Pursuant to Section 9 of the DILG Memorandum Circular No. 2019-143, otherwise


known as the Omnibus Guidelines for Peace and Order Councils (POC), the POC
Performance Audit shall be conducted by the Department annually, to assess the
functionality and performance of all sub-national POCs.

Relative to the above, and to the recently conducted 2022 POC Performance Audit,
this level respectfully requests your comments, suggestions, and recommendations
on the draft Memorandum Circular (MC) covering the guidelines thereof. The said draft
MC and its attachments may be viewed through the link:

PERFORMANCE AUDIT

1.0 Background

1.1. Pursuant to Executive Order No. 773, series of 2009, entitled “Furffier
Reorganizing the Peace and Order Council,’’ Peace and Order Councils
shall be organized at the Regional, Provincial, and City/Municipal levels of
government.

1.2. The Philippine Development Plan (PDP) 2023-2028 aspires for the
establishment of secure and peaceful communities as a necessary
condition in pursuing economic transformation through a whole-of-
govemment approach.

1.3. The Peace and Order Council (POC) is the government’s platform for
stronger collaboration of the LGU with law enforcement agencies and the
community to fight criminality, illegal drugs, insurgency, and violent
extremism. It creates an enabling environment among its members to
harmonize and effectively implement peace and order and public safety
activities.

1.4. Section 9 of DILG Memorandum Circular No. 2019-143 or the Omnibus


Guidelines for Peace and Order Councils (POCs) reiterates that the POC
Performance Audit shall be conducted annually to identify the compliance
rating of sub-national POCs and POC Secretariats.

1.5. In light of the lessons adopted from measures during the global pandemic
and in a bid to streamline the audit process, the 2023 POC Performance
Audit shall be conducted through an online modality - via the POC Audit
System.

2.0 PURPOSE
The POC Performance Audit aims to:

2.1. Assess the performance of the Regional, Provincial, City, and Municipal
POCs the year 2023;
2.2. Identify the innovations conducted and initiated by the POCs and their POC
Secretariats;
2.3. Determine possible interventions and Improvement strategies for POCs
and POC Secretariats; and
2.4. Create a platform for evaluation, assessment, and sharing of best practices
between and among POCs and POC Secretariats.

3.0 SCOPE / COVERAGE


The policy shall cover:

3.1. Seventeen (17) Regional POCs, 81 Provincial POCs, 145 City POCs and
1,489 Municipal POCs which shall be subjected to the performance audit;
and

3.2. All DILG Regional, Provincial, City and Municipal Field Officers that serve
as POC Secretariat primarily involved in the implementation of the
performance audit.

3.3. The Bureau of Local Government Supervision (BLGS) - Local Government


Relations Division (LGRD) shall serve as the over-all lead In the
implementation of the POC performance audit.

4.0 POLICY CONTENT AND GUIDELINES

2023 PERFORMANCE AUDIT CRITERIA

4.1. The 2023 performance audit process shall be guided by two (2) main pillars:

4.1.1. Functionality Indicators (50%) - POCs shall be assessed on their


compliance to the functions and responsibilities provided by the
Omnibus Guidelines for Peace and Order Councils. These indicators
shall assess the POCs on the following:

4.1.1.1. Organization
4.1.1.2. Meetings
4.1.1.3. Policies, Plans, and Budget
4.1.1.4. General Supervision
4.1.1.5. Innovation

4.1.2. Development Indicators (50%) - POCs shall be evaluated based

situation in their locality, covering the following indicators;

4.1.2.1. Addressing Criminality


4.1.2.2. Ensuring Public Safety
4.1.2.3. Gender Sensitivity
4.1.2.4. Citizen Participation

4.2. Prerequisites - The following tools shall be used during the 2023 POC
Performance Audit process:

4.2.1. POC Audit Portal - The 2023 POC Perfbnnance Audit shall be
conducted using the full functionality of the POC Audit Portal to
standardize and streamline the management and assessment of
documents.

4.2.2. Forms - only the prescribed forms shall be used in documenting the
results and observations during the audit process.

4.2.3. Protocols - contain the audit phases, processes, and timeframe


and lay out the roles and responsibilities of every stakeholder
involved In the performance audit.

4.3. Structures and Compositions

4.3.1. The National Peace and Order Council shall form a 8 (8) member
National Audit Committee (NAC) through any of the following:

4.3.1.1. NPOC Resolution;


4.3.1.2. Department Order; or
4.3.1.3. Any administrative issuance appointing the members of the
audit team.

4.3.2. The BLGS, as the Interim NPOC Secretariat, shall organize the
NAC, to be chaired by the Interim NPOC Secretariat Head, with the
Philippine National Police (PNP), Dangerous Drugs Board (DDB),
Department of National Defense (DND), Bureau of Jail Management

and Penology (BJMP), Bureau of Fire Protection (BFP), Land
Transportation Franchising and Regulatory Board (LTFRB), and
Civil Society Organization (CSO) representative as members. The
CSO representative shall be detormined by the NPOC Chairperson.
The NPOC Chair may also hdude other members of the NPOC as
members of the NAT. as may be deemed necessary.

4.3.3. The Regional / Provincial Peace and Order Councils shall form the
Regional/Provincial Audit Committee (RAC/PAC), with a minimum
number of 7 (7) members, through any of the following:

4.3.3.1. POC Resolution;


1.3.3.2. Regional / Provincial Order; or
4.3.3.3. Any administrative issuance appointing the members of the
audit team. .

4.3.4. The RAC/PAC shall be chaired by the regional or provincial POC


Secretariat Head or representative, with the highest ranking PNP,
BFP, BJMP, LTFRB, and PDEA Officers in the Region / Province
or their representatives, arid CSO representative/s as members of
the said audit teams. Other relevant agencies, as may also be
included as part of the Audit Team, as may be deemed necessary
by the respective POC Secretariat Head, as chair of the audit team.

4.4. Mechanisrn

Submission of documents, as weS as viewing and evaluation by the Audit


Team, shall only be done through the POC Audit Portal. All documents
uploaded and submitted through the Portal shall be considered FINAL AND
OFFICIAL. Thus, POCs are further encouraged to exercise the Portafs
features for the thorough review of their respective documents.

4.5. Participation of, and support to partners

The POC Performance Audit is a collaborative effort with the National


Government /Agencies (NGAs) and the Civil Society Organizations (CSOs)
to ensure the integrity of the audit process and its results. Therefore, travel
expenses thereof, as deemed necessary, is chargeable against POC funds,
subject to the availability of funds and the i^ual accounting and auditing
rules and regulations.

4.7. POC Performance Audit Process

4.7.1. Preliminaries

4.7.1.1. The NPOC Secretariat shall orient the POC Regional and
Provincial Focal Persons through video teleconference on
the conduct of the 2023 POC Performance Audit.

4.7.1.2. The National, Regional, and Provincial POC Secretariats


shall chair the National, Regional, and Provincial Audit
Teams and encode their names at the POC Performance
Audit System.

4.7.2. Audit Procedures

4.7.2.1.>te the 2023 POC Performance Audit pursue a bottonvup


method, the Provincial Audit Committee (PAC) shall be the
first to audit following the Pre-Audit, Audit Proper, and
Post-Audit phases.

4.7.2.2. After the PAT. the Regional Audit Committee (RAC) shall
be the next to audit following the Pre-Audit, Audit Proper,
and Post-Audit phases.

4.7.2.3. The National Audit Committee (NAC) shall be the last to


audit when all the Provincial and Regional Audit
Committees have already submitted their respective
Consolidated Report Forms following the Pre-Audit, Audit
Proper, and Post-Audit phases.

4.8. Performance Rating

4.8.1. The total of the points earned by the POC shall serve as their
Performance Rating, to be given an Adjectival Rating based on
the following scale:

0% - 5% Non-Performing

Only High Performing POCs shall be considered eligible to receive


an award, such as the Seal of Good Local Governance (SGLG).
Additionally, their ratings in each of the two main pillars shall be at
least forty percent (40%) to qualify for said eligibility, for instance:

4.8.2. Results of the POC Performance Audit, as conducted through the


POC Audit Portal shall be treated as FINAL AND IRREVOCABLE.

4.8.3. Results of the POC Performance Audit shall be utilized as


Indicators under the Safety, Peace and Order area of the SGLG.

4.9. Presentation of Audit Results: Endorsement, Approval, Certificate of


Recognition, and Announcement

4.9.1. Based on the results of the audit teams, the final list of High,
Moderate, and Low Performing POCs shall be consolidated by the
NPOC Secretariat.

4.9.2. Once the list is finalized, the list with the certificates shall be
endorsed, for approval, to the Secretary of the Interior and Local
Government, as the NPOC Chairperson. The signed documents
shall be the official list of the 2023 POC Performance Audit.

4.9.3. The results shall be published In the DILG official website, and
shall also be communicated to the DILG Regional Offices for
dissemination.

4.9.4. A national recognition may be awarded to the High Performing


POCs and their Secretariat, subject to the availability of funds.

4.9.5. Regional Offices may award / recognize the highest performing


LGUs in their respective jurisdictions.

conduct of orientations and information dissemination.

4.11.1.3. Issue further guidelines and reminders, as may be


necessary, to ensure the effective conduct of the POC
Performance Audit.

4.11.1.4. Consolidate the results garnered by


Regional/Provincial/City/Municipal POCs and present the same
to the NAC.

4.11.1.5. Consolidate the final results approved by the NAC and


present the same to the Secretary of the Interior and Local
Government, as Chairperson of the National Peace and Order
Council (NPOC).
4.11.1.6. Publish and disseminate the approved results through
the DILG Website and the POC Audit Portal

4.11.2. National Audit Committee

4.11.2.1. Assess and evaluate the documents of Regional Peace


and Order Councils, submitted through the POC Audit Portal.

4.11.2.2. Approve the final results consolidated by the DILG


BLGS, and the results from Regional and Provincial Audit
Committees, and endorse the same, through a resolution, to the
NPOC Chairperson.

4.11.2.3. Formulate recommendations and possible


interventions to POCs. as well as further policy developments^
based on the results.

4.11.3. Regional Audit Committee

4.11.3.1. Assess and evaluate the documents of Provincial,


Highly Urbanized City, and Independent Component City Peace
and Order Councils, submitted through the POC Audit Portal.

4.11.3.2. Consolidate the results of POCs assessed, including
tire results from their respective Provincial Audit Commitees, and
endorse the same, through a resolution, to the National Audit
Team.

4.11.3.3. Formulate recommendations and possible interventions


to POCs, as well as further policy developments based on the
results.

4.11.4. Provincial Audit Committee

4.11.4.1. Assess and evaluate the documents of Component


City and Municipal Peace and Order Councils, submitted through
the POC Audit Portal.

4.11.4.2. Consolidatse the results of POCs assessed, and


endorse the same, to the respective Regional Audit Teams.

4.11.4.3. Formulate recommendations and possible


Interventions to POCs, as well as further policy development
based on the results.

4.11.5. Peace and Order Councils

4.11.5.1. Facilitate the collection, organization, uploading, and


submission of required documents and means-of-verification
(MOVs) to the POC Audit Portal.

4.11.5.2. Exercise supervisory functions over component POCs


to ensure their compliance to the requirements of the POC
Performance Audit.

4.11.6. Peace and Order Council Secretariats

4.11.6.1. Assist the POCs in the collection and organizatiori of


required documents and means-of-veriTication that will be used
for the POC Performance Audit

4.11.6.2. Ensure bilateral coordination and communication with


the DILG and the POCs for efficient and effective dissemination
of rules, regulations, and guidelines concerning the POC
Performance Audit

All DILG Regional Directors, POC Focal Persons, and the BARMM Minister of
Local Government shall cause the widest dissemination of this Memorandum
Circular and monitor the adherence of all POCs and POC Secretariats to this
issuance.
