WITNESSETH
WHEREAS, the OWNER is the absolute owner/administrator of a parcel of lot held in its propriety
capacity situated in Barangay Buenavista, more particularly described as follows; TITLE NO.
031160120429
“A parcel of land owned by the OWNER in Barangay Salvacion , Sto. Domingo, Albay with an area of
One thousand six hundred sixty-two (1662) square meters declared in the name of RICHARD
HUENEFELD , with the following technical description:
1. N 13̊14'’5.1”” E123̊48'1.4"
2. N 13̊14'’5.1”” E 123̊48'11.4"
3. N 13̊14'’15.2”” E 123̊48'11.5"
4. N 13̊14'’5.1”” E 123̊48'’1.5"
WHEREAS, the OWNER desire to give the USUFRUCTUARY the right of Usufruct over the portion of
land with the latter having the full right the use and enjoyment of the fruits of the property in return
for assuming the obligation the obligation to preserve the property during the term of the usufruct;
NOW THEREFORE, for and in consideration of the mutual agreements, covenants and stipulations
herein set forth, the OWNER hereby transfers and conveys unto the USUFRUCRUARY by way of
USUFRUCT the portion of the above-described parcel of land measuring Two Hundred Fifty Square
Meters (250 sq. m.), subject to the following terms and conditions;
1. This grant of usufruct shall be valid and binding for FIFTEEN (15) years renewable
thereafter upon prior authorization from the OWNER;
2. The USUFRUCTUARY shall pay and be liable for all taxes and other charges as the
Government or any of its instrumentalities and agencies may impose by reason arising out
of this agreement and its implementation, including the real property taxes;
3. The USUFRUCTUARY may build and construct Watch Tower on the property subject to
this grant for the use and occupancy of the Bureau of Fisheries and Aquatic Resources, RO 5,
and after the expiration of 15 years Usufruct Agreement, the ownership of the Seaweeds
Solar Dryer on Stilt with Storage shall be transferred to the OWNER. The USUFRUCTUARY
hereby agrees and binds itself to ensure at its own expenses, the Seaweeds Solar Dryer on
Stilt with Storage build or placed therein against loss by fire, typhoon, flood, force majeure
or other similar events. In no case shall the OWNER be liable for any loss, damage, or injury
that may arise, by reason of the use and enjoyment of the fruits of said property by the
USUFRUCTUARY;
4. The USUFRUCTUARY, at its own expense, make all necessary repairs to keep the premises
and its equipment and facilities from deterioration in value or condition during the term of
the grant;
5. The USUFRUCTUARY shall not lease any part or portion of the premises or the whole
thereof, without the express consent of the OWNER;
6. The OWNER hereby covenants that the USUFRUCTUARY shall peaceably hold and enjoy the
full use and possession of the premises at any time;
7. The OWNER may immediately recover possession of the afore described real property,
including all permanent structures and improvements introduced, thereon, without
obligation to reimburse the herein USUFRUCTUARY, terminate the usufruct should the
USUFRUCTUARY violate any of the provisions of this DEED or fail to comply with its
obligation in the Usufruct as prescribed in the New Civil Code of the Philippines, the
applicable provisions of which are incorporated herein and deemed part of the provisions of
this deed.

Known to me and be the same persons who executed the foregoing instrument and they
acknowledge to me that the same is their free and voluntary act and deed, as well as the free act and
deed of the principals they represent.
This instrument refers to a DEED of USURFRUCTUARY RIGTHS and consisting of three (3)
pages, including this page on which this acknowledgement is written, signed by the parties and
their instrumental witnesses at every page hereof.
