Presented for consideration of the Body is Proposed Ordinance No. _____, S. of 2022
entitled “An Ordinance Providing New Water Services Billing Guidelines to All Consumers of
Municipal Economic and Enterprise Development Office, Thereby Repealing Municipal
Ordinance No. 21, Series Of 2021”.

Upon initiative of Hon. _____________________, and on his motion, duly seconded by


Hon. ____________________ the Sangguniang Bayan after due deliberation, agreed that:

EXPLANATORY STATEMENT

WHEREAS, Ordinance No. 21, series of 2021 was enacted suspending the collection of
water bills and charges from MEEDO’s concessionaires thereby making water services free for
all consumers while the Municipality is under state of calamity or public emergency due to
Covid-19 pandemic;

WHEREAS, ___% of the total population are already vaccinated against Covid-19
rendering them less vulnerable to infection thereby allowing resumption of livelihood activities
and employment engagements that augments family income;

WHEREAS, the Municipality is currently experiencing water shortage due to the


decreasing level of water reserve brought about by significant increase in water consumption or
excessive uses in some areas since the implementation of the above-mentioned ordinance;

WHEREAS, National Tax Allocation / Internal Revenue Allotment of San Vicente


decreased by almost 18 % or approximately Php 80,000,000.00 for the year 2023;

WHEREAS, the MEEDO is an income generating component of LGU that shall be


independently and entirely operating out of its own revenue;

WHEREAS, Section 16, Book II of Local Government Code of 1991 provides that “every
local government unit shall exercise the power expressly granted, those necessarily implied
therefrom, as well as power necessary, appropriate or incidental for its efficient and effective
governance, and those which are essential to the promotion of the general welfare”;

WHEREAS, SECTION 18 of RA 7160, Power to Generate and Apply Resources. - Local


government units shall have the power and authority to establish an organization that shall be
responsible for the efficient and effective implementation of their development plans, program
objectives and priorities; to create their own sources of revenue and to levy taxes, fees, and
charges which shall accrue exclusively for their use and disposition and which shall be retained
by them; to have a just share in national taxes which shall be automatically and directly
released to them without need of any further action; to have an equitable share in the
proceeds from the utilization and development of the national wealth and resources within
their respective territorial jurisdictions including sharing the same with the inhabitants by way
of direct benefits; to acquire, develop, lease, encumber, alienate, or otherwise dispose of real
or personal property held by them in their proprietary capacity and to apply their resources and
assets for productive, developmental, or welfare purposes, in the exercise or furtherance of
their governmental or proprietary powers and functions and thereby ensure their development
into self-reliant communities and active participants in the attainment of national goals;

WHEREAS, SECTION 22 of RA 7160, Corporate Powers - (d) Local government units shall
enjoy full autonomy in the exercise of their proprietary functions and in the management of
their economic enterprises, subject to the limitations provided in this Code and other applicable
laws;

WHEREAS, BOOK II SECTION 129 RA 7160, Power to Create Source of Revenue - Each
local government unit shall exercise its power to create its own sources of revenue and to levy
taxes, fees, and charges subject to the provisions herein, consistent with the basic policy of
local autonomy. Such taxes, fees, and charges shall accrue exclusively to the local government
units;

WHEREAS, Section 186, Book II of Local Government Code of 1991 provides that “local
government units may exercise the power to levy taxes, fees, charges on any base or subject
not otherwise specifically enumerated herein or taxed under the provisions of the national
internal revenue code, as amended, or other applicable laws: provided, that the taxes, fees or
charges shall not be unjust, excessive, oppressive, confiscatory of contrary to declared national
policy; provided, further, that the ordinance levying such taxes, fees or charges shall not be
enacted without any prior public hearing conducted for the purpose”;

WHEREAS, the provisions of Local Government Code of the Philippines - RA 7160


CHAPTER II, SECTION 16 of General Welfare - Every local government unit shall exercise the
powers expressly granted, those necessarily implied there from, as well as powers necessary,
appropriate, or incidental for its efficient and effective governance, and those which are
essential to the promotion of the general welfare. Within their respective territorial
jurisdictions, local government units shall ensure and support, among other things, the
preservation and enrichment of culture, promote health and safety, enhance the right of the
people to a balanced ecology, encourage and support the development of appropriate and self-
reliant scientific and technological capabilities, improve public morals, enhance economic
prosperity and social justice, promote full employment among their residents, maintain peace
and order, and preserve the comfort and convenience of their inhabitants;

WHEREAS, The Sangguniang Bayan deemed its necessary to protect the general welfare
of all, and to sustain the provision of water to a greater number of consumers if not all, the
need to provide new policy on water services is necessary to compel those irresponsible water
consumers to repair leaks on their water connection or to halt the irresponsible water wastage;

NOW THEREFORE, BE IT, AS IT IS HEREBY ORDAINED by the Sangguniang Bayan of San


Vicente, Palawan, in session duly assembled, AS IT IS HEREBY RESOLVES, TO ENACT the
following Barangay Ordinance, to wit:

NO. 21, SERIES OF 2021”

ARTICLE - I
GENERAL PROVISIONS

Section 1. Title. This ordinance shall be known as the “New Water Services Billing Ordinance of
San Vicente”;

Section 2. Scope of the Ordinance. This Ordinance shall be strictly imposed to all water
concessionaires (residential, commercial, industrial, institutional and government agencies)
within the jurisdiction of the Municipality of San Vicente;

Section 3. Objectives/Purposes. This Ordinance intends to achieve the general objectives of a


sustainable and quality water services at a reasonable cost or charge. Specifically, this
ordinance is enacted for the following purposes;

a) To conserve water and preserve balance ecosystem;


b) To lessen irresponsible water wastage;
c) To develop responsible water consumers;
d) To augment the income of LGU;

ARTICLE - II
DEFINITION OF TERMS SECTION

Section 4 . Definition of Terms. For the purposes of this Ordinance, the following terms shall
the respective meaning and import:

Section 5. Water Rates. – The MEEDO’s collection of water bills and charges from the
concessioners shall be governed by these new guidelines, as follows:

Section 6. Repealing Clause. Any Ordinance of regulatory provision inconsistent with any of
the provision of this ordinance is hereby amended;

Section 7. Separability Clause – If for any reason any part of the provisions of this Ordinance
shall be held to be unconstitutional or invalid, part or provisions hereof which are affected
thereby shall continue to be in force and effect;

Section 8. Effectivity. – Upon approval this ordinance shall take effect immediately after fifteen
(15) days posting in at least three conspicuous places in the Barangay.
