1. Purpose. This publication sets forth format and procedures to govern the Retirement of New
York Guard Commissioned and Warrant Officers.

2. Application

a. Format and procedures established in this publication apply to requirement for


Retirement.

b. This publication is a mandatory directive.

3. Scope. This publication describes the application of the New York State Law concerning
membership in the New York Guard by commissioned officers upon reaching mandatory
retirement age.

4. Basis. Consolidated Laws SNY, Military Law Chapter 36, State Militia Article I, Section 21,

CHAPTER I

POLICY

1. Mandatory Age. Any commissioned officer or warrant officer of the state military forces, in
active service or on the State Reserve List, who has reached the age of sixty-eight (68) years,
shall be retired for age and transferred to the State Retired List.

2. Voluntary. Any commissioned officer or warrant officer, who shall have served in the same
grade for a continuous period of ten years, or in the military or naval service of the state as a
commissioned officer or warrant officer for fifteen years may, upon their own request, be retired
from active service and placed upon the State Retired List.

CHAPTER II

RESPONSIBILITIES

1. The Personnel Staff Officer will:

a. Advise Major Command (MACOM) Commanders and individuals of retirement due date
one hundred and twenty (120) days prior to their birth date for the mandatory retirement age of
sixty-eight years (68).

b. Process orders and issuance of necessary documents for retirement.

2. Commanders of New York Guard Components, Commanders of the Army Division, Air
Division and Civil Military Affairs Brigade will: Provide Headquarters NYG of all
recommendations and request for awards approximately ninety days (90) before actual retirement
date.

CHAPTER III

PROCEDURES

1. Mandatory Retirement from Active Service.

a. Notification. Headquarters New York Guard will notify any commissioned officer or
warrant officer of the New York Guard of their pending retirement date, through the Chain-of-
Command, approximately one hundred and twenty (120) days prior to their birth date for the
mandatory retirement age of sixty-eight years (68).

b. Awards and Brevets. Major Commands will provide Headquarters NYG all
recommendations and requests for awards or brevet promotions, IAW appropriate directives,
approximately ninety (90) days before the actual retirement date.

c. Headquarters NYG will review all pertinent documents along with the officer or warrant
officer for transfer to the State Retired List, and issue the required orders.

2. Mandatory Retirement from State Reserve List.

a. Notification. Headquarters New York Guard will notify any commissioned officer or
warrant officer of the New York Guard of their pending retirement date, approximately one
hundred and twenty (120) days prior to their birth date for the mandatory retirement age of sixty-
eight years (68).

c. Headquarters NYG will review all pertinent documents along with the officer or warrant
officer for transfer to the State Retired List, and issue the required orders.

3. Voluntary Retirement from Active Service.

a. Prior to Age Sixty-Eight (68)

(1) Any officer or warrant officer requesting early retirement prior to age 68 will be
responsible to contact Headquarters, New York Guard attention Commander, through their
Chain-of-Command, by submitting a letter stating such intention and the date such action is to be
put into effect.

(2) Awards and Brevets. In addition to recommendation on the request, Major


Commands will provide Headquarters NYG all recommendations and requests for awards or
brevet promotions, IAW appropriate directives, approximately ninety (90) days before the actual
retirement date.

(3) Headquarters NYG will review all pertinent documents along with the officer or
warrant officer for transfer to the State Retired List, and issue the required orders.

b. Ten Years in Grade or Fifteen Years of Service.

(1) Any commissioned officer or warrant officer who has served in the same grade for
the continuous period of ten years, or in the military or naval service of the state as a
commissioned officer for fifteen years may request early retirement, and will be responsible to
contact Headquarters, New York Guard attention Commander, through their Chain-of-
Command, by submitting a letter stating such intention and the date such action is to be put into
effect.

(2) Awards and Brevets. In addition to recommendation on the request, Major


Commands will provide Headquarters NYG all recommendations and requests for awards or
brevet promotions, IAW appropriate directives, approximately ninety (90) days before the actual
retirement date.

(3) Headquarters NYG will review all pertinent documents along with the officer or
warrant officer for transfer to the State Retired List, and issue the required orders.

4. Retired List Time: Time spent on the state retired list shall not be credited in the
computation of seniority, pay, length of service for promotion or otherwise or any of the
privileges and exemptions pertaining thereto, except that the time during which he served on
active duty by order of the governor shall be so credited.
