Standard Operating Procedure (SOP) for Obtaining an Indian Work Visa

Purpose

This SOP outlines the process and requirements for obtaining an Indian Work Visa, ensuring compliance
with Indian immigration laws and regulations.

Scope

This procedure applies to foreign nationals seeking employment in India and employers sponsoring foreign
employees.

Definitions

Work Visa: A legal document allowing a foreign national to work in India.

Employer: The company or organization in India that sponsors the foreign national's work visa.

Employee: The foreign national seeking to work in India.

Responsibility

Employee: To provide accurate personal information and required documents.

Employer: To facilitate the visa application process and provide necessary documentation.

Procedure

Step 1: Pre-Application Preparation

1. Employee Requirements:

- Passport valid for at least six months from the date of application.

- Passport-sized photographs (as per specifications).

- Employment contract or offer letter from the Indian employer.

- Educational qualifications and relevant experience certificates.

2. Employer Requirements:

- Proof of registration/incorporation of the company.

- Justification for hiring a foreign national instead of an Indian citizen.

- Company’s financial statements for the last financial year.

Step 2: Online Visa Application

1. Access the Online Portal:

- Visit the official Indian Visa Online website (https://indianvisaonline.gov.in/visa/).

2. Fill the Application Form:

- Select "Regular Visa Application".

- Complete the form with personal details, passport information, and employment details.

- Choose the nearest Indian consulate or embassy.

- Schedule an appointment for submission of the application and biometrics.

Step 3: Submission of Application

1. Visit the Consulate/Embassy:

- Attend the scheduled appointment.

- Submit the printed application form and original documents.

- Provide biometrics (fingerprints and photograph).

2. Pay Visa Fee:

- Pay the required visa fee (check the fee structure on the official website or with the consulate).

Step 4: Application Review and Processing

1. Background Check:

- The Indian authorities will conduct a background check and verification of documents.

- The process may take several days or weeks.

2. Notification:

- The applicant will be notified via email or the online portal about the status of their application.

- If additional documents or information are required, the applicant will be informed.

Step 5: Visa Issuance

1. Collection of Visa:

- Once approved, the applicant will receive a notification to collect their visa.

- Visit the consulate/embassy to collect the visa or opt for postal delivery if available.

2. Verification:

- Verify the details on the visa for accuracy (name, passport number, visa type, validity).

Step 6: Post-Visa Issuance

1. Travel to India:

- Book travel arrangements and ensure to carry all relevant documents.

2. Registration in India:

- Foreign nationals staying in India for more than 180 days need to register with the Foreigners Regional
Registration Office (FRRO) within 14 days of arrival.

Terms and Conditions for Visa Consultant Services

1. Introduction

These Terms and Conditions outline the rules and regulations for the provision of visa application services
by Enrologies PVT LTD ("the Consultant"). By engaging the Consultant's services, the client ("Client") agrees
to comply with these terms.

2. Services Provided

The Consultant agrees to provide the following services:


- Consultation on visa application requirements and eligibility.
- Assistance in the preparation and submission of visa application forms and supporting documents.
- Scheduling of appointments with relevant embassies or consulates.
- Follow-up on application status and communication with the visa authorities.

3. Client Responsibilities

The Client agrees to:


- Provide accurate and truthful information and necessary documentation.
- Attend scheduled appointments and interviews.
- Make timely payments for services rendered.
- Comply with visa application processes and timelines.

4. Fees and Payment

- Service fees are outlined in the Consultant's fee schedule.


- Payment is due upon acceptance of the Consultant's service agreement.
- Fees are non-refundable unless otherwise stated.
- The client agrees to pay INR 5000 plus GST per application.
- The client will also bear any fees for attestation by the embassy or notary.

5. Confidentiality

The Consultant agrees to maintain the confidentiality of the Client's personal information and documents,
except as required by law or with the Client's specific consent.

6. Liability

- The Consultant will provide services to the best of their ability but does not guarantee the approval of any
visa application.
- The Consultant is not liable for any decisions made by the visa authorities or any delays in processing.
- The Client assumes responsibility for any consequences resulting from false or misleading information
provided.

7. Termination of Services

- Either party may terminate the agreement with written notice.


- Upon termination, the Client is responsible for any outstanding fees for services rendered up to the
termination date.
8. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of India and any
disputes will be subject to the jurisdiction of the courts in Bangalore.

Acknowledgement
By engaging the services of Enrologies PVT LTD, the Client acknowledges that they have read, understood,
and agree to these Terms and Conditions.
