The information contained in this Request for Qualification - Technical Proposal (“RFQ-
Technical”) or subsequently provided to Applicant(s), whether verbally or in documentary
form by or on behalf of MUMBAI METROPOLITAN REGION DEVELOPMENT
AUTHORITY (MMRDA) (hereinafter collectively referred to as the “Authority”) or any of
their employees or advisors, is provided to Shortlisted Applicant(s) on the terms and
conditions set out in this RFQ-Technical and such other terms and conditions subject to
which such information is provided.

This RFQ-Technical is not an agreement and is neither an offer nor invitation by the
Authority to the prospective Applicants or any other party. The purpose of this RFQ-
Technical is to provide interested parties with information to assist in the formulation of their
Technical Proposal (as part of the qualification process) pursuant to this RFQ-Technical
(hereinafter referred to as the “Technical Proposal”). This RFQ-Technical Proposal
Document includes statements, estimates, projections, targets and forecasts, which has been
prepared in good faith with due care and caution and reflect various assumptions and
assessments arrived at by the Authority in relation to the Project(s). Such assumptions and
statements do not purport to contain all the information that each Applicant may require.
This RFQ-Technical Proposal Document may not be appropriate for all persons, and it is not
possible for the Authority, their employees or advisors to consider the investment objectives,
financial situation and particular needs of each party who reads or uses this RFQ

The assumptions, assessments, statements and information contained in this RFQ-Technical


Proposal Document may not be complete, accurate, adequate or correct and each Applicant
should conduct its own investigations and analysis and should check the accuracy, adequacy,
correctness, reliability and completeness of the assumptions, assessments and information
contained in this RFQ-Technical Proposal Document and obtain independent advice from
appropriate sources.
The Authority, their employees and advisors or consultants make no representation or
warranty and shall have no liability to any person, including any Applicant(s), under any law,
statute, rules or regulations or tort, principles of restitution or unjust enrichment or otherwise
for any loss, damages, cost or expense which may arise from or be incurred or suffered on
account of anything contained in this RFQ-Technical Proposal Document or otherwise,
including the accuracy, reliability or completeness of the RFQ-Technical Proposal document
and any assessment, assumption or information contained therein or deemed to form part of
this RFQ-Technical Proposal document or arising in any way with pre-qualification of
Applicants for participation in the Bidding stage.

The Authority may in its absolute discretion, but without being under any obligation to do so,
update, amend or supplement the information in this RFQ-Technical Proposal document.

This Document is issued only to facilitate the submission of Technical Proposal.

The issue of this RFQ-Technical Proposal document does not imply that the Authority is
bound to invite the Applicant(s) for submission of Financial Bid or to appoint preferred
bidder / sponsor or concessionaire, as the case may be, for the Project (s) and reserves the
right to reject all or any of the Proposals without assigning any reasons whatsoever.

A copy of DPR made available to all the Shortlisted Applicants is a reference document for
general guidance only. Shortlisted Applicants are required to make their own independent
assessment of all aspects including Travel Demand/Ridership, Geotechnical Data, availability
of Power Supply, Construction Methodology and requirement of all Subsystems required for
the proposed MRTS system.
