CONTRACT OF LEASE

KNOWN ALL MEN BY THESE PRESENTS:

This Contract of Lease made and executed at _________________________,


Philippines, this ____ day of ___________ 2019, by and between:

_________________________, of legal age, married, Filipino and


residing at _________________________, hereinafter referred to as the
“LESSOR”;

-and-

_________________________, of legal age, married, Filipino and


residing at _________________________;

_________________________, of legal age, married, Filipino and


residing at _________________________, hereinafter all referred to as
the “LESSESS”;

WITNESSETH THAT:

WHEREAS, the LESSOR is the Administrator of _________________________


located at _________________________, as evidenced by Tax Declaration NO.
_________________________ issued by the Registry of Deeds of
_________________________.

WHEREAS, the LESSOR has agreed to lease unto the LESSEES and the LESSEES
have agreed to accept by way of lease the said property to be used for residential
purposes;

NOW THEREFORE, for and in consideration of the foregoing premises and of


the covenants and agreements hereunder set forth, the LESSOR hereby leases
unto the LESSEES, and the LESSEES hereby accept by way of lease the
_________________________ located at _________________________, under the
following terms and conditions:

1. SUBJECT OF LEASE. The subject matter of this Contract of Lease is the


_________________________ located at _________________________,
consisting of ______ square meters.

2. USE OF LEASED LAND.


a) The land hereby leased shall be used exclusively by the LESSEES for
residential purposes only and shall not be diverted to other uses
without consent of the LESSOR. It is hereby expressly agreed that if at
any time the premises are used for other purposes without the consent
of the LESSOR, the LESSOR shall have the right to rescind this
contract without prejudice to its other rights under the law.

3. TERM OF LEASE. This contract of lease shall be paid for
_________________________ years, beginning on _________________________
and expiring on _________________________, renewable upon mutual
agreement of the parties.

4. MONTHLY RENTAL. The monthly rental of the subject property shall be


_________________________, Philippine currency, net of withholding tax,
payable on or before the first day of the month on a cash basis without yearly
escalation. The LESSEES shall pay the monthly rental every
_________________________ regardless of whether or not they utilized the
leased premises. The LESSOR shall not refund the LESSEES’ rentals should
they not stay or use the leased premises.

5. DEPOSIT. The LESSOR acknowledges that the amount of


_________________________ deposited by LESSEES to the LESSOR during the
execution of its contract remains with the LESSOR. Said amount shall be
carried over and applied hereto as a security deposit. The deposit shall
answer for any damage caused on the leased premises by the LESSEES and
other person having access thereto through the lease contract. If said deposit
is insufficient to cover cost of damages, the LESSEES are obliged to pay the
difference to the LESSOR. Said deposit or the balance thereof shall be
refunded to the LESSEES upon termination of this Contract.

6. SUB-LEASE, TRANSFER OF RIGHTS. The LESSEES shall not be directly


or indirectly sublet, allow or permit the leased premises to be occupied in
whole or in part by any person or entity other than the LESSEES themselves,
unless expressly allowed by the LESSOR. Neither shall the LESSEES assign its
rights hereunder to any other person or entity and no right of interest thereto
or therein shall be conferred on or vested in anyone by the LESSEE without
the LESSOR’S approval.

7. IMPROVEMENTS. The LESSEES may make houses of light materials and


other temporary improvements in the leased land suitable for residential
purposes only. The LESSEES shall not be allowed to make houses made of
concrete materials, and other permanent improvements in the leased land,
except for flooring.

8. SURRENDER OF LEASED PREMISES. The LESSEE agrees to return and


surrender the leased land free from any structures whatsoever and without
any delay whatsoever, at the expiration of the term hereof or upon
termination of this contract for whatever cause. Upon the expiration of the
Contract, the LESSEES SHALL remove any temporary improvements it has
introduced and/or undertaken in the leased premises. The LESSEES may sell
the houses of light materials and other temporary structures it has introduced
and/or undertaken in the leased premises, provided they SHALL remove the
same from the leased premises upon expiration or termination of this
contract.

9. TERMINATION OF CONTRACT. The LESSOR may terminate this


contract before the expiration date for any violation of the conditions herein

set forth notwithstanding those provided by law. The LESSEES may opt to
terminate the contract before the expiration date, provided they give notice at
lease a month before the intended date of termination. Failure to do so would
result in forfeiture of the deposit amount equivalent to one month rental,
unless otherwise agreed upon.

10. WARRANTY. The LESSOR hereby expressly warrants, undertakes, and


binds himself during the existence of this contract thereof not to lease to a
third party the portion of land leased by them.

11. PUBLIC UTILITIES. All charges for water, electricity, telephone and
others shall be paid by the LESSEES.

12. TAXES, FEES, AND CHARGES. Taxes, fees, and other charges or
burdens imposed on the land shall be borne by the LESSOR.

13. VISITORIAL POWER. The LESSOR and his duly authorized


representatives have the right to inspect the leased premises during
reasonable hours of the day.

IN WITNESS WHEREOF, the parties have hereunto set their hands at the place

Known to me and to me known to be the same persons who executed the


foregoing instrument and acknowledged to me that the same is their free and
voluntary act and deed.

This instrument, consisting of four (4) pages, including the page where this
acknowledgment appears, has been signed by the parties including their two
