EXTRA JUDICIAL SETTLEMENT OF THE REAL PROPERTY OF THE

DECEASED JORGE MALOLOS AND ALEJANDRA N. MALOLOS WITH


DEED OF ABSOLUTE SALE

KNOW ALL MEN BY THESE PRESENTS:

We, Pasciano N. Malolos, widower; Nemensia M. Dantes, widow; Felomena M.


Hernandez married to Cesar Hernandez; Gerardo N. Malolos married to Alberta R.
Malolos; Felicitas N. Malolos, single; all of legal ages, Filipinos, with residence and
postal address at Barangay Sta Anastacia ,Sto Tomas City Batangas, by these
presents, do hereby state and confirm the following:

That we are the legitimate children and sole heirs of the deceased Jorge M.
Malolos and Alejandra Nuñez Malolos, who died on Nov. 18, 2013 and Feb 23, 2022,
respectively, without any will or debts, or obligation to any person or entity;

That the decedents left a parcel of land ( with no improvements), located at


Barangay Sta Anastacia Sto Tomas Batangas, which is more particularly described as
follows:

TCT# P-3851 (Lot with no improvements)

Lot 610 located at Sta Anastacia Sto Tomas Batangas, covered by TCT # P-
3851, issued by the Registry of Deeds of Batangas and more particularly
described as follows:
“Lot 610, Cad-424, C-1 Sto. Tomas Cadastre
Beginning at a point marked “1” of Lot 610, Cad-424, being N. 09 deg. 12 ’ W.,
3547.71 m. from BLLM. No. 1, Cad-424, Sto. Tomas Cadastre to cor. 1; thence;
N. 29 deg. 45’ W ., 25.90 m. to point 2;
N. 28 deg. 14’ W ., 04.14 m. to point 3;
N. 67 deg. 28’ E., 78.44 m. to point 4;
S. 11 deg. 07’ E., 29.17 m. to point 5;
S. 66 deg. 26’ W., 69.01 m. to point 1;
point of beginning
Containing an area of TWO THOUSAND ONE HUNDRED FIFTY-THREE (2,153)
SQUARE METERS.
All points referred to are marked on the ground by BL. Cyl. Conc. Mons.
Bounded on the W., along line 1-2 by Lot 608; along line 2-3 by Lot 622.; on the N.,
along line 3-4 by Lot 623; all Cad-424, Sto. Tomas Cadastre ; on the E., along line
4-5 by PNR and on the S., along line 5-1 by Lot 609, all Cad- 424, Sto. Tomas
Cadastre.
Bearings Grid:
This lot was surveyed in accordance with law and existing regulations promulgated
thereunder by Adrian G. Castañares, Geodetic Engineer on May 17,1971 and duly
approved on February 17, 1978.

That the above-described parcel of land is not tenanted and does not come
within the operation of the Comprehensive Agrarian Reform Programs

That the said decedents, left no other heirs, except us and pursuant to Section
4, Rule 74 of the Revised Rules of Court of the Philippines, we hereby inherit,
adjudicate unto ourselves the land described above; subject, however, to the liabilities
imposed by Section 4, Rule 74 of the said Rules of Court for a period of two (2) years;

DEED OF ABSOLUTE SALE

That FURTHER, WE, Pasciano N. Malolos widower, Nemensia M. Dantes


widow, Gerardo N. Malolos, Felomena M. Hernandez and Felicitas N. Malolos,
FOR AND IN CONSIDERATION of the sum of ONE MILLION PESOS
(P1,000,000.00) Philippine Currency, receipt whereof the whole amount of which is
hereby accepted and acknowledged by us to our full and complete satisfaction from
MIGNONETTE S. CAPONPON married to ALEXANDER CAPONPON, of legal ages,
Filipino and with residence at Barangay 3 Sto Tomas Batangas, we do hereby
SELL, TRANSFER , CONVEY and DELIVER , by way of ABSOLUTE SALE, unto said
VENDEE, MIGNONETTE S. CAPONPON, her heirs, assigns, and successors-in-
interest all our rights, interests and participation over the above described parcel of
land with full warranty free from and clean of all liens, charges and encumbrances of
whatever nature.

WHEREAS, herein the VENDORS warrants that the aforesaid land is free from
all claims for tenants disturbance compensation and that said VENDORS would
defend the title and rights of the VENDEE from any claims of whatever kind or nature
from third persons or entities; and that the provision of laws are satisfied to effect valid
and enforceable transfer and conveyance on the said property;

WHEREAS, herein the VENDORS guarantee that whoever claim or question


regarding this agreement the VENDORS hold their selves responsible and liable
thereof;
