AFFIDAVIT OF ARREST
I, PO2 Dan Oliver Landicho y Corpuz of legal age, a bonafide member of the
Philippine National Police and presently assigned at District Mobile Patrol Unit, Manila
Police District, United Nations Avenue, Ermita, Manila, after having been duly sworn to
in accordance with law, do hereby deposes and states.
1. That, on November 11, 2011 at about 10:05 in the morning, our office
received an information from Rey Cereneo y Santua of 314 Sta. Teresita Street,
Sampaloc, Manila that there was a shooting incident committed along Dimasalang
corner A. Maceda Streets, Sampaloc, Manila;
2. That, acting on the said information, I together with my buddy, PO2

Magno A Lopez, were directed by our Chief of Office PCI EDGAR ALINDAO REYES to
respond/proceed at the reported place of incident to verify the veracity of the said
information and if affirmative, to conduct an ocular investigation;
3. That, I acted as a team leader and upon arrival at the place of the
incident, I was personally informed by the witnesses/by standers that victim one
ALEXANDER BAUTISTA y PEREZ was already rushed to the Ospital ng Sampaloc,
Sampaloc, Manila for medical treatment; and that, I was likewise informed that the
suspect escaped after the incident with the weapon he used in the commission of the
crime;
4. That, I immediately informed our Office/Unit confirming this incident; and

thereafter, I, together with my buddy, PO2 Magno A Lopez and one Rey Cereneo y
Santua, who personally witnessed the incident and volunteered to help us, proceeded
at the squatters area in Del Pan, Tondo, Manila were the suspect ran after the incident;
and upon arrival thereat at about 10:45 o’clock in the morning of the same date, our
witness positively identified the suspect to us who was then walking near a creek along
Tahimik Street, Del Pan, Tondo, Manila;
5. That, I immediately identified ourselves to him (suspect) as police officer

and members of District Mobile Patrol Unit, MPD and that, I subsequently arrested the
same with the assistance of my buddy; and that I likewise informed him the reason of
his arrest and of his constitutional rights in a dialect known to and understood by him,
such as: he has the right to remain silent, to have a competent and independent
counsel of his own choice, and if he cannot afford the service of a lawyer, one shall be
provided for free by the government and any statement made by him during
investigation may be used for or against him in any Court of Law in the Philippines and
that he can waive these rights only if it is done in writing and in the presence of a
counsel. However, during the arrest, the weapon he used was no longer in his
possession and cannot be ascertained/located;
6. That, he (suspect) submitted himself to us peacefully; and further

identified himself as one CARLO VILLEGAS y SAN PEDRO of 1025 Craig Street,
Sampaloc, Manila; and that, we immediately brought him to our office/unit for medical
examination, investigation and proper disposition; and
7. That, I executed this affidavit/statement to attest the veracity of the

aforementioned facts and to support the filing of appropriate charge in court against
the arrested suspect.

one Rey Cereneo y Santua, who personally witnessed the incident and volunteered to
help us, proceeded at the squatters area in Del Pan, Tondo, Manila were the suspect
ran after the incident; and upon arrival thereat at about 10:45s in the morning of the
same date, our witness positively identified the suspect to us who was then walking

him the reason of his arrest and of his constitutional rights, I subsequently assisted him
in making the arrest, however, during his arrest, the weapon he used was no longer in
his possession and cannot be ascertained/located;
6. That, he (suspect) submitted himself to us peacefully; and further

identified himself as one CARLO VILLEGAS y SAN PEDRO @ CALOY of 1025 Craig
Street, Sampaloc, Manila; and that, we immediately brought him to our office/unit for
medical examination, investigation and proper disposition; and
7. That, I executed this affidavit/statement to attest the veracity of the

aforementioned facts and to support the filing of appropriate charge in court against
the arrested suspect.
