We warmly welcome foreign residents who live in


‘Ansan, a livable City’.

We, Ansan City, is the most harmonious multicultural


city in Korea with a thousand years of history and
various cultural arts.

However, many people are having difficulties due to


differences in language and culture in this foreign
country. In order to alleviate these inconveniences,
we compiled a guidebook that contains basic information
to know about domestic life and precious living
information about living in Ansan.

We will do our best to make Ansan, a multicultural


center city where foreign residents can live as a
member of our society and communicate with each
other freely.

General Status of Ansan (as of June. 30, 2019)

Location
Ansan is located 30km radius from southwest with Seoul as the center.
And it is also bounded by Gunpo-si on the east side,
West sea on the west side, Hwasung-si and Uiwang-si
on the south side and Siheong-si on the north side.

About Ansan Migrant Community Service Center
Ansan Migrant Community Service Center is an agency operated by Ansan City Government
to provide various administrative services to foreign residents and create an environment
harmonizing the Korean and foreign residents.

We Make Policy Bases for Supporting Foreign Residents.


We operate National Multicultural Cities' Council, Ansan Ordinance on Foreign Residents and
Multicultural Families, government-civil councils for foreign residents and multicultural families,
foreign residents' council, Korean Diaspora Center and World Culture Center.

Making appropriate circumstances to protect and promote human rights of foreign residents. 9
National Human Rights Commission of Korea, Gyeonggi-do and Ansan have made an interchange

agreement and they keep trying to develop environments for foreign residents such as enacting
an ordinance for human rights to raise people’s consciousness for protecting and improving
human rights. We also support the medical services with both public and NGO through the First-
aid Support Business and migrant’s translation support center.

The headquarters carries out many different projects to vitalize the Special Multicultural Zone.
It executes underground wire development project within the Special Multicultural Zone, surveys
the commercial district of foreigners in the special zone, issues recommendations for hiring
cooks, and performs an environmental improvement project to prevent crimes in foreigner-
concentrated areas.

We build a supporting foundation for multicultural family.


Finally, Ansan Multicultural Support Headquarters supports various administrative services such
as education, employment, counseling, etc. for multicultural families to adapt quickly to and lead
a stable life in the Korean society.

Supporting of cultural events and sports activities for the harmony between locals and
foreigners.
We are promoting the harmonious relationships between the Korean residents and the
international people through popular multicultural events, community events by country, and
global everyday sports program.

Providing educational programs and information for immigrant.


We seek harmony between locals and foreigners in various ways such as multicultural events in
every season, sports event for each nation and global sports programs etc.

Transportation

How to use the transportation card


● This card can be used only after charging it with cash. You can use this card
whenever you use public transportation such as bus and subway. You can pay
the bus fare with it by touching the card to the card reader.
● It has some advantages of discount in paying the fare than cash and you can get

additional discount when you transfer the public transportation.


● There are three different cards are available according to age (based on Alien

Card). Children card(6-12 years old), Youth card(13-18 years old), Adults(more
than 19 years old)
- Unlike the adult, children and youth can get special discount only when you
register the card on the homepage of transportation card before you use the card. 31
- You don’t need to reissue the transportation card once you buy it because it will

reflect your age automatically when you buy it with your alien card number.

How to transfer the public transportation

① Pay the fare by transportation card


② You have to touch the transportation card to the card reader whenever you get off
③ You must transfer the bus or subway within 30 minutes
④ You have to touch the transportation card to the card reader when you get off at
your destination.

(If you don’t touch the card when you get off, there will be additional charges to pay)
● Transfer discount validity time is 30 minutes (but during 9pm to 7am is 60 minutes)

Intra-city Bus (Urban bus)
● There are different bus fare system according to bus type and route, so you have
to check the fare system before you ride.
- For example, there are inter-city bus and express bus which fare is a bit higher than
city bus but the mini bus what we call village bus is cheaper than city bus.
● If you want to use bus, you should wait at the bus stop to the right direction of your

destination. You can pay in transportation card or cash when you get on.
● Free ride program

- Less than 6 years kids(up to 3 kids) under the guardian’s care.

Sioe bus(Intercity bus) & Gosok bus(express bus) is better for long distances.
Sioe buses stop for people to get into or out while they go to their destination, but
Gosok buses go directly to the destination without stopping. Both of them can be
taken at ‘Ansan Bus Terminal.

● There are two different types of taxi which are Deluxe(“Mobeum”) Taxi and regular
Taxi (“Ilban”)
- You can identify the deluxe taxi by “Taegeuk” logo. The deluxe taxi that is cozy and
safe than general taxi because these cabs are running by the drivers who do not
have car accident record for ten years. But the fare(basic fare is 5,000won) is a bit
higher than regular ones.
- If it is not deluxe taxi, it is regular taxi which basic fare is 3,000won in Seoul.

When someone wants to dispose garbage in Korea, he or she must buy the proper
waste bags for the disposing of it. Because disposal ways vary by the waste type,
they must be discharged in a designated time and place according to the waste type.

● Illegal exchange transactions
① If you want send your money for living cost and school fee to your family of
your own country, you have to use only exchange bank. If you don’t use
the exchange bank in sending your money to abroad, you will get less than
100million won penalty or less than 50 million won penalty or less than one
year imprisonment according to foreign currency exchange law.
② According to foreign exchange transactions act, handling foreign exchange
transactions without registration to government is illegal and subject to less
than 300 million won penalty or 3 years imprisonment.

Even though you are legally staying in Korea, If you work for entertainment
spot such as karaoke what we call ‘NoraeYeonsupjang’ to entertain the clients
there will get punishment of less than 3 million won penalty or less than year

Housing purchase and making rent contract


● Housing purchase
- When you purchase house you have to check every details of house environment such
as location, convenience in transportation, natural environment etc. You also need to
check the transcript of house register closely whether it was put up mortgage or not so
that you may not face and disadvantages in buying housing.

● Rent house
- In this system of rent house, you can rent a house only with a certain amount of deposit
during the contract period and get refund for the deposit after the contract.

contract.

- If you rent the whole house, the deposit will be 40~80% of the price of the house. The
contract period is normally 2 years (Officetel is only one year), and tenant and owner
should not break the contract during the period.

● Monthly rent
- This is commonly paid every month according the contract apart from a certain
amount of deposit. It is far cheaper than rent house. You can adjust the deposit
amount and monthly rent fee according to the agreement with the owner.
The higher the deposit , the lower the monthly rent, but the lower the deposit,
the higher the monthly rent.
- For both rent house and monthly rent house, the bills(electricity, tap water, gas,
internet, TV receiving fee) are not included in the rent fee. Furniture and home
supplies are not provided in the normal rent house, but in some ‘officetel’ or rent
apartment houses equipped with them as an options.

● Before you get a house


- You would better to rent a house through real estate agency near the house even
though you can rent a house direct with the house owner. The real estate agency
will check some details of the house and help you for paper work, but you have to
pay the handling processing fee to them.
● Contract
- To whom you have to make a contract?
You have to make a contract only with the house owner, so you have to check the
real owner of the house based on the house register certificate.
You can check it in internet through the real estate agency. You have to check the
house register whenever you pay the contract money in installment.

- How and when to pay?


Down payment is normally considered 10% of the deposit amount. If the deposit
is 2 million won, the down payment is 200,000won. You have to pay some part of
1.8 million won at the designated day before moving, and pay the balance on the
date of move into house. You have to get the receipt whenever you pay.

Comfortable life in Ansan


If you move a house before the contract, the owner can deduct your monthly rent
from the deposit. But it is illegal if the landlord didn’t pay back even after finish the
contract. If so, you’d better counsel at the nearest migrant counseling center.

● The Object of Alien Registration
- Every foreigner who wants to stay more than 90 days or longer, from the entry date.

Legal Status of Foreign Workers

● Foreign workers eligible to have the same rights as Koreans regarding the Labor
Standards Act, the Minimum Wages Act, the Occupational Safety and Health Act,
and the Labor Relations Act.
● Foreign workers are eligible to be covered by 4 major insurances: the Industrial

Accident Compensation Insurance, the National Health Insurance, the National


Pension(based on Mutualism), and the Employment Insurance (optional).
● Foreign workers should not be discriminated unreasonably(The ACT 22 of

migrant worker’s hiring ). However, rational discrimination based on


capabilities and productiveness of foreign workers is acceptable.

● Under the Employment Permission System, foreign workers allowed to stay in

working period. After the employment period is ended, they must depart from

Special Act on the Employment of Foreigners
(Employment Permission System)
This system was enacted in 2003 for the companies which have not been able to
hire Korean workers to get some migrant workers legally by issuing a certificate of
manpower shortage from the government to the (Ministry of Labor).

A Labor Contract

● An employee must make a standard labor contract with a foreign worker within

If he/she signs or stamps (thumb mark) on a contract without full understanding,
the worker can face severe disadvantages. The worker should make a decision
only after he/she understands the contents of the documents by asking the
company or consulting with colleagues or migrant supportive groups.

Appendix P.136 Standard Labor Contract


Changes of Workplace

● Reasons
- If a user is trying to cancel the employment contract during the employment
contract period for a just reason or refuses to renew the employment contract
after it expires.
- If a foreign worker cannot continue employment in a business site due to
temporary close, shutdown, and a reason not imputable to the foreign worker.
- Any cause occurred by a presidential decree.

● Procedures
- A foreign worker must visit the employment center of the Ministry of Labor within
102 1 month from the end of the employment contract to apply for business site
change, and can switch only to a business site arranged by the employment center.

- A job seeker must visit the employment center that has jurisdiction over the
region s/he wants to work in and give a desired place of work, desired type of
business, and a phone number that can be reached. Since there are only 3 days
of valid period, the jobseeker must decide whether to work in the company s/he
interviewed for and sign an employment contract within this period.
- The alteration of workplace can only be limited three times.(It is possible 2 times
if the employee extend the period by re-employment) However, if a worker is
forced to alter his/her workplace due to the shut down or close temporarily, reason
with responsible to the employee, the alternation is not calculated.
- After changing a workplace, workers shall receive permit from the Immigrant
Office covering the area where he/she works (Article 21 of the Immigration
Control Act).
※ If a foreign worker does not receive a permission for workplace change within 3 months after the
date of applying for a change into another business site or does not apply for a change to another
business site from the ending date of the employment contract with a user, the foreign worker
must leave the country. However, if the foreign worker cannot receive a permission for workplace
change or cannot apply for a workplace change due to reasons such as work-related disaster,
disease, pregnancy, childbirth, etc., the number of period is calculated from the date the reason
is gone..

You can change your working area at any time at job center, but your work
field(category such as manufacturing, construction, fishery work etc) cannot be
changed once you have chosen from your country. So you must be careful to choose
the working field in the beginning before you come to Korea.
About Re-employment of Foreign Workers

A foreign worker can engage in an employment activity within 3 years from the date of entry into the
country. If there is a request for re-employment permission by a user after 3 years of employment
activity period, the employment period can be extended (for 1 year and 10 months) once.

● The way of applying for re-employment


- If a user seeks to re-hire the foreign worker with expired period of employment
activity, the user must apply for the re-employment permission to the employment
center from 60 to 7 days before the period of stay of the foreign worker expires.
However, this is applicable only to foreign workers who have maintained more
than 1 month of employment contract period before the period of employment
activity expires. 103

You can only be rehired by the request of your employer unless your employer

Within 14 days equivalent to 30 days of the worker’s annual average wage(based on
service period of a worker)to all workers who have served for over 1 year regardless
of any reason such as volunteered retirement, disciplinary dismissal, expiration of
the work period. The payday of retirement benefits can adjust next general payday
if there is employment’s agree. (The company less than 5 employees has to pay
retirement benefits more than 50% of the legal standard from Dec 1, 2010 to Dec 31,
2012. After then, it is applied 100% of retirement benefit which is more than 30 days
of the worker’s annual average wage..) In this context, the average wage is the result
of a formula; the total amount of wages which have been paid to the worker for the
3 months before resignation divided by the total amount of days worked during
this period(usually 89~92 days). The average wage shall include the total wages and
overtime allowance, holiday work allowance, and other money paid to the
employee. If the resulting average wage is less than the worker’s ordinary wages for
this period, their severance pay will be based on their ordinary wages.

● Working Hours
Work hours refer to all hours involved in doing company-related work from the time
arrived at work to the time leaving work, and break time is excluded. Thus, viewing
time, work preparation time, cleaning time, and the time other than the main work
are included in workhours. Workhours are 8 hours a day, 40 hours a week excluding
the break time.
● Paid Leave
- Paid yearly Leave
· Paid yearly leave shall be provided 15 days a year in case of over 80% attendance
per year. However, If the worker works less than 80% of the regular workdays,
1day paid leave per month shall be provided to the workers who work full time
for a month.
· Basically this leave is provided to the worker whenever they want, but the leave
period is changeable if the worker’s leave can be a liability to the company or
workplace.
· Less than 1 year work: a (1 day) paid leave shall be provided to workers who have
not been absented for the entire month.(1 day / 1 month)
※ Paid leave will be deducted from yearly paid leave that will be generated after working for 1 year. (15days)
· More than 2 years work: One day leave will be added.
· If the total days of leave exceed 25 days, employers would not give additional
paid leave.

● Additional Allowances in cases of Overtime Work/Night Work and Holiday Work


If an employee works beyond 8 hours a day, 40 hours a week, 50% of the normal
pay must be calculated and added to pay him/her for the extended workhours.
The same applies for holiday work. This follows for holiday work as well. If he/
she works at night (10 p.m. ~ 6 a.m.), the worker should be paid an additional
50% of his/her ordinary wage. To receive such additional allowances without
any problems, workers should keep records of their over time or nightly work
(e.g. write down from start to finishing time and their dates) and keep the pay
envelopes or wage statements.

※ As the above examples mention, overtime work or night work leads to additional wages,
they work on a paid holiday. Employers are allowed to pay less than this if they provide an
alternative holiday to the employee. An alternative holiday must be notified in advance
though (at least a few days before)

Please Keep Important details and document~

Please keep the company address, phone number, the name of company president,
wage statements and the labor contract as well. You have to ask for them. If the
company doesn’t give you a copy of the labor contract, it can be obtained from the
ministry of labor. These documents and materials will be absolutely important if any
problems related to your wage or severance pay arises. Please keep them!!
● Shutdown Allowance
- An employer shall pay over 70/100(70%) of average wages during the shutdown
period when the cause of shutdown is attributed to the employer. If the shutdown
allowance exceeds the ordinary wages, the allowance is as much as the ordinary
wage. If a company can’t keep afloat because of inevitable reasons and the Labor
Committee approves the closure, the shutdown allowance may be less than the
standard (70/100 of the average wage).

- What causes are attributed to employer?


This can be any ill-management which happens and is in the range of the
employer’s control. Examples include a burnt factory, destruction of machines,
power failure, sluggish sales, shortage of raw materials, decrease of orders,
reduction of work load, financial difficultly, or disturbance of distribution ring. If
the civil court rules that the shutdown is attributed to employers, that is to say, if
employers’ intention or fault is recognized by the court, the employer shall make
full payment.

- When are businesses not considered to be at fault, and the slowdown is due to
an inevitable reason
The inevitable reasons for a business’s downfall include a natural disaster, a war,
an abnormal change of weather, and its subsequent effects on business such as
traffic control. However, even if there is an inevitable reason, the employer shall
pay the shutdown allowance if they can’t get the approval of a Labor Committee.
If this happens, then the employer shall be responsible for the burden of proof
(proving the business falling was due to an inevitable reason).

Industrial Accident Compensation Insurance Act


● What is an industrial accident?
Industrial accidents refer to accidents that occur at workplace and include any
injury, disease, or even death that befall a worker while doing any activity related
to his/her work. A worker in an industrial accident is allowed to ask his/her
employer for compensation even though the employer is not at fault or claim
insurance money in accordance with the Industrial Accident Compensation through
the Korea Labor Welfare Corporation, affiliated to the Korean labor ministry.
● What is an occupational disease?
An employee may catch a disease while working at his/her workplace.
Sometimes, a disease occurs for personal reasons, but it may be related to an
occupation. For example, a worker’s job might involve carrying heavy loads,
which gives them back problems, or the job might require working with paint
which can cause asthma or dizziness. Thus, any disease occurring in relation
to work or the environment of a workplace is called an occupational illness
or disease. If a worker’s disease is recognized as an occupational disease, the
worker is entitled to be covered by this insurance.
● Contents of Industrial Accidents Compensation
- Accidents created by a worker’s mistakes are also covered.
This is not applied to a business site with less than 5 people run by an individual
business owner among construction business less than KRW20 million of
construction amount, housekeeping service, agriculture, forestry, fishery, and
hunting business with les s than.
- Compensation is possible even though a company doesn’t subscribe to the insurance.
Industrial accident compensation insurance is mandatory. Therefore, if an
employer satisfies the requirements stipulated by the insurance, an employee
is allowed to ask the Korea Labor Welfare Corporation to pay compensation
regardless of whether their company has subscribed to the insurance or not.
- Compensation coverage
A worker is eligible to receive 70% of their average daily wage for each day they
can’t work, if it is recognized as an industrial accident. If the compensation is less
112 than the minimum wage, worker will receive at least the minimum wage. If he/she
recovers but still has some disability, the worker will be able to receive a disability

compensation. If the worker dies, some compensation and funeral costs will be
paid to the remaining family members. If the disease reoccurs later after treatment
has ended, the worker will still be covered by the insurance. The Korea Labor
Welfare Corporation pays all things related to compensation.
- All compensation is transferred into the worker’s banking account.
- Compensation Lawsuit
In addition to compensation received from an Industrial Accident Compensation
Insurance, the worker can get more financial compensation by filing a lawsuit
against his/her company. The court considers both the employer’s responsibility
and the damage caused to the worker while making the decision for the compensation
amount (after subtracting the amount already provided by the insurance). In the
case of migrant workers, the compensation amount is based upon the wage levels
of their native home country if their sojourn period has expired.
- The worker is entitled to make a firsthand claim for compensation.
If a company refuses to pay compensation, the worker or his/her family members
are entitled to call the Korean Labor Welfare Corporation directly. If he/she
contacts the Compensation Department of the Corporation, the worker will be
provided with a detailed explanation and counseling. If necessary, a staff of the
corporation will visit the worker in person to resolve any problem. In addition,
workers can gain some help from bodies supporting foreigners or such counseling

Examination Request and Re-examination Request(Appeal the decision)
If he/she is dissatisfied with the decision of the branch of the Korea Labor Welfare
Corporation dealing with his/her case, the worker is allowed to make an examination
request to the corporation headquarters within 90 days from the date when they
are notified of the decision. If he/she is still unhappy with the conclusion of this
examination, the worker can file an Insurance Examination Committee of the Labor
Ministry within 90 days from when they receive the conclusion of the examination.
※ Period required to make a decision: 50 days respectively
Administrative Litigation
The worker is also allowed to file an administrative lawsuit in accordance with the
Administrative Litigation Act within 90 days after the date of receiving either a
decision made by the branch of the corporation, the conclusion of the examination,
or the conclusion of the re-examination.
Disciplinary Action and Dismissal

Employers cannot inflict a dismissal, layoff, suspension, transfer, pay cut, or other such punishments
on a worker without having a “rational reason” for doing so. In cases where adismissal, layoff,
suspension, transfer, pay cut, of other punishment is imposed on the employee without any
rational(reasonable and fair) reason, the affected worker is allowed to ask for relief.

● Legal Meaning of “Rational Reasons”


If conventional wisdom finds that enough business failure can be attributed to
the employee to justify canceling an employment contract, the dismissal will be
considered to be rational. That is to say, the reasons given for the dismissal must be
what most people would think of it as reasonable and fair. Some examples would
be when a worker does a company severe damage, or destroys managerial order in
an organization.

A. Notice Obligation
• To prevent a worker from falling into difficulties caused by being fired unexpectedly,
employees must be notified of their dismissal at least 30 days in advance.
• If they are not given 30 days notice before being fired, their ordinary wages
B. Exception of obligation of notice
• Exceptions exist in special cases - A worker can be fired without notice when
the business can’t keep afloat due to a natural calamity, mishap, or another
inevitable accident, or if a worker causes financial damages to the business, or
intentionally impedes the business.
• Exception for short-term workers - Applied to daily employed workers
who
have not been hired for 3 months, those who were used within 2 months of
period, those who set and were used within 6 months of period for seasonal
work, and workers in the probationary period.
• A Dismissal Notice Should be in Writing
When firing a worker, the employer should notify the employee of the
reasons for the dismissal and the remaining period of employment. They
should include why it is necessary to fire the employee.
• Objection against Disciplinary Action
A worker on whom disciplinary action or dismissal is inflicted without
rational reasons is eligible to report it to the Labor Committee or a Court to
ask for relief. The report for relief must be made within 3 months after he/she
has asked for relief. The report for relief must be made within 3 months after
the unfair dismissal has been given. The labor committee shall then perform
a proper investigation and interrogation to decide if the dismissal was unfair.
※ Fair dismissal: The court rejects the relief application made by a worker.
※ Unfair dismissal: The court orders some relief(to either reinstate the worker or pay them wages for
the same period.)
Relief of Disadvantages of employment

● When wages are not paid on time


If an employer doesn’t pay your wages or pays you only part of the wages owed,
you can receive your wages fairly by using the methods below.
- You are allowed to make a petition to the labor ministry.
When a worker quits his/her job, an employer shall liquidate his/her wages,
retirement benefits, and all financial liabilities or money owed to the employee
within 14 days. If the payment is not made within 14 days, the worker is allowed
to make a petition to the labor ministry. The petition can be registered by direct
visiting, internet, Fax, or mail. To register it, the worker must know the address
and phone number of the employer. If a worker registers a petition form, a labor
supervisor at the labor office sends a summons to the employee and the employer
within 2~3 weeks, checks if the wage is delayed or not, and orders the employer
to clear all due wages.

Usually, many employers clear the back wages during the period of checking
if they do owe the employee money. If your employer doesn’t pay your back
wages, the labor ministry will send them for prosecution and deem them as
being in violation of the Labor Standards Act. The employer will then be forced
to pay a penalty to the government for violating the act.

● You are allowed to file a lawsuit.


Sometimes, an employer still doesn’t pay your back wages even when a labor
supervisor orders them to do so.
① In this case, the employer is sentenced to prison up to 3 year’s in jail or given a
fine up to 20 million won, but in reality, the fine is no more than 10~20% of the
unpaid back wages.
② If this happens, the affected worker can visit the labor office to receive the
confirmation of his/her owed back wage and then file a lawsuit through the
Korea Legal Aid Corporation. Before the ruling is announced, the litigation costs
are provided to the worker by the Korea Legal Aid Corporation, and if the worker
wins, the employer will be responsible for paying these costs, so employees do
not have to be concerned about costs.
※ Ministry of Employment and Labor established the substitute payment system which is a legal system
to pay the unpaid wages to the retired workers on behalf of employers up to 3 million won. If you get
final and conclusive judgment from the court, you may apply to Korea Worker’s Compensation and
Welfare Service. You will get paid within 14 days then.
● You can also get your unpaid wages through the aid of consulting and supportive organizations.
This is the most widely used way to resolve wage problems. However, these
consulting and supportive organizations are private bodies, and don’t have legal
binding, so they are only able to ask the employer to pay your missing back wages.
That is to say, such organizations don’t have any legal rights to punish the employer
even if they won’t pay you.
● You need to finish dealing with your unpaid wages problem within 3 years.

The statute of limitations on wages is three years. After three years have passed, it’s
hard to resolve the wage problems by using the above-stated, methods. Therefore, if
your wage payment is delayed, it’s best to take measures as quickly as possible.
- When you are injured while working
A worker in an industrial accident is eligible to receive 70% of his/her wages,
doctor’s fees, and disability compensation by applying to the Korea Labor Welfare
Corporation. As for the application procedures to receive industrial accident
compensation, the injured worker, his/her family members, or his/her company
116 can apply for it. This procedure requires a lot of time and effort and is difficult
for foreign workers to understand, so, unfortunately, many workers are prevented

from applying for this compensation. For example, sometimes, the company starts
the procedure for the compensation, but refuses to fully explain to the employee
what’s going on with the application process, and many workers find this very
stressful. Therefore, it is best to seek the counsel of the labor ministry or another
supportive group to make sure you will receive this money.
- When you contract a disease caused by your occupation
If you are ill or suffering from a disease while working, you need to question and
inquire if it is an occupational disease. To prove it is an occupational disease, you
will need to be diagnosed from a proper and special hospital.
- When you are assaulted or detained
It’s appropriate for you to consult with the relevant institutions(police station)
or organizations after running away from the place where you were assaulted or
detained. If this happens to you, you need to get a diagnosis not issued from a
hospital even if the injury is minor.

● National Health Insurance (Employer/Employee: fifty-fifty payment system)
Legal migrant workers are eligible to subscribe to this insurance, but illegal
workers are not (illegal workers are allowed to use free clinics).
● National Pension System (Employer/Employee: fifty-fifty payment system)
based on Mutualism
The national pension is the system of ensuring a subscriber’s income when they are
old, injured, disabled or die from unexpected accidents or diseases. The government
pays the pension to the subscribers and their remaining family members to help the
employees to maintain a basic level of comfort, health, and dignity.

P. 44 National Health Insurance

● Mandatory Subscription
Like Koreans, foreigners between 18 and 60 years old who reside in Korea are
qualified and usually required to subscribe to Korea’s National Pension.However,
foreigners who don’t subscribe to a similar insurance system in their own country
are excluded from mandatory subscription (foreigners from countries that have a
mutual treaty with Korea on security pensions are a special case, see below).)

● Pension Premium
- An employer and an employee pay fifty percent each(a worker’s monthly pension
premium is equal to 4.5% of their total monthly income). 117
- A subscriber to a regional pension however pays 9% of the monthly income that

※ Above mentioned percentages apply to foreigners and Koreans alike. The pension premiums have
to be paid by the 10th of the following month.

● Benefits
If a foreign subscriber meets the qualifications needed to receive old-age pension,
disability pension, or survivor’s pension, he/she will receive the pension just as
Koreans do.
- Old-age Pension
If a subscriber still suffers from disability after he/she has recovered, this pension
will be paid to him/her.
- Disability Pension
If a subscriber still suffers from disability after he/she has recovered, this pension

Effective July 29, 2014, a foreign worker can receive insurance benefits for departure
guarantee only after departure. The amended law applies to claims made after July 29,
2014 (and no later than 14 days after departure; Article 2 of Supplementary Provisions).

● How do I claim insurance benefits for departure guarantee, and what is the
paymen procedure?
If a foreign worker should leave Korea when the legal stay period expires, he or
she can send claims to Samsung Fire & Marine Insurance about a month before
leaving (after filing a scheduled departure report).
