CONSTRUCTION AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This CONSTRUCTION AGREEMENT made and executed this 20 th day of July 2024
in the San Fernando City (La Union) by and between:
Mr. Andrei Antonio B. Argueza with residential address at Purok 04, Brgy.
Pagdalagan Norte, San Fernando City, La Union, herein after referred to as the OWNER;
-and-
Engr. Czandrei Anthony A. Bambao, a licensed civil engineer under the laws of
the Philippines, with residence address at Barangay Pagdalagan Sur, San Fernando City,
La Union hereinafter referred to as the CONTRACTOR;
WITNESSETH:
WHEREAS, the OWNER, Mr. Andrei Antonio B. Argueza, shall construct a
Three-Storey Residential-Commercial Building located Purok 04, Barangay Pagdalagan
Norte, San Fernando City, La Union, with an approximate lot area of 460 square meters;
WHEREAS, the CONTRACTOR presented and warranted to the OWNER that he is
a duly licensed civil engineer and authorized by law to do the construction of the
aforementioned Three-storey Residential-Commercial Building.
WHEREAS, on the basis of the foregoing representation and warranty of the
CONTRACTOR, the OWNER accepted the offer of the CONTRACTOR to construct the
above-mentioned Three-Storey Residential-Commercial Building.
NOW, THEREFORE, for and in consideration of the foregoing premises and the
covenants and undertakings hereinafter set forth, the parties hereto agree as follows:
ARTICLE 1. SCOPE OF WORK. - The CONTRACTOR shall implement the
Proposed Construction at Purok 04, Barangay Pagdalagan Norte, San Fernando City, La
Union.
The CONTRACTOR shall:
(a) Furnish all labor, materials, tools and equipment therein; and
(b) Perform all the works stipulated and required under this Agreement
which are as follows;
Scope of work:
1. Designs, Plans and Permits
2. Necessary survey works if needed
3. Provision for the Building Structural Members (Slabs, Stairs including railings,
Beams, Columns and Foundations)
4. Provision for CHB masonry wall
5. Provision for 2 T&B (one per level) and necessary Plumbing works
6. Provision for Glass windows and doors
7. Provision for Steel Trusses and Roofing System
8. Provision for Tile works
9. Provision for Paintings
10.Provision for Ceiling
11.Provision for Electrical Fixtures
12.All other other finishing as stated in the plans and specifications
13.Water system and Electrical System connection

ARTICLE 2. TERMS OF PAYMENT. - Payment for this Contract shall be based on the
following:

(a) Down Payment - Php 3,000,000 Pesos


(b) Progress Billings of two (2) – Php 2,000,000 Pesos

(c) Retention – Php 300,000 to be released upon Turn-Over to the OWNER (or his
agent) of the Finished Project.

3,000,000 – Down payment


2,000,000 – Second Payment
2,000,000 – Third Payment
2,000,000 – Fourth Payment
300,000.00 – Retention upon completion of project

ARTICLE 3. EXCLUSIONS. All Items and/or Materials which are not indicated in
the scope of work which are not discussed, approved and signed by the parties to this
Agreement shall be excluded from their respective obligations.

ARTICLE 4. CONTRACT AMOUNT. - The CONTRACT AMOUNT shall be Ten


Million Pesos (10,000,000.00).

The OWNER shall pay the CONTRACTOR for the entire performance and supply of
the works, labor, services, materials and equipment stipulated in this Agreement in
accordance with the agreed schedule of payment stipulated in the Article 2 of
this Agreement.

The CONTRACTOR hereby guarantees and warrants the stability, strength


and structural integrity of the subject Multi-Purpose Building within the period
mandated by the Civil Code of the Philippines and other applicable building laws, rules
and regulations.

The OWNER shall not incur any expenses above and beyond the aforementioned
agreed contract amount, except for the additional or extra works or changes that may be
required and authorized in writing by the OWNER and consented to in writing by the
CONTRACTOR.

ARTICLE 5. DEFECTIVE WORKS AND MATERIALS. – All defective works


discovered in the course of the construction until the date of turn-over shall be promptly
made good, repaired, remedied, restored, corrected and rectified by the
CONTRACTOR at his own expense within seven days from such discovery or within
such reasonable period as may be mutually agreed upon by the parties, at the option of
the OWNER.

All unsuitable, sub-standard, and poor-quality construction materials and works


shall be rejected by the OWNER and the CONTRACTOR and shall be promptly made
good, remedied, corrected, rectified, and replaced by the CONTRACTOR at its expense.

All materials and workmanship are guaranteed by the CONTRACTOR for a


period of twelve (12) months from the date of the turn-over of the construction
project.
As stated in Article 6 of this Agreement, the CONTRACTOR hereby guarantees
and warrants the structural stability, strength and integrity of the subject Multi-
Purpose Building within the period mandated by the Civil Code of the Philippines and
other applicable building laws, rules and regulations.

ARTICLE 6. CHANGES AND ADDITIONS. - In the event additional or revised


works shall be communicated in writing by the OWNER to the CONTRACTOR through
written change orders for mutual discussion, approval and documentation and signing
thereof by the parties to this Agreement.

All mutually discussed, approved, documented and signed change orders including
any and all deletions and omissions, shall state the AGREED COSTS of the additional,
revised, deleted or omitted works.
Such agreed costs may or may not result in the upward or downward
adjustments of the agreed Contract Price stipulated in Article 4 of this
Agreement.

ARTICLE 7. TIME OF COMPLETION. - The CONTRACTOR warrants that the


construction of the subject Project (Article 1, scope of works) shall be completed within
Twelve Months (365) working days. Time commencement is from first payment or
signing of contract of the project.

ARTICLE 8. ESCALATION CLAUSE NOT APPLICABLE. - It is agreed that the


Contract Price stated in Article 5 of this Agreement is final and fixed.

It is not subject to escalations or increases in the amounts, rates and


valuations of materials, inflation, deflation, and/or devaluation of the Philippine Currency.

ACKNOWLEDGMENT

BEFORE ME in City of San Fernando, La Union , Philippines on this _6_th day of


July 2024 personally appeared: who are known to me and to me known to be the same
persons who executed the foregoing Construction Agreement consisting of Three (3)
pages, including the page on which this Acknowledgment is written, which Construction
Agreement is signed by the above named parties on the margin of each page thereof, and
who acknowledged to me that the same is their free and voluntary act and deed.
