The user has uploaded only these 5 photos : Unknown location : what is MME ? in what country ? On Google, CISMA is said to be a French company, but on the photos, the posters are in English ! ; generic file names without information (a warning has been sent to the user about that) ; too short descriptions ; no use ; so no encyclopedic value.

Promotional image published in 1974, but the claim by the uploader that it was distributed without copyright notice is suspect. The original uploader is currently blocked on enwp for socking, and a Tineye search led to a copy at Getty with a clearly visible copyright notice.
It is conceivable that these are two different images (or that Getty has `shopped in a retconned copyright notice, I suppose), but in light of other bad-faith behaviour by the uploader it seems probable that the uploaded version was deliberately cropped to hide the copyright notice. It may also be appropriate to apply closer scrutiny to this user's other uploads. Xover (talk) 09:14, 19 March 2018 (UTC)

- Proper date and author have been given for File:FRAD034 1 T 902 Archives départementales de l'Hérault. Fonds du rectorat de l'Académie de Montpellier.pdf ; it is from 1769 so obviously PD, I think it would have been better to correct the file than to start a deletion request ;
- More information is needed for File:Portrait de Jeanne Galzy âgée de 18 ans.jpg ; it is possible that the creator died later than 1947 (so more than 46 years after this artwork has been done) ; Tatakdh do you know who the creator was ?
- Keep No reason to think that it's not PD and that the Archives départementales de l'Hérault are wrong about it ! --TwoWings * to talk or not to talk... 11:40, 31 March 2018 (UTC)

This is most likely someone else's work. It was previously posted on a blog on 17 December 2014. Authorship would probably be Alain Kaiser on the behalf of the Opéra du Rhin. However, that's just my guess. I could not find sources confirming the certainty. Or maybe it belongs to Nicholas Descoteaux or Bruno de Lavenère. I'll contact either of them or the Opera to find out for sure. George Ho (talk) 01:54, 19 March 2018 (UTC)

This file was initially tagged by Krdbot as Copyvio (Copyvio) and the most recent rationale was: external source, no license, no permission. This comes from a US gov. website. OK or not? Yann (talk) 07:04, 19 March 2018 (UTC)
I wasn't sure whether the picture came from a government domain that was still commissioned and secure even though the link was determined as nonsecure. I'm also not sure whether using images from a government site are considered a copyright problem either? If it is considered coming from a US gov site, then yes, I would like to put it under the US gov. website license. BenDVu (talk) 18:42, 20 March 2018 (UTC)
- Hi BenDVu,
- It doesn't matter if the website uses HTTP instead of HTTPS (encryption).
- Coming from a government website is a clue, but it is not sufficient. Could you please find out if the author (Kent Sullivan?) is an employee of the US federal government (Commons:Copyright rules by territory#Works by the US Government)? Please add a license (see COM:USGOV for a list of licenses). Thanks, Yann (talk) 03:53, 21 March 2018 (UTC)
I went into the site and found out that Kent Sullivan is an Assistant Attorney General for the State of Alaska under the Department of Law. This is the website: http://law.alaska.gov/press/releases/2013/032013-RS2477.html I'm not sure if this would be sufficient information to consider the author of the photograph as an employee of the US federal government.Vu (talk) 20:26, 23 March 2018 (UTC)

This was previously listed as part of a mass deletion, but this seems to be a case of a derivative work of a copyrighted photograph. This is a drawing based on a William Coupon photograph here. Per Commons:Copyright rules by subject matter#Drawings based on_photographs, requires permission from the original photographer. Ytoyoda (talk) 16:08, 19 March 2018 (UTC)
- As I wrote previously this is a cartoon or caricature and in no case a realistic drawing just based on a photograph, Ytoyoda has tried several times to discredit my contributions so please read my comments on this subject about his previous attempt to delete this drawing on the discussion page where I explain my point of view. --Jacquelinekato (talk) 18:54, 19 March 2018 (UTC)
- I should point out that the Jacquelinekato is incorrect on a couple of points.
- I've made one previous deletion request, which was closed as "no consensus".
- I have made no attempt to discredit the user's contributions. I've merely pointed out that the user's contributions are either out of scope (non-notable artistic work) and/or not freely licensed as they are derivative works of copyrighted works.
- I'd ask the user to assume good faith. And yes, we can see that it's a caricature, but it's still caricature based on copyrighted work. Ytoyoda (talk) 19:59, 19 March 2018 (UTC)
- Delete I assume good faith with both of you, but agree with User:Ytoyoda on this drawing. The posture, expression, hair form, position of the hands and the colours of this drawing are exactly similar to the photograph by Coupon. But I hope User:Jacquelinekato is willing to make a new drawing of Basquiat that is distinct from this photograph. Vysotsky (talk) 20:12, 19 March 2018 (UTC)

- A drawing doesn't have to be a clear pixel-for-pixel recreation to be a derivative work. Ytoyoda (talk) 20:04, 19 March 2018 (UTC)
- Obviously you don´t understand that this particular cartoon has only a vague resembance with the photo you posted and therefore is not a derivative work. --Jacquelinekato (talk) 00:44, 21 March 2018 (UTC)
- I don't really appreciate your condescending tone. As for your response, it doesn't matter that it's a caricature or that it's stylized, it is based on a copyrighted image. Given that the uniform, facial expression, body position, ball design, and even the bracelet are the same, I don't think you can make a reasonable argument that there's only a "vague resemblance". Ytoyoda (talk) 15:12, 27 March 2018 (UTC)
- Ridiculous. If you consider my cartoon to be derivative art you have to consider the whole photo, and 2/3 of the photo consists of the playing field and the public in the background which are not depicted by me. That means only 1/3 of the photo consists of the depiction of the player. And here: Pattern and position of the shorts are very different (for example no number 10 is depicted on the photo), position of the feet and legs are also very different (in fact in my drawing Zidane has the right leg and foot in front and the left behind, exactly in opposite to the photo). The ball is much bigger and nearer to the player in my drawing, also, in case you missed it, there is a different pattern on the ball. Also in my illustration Zidane´s face is entirely visible, on the photo he is photographed in profile. The face in my drawing is much bigger than on the photo because it is a cartoon and not a realistic drawing. I also have to add that there are hundreds of photos in the web with Zidane playing in exactly the same football dress, a famous one, because he won the World Cup in 1998 with this wear which I, by the way, have bought. Therefore: distant resemblance, no derivative art. Jacquelinekato (talk) 22:11, 27 March 2018 (UTC)

I didn't find a photo similar to this drawing. It looks as if the draughtsman made a drawing based on several images, but from his own interpretation. Vysotsky (talk) 19:14, 19 March 2018 (UTC)
- @Vysotsky: I find it hard to believe face isn't based on this EFE-sourced photo - see position of cigar, exposed teeth, wrinkles around mouth, etc. And a drawing based on multiple photographs is still derivative work. Ytoyoda (talk) 20:03, 19 March 2018 (UTC)
- Comment See this completely different photograph: also Pío Leyva - see the position of the cigar, the exposed teeth, the wrinkles around the mouth. Perhaps the draughtsman has well understood Leyva's features when smoking -and given his own interpretation, which doesn't make the drawing derivative. Vysotsky (talk) 20:22, 19 March 2018 (UTC)

- Hello, Ruff tuff cream puff. I am FredD, a professional marine biologist, and I am used to uploading files given by colleagues, with their authorization. You won't find these files anywere else on the web before I uploaded them. The OTRS system is too heavy to use each time, so I do OTRS tickets only for people uploading a massive number of pictures. As the uploader, I take the entire responsibility of this, and for over 10 years I've been doing so there has never been any author complaint about my uploads, and many of the pictures I upload are extremely precious for WP as they illustrate biological groups that have no other illustration on the whole internet. I have discussed this method many times with other contributors and it always went OK. If you have any better idea, tell it to ME before setting a deletion request and putting in danger such a big work and all in my back. Of course I can provide to you the e-mail address of every photographer who send pictures to me if needed. Best regards, FredD (talk) 04:38, 21 March 2018 (UTC)
- I have no idea who you are or what you do, I just saw photos that seem to be created by someone other than the uploader, so I tagged them just as I tag anyone else's uploads. It's not personal, it's Commons policy and it's how prevent copyright violations. There was no disclaimer on the photos indicating "don't nominate this for deletion, come to me first" so how would I know. I do appreciate what you are doing, but at this time we can't tell if we have permission from each photographer. What happens to the images is not up to me at this point. Thanks, Ruff tuff cream puff (talk) 15:18, 21 March 2018 (UTC)
- There is a reason why the name of the uploader is available too, but fair enough. Can you please end the request then ? Thanks and br, FredD (talk) 05:41, 25 March 2018 (UTC)

Deleted: per nomination; Uploader is not correct to upload images created by other people, and the OTRS system is not "too heavy to use each time", it's Commons policy. Uploaders don't get to not do whatever they think is cumbersome to participate in Commons, in much the same way that drivers do not have the right to ignore traffic signals while driving. --Ellin Beltz (talk) 15:34, 1 April 2018 (UTC)

[edit]The full image is essentially the one used by Cruz on her campaign website. City Limits credits the image to "Catalina Cruz for Assembly". It's used by various other news outlets reporting on Cruz. Thus the uploader is unlikely to be the copyright holder. We'll need to confirm whether copyright belongs to the photographer (apparently given in the metadata) or the campaign and, if appropriate, confirm permission via OTRS. - Keep at least those that depict Wikipedia-related events. Although not categorized as such, and perhaps of little use otherwise, they may be of interest to WMF outreach projects, the local chapter, &c.—Odysseus1479 (talk) 07:16, 19 March 2018 (UTC)
Kept most, deleted two, see comments on the individual files. With regard to the small size, low quality and metadata "Google" of many of this user's uploads, I'm of course suspicious, but still want to give him the benefit of the doubt and assume that these photos are his own work nevertheless - probably taken with a mobile phone and processed through some Google application. They're topically consistent with a focus on a Wikipedia-related event at the Université Kofi Annan de Guinée where the uploader apparently was a participant. - Comment I kept some of these files in the last deletion request; see my reasoning in the closing statement of 2 April 2018. But if now another admin, given the uploader's history, comes to a different decision, maybe based on COM:PRP, I think that would be acceptable, too; I won't protest. Files uploaded by Fhsig13
[edit]Files were uploaded as "own work", but there are two copyrights which need to be taken into account here: the copyrights of the photos, and the copyrights of the two medals shown in the photos.
It's possible that the photos were taken by the uploader, but there's no EXIF data provided to really help verify that is the case. The same or similar photos of these medals can also be seen online here, here and here, so it's also possible that the uploader is not the original source of the photos.
In addition to the copyrights of the photos, the copyright status of the medals depicted in the photographs also need to be taken into account. If medals such as these are considered to be a type of jewelry or otherwise 3D work of art, then they may be subject to copyright protection per COM:CB#Jewelry and COM:CB#3D art (sculptures etc.). It's possible that these medals are within the public domain, but this should not be automatically assumed. Even if the medals themselves considered to be in the public domain or otherwise not eligible for copyright, any photographs of them is likely to be considered a derivative work per COM:DW, which again brings us back to the copyright of the photos themselves.
Just for reference, eight other photos of medals uploaded as "own work" by Fhsig13 around the same time as these two were deleted by administrator Jameslwoodward as copyvios. The files can no longer be seen by non-administrators, but the reason why they were deleted can be found on their pages: File:6-ARMY-CADET-SERVICE-MEDAL.png, File:Order-of-St-George.png, File:CadetCert.png, File:4-MAJOR-GENERAL-W.A.-HOWARD-MEDAL.png, File:Afa2.png, File:3-ROYAL-CANADIAN-LEGION-MEDAL-OF-EXCELLENCE.png, File:Bravery medal1-copy.png, File:ANAVETS.png.
It also should be noted that the uploader is currently under block, but that block should run out sometime today or tomorrow, so they should be able to respond to this nomination at that time. -- Marchjuly (talk) 02:13, 7 February 2018 (UTC)
- "12:41, 2 February 2018 Jameslwoodward (talk | contribs) deleted page File:ANAVETS.png (These images are all taken from http://2313cadets.ca/corps/awards/ which is " ©2313 Royal Canadian Army Cadets Corps, 1948-2018. " -)"
- I think @Jameslwoodward: is wrong here. These cannot be considered creative photographs, these are scans. Although it does not matter, it is in fact plausible they literally used a flatbed scanner to create these images. With this rationale you can also remove the Mona Lisa and other works of art.
- These can't really be considered "useful objects" or anything like that, so in my opinion copyright can probably apply to the medals themselves. Commons:Copyright rules by territory#Canada states "Works subject to Crown Copyright enter the public domain 50 years after publication". So if the design of any of these medals is more than 50 years old, they are PD. "own work" is obviously wrong though, so that needs to be fixed. - Alexis Jazz 03:16, 7 February 2018 (UTC)
- Our clear policy is that Bridgeman applies only to 2D works. It is also our clear policy that images of medals, which are photographically very similar to coins, are copyrighted, see Commons:Currency, where it says,
- "Attention: a photograph of a coin has two requirements before it can be included. The first is that the design of the coin itself is not copyrighted, or permission has been obtained. The second is that the photographer agrees to license it under a free licence."
- . Jim . . . (Jameslwoodward) (talk to me) 11:25, 7 February 2018 (UTC)
- @Jameslwoodward: I'm sorry, I understand the confusion but you haven't got the complete picture here.
- Commons:When to use the PD-Art tag#Photograph of an old coin found on the Internet: "Coins are essentially 3D articles, and there is likely to be sufficient creativity in the lighting arrangements for the photographer to obtain a new copyright on the image."
- w:Wikipedia talk:Non-free content/Archive 25#Photographs of ancient coins The Bridgeman decision said that "Elements of originality [that would qualify a photograph for copyright protection] may include posing the subjects, lighting, angle, selection of film and camera, evoking the desired expression, and almost any other variant involved."
- So if I put a coin in a flatbed scanner (or make a photo because I can't afford the scanner and I eliminate all creative input to mimic the scanner with my camera), I don't get new copyright. What you say applies when taking a photo where some creativity is involved. Now if you look at the pictures of the medals, there is no creativity at all and they were quite possibly just put in a flatbed scanner. When something is a slavish copy it gets no new copyright - this is the case here.
- The copyright on the medals themselves is a different story, their design needs to be 50 years for Canada and some probably longer term for the US. - Alexis Jazz 14:39, 7 February 2018 (UTC)

- You are looking for logic and consistency in copyright law. Good luck. The "slavish copy" language comes from Bridgeman, which does not apply everywhere. In much of Europe the statutes provide that you create a new copyright by taking a photograph of a painting. However, to some extent that is beside the point. Commons policy at the moment is that coins are 3D objects and that Bridgeman does not apply. I think that makes sense. We cannot have a rule that says that a photo of a coin with good lighting that shows its detail is not OK for Commons, while an image made on a scanner is OK. However, if you want to change the rule, go ahead and try, but please don't expect to get a variance from a well established rule here. This is not the place for rule changes. . Jim . . . (Jameslwoodward) (talk to me) 21:55, 7 February 2018 (UTC)
- @Jameslwoodward: The rules are fine. We just need to interpret them correctly. Admittedly there is a lot of grey area here.
- "Attention: a photograph of a coin has two requirements before it can be included."
- Does not mention a scan. Put it this way: if Fhsig13 aquires those actual medals, puts them in a flatbed scanner and the resulting image is virtually identical to the pictures now up for deletion. Will you nominate them because they can't be told apart from images already on the internet?
- Photographs that try to mimic a scanner may be a grey area, and with scanner-apps for phones and tablets that gets even more complicated.
- "A picture of a 3D-object creates in most jurisdictions a new copyright on the picture, something that is not the case when photographing pure 2D-objects."
- This is because the angle is completely irrelevant for 2D-objects. Any angle is nothing but a distortion. But when you put an object that has a (mostly) flat side in a scanner, you are equally eliminating the angle/lighting. If we were to attribute copyright to anyone besides the author of the coin/medal, it should be the scanner manufacturer. (like Canon) We don't do that.
- Coin pic from internet: "Coins are essentially 3D articles, and there is likely to be sufficient creativity in the lighting arrangements for the photographer to obtain a new copyright on the image. The WMF General Counsel has indicated that in his view coin images do not fall under Bridgeman v. Corel and hence are copyrighted"
- I agree when coins are laid out on a table, when there is an angle, when there was put any thought into the lighting of the object. When you just dump 'm in a scanner, that's not creative. Anyone putting the same object in a scanner will get the same result. Maybe some countries consider that to be creative, but it's pretty silly if you ask me. (but sure, some countries are silly) Here on Commons the usual practice appears to be that when something is a "slavish copy" and the subject is PD, we don't care where the photograph/scan was made. And I don't believe we would help the project in any way if we did. Just to be clear: it would have taken very little for me to agree with you. If some tablecloth had been visible in the background of the medals, I'd possibly already agree. If there were any angle suggesting the image couldn't have been made with a scanner, I'd agree. - Alexis Jazz 13:27, 8 February 2018 (UTC)

Again, everything you say makes sense but for two problems -- first this is the wrong place to be arguing about Commons policy -- we don't change policy for individual images. Second, as I said above, a policy that allowed scanner images of coins but not photographs of coins would be impossible to manage. Commons always errs on the side of protecting the copyright, so we do not keep images of 3D art, medals, and coins, unless the image is freely licensed. . Jim . . . Keep - @Jeff G.: As has been pointed out by me and others in the discussions above, quality is IRRELEVANT in these matters, so long as the image fulfills it's purpose. Secondly, there is no copyvio here, as I made these using actual pins and paint.net's software for the black background. I should add that I am willing to produce better quality versions if need be, as these were produced rather rapidly, so I admit that quality did take a bit of a back seat on File:RCSD FSGT.jpg, however the rest turned out alright. - @Fhsig13: Who designed the pins, when and where? — Jeff G. ツ please ping or talk to me 01:34, 7 August 2018 (UTC)
- @Jeff G.: I wouldn't know, and besides, they aren't used as army pins in these images, they are rank insignia, worn on epaulets and as collar insignia by members of the Richland County, South Carolina, Sheriff's Department. Secondly, I also edited the images I took of the pins heavily, including the backgrounds, and on File:RCSD SR CPL.jpg, I removed a chevron, as no such actual pin exists, as the deputies that wear that rank wear it as slip-ons only. That said, if anything, the ORIGINAL design for the pins is probably belongs to the US Army or the US Government, however that isn't entirely relevant here, as we're discussing the image in it's entirety, not simply the bits and pieces. That would be like requesting deletion on the cover art of a movie, because a character in it is holding a pop can with the Coke logo visible...it's unnecessarily subjective. - @Jeff G.: Even from that perspective, they aren't copyvios. They've been adapted and heavily altered, not to mention that they are self-taken and edited photos, not copied from anywhere, which allows me to claim "own work", on the grounds that I created everything in the image, aside from the original pin design, however we still haven't proven conclusively what the copyright status on them is, and even so, they were created more than 50 years ago for sure, making them PD at best. Fhsig13 (talk) 20:14, 8 August 2018 (UTC)
- The copyright status of the original pin design needs to be taken into account. You can take a photograph of a copyrighted object and possibly create a derivative work in doing so, but this doesn't void the copyright status of the original work. "Own work" basically means you created the work from start to finish; it doesn't mean you photographed something that someone else created, adapted/altered it in some way, and then uploaded it to Commons. Photographs of pins are similar to COM:CB#Jewelry and Commons can't keep such photos if the underlying work is still considered to be protected by copyright, unless permission of the copyright holder of the original work has been received. Having posted that, it's possible that these pins are either too simple in design or too old to be considered to be eligible for copyright protection, so it would help if you can provide more information about them. To me, they look like they might be {{PD-shape}}, but others might feel differently. As for their age, 50 years is not really a long time in terms of copyright eligibility and often more time needs to pass depending upon the country of origin and the type of work as explained in Commons:Hirtle chart. Finally, not having proven conclusively what the copyright status of something is actually often cited as a reason for deletion per COM:PCP; this is why it's important to know more about the pins if possible. As you pointed out above, the original design might be actually based upon something the US Army created, but this needs to be clarified. -- Marchjuly (talk) 01:04, 9 August 2018 (UTC)
- @Marchjuly: That all makes sense to me, and I feel your "derivative work" statement is especially pertinent here. That said, I am certain that we could easily source out the origins of the pins and when they were created, as the US Army is usually pretty good at keeping that info handy. Fhsig13 (talk) 05:35, 9 August 2018 (UTC)
- If the original imagery is PD for some reason, then most likely these files are also going to be PD because it doesn't look as if you've done enough to create a derivative which has its own copyright. Simply photographing, scanning, copying, etc. a PD work is generally just considered to be a mechanical reproduction, which is not eligible for it's own copyright. Think of it as simply priniting out some PD image you find online where all you really do is press "print image" in comparison to when you take the image and add it to a larger perhaps more complex work where some creativity is involved. Most likely another person can use the software you used or similar software to add a color background, so that's probably not enough to generate a new copyright; however, if you used the image in a collage of other images or altered in some other way to essentially create a new work, then that's probably a derivative. Technically, you probably shouldn't claim a mechanical reproduction of PD content as "own work" since that implies it's copyrightable and that you're just agreeing to release it under a CC license; however, making such a claim is just for practical purposes a minor mistake which can usually be resolved by just tweaking the license. Things only become more complicated when you claim copyrighted content created by others as your 100% "own work". You can claim the copyright on any derivative you create, but you cannot claim copyright ownership of any individual elements you didn't create. So, even though you might be able to use those elements under the concept of en:fair use or en:fair dealing in your work out in the real world, you cannot really release your work to Commons under a free license without the permission of the original copyright holders of those individual elements because Commons doesn't accept fair use content. Perhaps there's something similar to these files found in Category:Law enforcement insignia in the United States which is similar enough to these files which can be used instead or which can be altered to match these files. -- Marchjuly (talk) 06:24, 9 August 2018 (UTC)
- @Marchjuly: I disagree completely. I didn't just take photos of the pins and upload them, I altered backgrounds, I added and removed chevrons, and more. I would claim that I HAVE done enough to create derivative works here, and that irregardless, the design is likely PD. Fhsig13 (talk) 19:37, 9 August 2018 (UTC)

- @Fhsig13: It's more like example 7. — Jeff G. ツ please ping or talk to me 03:10, 7 August 2018 (UTC)
- @Jeff G.: How can you even make that point?? Each was used once in the article, and I think it qualifies as de minimis, under the 5th example. Fhsig13 (talk) 03:03, 7 August 2018 (UTC)
- @Fhsig13: None of these designs appear to be used in a de minimis fashion. — Jeff G. ツ please ping or talk to me 02:46, 7 August 2018 (UTC)
Fhsig13 (talk) 02:32, 7 August 2018 (UTC)
- Delete the quality is too, making them out of scope. Uploader should upload the full images, not put them through paint.net--BevinKacon (talk) 21:13, 7 August 2018 (UTC)
- @BevinKacon: As much as I'd like to do that, photo editing software was the easiest way to add the black background, and I assure you that that isn't what damaged the image quality, save perhaps for File:RCSD FSGT.jpg, however I could likely correct this by removing the black background, tidying up the borders of the pin photo, and replacing the background, which would correct the "paint bleed-like" edges. Fhsig13 (talk) 22:16, 7 August 2018 (UTC)

- @Jeff G.: , @Alexis Jazz: I don't think that is resolved yet, and when it is I will likely take you up on your request, or make the backgrounds transparent myself. The state of the images as they stand shouldn't be reason for deletion, in my opinion, however. Fhsig13 (talk) 05:35, 9 August 2018 (UTC)

Is there a way that we could put this discussion on hold temporarily while I investigate this?
