SECTION NH-244: Work Order for Urgent Maintenance/Repairing work

Ref.:- Your quotation and subsequently discussion regarding the works.

Dear Sir,

With reference to the above and further discussion with you, we hereby place a Work Order for urgent
repairing work on Highway (Subgrade/GSB/WMM/DBM), Breast wall, Retaining wall & Removal of debris
our above mentioned Project work on the following rates and terms & conditions.

TERMS & CONDITIONS


1.0 General: -
M/s Shree Girrajjee Infra Heights Pvt. Ltd is executing work of “CONSTRUCTION /UP-GRADATION 2
LANE WITH PAVED SHOULDER FROM DESIGN KM 95.55 (BANDARKOOT) TO KM 111.06 (CHATTROO) OF
15.52 KM ON KHELLANI-KISHTWAR-CHATTROO SECTION NH-244”.

2.0 Scope of Work: -


The scope of the work will be urgent repairing/maintenance work on Highway
Subgrade/GSB/WMM/DBM), Breast wall, Retaining wall & Removal of debris as per Technical
Specification. The scope of work will be restricted to Section Km 95+550 to Km 111+066.

3.0 Mobilization: -You have to mobilize required manpower for executing the work within 03 days
after final discussion with us and issue of the Letter of Award.

4. Completion Period: -Time is the essence of contract and you should complete the work within I
months including monsoon period after issuance of work order.

5. Program: -You shall have to execute the work as per scheduled program & program discussed with
Project Manager.

6. Variation of Quantities:- The quantities mentioned in the BOQ are final and are not liable to vary to
any extent. The quantities varying will be executed at the same rates as agreed and no extra payment
will be made in this regard.

7. Curing Work:-Curing of RRM work in your scope and responsibility. Curing must be accomplished
using hessian cloth / water. The period of curing will be as per MoRT&H.

9. Quatity and Finishing:- The finishing of work so executed is the sole responsibility of the agency.
Rectification of the same will be done at no extra cost.

10. Safety:- Safety measures of your manpower and general public is the sole responsibilities of yours.
All the safety measures should be done as directed and to the satisfaction of the SGIHPL / Client
Engineer, Traffrc diversion will be responsibility of SGIHPL, cones and barricading will be provided to
you. The staff of the contractor shall wear safety jackets, shoes, helmets etc. while on duty and any
violation will athact a fine of Rs. 5,000/- for each incident. Failure to erect safety signage or trying to
carry out the works without proper precautions/safety measures as required will attract a fine of Rs.
5,000/- for each incident.

11. Quantity:-The quantities given in the Bill of quantities are estimated quantities. The basis of
payment will be actual quantities of work indented and carried out and valued at the rates and prices
tendered in the priced Bills of quantities, where applicable and otherwise at such rates and prices as the
Engineer may fix within the terms of Contract.

12. Measurement:-
All the measurements & Levels recorded jointly by the SGIHPL/CIient Engineer are to be accepted by
you. The Bill of quantities shall be read in conjunction with the Instructions to Contractor, Conditions of
Contract, Scope of Work and Specifications.

12.0 Billing:-
Billing will be done monthly at the end of the calendar month. You should submit the bill in the
prescribed format as per the joint measurements recorded, which will be limited to the measurement
accepted by Client.

13.0 Payments:-
The payment will be made within 5 days after the certification of the bill. Payment to be made only after
submission of PAN number. The rates and prices shall be quoted entirely in Indian Currency.
14.0 Accommodation & fooding:-
Accommodation & fooding for the statf @ site is the sole responsibility of agency. No extra payment will
be made in this regard. Tractor will be arranged for transportation of Labour and material by SGIHPL as
and when required.

15.0 Taxes:- All statutory deductions will be done from your payments.

16.0 Retention Money:- Retention Money of 5Yo will be deducted from every bill. No interest shall be
payable on the Retention Money. The Retention Money shall be released to after preparation of final bill
and acceptance of the same by the SGIHPL.

17.0 Rate:-The rates and prices tendered in the priced Bill of Quantities shall include all equipment,
plant, tools, spa.res, labour, supervision, overheads, consumables, materials, erection, maintenance,
testing of input material delivered, profit, taxes and duties together with all general risks, liabilities and
obligations set out and implied in the Contract and other incidentals to comply with the requirements of
technical specifications and scope of work.

18.0 GST monthly return to be submitted electronically. GST will be payable once your monthly return
is submitted.

19.0 Termination of Contract:- SGIHPL reserves the right to take back part of the work or the whole
work giving 2 days notice if
i) The agency fails to adhere to its approved work schedule or any other failure /misconduct to achieve
the same.
ii) The contractor is unable to mobilize the equipment in the stipulated time.
iii) The contractor will be terminated in case his staffs have an altercation/ quarrel /manhandling /
verbal abuse / threatening of the SGIHPL's / Client Engineer Staff.
20.0 Sub-Contractor obligation
The Contractor shall ensure that:
a) The Sub-Contractor shall arrange all skilled labour, supervisor, tools & tackles, etc
required for execution of the Work at its own cost.
b) While performing the obligation under this Work Order, the Contractor shall comply
with all labour / industrial laws / ESIS/ PF and other applicable laws, rules, regulations, orders and
also direction / instruction given by the concerned statutory authorities and indemnify the Client
against any / all losses / expenses incurred on observance of the statutory laws / regulation;
c) The Sub-Contractor shall ensure to pay minimum wages to the labour as fixed by
concern Govt. by the stipulated date, from time to time;
d) Sub-Contractor shall comply with the Contract Labour (Regulation & Abolition)
Act, 1970 and the Rules, 1971 framed therein in regard to all matters provided therein and
shall comply with the provisions of various Labour Laws and Acts such as Payments of Wages Act,
1963, Minimum Wages Act, 1948, Workmen Compensation Act, 1923, Industrial Disputes Act,
1947, Personnel Injuries (Compensation Insurance) Act, 1963, Labour cess Act, 1996 etc.
e) Payment against wages, labour benefits, whatsoever as provided in labour laws
& other laws of State, other incidental expenses for the welfare of labour etc. shall be sole
liability of the Sub-Contractor. If the Client has to make such payment as stipulated above on
behalf of the Sub-Contractor, the same shall be deducted from the bills of the Sub-Contractor or
security deposit, available with the Client;
f) In case of any accident to any workmen in the course of performance of Work
because of any reason, any compensation, if payable, shall be paid by the Sub-Contractor at its
own cost. No claim of the Contractor shall be entertained on this account;
g) The Sub-Contractor shall be responsible and liable for providing general site
security and taking safety measures within the Work area including its Camp and office area by
arranging necessary fencing, barriers, lighting, guard, watchman etc. to the satisfaction of the
Client.
h) The Sub-Contractor shall obtain approval of In-charge before starting the work &
acceptance of work order.
i) If diversion will require, it will be made by contractor its own cost.

21.0 Indemnify:- Contractor shall indemnify SGIHPL / Client against any losses and claims in
respect of injuries or damages caused to any person or material or physical damage to any
property whatsoever which may arise out of or in consequence to execution of the said work in
complying with any loss and statutory obligations. Any damage or losses arising thereof shall be
debited entirely to the account of contractor and SGIHPL shall not be liable for any losses or
damages.
