    COUNTER- AFFIDAVIT

    I, HUAZE LEE, of legal age, single, a resident of Brgy. Basak


    Pardo, Cebu City, Philippines, the respondent in the above case, after
    having been sworn in accordance with law, hereby depose and say
    THAT:

    1. That around 6:00 pm on the 30 th day of August 2018; I was on


    my boarding house with my cousin Daw Min Su, waiting for my
    parents to come on my boarding house.

    2. While waiting for my parents I asked my cousin to buy meat for


    us to cook, because it was almost 7:00 pm and we didn’t had
    any dinner yet.

    3. When my cousin left to my boarding house, I decided to


    prepare the spices like onion, garlic and other necessary
    material for cooking our meal.

    4. After a while I heard a noise outised,I saw the complainant


    outside boarding house together with her daughter,she slamp
    the door of my boading house and start nagging and shouting
    to me, She said “HUAZE LEE gawas dira oi baga kaayo kag
    nawong da imong bayad oi.”( HUAZE get out you have a bald
    face, your payment)

    5. I opened the door, with a knife on my left hand I tend to forget to


    put the knife because I rush to opened the door to see who’s
    outside and when I saw the complainant I put the knife on the
    table for safety purposes.
    6. When I face Joy Maldita Soberano I told her, “Pwede raman
    nato ni sultian og tarong maam ayaw lang panghagis dire
    maam padung naman akong parents dire sila ra ang mo bayad
    sa imoha maam”.( we can talk it privately, my parents will come
    here and they will pay you, don’t my any scandal here maam

    7. Instead of listening to me she keep on shouting “Bagaa kaayo


    kag nawong ha tan.awon nato na imong kabaga” ( You have a
    bald face ha, let see)

    8. Few minutes later my cousin came and saw the incident she
    told the complainant “Maam padung na sila uncle maam ayaw
    lang paggubot dire maam” ( Maam please don’t make any
    scandal here because his parent will almost here). To ensure
    our safety I put the knife on the table.

    9. The complainant didn’t stop there she forced to enter to my


    premises and it creates attention to the other board mates. My
    cousin get his phone and record everything what happened to
    show to my parents what the complainant did to me.

    10. The testimony of Liza E. Soberano, the daughter of the


    complainant was highly incredible. I did not point the knife to
    them but instead put the knife to the table to ensure safety. She
    was not an eyewitness on the incident. She only testified on
    what she believed on her mind to be true as what her mother
    said to her and she didn’t saw the full scenario.

    11. The testimony of Yuan Gonzaga was likewise fabricated.


    He could clearly see the scenario because his room was 100
    meters away from the incident and he didn’t personally went to
    the scene but instead he glimpsed only what happened.

    12. The testimony of Joy Maldita E. Soberano, Liza E.


    Soberano and Yuan Gonzaga were all not true

    13. I am executing this affidavit to attest to the truth of the


    foregoing statements and for whatever legal purpose that this
    may serve.

    IN WITNESS WHEREOF, I hereunto affix my signature this 4 thday


    of September 2018 at Cebu City, Philippines.
