GUIDELINES FOR THE ONLINE MONITORING SYSTEM FOR LGUs IN THE


IMPLEMENTATION OF BUSINESS PERMIT AND LICENSING SYSTEM (BPLS) AND
BUILDING PERMIT AND CERTIFICATE OF OCCUPANCY (BPCO) AND
NATIONWIDE ONLINE CLIENT SATISFACTORY SURVEY (“RATE MY LGU
SERVICE”) SYSTEM

1. BACKGROUND

1.1. “Increasing competitiveness and the ease of doing business” is one of


President Rodrigo Duterte’s 10-point socio-economic agenda, and is also
reiterated in the Philippine Development Plan 2017-2022, which espouses
“people centered, clean, efficient and effective governance”.

1.2. On May 28, 2018, the Ease of Doing Business and Efficient Government
Service Delivery (EODB-EGSD) Act or Republic Act No. 11032, an
amendment of the Anti-Red Tape Act of 2007, was signed into law seeking to
make the process of putting up and running a business in the Philippines
easier and more efficient.

1.3. In compliance to the President’s directive, the Department of the Interior and
Local Government (DILG) issued DILG-DTI-DICT JMC 2016-01 (Revised
Standards in Processing Business Permit and Licenses in all Cities and
Municipalities) and DILG-DPWH-DICT-DTI JMC 2018-01 (Guidelines in
Streamlining the Processes for the Issuance of Building Permits and
Certificates of Occupancy) that provided the standards in the processing and
issuance of business permits; building permits and certificates of occupancy,
respectively.

2. PURPOSE

Issuance of the above-mentioned laws and guidelines underscored the need to


periodically monitor and assess compliance of local government units (LGUs) to
the standards set by the National Government.

2.1. To systematically monitor the compliance of LGUs to the EODB Law,


Revised Standards on Processing Business Permits and Licenses (JMC
2016-01) and Streamlining the Processes for the Issuance of Building
Permits and Certificate of Occupancy (JMC 2018-01) nationwide;

2.2. To validate the report of the LGUs’ compliance thru a direct online client
feedback;

2.3. To provide feedback to regions on the results of the survey of their


respective LGUs for technical assistance if necessary;
2.4. To encourage LGUs to be proactive in improving their services to their
constituents and clients.

3. LEGAL COMPLIANCE

3.1. Republic Act 11032 also known as Ease of Doing Business and Efficient
Government Service Delivery Act of 2018.

3.2. DILG-DTI-DICT Joint Memorandum Circular (JMC) 2016-01 dated August


31, 2016 titled “Revised Standards in Processing Business Permits and
Licenses in all Cities and Municipalities.”

3.3. DILG-DPWH-DTI-DICT Joint Memorandum Circular (JMC) 2018-01 dated


January 4, 2018 titled “Guidelines in Streamlining the Issuance of Building
Permits and Certificates of Occupancy.”

4. SCOPE/COVERAGE
This guideline covers all Local Chief Executives (LCEs) of Cities and
Municipalities, Business Permits and Licensing Officer (BPLO), Office of the
Building Official (OBO), DILG Regional and Provincial Directors, DILG Field
Offices and all others concerned.

5. DEFINITION OF TERMS
For purposes of this guidelines, the following definitions apply, unless otherwise
stated:
5.1 Administrator refers to the person primary responsible in the use of the
system.

5.2 BPCO refers to Building Permit and Certificate of Occupancy.

5.3 BPLS refers to Business Permit and Licensing System.

5.4 Business Permit and Licensing Office (BPLO) refers to the Office
authorized to issue business permits and regulates the operations of
business activities.

5.5 Clients refer to any person, firm, partnership, corporation, and head of
government or private institution applying for permits or clearances; or
requesting party.

5.6 User refers to an individual who has an access to the system.

5.7 Monitoring and Evaluation Form 1 (M&E Form 1) refers to the


monitoring tool used to determine the compliance of each LGU to the
revised standards.
5.8 Office of the Building Official (OBO) refers to the Office authorized to
enforce the provisions under the National Building Code of the Philippines
(NBCP) and its Implementing Rules and Regulations (IRR ) in the
field as well as the enforcement of orders and decisions made pursuant
thereto (DILG-DPWH-DICT-DTI JMC 2018-01)

6. POLICY CONTENT, GUIDELINES AND PROCEDURES

All Cities and Municipalities are enjoined to follow the guidelines in the Online
Monitoring of BPLS and BPCO and the Nationwide Online Client Satisfactory
Survey (“Rate my LGU Service”) System and to provide quarterly data reports in
monitoring the compliance of LGU with the standards set by the National
Government.

6.1. Development of Monitoring Form and Rate my Service Application

6.1.1. The Bureau of Local Government Development (BLGD), in


collaboration with Information Systems and Technology
Management Service (ISTMS), shall develop an Online Monitoring
System for BPLS and BPCO as well as the Rate My LGU Service
Satisfaction Survey which shall be disseminated to all LGUs.

6.2. Filling-up/Accomplishing of Monitoring Form

6.2.1. The LGU, through its BPLO and OBO, shall accomplish the BPLS
and BPCO M&E Form 1 by encoding the data to the system and
upload same after.

6.3. Validation of Data

6.3.1. The C/MLGOO shall validate the correctness and completeness of


the data encoded in the system based on the M&E Form 1 which is
accomplished by the BPLO and OBO and uploaded in the system.

6.3.2. The Provincial Office shall be notified after the submission of the
data validation of the C/MLGOO and shall then verify the encoded
data accomplished by the BPLO and OBO and validated by the
C/MLGOO.

6.3.3. The Regional Office shall be notified after the data validation of the
Provincial Focal and shall then verify the encoded data
accomplished by the BPLO and OBO and validated by the
C/MLGOO and the Provincial Focal.

6.4. Submission of Monitoring Reports


6.4.1. The BPLO and OBO shall submit the Online BPLS and BPCO M&E
Form 1 on the following frequency:

6.5.1. The Department developed an online client satisfactory survey to (i)


validate the report of LGUs’ compliance thru a direct client feedback
online survey, and (ii) encourage LGUs’ constituents and clients to
be proactive on improving the services of their LGU.

6.5.2. The LGU shall encourage the constituents and clients to conform to
the online client satisfactory which can be accessed at
https://ratemyservice.dilg.gov.ph. The Department assures the
confidentiality of the survey response.

6.6. Monitoring of Report Submitted

6.6.1. The BLGD, through Local Fiscal Resource Development Division


(LFRDD), shall monitor the submission of LGU’s reports from the
Online Monitoring Form 1 every quarter or as required by the higher
Officials.

6.7. Data Processing thru the Online Monitoring System

6.7.1. The BLGD together with the ISTMS shall validate the correctness of
the data gathered from the submission of BPLO and OBO through
the online monitoring system before data processing.

6.7.2. The BLGD and ISTMS shall process the data collected from the
Monitoring Form 1 submitted by LGUs and provide significant
information and recommend for possible policy development.

6.7.3. The BLGD, through its Director, shall submit report from the
processed data gathered from the Online Monitoring of BPLS and
BPCO to the Secretary of the Interior and Local Government thru the
Undersecretary of Local Government.
7. ROLES AND RESPONSIBILITIES

7.1. Local Government Units (LGUs)

7.1.1. Local Chief Executives (LCEs) to issue an executive order for the
implementation of this circular.

7.1.2. BPLO and OBO to participate in the survey by encouraging clients


to respond to the survey. In order to inform the constituents and
clients, a “Rate My LGU Service” poster/tarpaulin shall be posted
year-round in a conspicuous place within the LGU vicinity and
permitting offices.

7.1.3. BPLO and OBO to accomplish the M&E Form 1 in a quarterly


basis.

7.2. Department of the Interior and Local Government (DILG)

7.2.1. Regional Office (RO)

7.2.1.1. Validate the correctness and completeness of the data


verified by the C/MLGOO.

7.2.1.2. Directed to cause the widest dissemination of this


Memorandum Circular to all local government units
within their area of jurisdiction.

7.2.1.3. Provincial Office (PO)

7.2.1.3.1. Validate the correctness and completeness of the


data verified by the Regional Office.

7.2.1.3.2. Directed to cause the widest dissemination of this


Memorandum Circular to all local government
units within their area of jurisdiction.

7.2.1.4. City and Municipal Local Government Operations


Officer (C/MLGOO)

7.2.1.4.1. Validate the correctness and completeness of the


data submitted by the BPLO and OBO.

7.2.1.4.2. Ensure the submission of the LGUs on the


required forms and documents needed.
7.2.1.5. Regional Information and Communications
Technology Unit (RICTU)

7.2.1.5.1. Responsible in providing users access to the


online monitoring system for their respective
region.

7.2.1.5.2. Provide technical assistance to LGUs on the


implementation of the online monitoring system, if
necessary.

7.2.2. Information Systems and Technology Management Service


(ISTMS)

7.2.2.1. Responsible in the development and maintenance of the


web-based system.

7.2.2.2. Secure a database backup for the system.

7.2.3. Public Affairs and Communication Service (PACS)

7.2.3.1. Responsible in the information campaign and media


making of the “Rate My LGU Service” online client
satisfaction survey.

7.2.4. Bureau of Local Government Development (BLGD)

7.2.4.1. Initiate and lead the nationwide implementation and


advocacy of the online survey.

7.2.4.2. Administer the system and protect the integrity of the


data gathered during the survey.

7.2.4.3. Monitor the compliance of LGUs collected in the survey.

7.2.4.4. Provide summary report to LGUs from the results of the


survey process and analysis.

10. MONITORING

The DILG Regional and Provincial office shall monitor the submission of the
LGUs in their respective areas of jurisdiction. While, BLGD shall monitor the over-
all compliance of LGUs to the revised standards.

11. EFFECTIVITY

This Memorandum Circular shall take effect immediately.
