Özet Hadis ve fıkhın erken dönemiyle ilgilenen oryantalist araştırmacıların Muvatta' hakkında önemli bir literatür oluşmasına imkan sağlayacak kadar sayıda eser kaleme aldığını söylemek mümkündür. Bu çalışmalar arasında özellikle Muvatta'ın ortaya çıktığı dönemi tartışması itibariyle kendisinden sonra pek çok kitap, makale ve değerlendirmenin yazılmasına neden olması sebebiyle Norman Calder'ın Studies in Early Muslim Jurisprudence adlı eserini zikretmek önem arz etmektedir. Bu makalede Calder'a eleştiriler yönelten araştırmacılar arasında özellikle Wael B. Hallaq ve Harald Motzki'nin tenkidleri ele alınarak hem Oryantalist paradigmanın içerisindeki ilmî ve fikrî süreklilik ortaya konulmuş hem de Oryantalist araştırmacıların tamamının aynı fikre sahip olduğu ve onlar tarafından kaleme alınan her eserin benzer sonuçlar içerdiği şeklinde genellemeci bir yaklaşımın yol açacağı muhtemel hatalara dikkat çekilmiştir. Oryantalist paradigmanın hadis ilminin temel bir problemi hakkındaki yaklaşımını tespit edebilmenin, ancak ilgili mesele etrafında ortaya çıkan çalışmaların tamamını bir arada görmek ve değerlendirmek ile mümkün olabildiği düşüncesini ortaya koymayı amaçlayan bu makale, söz konusu literatürden istifade etmek isteyen bilim insanlarına bir yöntem ve perspektif sunmayı da ön görmektedir.

It is possible to say that the orientalist researchers who showed a particular interest in the early period of hadith and Islamic jurisprudence have written enough to form a significant literature on Muwatta'. Among these works, Norman Calder's Studies in Early Muslim Jurisprudence is worthy of note, for it discusses the period in which Muvatta' emerged and his book is widely discussed in many books, articles and reviews. In this article, the scientific and intellectual continuity within the orientalist paradigm will be discussed, as well as the possible mistakes caused by a generalist approach asserting that all orientalist researchers have the same mindset and each study made by them arrives at similar conclusions. The subject will be handled through the criticisms made researchers for Calder; especially Wael B. Hallaq and Harald Motzki. This article aims to present the idea that the only way to determine the approach of the Orientalist paradigm on any fundamental issue of the science of hadith, all of the studies ever done in that particular subject must be evaluated together. It also aims to provide a method and a perspective to researchers who want to benefit from orientalist literature.

This article aims to determine the reasons for differences in approaches of Muslim and Western ḥadīṯ scholars to ḥadīṯ literature. Since it is recognised that Orientalists do not consititute a coherent group in this respect, they are classified into three groups embracing either skeptical , revisionist or middle-ground positions. A further question to be explored is what enables to identify an Orientalist and Islamic paradigm despite the existence of various groups in both scholarly traditons. For this purpose, the article attempts to determine the premises upon which Muslim and Western scholars base their studies.

CRITIQUE OF THE COMMON-LINK THEORY BASED ON LEGAL MARFŪ‘ AHADĪTH

      The methods of dating traditions developed by Western scholars are of great importance in terms of being proposed as alternatives to classical hadīth methodology. In this respect, the value of these methods compared to Islamic hadīth criticism inevitably becomes a question.
      In the present study, the common link theory is examined and tested based on the matn cluster of hadith al-'Uraniyyin. Although Joseph Schacht, the architect of the theory, and G. H. A. Juynboll, one of the most important defenders of the theory are among the skeptical orientalists, Harald Motzki, who applies the theory on the axis of the correlation between isnāds and matns outside the Schachtian interpretation is a middle-ground orientalist, and dates ahadīth to relatively earlier periods than his predecessors did. In the present study, the possibility to interpret common link-based isnād-matn analysis (isnad-cum-matn analysis) outside the premises of the orientalist paradigm -as Motzki does in terms of the Schachtian common link theory- is discussed. It is aimed to show that the correlation between isnāds and matns points to the history of hadīth transmission as a historical and 'organic' process not as a fiction as is presumed by some orientalists, and to determine the reflections of the history of hadīth transmission and the systematization of hadīth education on the isnāds and matns. In addition, it became possible to make an evaluation about rijāl literature through the comparison between the results obtained from the isnād-matn analysis and the information in the rijāl literature.

It is possible to say that the orientalist researchers who showed a particular interest in the early period of hadith and Islamic jurisprudence have written enough to form a significant literature on Muwatta'. Among these works, Norman Calder's Studies in Early Muslim Jurisprudence is worthy of note, for it discusses the period in which Muvatta' emerged and his book is widely discussed in many books, articles and reviews. In this article, the scientific and intellectual continuity within the orientalist paradigm will be discussed, as well as the possible mistakes caused by a generalist approach asserting that all orientalist researchers have the same mindset and each study made by them arrives at similar conclusions. The subject will be handled through the criticisms made researchers for Calder; especially Wael B. Hallaq and Harald Motzki. This article aims to present the idea that the only way to determine the approach of the Orientalist paradigm on any fundamental issue of the science of hadith, all of the studies ever done in that particular subject must be evaluated together. It also aims to provide a method and a perspective to researchers who want to benefit from orientalist literature.

Batı’da Ignaz Goldziher’le (1850-1921) birlikte isnâdların hadislerle ilgili değerlendirmelerde dikkate alınmaması yaygınlaşmışsa da hem Goldziher’den önceki dönemde Alois Sprenger (1813-1893) ve William Muir (1819-1905) gibi isimler hem de sonraki dönemde J.H. Kramers (1891-1951) ve Joseph Schacht (1902-1969) gibi oryantalistler  isnâdlardan belirli sınırlamalarla birlikte yararlanma yoluna gitmişlerdir.  Söz konusu sınırlamaların en dikkat çekeni tek râvîli ilerleyen tarîklerin  güvenilmez kabul edilmesidir. Schacht geliştirdiği müşterek râvî teorisi ile müşterek râvîlerden önceki döneme ait kişilerin yer aldığı tek râvîli tarîklerin tarihîliğini  reddetmiş ve bu konuyla irtibatlı olarak yayılma kavramını geliştirmiştir. Müşterek râvî teorisini ondan alarak üstlenen G.H.A. Juynboll (1935-2010) ise hem müşterek râvî öncesi hem de sonrası tek râvîli tarîklerin sıhhatini reddederek, esasen mefhûm olarak ilk defa Schacht’ta görülen “dalış”ları kavramlaştırmış, ayrıca “örümcek” adını verdiği isnâd yapılarının bu tür dalışlardan mürekkep tarihlendirilemez isnâdlar olduğunu iddia etmiştir. Bu tebliğde müşterek râvî teorisi bağlamında geliştirilen yayılma, dalış ve örümcek kavramlarından hareketle tek râvîli isnâdlara yöneltilen eleştirilerin, klâsik İslâmî paradigma içerisinden yürütülecek isnâd-metin analizi ile çürütülebileceği gösterilecek, ayrıca bu konuda, isnâd-metin analizini oryantalist paradigma içerisinden uygulayan Harald Motzki gibi oryantalistlerin görüşlerinden ve ulaştıkları sonuçlardan da istifade edilecektir.

It has been the prevalent idea among orientalists that Islamic historical and religious literature appeared from the early-third century A.H. onwards and reflected the political and religious divisions in the Islamic community. In this book, Motzki goes against this idea and suggests that that early Islamic literature can be dated to the end of the first and the beginning of second centuries A.H. Motzki develops this thesis by studying Ibn 'Abbas' traditions that have been considered suspect by the Western researchers for he lived with the Prophet Muhammad for a limited time.
