SERGEANT ADVISED ME THAT SERGEANT WAS REQUESTING A PATROL OFFICER TO ASSIST IN CONDUCTING A TRAFFIC STOP ON HIGHWAY SR85. SERGEANT STATED THAT SERGEANT WAS FOLLOWING A GOLD IN COLOR HONDA SEDAN BEARING AZ LICENSE PLATE NORTH ON HIGHWAY SR85 NEAR THE ARIZONA STATE LEWIS PRISON COMPLEX. SERGEANT ADVISED THAT SERGEANT HAD RECEIVED INFORMATION FROM ANOTHER AGENCY THAT THE VEHICLE WAS TRANSPORTING DRUGS FROM THE BORDER. SERGEANT ADVISED THAT HE HAD ALREADY ESTABLISHED PROBABLE CAUSE FOR THE TRAFFIC STOP. IT SHOULD BE NOTED THAT HIGHWAY SR85 IS KNOWN DRUG CORRIDOR FOR TRANSPORTING DRUGS FROM THE MEXICO BORDER. I RESPONDED TO THE AREA OF HIGHWAY SR85 AND HAZEN RD TO AWAIT THE VEHICLE TO PASS ME. I OBSERVED THE VEHICLE TRAVELING NORTH ON HIGHWAY SR85 NEAR IN THE #2 LANE. AS THE VEHICLE PASSED ME, SERGEANT ADVISED OVER THE RADIO THAT A RED TRUCK FOLLOWING DIRECTLY BEHIND THE GOLD HONDA WAS ALSO INVOLVED. THE VEHICLE HAD A FULL SIZE WHITE PIECE OF PAPER IN THE LOWER PART OF THE DRIVER SIDE WINDSHIELD. TEODULO MADE EYE CONTACT WITH THE SUITCASE AT LEAST ONE TIME. AT THIS TIME, I BELIEVED CONTRABAND WAS POSSIBLY INSIDE THE SUITCASE. I CONTINUED GIVING TEODULO VERBAL COMMANDS IN AN ATTEMPT TO SEE HIS HANDS. TEODULO'S MOVEMENTS INSIDE THE VEHICLE WERE NOT NORMAL TO ME. I HAVE RESPONDED TO ASSIST OTHER AGENCIES IN THE SAME AREA WITH DRUG RELATED INCIDENTS. IN THOSE CASES DRUG SMUGGLERS HAVE FLED ON FOOT LEAVING THEIR LOADS INSIDE THE VEHICLE. DUE TO ALL THE AFOREMENTIONED INFORMATION, I TOLD THE TEODULO, IF HE MOVED I WOULD KILL HIM. I TOLD TEODULO THIS STATEMENT IN AN EFFORT TO STOP ANY POTENTIAL VIOLENT ALTERCATION. AT THIS POINT, TEODULO COMPLIED WITH ALL OF MY VERBAL COMMANDS. OFFICER ARRIVED ON SCENE AS A BACK-UP OFFICER. I BRIEFED OFFICER OF TEODULO'S ACTIONS. I WALKED AROUND TO THE DRIVER DOOR AND CONTACTED TEODULO. I HAD TEODULO EXIT THE VEHICLE AND FACE INSIDE THE DRIVER DOOR FRAME, I CONDUCTED A PAT DOWN FOR WEAPONS, NO WEAPON WAS FOUND ON HIS PERSON. THE TRAFFIC STOP OCCURRED AT STATE ROUTE 85 AND MILE POST 150 (BUCKEYE, AZ). OFFICER RECEIVED INFORMATION THAT THE VEHICLE WAS POSSIBLY TRANSPORTING DRUGS FROM THE MEXICO BORDER. I ARRIVED AT THE TRAFFIC STOP AS OFFICER BACK-UP. IT SHOULD BE NOTED THE HONDA'S WINDSHIELD HAD AN OBVIOUS OBSTRUCTION. THE PAPER APPARENTLY WAS THE DRIVER'S PERMIT TO ACCESS A MILITARY BASE IN YUMA (AZ). I ARRIVED ON SCENE TO ASSIST OFFICER WITH THE TRAFFIC STOP. I PARKED MY PATROL VEHICLE DIRECTLY BEHIND OFFICER PATROL VEHICLE. I EXITED MY PATROL VEHICLE AND WALKED UP TO THE TRAFFIC STOP. I OBSERVED OFFICER STANDING BY THE HONDA'S RIGHT REAR QUARTER PANEL. THE DRIVER OF THE VEHICLE WAS SITTING IN THE DRIVER'S SEAT. OFFICER ADVISED ME THE DRIVER HAD REPEATEDLY FAILED HIS VERBAL COMMANDS. DATE/TIME: 10/10/2014 1224 DR#: 141013057 ADDRESS: NB SR85 & MC85 CITY: Buckeye ST: Arizona -------------------------------------------------------------------- NARRATIVE: On 10/10/2014, at approximately 1110 hours, I received a telephone call from US Border Patrol Agent who informed me that a gold Honda Accord, Arizona registration had passed through their checkpoint outside of Yuma. Agent told me that agents working the checkpoint observed indicators that the vehicle may possibly transporting narcotics based on current trends. Agents at the check point believed the vehicle had a temporary license plate in the windshield. The agents working the checkpoint were unable to get to the vehicle in time for a secondary inspection before it left the checkpoint eastbound on Interstate 8. The agents working the checkpoint notified Agent and he attempted to catch up to the vehicle. Agent was at the Welton Border Patrol station at the time he received the information. As Agent did not believe he would be able to catch up for the vehicle and asked if I could assist with locating it. I drove to State Route 85 and monitored northbound traffic at mile post 134. While monitoring traffic, I observed a gold Honda Accord pass northbound. I pulled out and got behind the vehicle and confirmed that it was the vehicle Agent provided the information on. While traveling north in the left lane in my unmarked police vehicle, the Accord travelled in the right lane varying speed between 63 and 65 miles per hour. The vehicle had a piece of paper taped to the lower left portion of the windshield, directly in line of the driver's view. At least two times between mile post 137 and mile post 139, the right hand tires of the Honda crossed the lane marker line on the right hand side of the roadway. While following the Honda, a red Ford truck driving northbound behind me approached at a high rate of speed. I turned my rear lights on to warn the driver to slow down. The driver slowed, but then would drop back and speed back up. This driving behavior was displayed approximately 20 times. As it is not uncommon for narcotics traffickers to have trail vehicles, I contacted Agent to see if the Honda had gone through the checkpoint with the red Ford truck. Agent told me that he would contact the checkpoint to find out. Agent called me back and asked if the license plate on the truck was Arizona . I informed him that I did not know because the truck was behind me. Agent told me that it the plate on the truck matched the plate he had given me, it belongs to a known drug smuggler. I had previously contacted Sgt. and asked for assistance from patrol with the traffic stop on the Honda. As it now appeared the two vehicles may be together, I asked patrol to stop the Honda while I stopped the Ford truck. Officer stopped the Honda on northbound SR85, just north of Hazen. I stopped the truck at SR85 and MC85 while patrol stopped the Honda on SR85 north of Hazen at approximately 1224 hours. I contacted the driver of the truck and asked him for his license, registration and insurance card. The driver, identified by an Arizona driver's license as , Uriel, provided me the requested documents. I asked the driver to exit the vehicle and he complied. Once outside the vehicle I explained the reason for the stop to Uriel. Uriel understood the violation. I asked Uriel where he was coming from and he told me he was coming from Yuma. I asked him where he was going to and he told me he was going to visit his mother in Phoenix. I asked him if his mother knew he was coming and he told me she did not. I asked Uriel what his mother's address was and he did not know. I asked him what street his mother lives on and he did not know. I asked Uriel if he knew the person traveling in front of him prior to his being stopped and he told me he did not. I asked Uriel if he had anything illegal in the vehicle and he told me he had a gun. A chrome plated Colt 9mm pistol was located under a ball cap on the front seat. An engraving in the slide read "El Rey." I asked him if he goes by El Rey and Uriel told me that El Rey was the manufacturer of the pistol. Mexican drug cartel members often times engrave their street name into their firearms. I asked Uriel for consent to search his vehicle and he stated I could. As no Buckeye Police K-9 Officers were available, I contacted K-9 Sgt. of the Arizona Department of Corrections for assistance. Sgt. who had arrived on scene shortly prior to locating Uriel's pistol waited with Uriel while I went to Officer traffic stop to see if the two vehicles were related. Upon arrival at Officer traffic stop I observed that Officer was in the process of searching the Honda. Upon speaking to Officer he told me that the driver had made furtive movements towards the center console upon his initial contact. I asked where he was going and he told me he was on his way home to Mesa from work in Yuma. stated he was a plumber and was currently working for a contractor on the military air base in Yuma. The large piece of paper taped to his windshield was a Department of Defense pass to be on the base. I asked for his boss' telephone number so I could confirm his story. provided it to me and I contacted him employer. I spoke to a male named who verified that had just left work in Yuma a couple of hours prior. I informed Officer that I would be returning to my traffic stop to resume the investigation. K-9 Officer used a narcotics certified K-9 to conduct a sniff of the vehicle. The K-9 did not alert.
