EXECUTIVE ORDER NO. 2


SERIES OF 2022

AN EXECUTIVE ORDER DESIGNATING THE COOPERATIVE DEVELOPMENT OFFICER IN


THE MUNICIPALITY OF NAVAL, PROVINCE OF BILIRAN

WHEREAS, Article II, Section 20 of the 1987 Constitution provides that the
State recognizes the indispensable role of the private sector, encourages private
enterprise, and provides incentives to needed investments;

WHEREAS, Republic Act 9520 or otherwise known as the An Act Amending


the Cooperative Code of the Philippines to be known as the “Philippine Code of
2008” declares that it is the policy the State to foster the creation and growth of
cooperatives as a practical vehicle for promoting self-reliance and harnessing
people power towards the attainment of economic development and social
justice. The State shall encourage the private sector to undertake the actual
formation and organization of cooperatives and shall create an atmosphere that
is conducive to the growth and development of these cooperatives. Toward this
end, the Government and all its branches, subdivisions, instrumentalities and
agencies shall ensure the provision of technical guidance, financial assistance
and other services to enable said cooperatives to develop into viable and
responsive economic enterprises and thereby bring about a strong cooperative
movement that is free from any conditions that might infringe upon the autonomy
or organizational integrity of cooperatives;

WHEREAS, Section 33 of RA 7160 or otherwise known as the Local


Government Code of 1991 provides that Local government Units may enter into
joint ventures and such other cooperative arrangements with people's and non-
governmental organizations to engage in the delivery of certain basic services,
capability-building and livelihood projects, and to develop local enterprises
designed to improve productivity and income, diversity agriculture, spur rural
industrialization, promote ecological balance, and enhance the economic and
social well-being of the people;

WHEREAS, RA 11535 or otherwise known as An Act Making the Position of a


Cooperatives Development Officer Mandatory in the Municipal, City and
Provincial Levels, amending for the Purpose Republic Act No. 7160, otherwise
known as the Local Government Code of 1991, provides that the cooperatives
development officer is mandatory for the municipal, city and provincial
governments as specified under Sections 443, 454 and 463 of this Code;

WHEREAS, DILG Memorandum Circular 2021-110 issued by Secretary


Eduardo M. Año mandates all LGUs including the Province, City or Municipality to
designate a Cooperatives Development Officer;

NOW THEREFORE, I, GERARD ROGER M. ESPINA, Municipal Mayor, by virtue


of the powers vested in me by law, do hereby appoint and designate the
Cooperatives Development Officer in the Municipality of NAVAL, Province of
Biliran.

SECTION 1. Appointment and Designation of Cooperatives Development


Officer (CDO). JEANNE C. SANJORJO is hereby designated as the
Cooperatives Development Officer of this Municipality.

SECTION 2. Functions, Duties and Responsibilities. The CDO shall perform the
following duties and responsibilities:
1. Create rules and procedures to ensure the orderly delivery of
basic services and facilities through the organization, promotion
and development of cooperatives and give access to the said
services and facilities;
2. Create plans and strategies through consultation with the sectors
of cooperatives as well as its implementation, particularly those
with connections with the integration of cooperative values,
principles and capabilities of the cooperatives in programs and
projects wherein the Local Chief Executive has the power and
authority relative to its implementation and wherein the Local
Sanggunian has the mandate relative thereto under the Local
Government Code of 1991;
3. Lead the determination of groups, sectors or communities that
has the prospect to be a cooperative with the objective to be a
vehicle in the reduction of poverty, unemployment and in the
growth and development of municipalities, cities or provinces;
4. In cooperation with the Cooperatives Development Authority
(CDA), provide assistance to those seeking to create a
cooperative through the implementation of the relevant and
necessary pre-registration seminar and pre-membership
education seminar as well as the preparation of the appropriate
and required documents relative to their registration;
5. In cooperation with the CDA, Department of Trade and Industry
(DT), other agencies of the government, federations and unions
of cooperatives, academe and private organizations, provide
technical and/or other kinds of necessary and relevant assistance
to the registered cooperatives to bolster and broaden their skills
abilities i.e., training and education relative to business
management, finance and financial management;
6. Assist and help cooperatives in establishing connections with
various agencies of the government, federations and unions of
cooperatives, academe, and private organizations that has

initiatives relative to promotion and integration of the concept of


cooperatives in the livelihood of the citizens and the community;
7. Assist and help cooperatives in the creation and implementation
of their risk management plans and business community plans
and management in response to the effects of unforeseen
disasters and calamities and help surpass and prepare for these
disasters as well as in providing relief and rehabilitation thereof, if
necessary;
8. Assist the CDA, if necessary, in the conduct of inspection and
examination;
9. Assist cooperatives, especially in its compliance with the findings
and results of the said inspection and examination.

SECTION 3. Separability Clause. Should any provision of this Order be


declared invalid or unconstitutional, the other provisions unaffected
thereby shall remain valid and subsisting.

SECTION 4. Repealing Clause. All orders, proclamations, rules, regulations,


or parts thereof, which are inconsistent with any of the provisions of this
Order are hereby repealed or modified accordingly.

SECTION 5. Effectivity. This Order shall take effect immediately.
