REPUBLIC OF GHANA TREATY MANUAL
FOREWORD
The former Attorney-General, Joe Ghartey, M.P. expressed concern about the fact that a
comprehensive list of multilateral treaties that the Republic of Ghana has ratified did not exist and that
guidelines did not also exist to assist Ministries, Departments and Agencies on the procedure for the
domestic ratification of treaties, agreements and conventions in accordance with article 75 of the
Constitution.
The Committee was made up of representatives from the Attorney General’s Department, the
Ministry of Foreign Affairs and the Office of Parliament. The Committee prepared guidelines for the domestic
ratification of multilateral treaties, agreements and conventions and compiled a comprehensive list of treaties,
agreements and conventions ratified by the Republic of Ghana including the date of signature of the treaty,
the date that Parliament ratified the treaty and the date of deposit of the instrument of ratification. It is hoped
that the guidelines and list of treaties will serve as a reference guide for Ministries, Departments and
Agencies as well as other members of the public to engage stakeholders in the international commitment of
the Republic and sensitise members of the public to the international treaty obligations of the Republic.
The Committee sourced information for the compilation of the list of treaties from the United Nations
Treaty Section-Office of Legal Affairs, the AU and the ECOWAS Commission and is grateful to each person
who contributed to this important assignment. Further information can be obtained from the following

GUIDELINES FOR THE DOMESTIC RATIFICATION OF TREATIES /
AGREEMENTS / CONVENTIONS UNDER THE DUALIST APPROACH
AND FOR THE TRANSFORMATION OF TREATIES INTO NATIONAL
LEGISLATION
Article 75 of the Constitution, outlines the processes for the execution of a treaty. A treaty is
an international agreement concluded between states in writing governed by international law. Article
75 (2) makes it clear that treaties, agreements or conventions executed by or under the authority of
the President must be ratified by Act of Parliament or a resolution of Parliament supported by the
votes of more than one-half of the members of Parliament after the requisite Cabinet approval.
As a dualist state, the Republic is required to ratify a treaty internationally and then proceed to
ratify the treaty, in accordance with the Constitution. Two steps are required, the international
intervention followed by the domestic process in order to transform the treaty from international law to
domestic legislation.
For the domestic ratification of a treaty, agreement or a convention, the following guidelines
should be followed:
Advice must be sought from the Attorney-General and Minister for Justice in accordance with
article 88 of the Constitution to determine:
(1) the legal obligations of the Republic of Ghana under the treaty, agreement or
convention; and
A Cabinet Memorandum for the approval of the Cabinet for the treaty, agreement or
convention to be ratified by an Act of Parliament or by resolution of Parliament is prepared by the
relevant Ministry in accordance with the Cabinet Memorandum Manual. This is submitted to the
Cabinet Secretariat with copies of the treaty, agreement or convention requiring ratification attached.
• The Cabinet Memorandum should indicate what decision is required of Cabinet on the treaty,
agreement or convention;

• The Cabinet Memorandum should explain the contents of the treaty, agreement or convention
and contain background information;
• The Cabinet Memorandum should also indicate the benefits to the Republic of Ghana if the
treaty, agreement or convention is signed or ratified;
• The Cabinet Memorandum should further spell out the obligation of government, that is the
financial and legal impact, if the treaty, agreement or convention is ratified and must state that the
Attorney-General and Minister for Justice has been consulted;
• The Cabinet Memorandum should also specify whether there is the need for the Republic of
Ghana to make any reservations; and
• The Cabinet Memorandum should contain other information relevant to arrive at the decision
requested of Cabinet.
• The Cabinet Memorandum must be submitted to the Secretary to the Cabinet under the signature
of a Minister or Ministers where there is joint sponsorship to ensure authenticity;
• The original copies of the treaty, agreement or convention should be submitted to the Secretary to
Cabinet;
• 45 copies of the Cabinet Memorandum should be submitted to Cabinet before the proposed
Cabinet meeting at which the matter will be considered.
4. DECISION OF CABINET
The relevant Ministry or Ministries will be informed of the decision of the Cabinet by the
Secretary to the Cabinet copied to the Attorney-General’s Department.
• Following the approval of Cabinet, where ratification of the treaty is by Act of Parliament, a
letter should be sent to the sponsoring Ministry by the Secretary to the Cabinet and copied to
the Attorney-General’s Department providing approval for the issue of drafting instructions for
the preparation of the law by the Attorney-General’s Department.

• After the completion of the legislative drafting process, the draft Bill and explanatory
memorandum must be submitted by the sponsoring Minister to the Cabinet for the approval for
the Bill to be laid in Parliament. After the conclusion of the enactment process the treaty,
agreement or convention will commence after publication of the Act in the Gazette.
• The treaty, agreement or convention is then laid before Parliament and the clerk draws the
attention of the Business Committee to the matter. The Business Committee designates a day
on which the treaty, agreement or convention is to be laid in the House by the sector Minister
or any Minister designated for that purpose.
• The Speaker orders the treaty, agreement or convention to be referred to the relevant
Committee or joint committee after the treaty, agreement or convention is laid. Invariably it is
the Committee on Foreign Affairs that has responsibility for these matters. Another Committee
may however be directed to participate in the consideration of the subject.
• The relevant committee causes a report to be laid in the House after considering the matter
and copies are served on the members of Parliament.
• At the time appointed for debate, the Chairman of the Committee moves the House to adopt
the report. In the ensuing debate, the members of Parliament consider the principles of the
treaty, agreement or convention and raise relevant arguments for and against the matter. The
sector Minister, if available, responds to issues raised.
• At the close of the debate, the Speaker puts the question and by a voice vote, a resolution on
the matter is passed.
• The Clerk of Parliament prepares and forwards the resolution adopted to the Minister of
Foreign Affairs.
• Parliament should also notify the sector Ministry concerned after the ratification by resolution.

INSTRUMENT OF RATIFICATION
• A copy of the ratification is forwarded to the Ministry of Foreign Affairs and Regional
Integration for the preparation of the appropriate Instrument;
• The Instrument is then forwarded to the Office of the President for the signature and seal of
the President;
• Upon return, the Ministry of Foreign Affairs and Regional Integration deposits the Instrument
with the appropriate depository and forwards two copies to the sponsoring Ministry for its
records, and two copies to the Ministry of Justice and Attorney-General’s Department.
