CONTRACT TO SELL

KNOW ALL MEN BY THESE PRESENTS:


This contract, made and entered into by and between Michael S.
Cosue, of legal age, single, Filipino citizen and resident of
___________________________, Pangasinan, hereinafter called the SELLER, and
Domiciano O. Mendoza married to Florinda V. Mendoza and Rode O.
Mendoza, widower, all of legal age, Filipino citizens and residents of Brgy.
San Bartolome, Rosales, Pangasinan, hereinafter called the BUYERS.
WITNESSETH:
1. That the SELLER is the registered owner of a pertain parcel of land
identified as agricultural land, located in Tomana West, Rosales,
Pangasinan, containing an area of THIRTY SEVEN THOUSAND FOURTY
FOUR (37,444) SQUARE METERS, covered by TCT No. T-75399 more
particularly bounded and described as follows.
North: NE Brgy. 036
East : SE 025

South: SW: 021 irrig. Canal


West: NW: 022, Sec. 08,023,010

2. That, for in consideration of the agreed purchase price Eight hundred


thirty two thousand and fifty pesos (P 832,050.00) Philippine
Currency. ON EHUNDRED THOUSAND PESOS has been paid by the
BUYERS upon the execution of this instrument, and the balance to be
paid within seven (7) years by every cropping of Fifty Thousand
(P50,000.00), due on or after the cropping of each harvest season of
the year, the SELLER does by these presents, PROMISE TO SELL to the
buyers, the 5,547 square meters from the above described parcel of
land (which area they are tilling since 1985), under the following terms
and conditions:
a. That Twenty Five Thousand Pesos (P25,000.00) each from
Domiciano O. Mendoza and Rode O. Mendoza be paid to the
seller on or after the cropping of each year.
b. Upon the payment of the total purchase price by the BUYERS, the
SELLER binds himself to deliver to the BUYERS a good and
sufficient Deed of Sale and conveyance for the said 5,547 square
meters of the above described property free and clear of all liens
and encumbrances except such as may be subsisting by
operation of law, the expenses for the transfer of the title to be
defrayed by the BUYER.
c. The BUYERS shall have the option to pay the entire balance of
the purchase price at any time within the period stipulated.
d. All taxes and any special assessments imposed by the
Government on the property, beginning with the year following
actual delivery of possession, shall be for the account of the
BUYERS as if the property were its own.
e. The BUYERs shall not erect or cause to be erected, permanent
improvements on the subject premises without the previous
written consent of the SELLER;

3. That this agreement shall inure to the benefit of, and be binding upon,
the parties hereto and their respective representatives and assigns,
but the right of the BUYERS by virtue hereof cannot be validly
transferred, assigned or encumbered to a third aprty without the prior
written consent of the SELLER.
IN WITNESS WHEREOF, the Parties have hereunto set their hands this

Contract to Sell consisting of two (2) pages, duly signed on each page and
