VOLUNTARY JURISDICTION TO PROVE COHABITATION

OF THE FIRST JUDICIAL DISTRICT IN THE STATE
PRESENT:

before you with due respect I appear to state the following:

That by the present writing I appear to promote DILIGENCES OF VOLUNTARY


JURISDICTION, to accredit facts relative to my possession of marital status, which
corresponds to the union designated by law as CONCUBINATE, since the
undersigned I have more than _____years living in free union with
Mr._______________________________; based on the following facts and legal
considerations.

FACTS
1.- At the end of May of the year _________
The undersigned and Mr. ____________________________ by mutual agreement we
began a marital relationship complementing each other in our reciprocal obligations to
provide food, mutual affection, care when we have been sick, (mention if they had
children ...) our relatives know and live with the undersigned and my partner providing
us with considerations, respect and support, so our free union has been accepted by

By virtue of the foregoing, since our relationship has been in force for more than

order to accredit the existence of my civil status of cohabitation, a relationship that has
existed and is still in force with Mr. ______________, it is necessary for me to obtain
the resolution approving these proceedings, which is indispensable for the
undersigned to be accredited and recognized as a cohabitant, and to be able to carry
out procedures before various institutions of the Health Sector as well as
Administrative and Judicial Authorities

3.In order to accredit the above facts indicated by the undersigned, I offer the
testimonial information of the following

In view of the foregoing and supported by Articles 34, 34Bis, 34 Bis I, 34Bis II, 291 Bis,
291 Bis I of the Civil Code in force in the State, and 902, 906, 913 and other relative
articles of the Code of Civil Procedures in force; TO YOU C. JUDGE I ATTENTIVELY
REQUEST:
FIRST: I am deemed to have filed these proceedings of Voluntary Jurisdiction in the
terms that I indicate, that they be admitted for processing and that a date and time be
set for the reception of the testimony offered.

SECOND: To have as authorized to hear and receive notifications in terms of the


provisions of Article 78 of the Code of Civil Procedures in force, C.

THIRD: In due course, to issue a resolution approving the proceeding of these
proceedings and to issue me a certified copy of the same.

P R E S S E N T E.-

___________________________________, Mexicans, of legal age, in our own right,


indicating as domicile to hear and receive all types of notifications the one located at
____________________________ of this city, authorizing in the terms of article 118 of
the Code of Civil Procedures in force for our state, C. Lic. _______________; with all
due respect, we appear to state:

That by means of the present writ, and in the way of Voluntary Jurisdiction, based on
article 796 of the Code of Civil Procedures in force in the state, by our own right, we
come to request the following::

a) The declaration of concubinage.

Our petition is based on the following facts and legal considerations:

HECHOS

1.- As of April 21, 2008, the undersigned _______________ and the undersigned
______________________ began to live in a common-law marriage at the address
located at ____________________________.

2.- During our cohabitation we created a son named __________________ as we


prove it with the birth certificate as annex number one

I. You are competent to hear this matter, in accordance with the provisions of Articles
797 and other articles of the Code of Civil Procedures in force in the State.

II. The action is contemplated in sections 101, 102 and other related provisions of the
Procedural Code in force in our entity.

III. For the purposes of the proceeding, the provisions of articles ____ and other
relative articles of the Family Code in force in our State are applicable at the
appropriate procedural moment.
As this is the legally appropriate stage, I hereby offer the evidence that I am required
to submit

PRUEBAS

CONFESSIONAL: Consisting of the statement of positions that must be personally and


not by proxy or legal representative, the C.C.'s. _________________, on the day and
time that your Honor may deem fit to set for such purpose, warning the absolvents, in
a legal manner, so that in case they do not appear without just cause, they will be
