FACTS
Administrative complaints against Judge Eliza Yu of MTC Branch 47 Pasay City
o Non-compliance with admin order for establishment of night courts in Pasay
o Refusal to honor appointments of Lagman and Lopez, clerks of court
o Show-cause order respondent issued against fellow judges
o Refusal to sign leave of absence of Labid
o Allowing OJTs to perform judicial tasks
o Designation of an OIC and ordering reception of evidence by a non-lawyer
o Allowing criminal proceedings to continue without a prosecutor
o Sending inappropriate email messages to co-lawyers
Court found Yu guilty of gross insubordination, gross ignorance of the law, gross
misconduct, grave abuse of authority, oppression, conduct unbecoming of a judicial
official, and dismisses her from service.
ISSUE
Whether or not Yus Motion for Reconsideration with Explanation for the Show
Cause Order should be granted
HELD
Lack of merit; respondent flagrantly and blatantly violated the Lawyer's Oath, and
several canons and rules of the Code of Professional Responsibility, the Canon of
Judicial Ethics and the New Judicial Code of Conduct.
Respondent's overall conduct negated her allegation of good faith i.e. in the email
messages and in her conduct to employee Labid who was ill, and to the clerks.
Disbarment is also to be imposed on Yu- respondent's accountability did not end
with her removal from the Judiciary.
misdemeanor as a member of the Bench could also cause her expulsion from the
Legal Profession through disbarment.
Yu's violation of the fundamental tenets of judicial conduct embodied in the New
Code of Judicial Conduct for the Philippine Judiciary would constitute a breach of the
following canons of the Code of Professional Responsibility, to wit:
CANON 1 - A LA WYER SHALL UPHOLD THE CONSTITUTION, OBEY THE LAWS OF
THE LAND AND PROMOTE RESPECT FOR LAW AND FOR LEGAL PROCESSES.
Rule 1.02 - A lawyer shall not counsel or abet activities aimed at defiance of
the law or at lessening confidence in the legal system.
CANON 6 - THESE CANONS SHALL APPLY TO LAWYERS IN GOVERNMENT SERVICE
IN THE DISCHARGE OF THEIR OFFICIAL TASKS.
Rule 6.02 - A lawyer in the government service shall not use his public
position to promote or advance his private interests, nor allow the latter to
interfere with his public duties.
CANON 11 - A LAWYER SHALL OBSERVE AND MAINTAIN THE RESPECT DUE TO
THE COURTS AND TO JUDICIAL OFFICERS AND SHOULD INSIST ON SIMILAR
CONDUCT BY OTHERS.
Rule 11.03 - A lawyer shall abstain from scandalous, offensive or menacing
language or behavior before the Courts.
DISBARS EFFECTIVE IMMEDIATELY respondent ELIZA B. YU pursuant to A.M. No.
02-9-02-SC for violation of the Lawyer's Oath, the Code of Professional
Responsibility, and the Canons of Professional Ethics; and ORDERS the striking off of
respondent ELIZA B. YU's name from the Roll of Attorneys.
