Reasons for Decision

Your application has been refused for the following reason(s):

You applied for entry clearance as a Skilled Worker Migrant under Appendix Skilled
Worker of the Immigration Rules. Your application has been refused, because you do
not meet the sponsorship, job at the appropriate skill level or tradable points
requirements.

You must be awarded 70 points to be granted permission as a Skilled Worker. This


includes 50 mandatory points and 20 tradeable points.

I have considered the mandatory points requirements and awarded you:

• 0 points for sponsorship


• 0 points for a job at the appropriate skill level
• 10 points for the English language requirement

I have considered the options for awarding tradeable points and I have awarded you
0 tradeable points.
I have awarded you 10 points in total.

Details of why I have not awarded you 70 points are set out below.

I have awarded you 0 points for sponsorship for the following reason.

SW 5.1. The applicant must have a valid Certificate of Sponsorship for the job
they are planning to do; which to be valid must: (e) not have been withdrawn
by the sponsor or cancelled by the Home Office;

SW 5.3. The sponsor must be listed as A-rated on the Home Office’s register
of licensed sponsors, unless the applicant was last granted permission as a
Skilled Worker and is applying to continue working for the same sponsor as in
their last permission.

It is noted that your Certificate of Sponsorship (CoS) C2G5U28446P was cancelled


by the Home Office on 19th June 2024 as your sponsor is no longer listed as A-rated
on the Home Office’s register of licensed sponsors.

Given that your sponsor is no longer listed as A-rated on the Home Office’s register
of licensed sponsors and your Certificate of Sponsorship has been cancelled by the
Home Office I am not satisfied that you have a valid CoS. Your application is
therefore refused under paragraph SW 5.1 (e) and SW 5.3 of Immigration Rules
Appendix Skilled Worker.

As I have refused your application under the sponsorship requirements, I have


therefore not considered if your application meets the requirements of SW 5.5 (a) (b)
(c).

I have awarded you 0 points for job at the appropriate skill level for the following
reason.

You must have valid sponsorship to be awarded points for a job at the appropriate
skill level, but you have been awarded 0 points for sponsorship. Your application is
therefore refused under paragraph SW 6.5 of Immigration Rules Appendix Skilled
Worker.

I have awarded you 0 points for tradable points for the following reason.

You cannot score tradeable points if you do not score points for sponsorship and a
job at the appropriate skill level. As I have awarded you 0 points for sponsorship and
a job at the appropriate skill level I have also awarded you 0 tradeable points.

After a discussion with an Entry Clearance Manager, I have chosen not to contact
you for further evidence as I am satisfied from the evidence submitted that you do
not meet the sponsorship, job at the appropriate skill level or tradable points
requirements and therefore I have awarded you 10 points out of 70 points in total.

I therefore refuse your visa application under paragraphs SW 4.2, SW 5.1, SW5.3,
SW 6.5, SW 8.1 to SW 8.5 and SW 14.1 to SW 14.5.

Next steps

Administrative Review

You have 28 days from the date on which you received this decision to apply
for administrative review.

You may only apply for administrative review if you think there has been a
case working error.

Immigration Health Charge


If you have paid the Immigration Health Charge it will be refunded:

• if you do not apply for administrative review within 6 weeks from the date you

determined.
