AN ORDINANCE AUTHORIZING THE CITY/MUNICIPALITY OF SILAGO TO ISSUE


BARANGAY CLEARANCE AND COLLECT CORRESPONDING BARANGAY
CLEARANCE FEE IN THE APPLICATION FOR ANY BUSINESS RELATED
TRANSACTIONS SUBJECT TO THE REMITTANCE OF THE AFORESAID FEES TO
THE BARANGAY AND CONDITIONS HEREUNDER
___________________________________________________________________

WHEREAS, under Section 152 (C) of the Local Government Code States that:

“(c) Barangay Clearance – No city or municipality may issue any license or


permit for any business or activity unless a clearance is first obtained from the barangay
where such business or activity is located or conducted. For such clearance, the
Sangguniang Barangay may impose a reasonable fee. The application for clearance
shall be acted upon within seven (7) working days from the filing thereof. In the event
that the clearance is not issued within the said period, the city or municipality may issue
the said license or permit.”

WHEREAS, the EODB ACT of 2018 or Republic Act 11032, otherwise known as “An
Act Promoting Ease of Doing Business and Efficient Delivery of Government Services,
Amending for the purpose of Republic Act No. 9485 “ was duly enacted;

WHEREAS, Section 11 (f) of the above-mentioned Republic Act duly amended the
Section 152 (c) of the Local Government Code, and provides that “ Barangay
Clearances and Permits related to doing business shall be applied, issued and collected
at the City/Municipality in accordance with the prescribed processing time of said Act.
Provided, that the share in the collection shall be remitted to respective Barangays; and

WHEREAS, Barangay Imelda, in accordance with the above provisions, and as an


implementation of “one stop shop “, hereby authorizes the City/Municipality of Silago
to issue Barangay Clearance and collect corresponding Barangay Clearance fee in the
application for any business related transactions subject to the remittance of the
aforesaid fees and barangay and the conditions hereunder.

NOW THEREFORE, be it ORDAINED as it is hereby ORDAINED by the Barangay


Council of Imelda in session assembled the following:

SECTION 1. Coverage. This policy applies only to the issuance of Barangay Clearance
for business permit and locational clearance (as a requirement for the issuance of
building permit) at the City/Municipality. Other clearances for other purposes shall still
be obtained at the Barangay.

This circular shall cover all City and Municipal Mayors, Punong Barangays, Concerned
Local Officials, DILG Regional Directors and BARMM Minister of Local Government and
all others concerned.
SECTION 2. Definition of Terms. The words and phrases used in this ordinance are
hereby defined as follows:

Barangay Clearance- refers to any and all documents issued by the barangays
with or without corresponding fees as defined in their ordinances relative to or in relation
to the issuance of business permit and locational/zoning clearance by the
city/municipality or any other permit as may be required. (IRR 0F RA 11032)

Barangay Clearance fees- is an amount imposed by the barangays through an


ordinance and collected by the city/municipality in relation to the issuance of business
permit and locational/zoning clearance by the city/municipality.

Business Permit- is a document that must be secured from the city or municipal
government, usually through its Business Permits and Licensing Office (BPLO), for a
business to legally operate in the locality. (IRR OF RA 11032)

Locational Clearance- is a clearance issued by the Zoning Administrator/Zoning


Officer to a project that is allowed under the provisions of an ordinance of a particular
City/Municipality. It is a requirement for the issuance of Building Permit. (House and
Land Use Regulatory Board—Comprehensive Land Use Plan Guidebook).

SECTION 3. Authority to collect Barangay Clearance Fee of Business Related


Transactions- The City/Municipality of Silago is given the authority to collect Barangay
Clearance Fee subject to the remittance to the subject Barangay.

SECTION 4. Rate of the Barangay Clearance Fee to be Collected- The rate of


Barangay Clearance Fee to be collected by the City/Municipality for the issuance of
clearance shall be computed in accordance with the subject Barangay Revenue
Ordinance herein attached as “ Annex A”, and made as an integral part hereof.

SECTION 5. Barangay Clearance Signatory- Electronic Signature of Punong


Barangay concern shall appear in all Barangay Clearance issued.

SECTION 6. Reporting and Remittance- The City/Municipality shall remit the


Barangay Clearance Fee collected to the subject Barangay not later than seven (7)
working days of the ensuing month with the list of the issued Building and Business
Permit.

SECTION 7. Separability Clause – If for any reason, a part of this Ordinance is


declared illegal or invalid, other parts or provisions hereof which are not affected thereby
shall remain valid and in full force and effect.

SECTION 8. Repealing Clause- All previous Ordinance and rules/regulations which are
inconsistent with the provisions of this ordinance are hereby deemed, modified or
repealed accordingly.

SECTION 9. Effectivity Clause- This ordinance shall take effect fifteen (15) days after
its publication.

AN ORDINANCE CREATING THE HALINA’T MAGTANIM NG PRUTAS AT GULAY


(HAPAG) SA BARANGAY PROJECT

WHEREAS, the government recognizes the need to promote lifestyle among


Filipinos by encouraging the consumption of fruit and vegetables;

WHEREAS, the Barangay is the Basic political unit where health and nutrition
program can be best implemented;

WHEREAS, the Halina’t Magtanim nga Prutas at Gulay (HAPAG) sa Barangay


Project promotes the establishment of vegetable garden in home, schools and
community areas as means of increasing access to fresh and nutritious produce,
promoting local agriculture,and improving the livelihood in the community;

NOW THEREFORE, as the Punong Barangay of Barangay Imelda,through the


pwers vested in me by law,do hereby order the following:

SECTION 1. Creation of the Halina’t Magtanim ng Prutas at Gulay (HAPAG) sa


Barangay Project. The Halina;t Magtanim ng Prutas at Gulay (HAPAG) sa Barangay
is hereby created to promote the establishment of vegetable garden in homes,schools
and community areas to increase access to fresh and nutritious produce, promoting
local agriculture,and improving the livelihood in the community.

SECTION 2. Organization of the HAPAG Project Committee. A HAPAG Project


Committee shall be organized, which shall be composed of the following:
a. Punong Barangay - Chairperson
b. Kagawad Committee on Agriculture - Vice Chairperson
c. Kagawad Committee on Health - Member
d. Sangguniang Kabataan Chairperson - Member
e. Barangay Nutrition Scholar (BNS) - Member
f. Barangay Health Worker - Member
g. Barangay Day Care Worker (DCW) - Member

SECTION 3. Functions of the HAPAG Project Committee. The HAPAG Project Committee shall
have the following functions:
a. spearhead the implementation of the HAPAG Project in the Barangay;
b. Formulate policies, programs, and projects related to the establishment of vegetable
gardens in homes, schools and community areas;
c. Coordinate with government agencies and non-government organizations for the
provision of technical assistance and funding support for the HAPAG project;
d. Conduct monitoring and evaluation of the progress and impact of the HAPAG
project,and recommend measures as may be necessary to achieve for its improvement;
e. Perform other functions as may be necessary to achieve the objectives of the HAPAG
Project.
SECTION 4. Implementation of the HAPAG Project. The HAPAG Project Committee shall
implement the following activities:
a. Conduct advocacy and information campaign on the importance of establishing
vegetable gardens in homes,schools and community areas;
b. Provide technical assistance to interested households,schools, and organizations in
planning and establishing their own vegetable gardens;
c. Distribute planting materials and inputs to households, schools and organizations;
d. Monitor and evaluate the progress and impact of the vegetable gardens established
under the HAPAG Project.

SECTION 5. Funding Support for the HAPAG Project. Funding for the HAPAG Project shall be
sourced from the Barangay Annual Budget,and funding support from the government agencies
and non-government organizations.

SECTION 6. Effectivity. This Barangay Ordinance shall take effect fifteen (15) days after its
publication.

TUNGOD KAY, ang mga kagawad sa Barangay Imelda,Silago, Southern Leyte nga nag ka-uyon nga
incresan ang pagpangolikta sa potable water supply para sa reffiling sa water brake tank gikan sa 50
centavos per cubic meter ngadto sa 2.00 pesos per cubic meter.

TUNGOD KAY, ang potable water supply gihimo nang commercial sa mga tindahan.

TUNGOD KAY, ang potable water supply para ra unta sa katawhan sa Barangay Imelda.

BUSA gimando sa Sangguniang Barangay Sa Barangay Imelda,Silago,Southern leyte.

SECTION 1. TITLE
Us aka Ordinansa pag –imposar og balayrunon sa bisan kinsa nga tawo or grupo sa mga
tawo nga mogamit sa potable water supply para sa reilling sa water brake tank mobayad gikan sa 50
centavos per cubic meter ngadto sa 2.00 pesos per cubic meter nga bisan onsa nga klase nga mga
sakjanan nga dili panag –iya sa katawhan sa barangay Imelda,Silago,
Southern Leyte.

SECTION 2.REQUIRED ACT.

Ang Sangguniang barangay Imelda,Silago,Southern Leyte mag himo usab og E.O. or


resolution sa mga commercial sa pagpahunong og gamit sa potable water brake tank panahon sa
huwaw o ting –init og kanus- a pod sila mobalik og gamit para sa refilling sa water brake tank.

SECTION 3.PENALTY CLAUSE.

Si bisan kinsa nga mga tawo o grupo sa mga tawo nga dili motorman sa maong
ordinansa nga gihimo sa Sangguniang Barangay sa barangay Imelda,Silago,Southern Leyte
pagamultahan sa kantidad nga:

Premerong Pagpakasala pabayaron sa kantidad nga 500.00 pesos.


Ikaduhang pagpakasala pabayaron sa kantidad nga 700.00 pesos.
Ikatulong pagpakasala pabayaron sa kantidad nga 1000.00 pesos unya potdan og
pabungayon sulod sa 2 ka adtaw are sa barangay.
SECTION 4. Effectively Clause.
kining maong ordinansa mo epekto unta dayon sulod sa30 ka adlaw gikan sa pagsumite
ngadto sa Sangguniang Bayan para sa pagsusi sa katokma niini.

Naaprobahan sa Sangguniang Barangay sa barangay Imelda, Silago, Southern leyte

AN ORDINANCE ON COLLECTION OF CORRESPONDING BARANGAY


CLEARANCE FEE IN THE APPLICATION FOR ANY BUSINESS RELATED
TRANSACTIONS

WHEREAS, there is a need to streamline/simplify the process of business registration in


the City of Silago to provide more efficient and effective revenue collection and to
promote a friendlier atmosphere for taxpayers and investors;

WHEREAS, when regulations are simple and transparent entrepreneurs need not so
suffer from red tape and time consuming collections;

WHEREAS, the EODB Act of 2018 or Republic Act 11032, otherwise known an “An Act
Promoting Ease of Doing Business and Efficient Delivery of Government Services was
signed into law seeks to make the process of putting up and running a business in the
Philippines easier and more efficient”;

WHEREAS, Section 11(f) of RA 11032 provides “Barangay Clearance and permits


related to doing business shall be applied, issued and collected at the City/Municipality
in accordance with the prescribed processing time of said Act. Provided, that the share
in the collections shall be remitted to the respective barangays; and

WHEREAS, Barangays in the City/Municipality of Silago, enacted Barangay Ordinances

corresponding barangay clearance fee in application for any business related
