Chapter I

PROBLEM

Introduction

Barangay is the Philippines basic unit of government. Barangay can enact

ordinances; levy taxes and other revenue measures; provide for construction and

maintenance of barangay facilities and other public works; And the problem and issues

for barangay, it have not been effective in the performance of the above duties and

responsibilities. Much of its written responsibilities are beyond its competence.

Moreover, the officials may lack an appreciation of their written powers to enable them

to perform those responsibilities successfully. Created a complex structure and

provided funding to a system that simply cannot effectively deal with things the system

is designed to deal with. And also, Barangay tanods are not aware on duties and

responsibilities; and lack of dissemination on new policy to enforce within barangay. It

would grant rights for barangay watchmen to receive medical and housing benefits, as

well as legal assistance and right to security of tenure and due to lack of resources,

conventional socialization practices and the value of the barangay justice system,

juvenile courts and correctional facilities are used less often than the juvenile code

would suggest and this situation is likely to continue. Several businesses are already

introducing programs to help motivate the public even from the level of barangay, as a

way to help curb rising crime incidences (Samaniego, 2015).

The barangay ordinances can be gleaned from the body of knowledge. The

barangay Officials create a policy on the duties and function of the Barangay Tanod and

work together towards a common goal. These people have an important duty in their

community to maintain a peace and order. These people are also the lowest level of

enforcement officials in the community who supervised their Barangay but still perform a

variety of police function. Barangay Officials and Tanod are the front of liners in the

preparation and response to any type of calamities that threaten peace and order and

public safety and are also responsive to unique peace and order in the barangay. In

every barangay there are Barangay Tanod which play an important part in the

development and progress of the barangay (Donald Sumad-On 2020).

Moreover, Barangay officials must exercise its lawful functions in monitoring all

the residents within its jurisdiction, especially those who are engaged in criminal

activities. Close coordination with the police department within their locality must be

established for crime prevention and even criminal detection and apprehension by

Guererro (2014).

The purpose of this study is to determine the responsibilities of the barangay that

has several powers, duties, and functions. In Republic Act No. 7160, Local Government

Code of 1991, the role of the Barangay that assures the peace and order in the

barangay level. It also provides for construction and maintenance of barangay facilities

and other public works; regulated use of public facilities. The barangay serves as a

primary planning and implementing unit, the barangay is mandated to plan development

projects and programs and implement government policies and activities in the

community, create projects in its territory and to deliver basic services of the

government to the people. (Caldo, 2015).

Conceptual Framework

The schematic diagram shows the relationship of independent and dependent

variable of the study. Factors affecting the implementation of barangay ordinance in

Población Aurora Zamboanga del sur. In Republic Act No. 7160, Local Government

Code of 1991, the role of the Barangay that assures the peace and order in the

barangay level. It shows the trend and the affect the implementation of barangay

ordinance.

Statement of the Problem

This study aims to know the factors affecting the implementation of barangay

ordinance in Poblacion Aurora Zamboanga Del Sur.

Specially, this study seeks to answer the following questions;

1. What is the profile of the respondents in terms of,

1.1 Name (Optional)

1.2 Age ;

1.3 Gender;

1.4 Civil status;

1.5 Educational background; and

1.6 Occupation?

2. What are the factors affecting the implementation of barangay ordinance in terms

of,

2.1 Enforcement; and

2.2 Policies;

3. Is there a significant differences between the response of the barangay officials

and community?

Hypothesis

There is no significant differences between the response of the barangay

officials and community.

Significance of the study

The results of this research study will be highly beneficial to the following:

Course Program. This study serves as a documentary analysis about the need for

introducing improvements in the quality of programs and building new programs that

address students' real-world training demands while also boosting the efficiency in

implementing ordinance of its graduates.

Criminology Students. This research study will benefit all undergraduate criminology

students to prepare for the problem encountered in implementing the ordinance or law.

Future Researchers. This study will be a helpful resource for future researchers who

wish to conduct any related research connected to any organization that implements

law. This will also serve as a guide for the future researchers to have an advance

knowledge or information about the study.

Institution. The data would help the institution evaluate its graduates' opinions of the

school's contribution to their skill development, as well as the efficacy, adequacy, and

relevance of their education.

Scope and Limitations of the Study

This study focuses on factors affecting the implementation of barangay

ordinance in Población, Aurora Zamboanga del sur. This study will examine the

situation of barangay conflict with empowered to enforce all laws and ordinances;

maintain public order; ensure the delivery of basic services; enforce laws and

regulations relating to pollution control and protection of the environment; adopt

measures to prevent and control the proliferation of squatters; and adopt measures to

prevent and eradicate drug abuse, child abuse, and juvenile delinquency.

In Republic Act No. 7160, Local Government Code of 1991, the role of the

Barangay that assures the peace and order in the barangay level. The variables

covered on this study includes enforcement and policies that may affect the

implementation of barangay ordinance in Población, Aurora Zamboanga Del Sur.

Definition of Terms

Barangay. As used in this study, it refers to a place where the study conducted.

Barangay Tanod. As used in this study, it refers to someone whose primary role is to

maintain peace and order in a particular barangay.

Barangay citizen. As used in this study, they are independent and progressive barangay

advocating principles and practices of good governance that help build nurture honesty

and responsibility among its public officials and employees and take appropriate

measures to promote transparency in transacting with the public.

Budget. As used in this study, it refers to the amount prepared budget that is used to

supplement the effect of the barangay ordinance.

Crime. As used in this study, it refers to the unlawful acts of some people in a particular

community or barangay.

Curfew. As used in this study, it refers to an order specifying a time during which certain

regulations apply.

Ordinance. As used in this study, it refers to an act adopted by a municipal governing

body having effect only within the jurisdiction of the municipal government.

Patrol. As used in this study, it refers to something which is necessary to do as a

barangay tanods just to lessen the crime in particular barangay.

Planning. As used in this study it refers to planning the implementation of ordinance.

Policy. As used in this study it refers to the ordinance enacted by the barangay council.

Republic Act No. 7160, Local Government Code of 1991, the role of the Barangay that

assures the peace and order in the barangay level. It refers to the law that decentralized

the power to the local officials and law enforcement.
