O artigo objetiva identificar aspectos da concepção de moralidade que orienta o procedimento administrativo de exame dos pedidos de registro de marcas pelos analistas do INPI. Em especial, nos interessam os sinais que foram indeferidos por terem sido classificados como ofensivos à moral e aos bons costumes. Neste sentido, o cerne da análise se volta para os casos em que os pedidos de registro foram negados com base inciso III, do art. 124, da Lei de Propriedade Industrial, que fixa que não são registráveis como marca “Expressão, figura, desenho ou qualquer outro sinal contrário à moral e aos bons costumes ou que ofenda a honra ou a imagem de pessoas ou atente contra liberdade de consciência, crença, culto religioso ou ideia e sentimento dignos de respeito e veneração”. This paper is focused on the topic of industrial property and private international law. Currently the industrial property relationship often has an international element. The Czech Republic law system include national law system (legal rules), supranational law system (the European Union law rules /primary and secondary/) and the Czech Republic is a member a lot of international agreements. Those agreements are global (example could be PCT) regional (EPO), open (the Paris convention) and relatively open (limited by territoriality such as EPO or limited by the membership in the European Union such as Unified Patent Court). Next international agreements are bilateral. Industrial property is around the world unified by the international agreements. This paper is given information about current situation in the industrial property field with international element in the Czech Republic.

O artigo, apresentado no II Congresso Internacional de Marcas/Branding, em Lajeado (RS), no dia 01º de outubro de 2015, objetiva desvelar aspectos da concepção de moralidade que orienta o procedimento administrativo de exame dos pedidos de registro de marcas pelos examinadores do INPI. Em especial, nos interessam os sinais que foram indeferidos por terem sido classificados como ofensivos à moral e aos bons costumes. Neste sentido, o cerne da análise se volta para os casos em que os pedidos de registro foram negados com base inciso III, do art. 124, da Lei de Propriedade Industrial, que fixa que não são registráveis como marca “Expressão, figura, desenho ou qualquer outro sinal contrário à moral e aos bons costumes ou que ofenda a honra ou a imagem de pessoas ou atente contra liberdade de consciência, crença, culto religioso ou ideia e sentimento dignos de respeito e veneração”. Mas que moralidade é essa? Em levantamento efetuado no banco de dados do Instituto Nacional da Propriedade Industrial (INPI), referentes a pedidos de registros de marcas depositados entre setembro de 1987 a outubro de 2009, encontramos 360 casos de marcas que foram negadas por terem sido classificadas como infringentes ao inciso supracitado. A partir do estudo desse material, estruturamos o presente texto na tentativa de mapear os fatores que influenciam nas decisões denegatórias dos examinadores de marcas. O resultado pretendido será o de identificar se há, nos dados coletados, um padrão moral subjacente às decisões da instituição, tomadas por suas duas instâncias administrativas.

Among the most important factors that indicate the level of development of a state's economy are the industry and commerce in the globalizing world, rapidly increasing competition conditions rendered the protection of industrial property rights indispensable and the necessity raised to distinguish a product from others. For this reason, a significant part of the economic activities of today's states consists of industrial property rights and their protection. Turkey carried out very significant and serious works recently on both improving the national legislation and participating in the international agreements on industrial property. In Türkiye, Turkish Patent Institute being the only public institution fulfilling official registration of industrial property rights, in order to gain safety and legal acceptability for the internet application system, an electronic signature and time stamp integration is fulfilled, in August 2007 online trademark application with e-signature, after that, in January 2008 online patent and industrial design application with e-signature and in April 2008 trademark, patent and industrial design application with e-signature has been serviced. Today humanity is immersed in the knowledge society, so that intangibles have acquired great value throughout the world. This has contributed to globalization and the emergence of economies founded on knowledge and technological development, which have led to the emergence of new intellectual products that generate industrial property rights. The ownership of these industrial property rights has determined the development and economic advancement of countries, but also an absolutely heterogeneous growth between them, as a differentiating element is contemplated, the science and technology they possess. It is therefore in permanent debate whether industrial property is a mechanism of technological development, based on economic recognition of the institutions and their inventors for the science and technology they generate, or whether it is a form of privatization of knowledge and a new Technological colonialism. Resúmen Actualmente la humanidad se encuentra inmersa en la sociedad del conocimiento, por lo que los intangibles han adquirido gran valor en todo el mundo. Para ello ha contribuido la globalización y la aparición de economías fundadas en el conocimiento y el desarrollo tecnológico, que han motivado la aparición de nuevos productos intelectuales que generan derechos de propiedad industrial. La titularidad de estos derechos de propiedad industrial ha determinado el desarrollo y adelanto económico de los países, pero también un crecimiento absolutamente heterogéneo entre ellos, como elemento diferenciador se contempla, la ciencia y la tecnología que poseen. The Law 9,991/2000 can be considered a milestone in the history of the ANEEL R&D Program, which was created to stimulate the technological development of the Brazilian Electricity Sector. Around R$ 4.5 billion were already invested in the program, covering more than 6,000 projects. Considering the amount of resources involved, the present study aimed to evaluate the results of this program, after the Law 9,221/2000, using industrial property indicators as a measure of performance. The research was based on a survey of the applications for patents and industrial designs, filed in the Brazilian Patent Office (INPI), by the 117 companies operating in the electricity generation segment. The findings showed: the companies that had at least one patent or industrial design application filed in the INPI after the Law 9,991/2000; the type of protection requested; and if the content of the application was related to the goals of the program.
