Package: CP-01 GENERAL CONSTRUCTION (STRUCTURAL, EXCAVATION, FRAMING,


ARCHITECTURAL AND FIT-OUT WORKS) & ASSOCIATED WORKS

Gentlemen:

In accordance with your "Invitation to Tender" for Contract Package No. 01 (CP-01) - General
Construction (Structural, Excavation, Framing, Architectural and Fit-out Works) & Associated Works
Package for CLUB NALU PROJECT and subject to all conditions and requirements thereof, and of your
Drawings, Technical Specifications and related Tender Documents, which so far as they are related to
this proposal, are made parts thereof, we will furnish the necessary tools, equipment, labour,
materials, plant and supplies and supervision and other incidentals as called for by said Drawings,
Specifications and related Contract Documents, at the following prices in Philippine Currency:

COMMERCIAL PROPOSAL NO.___: Total Contract Price for the Contract Package No. 01 (CP-01) -
General Construction (Structural, Excavation, Framing, Architectural and Fit-out Works) & Associated
Works Package for the CLUB NALU PROJECT - all in accordance with the Drawings, Specifications and
related Tender Documents,

Sixty-Two Million One Hundred Thirty -Three Thousand Sixty-Two Pesos and Thirty Eight Centavos
PESOS (62,133,065.38)

We (or I) make this proposal with a full knowledge of the kind, quantity, and quality of the article and
services required, and if said proposal is accepted, we (or I), after receiving Letter of Acceptance shall
enter into Contract with NALU RESORTS, INC. within two (2) days or as required by the Employer with
good and sufficient securities for the faithful performance thereof.

We (or I) shall complete the specified scope of work for the above package in accordance with the
specifications, and related documents, within the number of days specified in the Project Time
Schedule after award of the Contract to us. We shall not request for any extension of time other than
as provided for under the Conditions of Contract.

We (I) understand that time is an essential part of this proposal, and that upon failure to complete the
project within the stipulated time, we agree to pay Liquidated Damage amount equivalent to one-
tenth (1/10) of one (1%) percent of the Contract Price for each and every calendar day of delay
(Saturday, Sundays and Legal Holidays included), but not to exceed 10% of the Contract Price, in the
fulfilment of this Contract. Said payments shall be made as liquidated damages and not by way of
penalty, and we further agree that NALU RESORTS, INC. may deduct any amount due to us or shall
become due to us and such sum accruing as liquidated damages as herein stated.

We (I) understand that when the extent of work originally contemplated under this Contract is
changed, then the difference between the originally envisaged amount of work and the work
resulting from such change shall be taken into account and an equitable adjustment of the Contract
price shall be made in accordance with the provisions of SECTION 5: GENERAL CONDITIONS OF THE
CONTRACT.

We (I) understand that the Employer reserves the right to reject any and all tenders, to waive any
defect or informality therein, or to accept such tenders as may be advantageous to the Employer.

We (I) hereby certify that we have prepared and/or checked and reviewed the contract procedures,
contract schedules, and prices submitted with this proposal.

Upon receipt of this tender documentation this is to formally confirm our intent to submit proposal
for captioned works. We shall provide all necessary manpower, materials and supervision to
accomplishment of the following items of works. {Bidder to attached proposal in this letter}
