It further revealed. that members of this organization were holding meetings at various place i.e. Faridabad, Kolkat.a, Bhopal, Jabalpur, Indore, Nasik etc. They were uniting peC!ple from all O\~er India and were making 'preparations for achieving their objects. on: 29/09/2008, during Ramzan, at about 2135 hrs, there was a bomb explosion in a : cro~ded place, opposite Shakil Goods Transport Company, between Anjuman Chowk and Bhiku Chowk, Malegaon. The said blast took place by an explosive device fitted on LML Freedom motorcycle bearing number MH-15-P-4572. As a result of the explosion six persons were killed and 101 were injured with various degrees of injuries and causing : damage to property worth Rs. 4,23,500=00. Since it was the holy month of Ramzan and on 30/09/2008 the holy festival of Navratrotsav was to commence, it was apparent that, the conspirators had caused' bomb blast

with intent to strike terror in the people by using bomb/explosive substance and/or other substances as 'to cause death or injuries to persons or damage or destruction of property or disruption services essential t~· the life of th~ community and to cause damage and to create communal rift. Immediately after the blast, police rushed 'to the spot to investigate the case, but they were prevented from going to the spot.as some 15,000 people gathered there as they were angered by the blast. They started pelting stories anc~ attacked police in protest. This mob fury lasted for few hours resulted in injury to many policemen and damage to many vehicles. The investigation in the bomb-blast case could start only after the mob was controlled and the fury subsided. In this connection a separate case of rioting .·&a.ttempt to murder was registered by Azad Nagar Police Station vide C.·R. No. 131/08.

A case regarding bomb blast came .to be registered 30/09/2008 at 0300 hrs. vide Azad Nagar Police Station, Malegaon vide C R No. 130/2008 u/s302,307, 326,324, 427, IS3-A, 120-8 IPC r/w s. 3, 4, 5 of Explosive Substances Act.

After the bomb explosion, a team of experts from Forensic Science Laboratory (FSL) , Nasik visited the spot of blast and carried oJl.t scientific investigation. The experts opined that the exhibits collected from the place of offence contained Cyclonite (RDX) , Am~onium,Nitrate and Nitrite radic~ls.

used as an explosive. Further investigation revealed that the motor cycle GJ- 05-BR-1920, which was used in the blast stood in thenameof accused NO.

During the house search of accused Sudhakar Onkarnath Chaturvedi (A~ll) one detonator, Gunny Bag & Cotton Swabs etc were taken in presence of experts of Forensic Scie"tice Laboratory. The same were sent to FSL, Mumbai which opined .that the seized articles contained traces of Cyclonite (RDX) , ArrtmoniuIl_l Nitrate and Nitriteradicals.FSL has also opined that explosive ingredients '(RDX , Ammonium and Nitrite radicals) detected in blast site exhlbitsat Malegaon are similar to that of report in. samples seized from. the house accused.

The call details of some mobile numbers used by the accused are yet to be received. Those call details will' be filed as soon as they are received as additional documents.

The investigation is still in progress, Reports of FSL in connection with Voice Sample and electronic timers is still awaited. However, report about analysis of the contents of laptops, mobile phones, pen drives, taken charge of during the course of investigation is received fromfSL, Mumbai on 17/1/09. Transcripts of SOme audio tapes retrieved by FSL from the of hard disc of laptop of accused Sudhakar Dhar Dwivedi(A-lO),are prepared and submitted along with the chargesheet. The material retrieved by FSL, from the hard disc of laptop of accused Sudhakar Dhar Dwivedi and mobile phones, pen drives r . other laptops is voluminous. Therefore, it is necessary to study the material receiyedfromFSL andinvestigate further in the case. AND WHEREAS,

on going through the case papere, reports .

prior approval, statements of witnesses and other material, placed

before me, I am satisfied that there is sufficient material against the

accused persons referred to herein above of having conspired and aided

and abetted each other to achieve the objective of the Organised Crime

Syndicate, thereby liable for being tried under sections 3 (l)(i), 3(1)(ii),

3(2L 3(4) and 3(5) of the M.C.O.C~ Act, 1999.

AND WHEREAS, I find that arrested accused persons referred to

hereinabove have conspired to commit continuing unlawful activities

and in pursuance of a criminal conspiracy, the accused persons

caused bomb explosion in Malegaon town on 29.09.2008, with the

. objective of gaining undue advantage of obtaining political hold on

Hindu community apart from obtaining pecuniary benefits for

themselves by indulging in these continuous unlawful activities.

Accused Rakesh Dhawde, has' committed more than one offence of'

similar nature in the past ten years for and on behalf of the organized

crime syndicate and more than one charge sheet has been filed against

him before the competent courts, punishable with imprisonment for

more than three years, and that the s~d courts have taken cognizance of said offences. The accused persons referred hereinabove, have

knowingly conspired, facilitated, aided, participated abetted. and

advocated the objective of the above mentioned, Organized Crime

Syndicate .

Brief History of case: On :29lhSep.08 around 21:3 5hrs. an explosion had occurred in Bhiku Chowk in front of shakil transport at-lice. The bhiku chowk is a crowded area. Five persohs were killed and around eighty persons were

· injured in the blast. Nasik control room had in formed about the incidence around 23.00hrson 29/09/08. The scientific team reached the spot around 5.3011rs on 30/09/08 .

. Observation at crime Scene: The motorbike (Llvll. Freedom) bearing no. MH- ' 15-P4572 "vas found to be severely daruagedtRe fer Photo No.1 )The seat

· portion & fuel tank was completely blown 011 The rear tyre of the bike was

also damaged. The dickey of the bike was also blown off. The shock absorber, .: plastic. pieces (Golden color) of the bike, spring of the side stand of the bike, .: rubber pieces, sponge, fuel lank etc were observed at the spot. The damaged bike bears distinct chasis number(Refer Photo No.2) however the careful

obs.ervation on engine .block does not reveal any engine no. but bears scratches on.theengineblockflcefer Photo No.3) The other blackbike(Honda Unicorn) bearing 'no. MHAIIMH15 was found to havesmall holes on the body, This vehicle was standing about 5 foot behind the Llvll, Freedom bike.(Refer Photo no.4). Five bicycles having small holes on the body, bent tyres, broken spokes

were also observed. TI1e shakel transport office located about 10 foot away from the parked Llvll, Freedom bike had also holts on its roof, damaged pari of vehicles, ball bearings & threaded sm~llcast iron pieces. The. shakel transport office' papers, bed sheets' & furniture were found to be .. partly burnt. The

· meticulous observation at crime scene reveals presence of small threaded cast iron pieces & ball bearings.(Refer Photo no.S) The crime scene spot was carefully searched for stop watch/alarm piece, 'electrical wires battery piece & . detonators . pieces. The spot does not reveal any presence of stopwatch/alarm

piece, electrical wires & detonator pieces .. The crime scene spot also does-not

bearings which were used as missiles in explosive device.

. to the Laboratory for analysis of explosive residues. The 1.0. was also instructed to send the victims cloth & missiles/cast.iron pieces found in the body for explosive' residue analysis .

. Observations & Conclusions: The careful observation of the damaged L~1L

, freedom bike reveals that the explosive device was placed below the seat of motorbike (LML Freedom) bearing no. MH-15-P4572 (Refer Photo No.1) The fuel tank of the bike had blown off due to explosion which further ~esulted in to
