Unlawful Interference
Acts of unlawful interference / attempted acts to
jeopardize the safety of civil aviation & air transport :
• introduction on board an aircraft or at an airport of
a weapon or hazardous device or material intended
for criminal purposes;
• communication of false information such as to
jeopardize the safety of an aircraft in flight or on
the ground, of passengers, crew, ground personnel
or the general public, at an airport or on the
premises of a civil aviation facility

Unlawful Interference
Acts of unlawful interference / attempted acts to
jeopardize the safety of civil aviation & air transport :
• unlawful seizure of aircraft in flight;
• unlawful seizure of aircraft on the ground;
• hostage –taking on board aircraft or on aerodromes.
• forcible intrusion on board an aircraft, at an airport
or on premises of an aeronautical facility

Preventive Security Measures

Each state shall establish measures to prevent:


o weapons, explosives or other dangerous
devices …. taken aboard an aircraft
engaged in civil aviation.
If a person needs to carry a weapon due to his
duties, like police or military personnel,
o a special authorisation in accordance with
the laws of the state is required.

Management of Response
Each state in which an aircraft has landed and subject
to an act of unlawful interference shall notify:

• the State of registry of aircraft


• the State of operator
• each State whose citizens suffered fatalities or injuries.
• each State whose citizens were detained as hostages.
• each State whose citizens are known to be on board the aircraft.
• the ICAO

Pilot Procedures
Unless otherwise the pilot should attempt to continue flying
on the assigned track and level at least until able to notify
ATS or within radar coverage.
When ACFT which is subject to unlawful interference must
depart from its assigned track or level without being able to
report that to ATS shall attempt to :
a) to broadcast warnings on VHF FREQ or with other
equipment as transponders and data-link.
b) follow special in-flight contingency procedures when
such have been established.
c) proceed at a level which differs from normal IFR level by
500 ft below FL 290 and 1000 ft above FL 290.

ATC Response
When it is observed that an ACFT is squawking 7500,
the controller shall attempt to verify the code setting.

Whenever it has been verified that the code is


intentionally selected or when no verification
can be obtained, the controller shall assume
that the ACFT has been hijacked.

Unlawful Interference
An ACFT known or believed to be in the state of
emergency including subjected to unlawful
interference, shall be given maximum consideration,
assistance and priority over other ACFT.

• ATS units shall attend promptly to the requests


from the ACFT.
• Information pertinent for the safe conduct of
flight shall continue to be transmitted and
necessary action shall be taken in order to
expedite the conduct of all phases of the flight,
especially the safe landing of the ACFT.

Unlawful interference

When it has been established by ATS that an ACFT


is in the state of emergency, other ACFT known to
be in the vicinity shall be informed of the nature of
the emergency except when….

it has not been referred by the ACFT concerned


that, this information can be passed on an ATS
frequency without aggravating the situation.

Unlawful Interference

Alerting Service shall be provided to :


▪ any ACFT known or believed to be subject
to unlawful interference.

▪ ATS units shall notify RCC immediately if an


ACFT is subject to unlawful interference.
