EXTRAJUDICIAL SETTLEMENT with WAIVER AND

RELINQUISHMENT of RIGHTS

KNOW ALL MEN BY THESE PRESENTS:


WE, MANUEL LAZARO, of legal age, Filipino, married to Marissa
Guerrero-Lazaro, son of the decedent, and with residence and postal
address at 12 McKinley Street, Pio del Pilar, Makati City; JOSE GABRIEL
LAZARO JR., of legal age, Filipino, married to Elenita Mendoza-Lazaro,
son of the decedent, and with residence and postal address at No. 18 Salas
Street, Ermita, Manila City; LETICIA LAZARO-LEWIS, of legal age,
Filipino, married to Nicolas Lewis, daughter of the decedent, and with
residence and postal address at 2 Macabulos Street, Bangkal, Makati City,
CARMEN LAZARO, of legal age, Filipino, single, daughter of the
decedent, and with residence and postal address at 234 Engracia Cruz-
Reyes Street Ermita, Manila City, after having been sworn to in accordance
with law, do hereby depose and state:
1. That we are the heirs of Jose Gabriel Lazaro who died intestate on
June 27, 2021, as evidenced by his Death Certificate hereto attached as
Annex “A” and made an integral part hereof;

2. That said deceased, at the time of his death, left certain personal


properties and real properties, to wit:

I. PERSONAL PROPERTY

1. Cash in the amount of Php5,000,000.00 deposited at BDO Quezon


Avenue Branch.

Bank Statement and Bank Book under the name of the Decedent is
hereto attached and made integral parts hereof, respectively, as
Annexes “B” and “C”.

2. Motor Vehicle – Toyota Hilux Pick Up, said motor vehicle being
more particularly described as follows, to wit:

Mode : 2021
Plate Number : 120129
Engine Number : J13S-FB12401
Chassis Number : PL1MJF-10303
Official Receipt, and Certificate of Registration of the motor vehicle in the
name of the Decedent are hereto attached and made integral parts hereof,
respectively, as Annexes “D” and “E”.

II. REAL PROPERTY

1. A parcel of land situated in Ermita, City of Manila, Philippines, covered


by Transfer Certificate of Title No. T-376804, bounded and described as
follows:
A parcel of land (Lot 2-F of the subdivision plan (LRC) PSD-
216784, being a portion of Lot 2, (LRC) PSD-9870, LRC (GLRO)
Rec No. N-9209), situated in the Bo. Of Engracia Cruz-Reyes
Street, Ermita Manila. Bounded on the NE., Points 2 to 3 by a
trail; on the SE., Points 3 to 4 by Lot 2-G; on the SW., Points 4 to
1 by Lot 2-F; on the NW., Points 1 to 2 by Lot 3-D, both Subd.
Plan. Beginning at a point marked “1” on Plan, being S. 68 Deg.
31’E., 3596.89 M. BLLM 1, Ermita Manila; Thence N. 17 Deg.
48’E., 19.46 M to Point 2; Thence S. 70 Deg 27’E., 13.00 M to
point 3; Thence S. 17 Deg 48’W., 18.95 M to Point 4; Thence N.
72 Deg. 44’W., 12.0M to the point of beginning, containing an
area of Sixty Three square meters (63 sq.m.), more or less. All
points referred to are indicated on the plan and are marked on the
ground by TS CYL. CONC. MONS., 15x60 cm., bearings true;
date of the original survey, March 27, April 10, 1954, and that of
the subd. Survey, Dec 13, 1969.
Copy of Transfer Certificate of Title No. T-376804 is attached hereto as
Annex “F” and made an integral part hereof.

2. A parcel of land situated in Sampaloc, City of Manila, Philippines,


covered by Transfer Certificate of Title No. T-23289, bounded and
described as follows:
A parcel of land (Lot 2, Block 4 of the Consolidation Subdivision
Plan (LRC) PCS-12836, being a portion of the consolidation of Lot
2-21, (LRC) PSD-286906, LRC Rec. No. N-2563), situated in the
Gerardo Tuazon Street, Sampaloc Manila IS. Of LUZON
bounded on the NW., Points 2 to 3, by Lot 2, Block 4, of the
Consolidation-Subdivision Plan; on the SE., points 3 to 5, by Lot
2, (LRC) PSD-28842; Points 5 to 1 by Lot 4, Block 2, and on the
SW., Points 1 to 2 by Rd. Lot 2, both Cons. And Subd. Plan,
beginning at a point marked “1” on Plan, being S.67 DEG. 59’E.,
3838.37 M. From BLLM No. 1, Sampaloc, Manila; Thence N. 13
Deg. 47’W., 12.00M to Point 2; Thence N.79 Deg. 59’E., 22.15
M. to Point 3; Thence S.4. Deg. 19’W., 1.20 M to Point 4; Thence
S.4. Deg. 19’W., 11.85M. to Point 5; Thence S.81 Deg. 57’W.
16.15 M. to Point of beginning; containing an area of Four
Hundred Fifty square meters (450 sq.m.). More or less. All
points refereed to are indicated on the plan and are marked on the
ground by PS. CYL. Conc. Mons., 15x60 CM., bearings true; date
of the original survey, May 19, 23 & June 17, 1949, and that of the
cons. Subd. Survey was executed by Kris F. Aquino, Geodetic
Engineer, on Sept. 3-6, 1971.
Copy of Transfer Certificate of Title No. T-23289 is attached hereto as
Annex “G” and made an integral part hereof.

3. A parcel of land situated in Municipality of San Miguel, Bulacan


Philippines, covered by Transfer Certificate of Title No. T-24747-EP,
bounded, and described as follows:

A parcel of land (Lot 3, Block 2 of the Consolidation Subdivision


Plan (LRC) PCS-12836, being a portion of the consolidation of Lot
1-33, (LRC) PSD-53784, LRC Rec. No. N-2343), situated in the
Bagong Silang, San Miguel Prov. Of Bulacan, IS. Of LUZON
bounded on the NW., Points 2 to 3, by Lot 2, Block 2, of the
Consolidation-Subdivision Plan; on the SE., points 3 to 5, by Lot 2,
(LRC) PSD-28842; Points 5 to 1 by Lot 4, Block 2, and on the SW.,
Points 1 to 2 by Rd. Lot 1, both Cons. And Subd. Plan, beginning
at a point marked “1” on Plan, being S.77 DEG. 59’E., 3838.37 M.
From BLLM No. 1, Paranaque, Rizal; Thence N. 13 Deg. 47’W.,
12.00M to Point 2; Thence N.79 Deg. 59’E., 22.15 M. to Point 3;
Thence S.4. Deg. 19’W., 1.20 M to Point 4; Thence S.4. Deg.
19’W., 11.85M. to Point 5; Thence S.81 Deg. 57’W. 16.15 M. to
Point of beginning; containing an area of Seventeen Thousand
Nine Hundred Fifty-One square meters (17,951 sq.m.). More or
less. All points refereed to are indicated on the plan and are marked
on the ground by PS. CYL. Conc. Mons., 15x60 CM., bearings
true; date of the original survey, May 19, 23 & June 17, 1949, and
that of the cons. Subd. Survey was executed by Leo S. Tim,
Geodetic Engineer, on Sept. 3-6, 1971.
Copy of Transfer Certificate of Title No. T-24747-EP is attached hereto as
Annex “H” and made an integral part hereof.

3. That we hereby voluntarily WAIVE, RELINQUISH, and ABANDON


our rights and interest whatsoever to any and all properties, be it
real, personal, monies, deposits, jewelries, or anything of value that is
owned or left behind by our father, JOSE GABRIEL LAZARO, in
favor of our mother, CARIDAD LAZARO, who can dispose of it in
whatever manner and method she wished to;

4. That we are executing this Extrajudicial Settlement releasing and


holding whosoever is in the possession or is otherwise taking care of
these properties and other personal effects, monies, deposits,
jewelries, or anything of value owned and left behind by our father
JOSE GABRIEL LAZARO free from any liabilities arising from their
release to our siblings of the said properties;

5. That the parties executed this Extrajudicial Settlement shall file in the
office of the Register of Deeds; a bond to be posted with the register
of deeds, in an amount equivalent to the value of the personal
property involved as certified to under oath by the parties concerned
and conditioned upon the payment of any just claim that may be
filed under section 4 of Rule 74 of the Rules of Court;

6. NOW THEREFORE, for and in consideration of the foregoing


premises and invoking the provision of Sec. 1 Rule 74 of the Rules of
Court, the said HEIRS above named have agreed to settle the estate
extrajudicially and to this effect do hereby partition and adjudicate
the same unto themselves and the foregoing inheritance, subject
however to the liabilities imposed by Sec. 4, Rule 74 of the Rules of
Court for a period of two years in favor of any other possible heirs,
creditors or any other person deprived of the lawful participation
over the said estate of the deceased and encumbrances;

7. The parties agree to publish this instrument in a newspaper of


general circulation in the City of Manila and Province of Bulacan
once a week for three consecutive weeks.

8. In the remote event that any other property of the decedent should
ever be found which is not included hereinabove, the HEIRS hereto
further agree as they do so agree to settle and distribute the same in
like manner and proportion as herein established and disposed.

9. That the HEIRS hereby covenant and further warrant that should
there be preterition or omission of one, some, or all the compulsory
heirs in the direct line, whether living or not at the time of the
execution of this Deed, will not invalidate/nullify the terms and
conditions of this Deed. Instead, the HEIRS shall proportionately
oblige themselves to pay to the omitted Heirs or the latter’s’ heir(s)
the share which belongs to him/them, in accordance with the rules of
succession under the Civil Code of the Philippines.

10. Finally, this Extrajudicial Settlement is being executed for whatever


legal purpose it may serve.
