THIS IS A FIXED TERM SERVICE CONTRACT BETWEEN JIANGXI WATER AND HYDROPOWER
CONSTRUCTION KENYA LIMITED, a China based Company which carries out civil constrution works on
contractual basis for its various clients in Kenya and of Post Office Box Number 75372-00200 in
Nairobi County in the Republic of Kenya hereinafter called the Company or the Employer which
expressions shall where the context so admits include its successors and assigns of the ONE PART
AND the Employee.

The Company is an equal opportunity employer which does not practice or entertain any form of
discrimnation, harassment or child labour.

COMMENCEMENT OF THE EMPLOYMENT CONTRACT

The employment contract is for a term of three (3) months from the first day of employment on
_______________to________________. The

Contract may be renewed subject to availability of work.

WAGES

You will be working with the company as a/an ______________. Your daily Wage will be
Kshs._____________Per day which will be paid to you in arrears at the end of each month.

You shall also be paid house allawance which shall be twenty per cent (20%) of your basic daily
wage which shall be paid in arrears at the end of the month.

PROBATIONARY PERIOD.

The first two (2) weeks of this employment contract shall treated as probationary period and during
this period, either party may terminate this contract by giving seven (7) days’ notice or pay in lieu.

PERSONAL PROTECTIVE EQUIPMENT

You shall be provided with boots,helmet, reflectors, gloves, ear muffs and goggles (when and where
necessary) which shall be the property of the Employer returnable upon the expiry of the contract or
earlier termination of the contract.

You shall bear the cost of replacement of lost items and shall be provided with another set.

You shall take utmost care of all the company property entrusted to you and shall report any loss or
damage to your immediate supervisor or foreman and it shall be the discretion of the Employer to
decide upon considering all factors including giving you a fair hearing to recover the market value of
the item(s) lost or damaged by yourself from your unpaid salary or any other dues if it is found that
there was negligence on your part.

SICK LEAVE

You shall be entitled to sick leave on production of medical certificate from a registered medical
practitioner.

HOURS OF WORK

The normal working hours per week shall be forty - five (45) hours at the rate of eight (8) hours per
day from Monday to Friday and five (5) hours on Saturday.

OVERTIME

You shall shall be paid fifty per cent (50%) over and above the normal hourly remuneration rate for
overtime worked from Monday to Saturday.

On Sundays and during gazetted Public Holidays, you shall be paid tripple the normal hourly rates for
all the hours worked..

ANNUAL LEAVE

You shall be entitled to two decimal two five (2.25) days’ leave for every full month worked on
prorata basis which translates to twenty six (26) days for every full calender year worked which shall
be applied for seven (7) days in advance after it falls due and which shall be sanctioned by the
Employer depending on the labour needs prevailing at the site for the time being.

You shall be at liberty to commute his leave days at the end of every calender year in agreement
with the Employer in exchange for pay.

Should the contract be terminated before its expiry, you shall be paid prorated leave at the rate of
2.25 days for every completed month of service..

TERMINATION

Either party may terminate this contract upon giving the other party one (1) month’s notice or one (1)
month’s salary in lieu of notice.

The Employer shall comply with the laid down procedure before terminating your employment.

SUMMARY DISMISSAL

The Employer shall summarily dismiss you from employment if you found to have committed any
act(s) that amount to gross misconduct as provided by the law.

Employer shall however follow the procedure prescribed by law before dismissing you from
employment.
