused the above-described property to be subdivided into Lot Nos. 3020-B-1 and 3020-
B-2 per tracing and blueprint (LRA) PSD-E2023009060 and technical descriptions, duly
approved by the Department of Justice-Land Registration Authority (DOJ-LRA) in
Quezon City, Metro Manila, on December 04, 2023 which are attached hereto, and made
integral part of this agreement;

WHEREAS, the parties hereto have mutually and voluntarily agreed, to partition
and adjudicate between themselves their common property as above-described, in the
