This has reference to your renewal application for Wastewater Discharge Permit
(WWDP) of your establishment located at the above-mentioned address with application no.
174679.
After careful review and evaluation of the documents submitted, the following
deficiencies/discrepancies were revealed to wit:
1. Proof of Compliance to condition no. 3
Our records showed that you failed to submit an analysis of abstracted or intake water
from DENR-recognized laboratory for parameters BOD and TSS. You are hereby
required to submit this lacking document(s).
Our records showed that you failed to submit a monitoring of your water consumption
and discharge documented daily. You are hereby required to submit this lacking
document(s).
Our records showed that you failed to submit a notarized copies of self-monitoring
reports(SMR) and compliance monitoring reports(CMR) for the year 2021. You are
hereby required to submit this lacking document(s).
4. Proof of Compliance with RA 9275 (Clean Water Act)
Our record showed that your firm failed to submit a copy of Copy of Certificate of
siphoning/desludging of septic tanks, hauling, and transport and treatment of

Certificate as Hazardous Waste Generator (https://hwms.emb.gov.ph). You are
hereby required to submit your proof of online filing for such certificate
through the Online Permitting and Monitoring System
6. Copy of billing statement for the whole year / NWRB Permit
Our record showed that your firm failed to submit a copy of billing statement for the
whole year / NWRB Permit or proof of application of such. You are hereby required to
submit this lacking document(s).
7. Pollution Control Officer Accreditation
Our record showed that your firm failed to submit a copy of valid PCO Accreditation.
You are hereby required to submit this lacking document(s).
8. Proof of Compliance with RA 9003 (ESWM ACT)
Our record showed that your firm failed to submit a proof of compliance with RA 9003.
Kindly submit, any of the following.
• Photo of designated temporary storage area/MRF for recyclables, electronic wastes,

BFLs, batteries and other special wastes.
• Photo of backyard composting area/ facility (if applicable) or proof of collection of
compostable/biodegradable wastes.
• Copy of Contract/MOA with the LGU as hauler and with Contract/MOA with
accredited Sanitary Landfill (SLF)/Co-Processing/TSD Facility operators for disposal
of residual wastes.
• Copy of Certificate of Disposal/Treatment issued by accredited SLF and TSD
Facility operators
9. Penalties/fines and/or arrears
Our records showed that your WWDP is valid only until 10 May 2014 and you filed
your renewal application last 08 February 2022. In this regard, this office has
determined that you are operating with an expired permit. Section 27 Chapter 5 of
Implementing Rules and Regulations of the Republic Act 9275 provides that an act of
discharging regulated water pollutants into a water body or into land from which it
might flow, drain or wash into such surface, ground, coastal or marine water without
the valid Discharge Permit is a prohibited act. As such, this Office is constrained to
hold you liable for the amount of One Hundred Eighty-Eight Thousand, Six

Hundred Thirty Five and 84/100 pesos (₱ 188,635.84) as penalty. Accordingly, you
are given fifteen (15) days upon receipt hereof to show cause why you should not be
imposed the above-mentioned fine/penalty. Otherwise, you are hereby advised to settle
this penalty personally at our Regional Office/PEMU Office through cash, Postal
Money Order, Manager’s/Cashier’s Cheque payable to EMB – MIMAROPA Region.
Hence, your application for WWDP is hereby held in abeyance pending the submission
via OPMS of the above-mentioned requirements in order to resolve the
discrepancies/deficiencies found by this Office. Submission of applications with lacking
requirements or failure to complete the same within thirty (30) days shall be Denied by the
Office without prejudice to refilling.
