development through imposition of building heights, bulk, open space, and
provisions in a given area.

WHEREAS, Republic Act 7160, otherwise known as the Local € overnment Code
of 1991, authorizes local government units to enact zoning ordinances subject fo and in
accordance with existing laws:

SECTION 2. AUTHORITY
This Ordinance is enacted pursuant to the provisions of the Local Government
Code of 1991, R.A. 7160 Sections 447, 448 and 458 a.2 (7-9) dated 10 October
1991, “Authorizing the City/Municipality, through the Sangguniang
Panlungsod/Bayan, to adopt a Zoning Ordinance subject to the provisions of
xisting laws” and in accordance with related laws such as but not limited to
ommonweaith Act 141, PD 1067 Water Code, PD 1096 Nationa! Building
ode, and Executive Order No. 72. : .
- SECTION 3. PURPOSES
is ordinance is enacted for the following purposes:

private jands in the City of Muntiniupa in accordance with its
Comprehensive Land Use Plan (CLUP);
(b) Protect the character and stability of residential, commercial, industrial,
institutional, parks, open space and other functional areas within the City
and promote the orderly and beneficial development of the same:
{c) Promote and protect the health, safety, peace, comfort, convenience
and general welfare of the inhabitants of Muntiniupa;
(d) Provide adequate, light, air, privacy and convenience of access to the
property;
(e) Prevent undue concentration of population and properties; and
(f) Regulate the location and use of buildings and lands in such manner as
to obviate the danger to public safety caused by undue interferenc
existing or prospective traffic movements on such streets’ and
thoroughfares. — xX

(a) The Ordinance reflects the City of Muntinlupa’s vision to be "one of the
leading investment hubs in the country, with educated, healthy and God-
loving people living peacefully and securely in a climate change-adaptive
and disaster-resilient community, under the rule of transparent, caring
and accountable leadership.”
(b) The local government unit recognizes that any land use is a use by right
but provides however that the exercise of such right shall be subject to
the review standards of this Ordinance;
{ (c) The Ordinance gives the free market the maximum opportunity to spur
; the City’s development within a framework of environmental integrity and
social responsibility;

(d) The Ordinance has been designed to encourage the evolution of high-
quality developments rather than regulating against the worst type of
projects;
(e) The Ordinance has been crafted in a manner that is fully responsive to
the ever-changing conditions that the City continually face;
(f}) The Ordinance functions as a too! for informed decision-making on. the
part of jland use administrators by way of providing specific criteria to Ss
judge the acceptability of developments;
(h) The regulations in the Zoning Ordinance are considered as land use
management tools that are necessary to provide a clear guidance to land
development in order to ensure the community’s common good.
‘ (i) This ordinance prescribes rules and regulations to help implement the
City’s Comprehensive Land Use Plan formulated within the framework
of sustainable development with its multi-sectoral thrusts. This plan
addresses the need to create a balanced distribution of social and
economic development and environmental integrity;

DEFINITION OF TERMS
The definition of the terms used in this Zoning Ordinance shall carry the same
meaning given to them in already approved codes and regulations, such as but
not limited to the National Building Code, Water Code, Philippine Environmental
Code and other Implementing Rules and Regulations promulgated by the
Housing and Land Use Reguiatory Board. The words, terms and phrases

enumerated hereunder shall be understood to have the corresponding meaning
indicated as follows:
Absolute Majority Vote - means that the "in favor" votes represent more
than 50 percent of the valid votes. This is also called the 50% + 1 vote.
Accessory Use- pertains to those that are customarily associated with the
Principal Use application (such as a garage is accessory to a house).

Actual Use - refers to the purpose for which the property is principally or 5
predominantly utilized by the person in possession of the property. ‘
. Base Zones - refers to the primary zoning classification of areas within the
City/Municipality and that are provided with a list of allowable uses and
regulations on building density and bulk, among others.
Building Height Limit (BHL) - per the National Building Code, this is "the
maximum height to be allowed for buiidings/ structures and shall be
generally measured from the established grade line to the topmost portion
of the proposed building/structure. If applicable, the BHL may be subject to
clearance requirements of the Civil Aviation Authority of the Philippines
(CAAP) or the concerned military/security authorities."

Commercial-1 Zone (C1-Z) — a low density commercial area within the City
intended for neighborhood or community scale trade, service ang business
activities.
Commercial-3 Zone (C3-Z) — a high density commercial area within a City <
intended for regional shopping centers such as large malls and other
mmercial and business activities which are regional in scope or where
market activities generate traffic and require utilities and services that
extend beyond local boundaries and requires metropolitan level
development planning and implementation. High rise hotels, sports stadium
or sports complexes area also allowed in this zone. This zone may also be
called as the Central Business District (CBD).

(9) Where a lot of one ownership, as of record the effective date of this
Ordinance, is divided by a zone boundary line, the lot shail be
construed to be within the zone where the major portion of the lot is
located. In case the lot is bisected by the boundary line, it shall fall in
the zone where the principal structure falls;

(h) Where the zone boundary is indicated as one !ot deep, said depth
shail be construed to be the average depth of the lots in such
particular city block. Where, however, a lot has a depth greater than
the average, the remaining portion of sand lot shall be construed to
be one lot-deep if the remaining portion has an area less than fifty
percent (50%) of the total area of the lot. Otherwise, the lot shall
become divided and be covered by two or more different zoning
districts, as the case may be: and

complies with the regulations of the zone in which it is located,

ZONE REGULATIONS
A. Allowable Uses
The uses enumerated in the succeeding sections are not exhaustive nor all
inclusive. The Local Zoning Board of Appeais (LZBA) may allow other uses
subject to the requirements of the Mitigating Devices provision of this
Ordinance.
B. Building Regulations ;
Building regulations specify whether buildings/structures may be allowed in
specific zones/sub-zones. When allowed, buildings/structures shall be
designed, constructed and operated in accordance with the requirements of
each zone's governing authority as well as with the relevant provisions of the
National Building Code (NBC) and this Ordinance.
In certain zones, the design of buildings/structures may also be regulated by
this Ordinance according to Building Height Limit (BHL) in consonance with

A “transparent zone” that is overlaid on top of the Basic Zone that provides an
additional set (or layer) of regulations. These additional layers of regulations
may pertain to additionally allowabie uses, building density and bulk and

Article VII
PERFORMANCE STANDARDS -
The following performance standards are intended to ensure land use and
neighbourhood compatibility. Proposed developments shall comply with the
applicable performance standards which shall form part of the requirements for

drainage design and without proper consideration of possible inundation
effects on nearby properties.

seek the assistance of the HLURB or external consultants in the evaluation of

depots, reclamation areas, shopping malls, special economic zones, tourism
enterprise zones, and the like.

which shall be subject of evaluation by the concerned City departments or
offices (i.e. Engineering, Building Official, MTMB) and there after endorsed by
