Implementation of Scheduled Tribes and Other Traditional Forest Dwellers

(Recognition of Forest) Act, 2006.


------The Government of India has enacted The Scheduled Tribes and Other
Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 which came into
existence on 29.12.2006. Under this Act, the State Government have to recognize and
vest the forest rights and occupation in forest lands in forest dwelling scheduled tribes
and other traditional forest dwellers who have been residing in forests for generations
but whose rights could not be recorded and therefore it has become necessary to
address this long standing demand of Scheduled Tribes people and the traditional forest
dwellers. This Act extends to the whole of India except the State of Jammu and
Kashmir.
2. Government of India have requested the State Government to implement the
provision of this Act and distribute title deeds to the claimants before 31.12.2009. In
order to implement this Act, the State Government have already constituted following
Committees:i)

State Level Monitoring Committee headed by the Chief Secretary.


District Level Committee headed by the District Collector.
Sub-Divisional Level Committee headed by the Revenue Divisional Officer.

3. Objective of the Act.

To give rights to Scheduled Tribes and other traditional Forest Dwellers of


land in their historical possession.
To provide rights to Scheduled Tribes and other traditional forest dwellers to
collect, use and dispose off minor forest produce.
To provide rights to Scheduled Tribes and other Traditional Forest Dwellers
on land used for Community purposes.

Under the provision of this Act, land rights are to be conferred to scheduled
tribes who are in possession of land upto 13th December 2005. (Cut-off date) and land
rights to other traditional forest dwellers in case they are in possession of the land for
three generations calculated as 75 years.
4. The District Collectors have to facilitate to hold meetings of Gram Sabhas in
villages and to set up Forest Rights Committees to decide the nature and extent of
forest rights of individuals or for community purposes and submit reports to the Gram
Sabhas which will pass resolutions on claims on forest rights after giving reasonable
opportunity to be heard to the interested persons etc., The Gram Sabhas then will send
their reports to the Sub-Divisional Level Committee after scrutiny of claims of the
claimants. In short, the Sub-Divisional and District Level Committees would be
monitoring the process of recognition and vesting of forest rights and hear appeals (if
any).

5. Claims Received for Forest Rights:


As on 31.08.2009, 8502 claims have been received from 15 Districts in the State
as under. However, till date only 89 title deeds are finally kept ready in the Villupuram
District only.

6. The Chief Secretary has already convened 2 meetings of the State Level
Committee on 19.11.2008 and on 06.08.2009 and reviewed the progress. There is an
urgent need to step up the efforts at the District Level to complete the task before
31.12.2009. The State Government have already committed to the Government of India
that all claims will be scrutinized, finalized and title deeds are distributed to the eligible
claimants before 31.12.2009.
7. Therefore these 16 District Collectors have to evince interest to see that the
Gram Sabha meetings are organized at village levels, Forest Rights Committee are
formed and claims are received, verified and are finalized. The distribution of the title
deeds to the claimants shall be done after getting clearance from the Honble High
Court of Madras as the Court have already directed the State Government to process
claims but actual distribution of title deeds shall be done after getting orders from the
High Court (as ordered in M.P.No.1 of 2008, in W.P. No.4533/2008, dated 30.04.2008).
