Judicial Affidavit of Michael Roa

I, Michael Roa, Filipino, 17 years of age, single, a student and residing at

Fairlane Village, Guadalupe, Cebu City after having been sworn to in
accordance with law, do hereby depose and state that:
Preliminary Statement
The person examining me is Atty. Mary Elaine Bagol with law

office address MEB Law Office ABS Building i2 IT Park, Cebu City. The
examination is being undertaken at the same office address. I am
answering her questions fully conscious that I do so under oath and may
face criminal liability for false testimony and perjury. I also attest that
the attachments of this Judicial Affidavit are faithful reproductions of
their corresponding original copies.
Purpose:
That the testimony of the witness MICHAEL ROA is being offered: (1) To
prove that the herein complainant, Meg Miralles and him (Michael Roa)
has a romantic relationship; and (2) that they had carnal knowledge at
the date of the alleged incident.
The questions she asked and my corresponding answers were the

following:

1. Q: Please state your name, age, residence and other personal
circumstances
A: I am Michael Roa, 17 years of age, single, currently a student
and residing at Fairlane Village, Guadalupe, Cebu City.
2. Q: You mentioned earlier that you are still a student, may I

know from what school are you in?
A: I am studying at the University of San Carlos.
3. Q: Do you know the complainant in this case?

A: Yes, he is Meg Anthony Miralles.
4. Q: How do you happen to know Mr. Miralles?

A: He is my boyfriend for 2 years now and we are schoolmates.
5. Q: How can you prove that he is indeed your boyfriend?

A: I have a picture of us together. It was taken at his classroom
when I surprised him with a flower during Valentine’s Day.
6. Q: When was this picture taken?

A: It was taken on February 14, 2017.
7. Q: If the said picture will be shown to you, will you be able to

identify it?
A: Yes, ma’am.
8. Q: I am showing you a copy of the picture attached as Annex

“A”. Is it the same picture you are referring to?
A: Yes, it is the same picture that I am referring to.
9. Q: Where were you at the time of the alleged incident,

February 14, 2017 around 5:00 o’clock in the afternoon?
A: I was just outside Meg’s classroom, waiting for him because we
planned to have a date after class since it is Valentine’s Day.
10. Q: While waiting for Mr. Miralles, did you happen to notice
anything?
A: Yes. I saw Mr. Largo and Meg talking to each other but I
couldn’t hear anything since I was waiting outside the classroom.
11. Q: What else, if any?

A: The conversation seems serious but short. After that, Meg went
out the room to meet me and we proceed to our date.
12. Q: What happened next, if any?

A: After we had our dinner, we immediately proceeded to my
house. Since my parents were not around, we stayed in my room
and we watched the movie fifty shades darker.
13. Q: Where exactly in your room did you watch the movie?
A: We watched it on my bed since we are only using my laptop.
14. Q: What happened next, if any?

A: While watching the movie, I felt Meg’s hand caressing my arms
then to my chest then down to my groin and the rest is history.
15. Q: What do you mean by “the rest is history?”
A: It means that we had sex.
16. Q: By sex, what do you mean?

A: He inserted his penis into my butt hole and I inserted mine to
his as well.
17. Q: You earlier mentioned that Mr. Miralles is your boyfriend,

why then are you testifying against him?
A: Because my conscience is bothering me. When I heard about
this case at school, I immediately confronted Meg and asked him if
these are true since we are together on that same day of the
alleged incident. I can’t take that an innocent man like Mr. Largo
be suffering.
18. Q: I have no further questions. Do you have anything to add

or retract, Mr. Witness?
A: No more ma’am.
19. Q: Do you voluntarily and willingly sign this statement?

A: yes ma’am.
