OVERVIEW OF THE LIVE LOCAL ACT

Background

The Live Local Act, also referred to as SB 102, is a comprehensive workforce housing initiative
which aims to increase the availability of affordable housing options. The legislation
introduces several new finance programs, land development and tax incentives, and
streamlined procedures for qualifying projects. SB 102 became effective July 2023 and was
recently updated in February 2024 through SB 328.

Provisions

One feature of the Act allows projects that provide at least 40% of residential units as
affordable as defined in State law at 120% of Area Median Income to utilize the land
development regulations from other parts of the City. The sites must be zoned as
commercial, industrial, or mixed use.

Example provisions for qualifying projects include:

• Density: the highest density allowed in the jurisdiction, which is 1000 dwelling units
per acre.
• Height: the height permitted within 1 mile “for a commercial or residential
development” (unless restricted due to adjacency to a T3 Transect Zone).
• FLR: SB328 introduces a new preemption for Floor Lot Ratio (equivalent to Floor Area
Ratio), prohibiting the restriction of FLR below 150% of the “highest currently allowed
floor area ratio”.
• Parking: requirements for parking are eliminated for mixed-use residential Live Local
Act projects within a Transit-Oriented Development (“TOD”) or area. Parking
requirements reduced by 20% for a project within 1/2 mile of a ‘major transportation
hub’ and has available parking within 600 feet.
• Process: A qualifying project is processed administratively but shall still be subject to
review by the Historic and Environmental Preservation Board, Urban Development
Review Board, and Wynwood Deisgn Review Board and, as applicable.
