A RESOLUTION AUTHORIZING PUNONG BARANGAY LOEL JOY O. MESIAS, TO SIGN

AND ACCEPT THE DEED OF DONATION AND ACCEPTANCE IN BEHALF OF THE
BARANGAY LIPATA COUNCIL WITH MA. CRISOL B. RECABO, MARRIED TO
__________________, CONSISTING OF ONE (1) PARCEL OF LAND TO SERVE AS ROAD
RIGHT OF WAY OF LIPATA NATIONAL HIGH SCHOOL COVERED BY TRANSFER
CERTIFCATE OF TITLE (TCT) NO. ____________________OF THE REGISTRY OF DEEDS
OF SURIGAO CITY LOCATED AT BARANGAY LIPATA, SURIGAO CITY.
WHEREAS, the BLGU-LIPATA is a local government unit organized and existing by virtue of
the laws of the Republic of the Philippines, with principal office and postal address at Purok 1, Barangay
Lipata, City of Surigao, represented by Punong Barangay Loel Joy O. Mesias;
WHEREAS, Ma. Crisol B. Recabo, of legal age, married to ________________, with residential
address at _____________________;
WHEREAS, Ma. Crisol B. Recabo is the registered owner of a parcel of land as Lot # 8 located
at Barangay Lipata, Surigao City;
WHEREAS, in compliance with the provisions of Section 50 of PD 1216, Ma. Crisol B. Recabo
hereby donates and conveys in favor of the BLGU-Barangay Lipata, one (1) Parcel of Land covered by
TCT No.__________________ of the Registry of Deeds of Surigao City an area of _____________
square meters (____ sq.m.) more or less, located at Barangay Lipata, Surigao City to serve as Lipata
National High School Road Right of Way;
WHEREAS, Ma. Crisol B. Recabo hereby transfers, cedes and conveys by way of this Deed of
Donation and Acceptance in favor of BLGU of Barangay Lipata, all rights, interest and title of the said
parcel of land, free from all liens and encumbrances.
NOW, THEREFORE
BE IT RESOLVED BY THE BARANGAY COUNCIL OF BARANGAY LIPATA,

SURIGAO CITY IN SESSION ASSEMBLED, to authorize, as it hereby authorize, the Punong
Barangay, Honorable Loel Joy O. Mesias of Barangay Lipata, this City to sign and accept the Deed of
Donation and Acceptance in behalf of the Sangguniang Member of Barangay Lipata with Ma. Crisol B.
Recabo, married to __________________, consisting of one (1) parcel of land to serve as Lipata National
High School ROAD RIGHT OF WAY covered by Transfer Certificate of Title (TCT) No.
______________________ of the Registry of Deeds of Surigao City locate at Barangay Lipata, Surigao
City.

DEED OF DONATION
KNOW ALL MEN BY THESE PRESENTS:
This Deed of Donation and Acceptance was made and entered into at Barangay Lipata,
Surigao City this 16th day of September 2022, by and between:
MA. CRISOL B. RECABO, of legal age, Filipino, represented herein by son BRANDY
SER RECABO BAUTRO, of legal age, Filipino, resident of Purok Camia, Barangay
Magsaysay, Mainit, Surigao del Norte, herein referred to as DONOR.

BLGU of Barangay Lipata, local government unit organized and existing under and by
virtue of the laws of the Republic of the Philippines with principal office at Purok 1, Barangay
Lipata, Surigao city, represented herein by Punong Barangay LOEL JOY O. MESIAS,
hereinafter referred to as the DONEE.
----WITNESSETH----
That the DONOR is true and lawful owner of a parcel of land described as TRANSFER
CERTIFICATE OF TITLE NO. T-23216 containing an area of FOUR THOUSAND
SEVEN HUNDRED FORTY ONE (4,741) SQUARE METERS, located at Barangay
Lipata, Surigao City;
That FOR AND IN CONSIDERATION of the DONEE’s trust, devotion and affection
shown to the DONOR, and as an act of gratitude and liberality on his part, the DONOR hereby
voluntarily GIVES, TRANSFERS, and CONVEYS by way of donation of a LOT PORTION
of LOT NO. 8 containing area of FOUR HUNDRED FIFTY TWO (452) SQUARE METER
, unto the said DONEE, her heirs and assigns, the above described property, together with all the
improvements found thereon, free from all liens and encumbrances; condition that the said
portion of lot shall be utilized as the ROAD RIGHT OF WAY of Lipata National High School,
Barangay Lipata, Surigao City;
That the DONOR affirms that this donation is not made with intent to deceive her
creditors, and that she reserved for herself sufficient funds and property;
That the DONEE hereby accepts and receives this donation made in his favor by the
DONOR, and hereby manifests his gratefulness of the latter’s generosity.
IN WITNESS WHEREOF, both the DONOR & DONEE have hereunder have
subscribed their names this 16th day of September 2022 at Barangay Lipata, Surigao City,
Surigao del Norte,Philippines.
