Casio and Palatino earlier led House Bill 6613, which sought to repeal several contentious provisions in RA 10175. The bill remained stuck at the committee level.
Palatino said that with very little time left, the Congress remained lukewarm on the issue. Sessions in both houses of Congress would resume on January 21, and will continue only until February 8 to give way to the campaign period. It is obvious that Congress leadership is not keen on passing the Cybercrime repeal bill. Yet we still have one potent tool left -- great public pressure. Just as what happened in the RH Law, mounting public pressure will force the House leadership to act, Palatino said.

Garcia resisted her suspension and camped inside her ofce at the provincial capitol and vowed to cling on until the CA ruled on her petition. She claimed her suspension was illegal and politically motivated. Salvador argued that the case was not about back wages but about Garcias lost opportunity to serve her constituents and her besmirched reputation as a resul of her suspension from ofce. He said the suspension should be nullied because it violated Garcias right to speedy trial and that under the Local Government Code an administrative case must be re-
solved within 30 days. The complaint was led in November 2010 and the investigation was terminated on August 31, 2011, but the suspension was carried out on December 11, 2012, or 474 days after the complaint was led, Salvador said. The Ofce of the Solicitor General said the 30-day period for the government to resolve an administrative case is not mandatory because of other duties and responsibilities of the president. Justice Veloso said the case has been submitted for resolution and they are expected to come out with a decision in the next few days. Thats why we met immediately. In December last year the Comelec announced that the personnel from 33 government ofcesincluding the National Bureau of Investigation and the Bureau of Customswere included in the list of those authorized to carry rearms during the election period. Meanwhile, Senator Gringo Honasan, head of the Senate committee on public order and dangerous drugs, on Thursday said he supported the stand of the National Police for gun control instead of a total gun ban. They are asking for a stricter implementation of the law, Honasan told reporters after a public hearing on rearms and recrackers.
He said he would be proposing to increase the penalties on the illegal sale of rearms and on crimes involving the use of guns. In the House of Representatives, lawmakers on Thursday rejected or supported the calls to revive the death penalty and the proposal for a total gun ban. House Deputy Majority Leader and Marikina City Rep. Romero Federico Quimbo and Quezon City Rep. Winston Castelo said gun control and not a gun ban would address the increasing number of crimes involving guns. I dont support either, Quimbo said. These proposals are but an overreaction that will complicate yet not solve the problem. The death penalty has been proven
as ineffective in curbing crime. What we need is enforcement. Castelo, vice chairman of the House committee on dangerous drugs, said the re-imposition of the death penalty was not the solution to crime. What we need is Japan-like gun-control laws, strict but efcient and effective, Castelo said. Rep. Angelo Palmones, author of House Bill 4084, a bill seeking to revived the death penalty, admitted that his proposal and a similar one led by the late Bohol Rep. LABOR Department on Thursday released the list of declared Regular Holidays, Special (nonworking) Days, and Special Holiday (for all schools) for the Year 2013. Labor Secretary Rosalinda Baldoz said the employers of private workers should observe pay rules for holidays in 2013. President Benigno S. Aquino III issued Proclamation No. 459 on Aug. 16, 2012, consistent with the laws of the Philippines governing the observance of holidays, to wit: Republic Act (RA) No. 9492, dated 24 July 2007, which amended Section 26, Chapter 7, Book I of Executive Order (EO) No. 292, also known as the Administrative Code of 1987, by declaring certain days, specic or movable, as special or regular holidays. She said that under Proclamation No. 459, there are 10 regular holidays, seven special nonworking days, and one special holiday for all schools for the year 2013, as follows: Regular Holidays: New Years Day, Jan. 1 (Tuesday); Maundy Thursday, March 28; Good Friday, March 29; Araw ng Kagitingan, April 9 (Tuesday); Labor Day, May 1 (Wednesday); Independence Day, June 12 (Wednesday); National Heroes Day, Aug. 26 (Last Monday of August); Bonifacio Day, Nov. 30 (Saturday); Christmas Day, Dec. 25 (Wednesday); and Rizal Day, Dec. 30 (Monday). The senator issued the blunt remark in reaction to the public admission of Senate President Juan Ponce Enrile that he authorized the release of the Christmas bonuses of 22 senators totaling almost P30 million from unspent funds. At least 18 senators received P1.6 million each and four senators P250,000 each. Enriles admission was unconscionable, even if he defended his action as purely discretionary on the part of the Senate President. The savings remain public funds that could be reallocated to more deserving sectors such as health and education. They could contribute to the funding of farm-to-market roads, purchase medicines in behalf of many indigent Filipinos or rehabilitate bridges or other structures damaged by recent typhoons. SENATOR Miriam Santiago said a mouthful that should put many of her colleagues in the Senate and the House of Representatives to shame. The feisty senator called a spade a spade when she exposed the practice of her colleagues to pocket, every year, hundreds of millions of pesos in pork barrel kickbacks, unspent money in their budgets and numerous bonuses coming from secret funds. In the Atimonan case, the administration was just caught noynoying again, and Aquino just isnt honest enough to admit that the only knee that was jerking was his. *** Speaking of implicit trust, Aquino has just named yet another former classmate, Alfredo Benjamin Caguioa, as the new chief presidential legal counsel. Nothing illegal about this new appointment, certainly, although you may wonder if there are still any of Aquinos Ateneo classmates who havent found jobs in his administration. Ive said it before and Ill say it again: Aquino is different from his predecessors in that he feels he has to surround himself with people he has known since he was in grade school because he values loyalty more than qualications and likemindedness more than competence. Surely, the administration will always be able to justify the propriety of Aquinos naming his cronies to high government ofce. In the case of Caguioa, the palace press release has highlighted his credentials as a distinguished private practitioner, law-school instructor and senior partner in the white-shoe Sycip Salazar law rm. Still, I pine for the days when Presidents would appoint people they had never heard of or met, basing their decisions solely on the strength of their stellar accomplishments. This is not to say that Aquinos predecessors did not keep coteries of cronies; but in the past, these people belonged to kitchen Cabinets and were not so blatantly rewarded for the mere accident of having known the President when he was a nobody. It is difcult to say if Aquinos top ofcials are the very best he can appoint. It is clear, though, that the President has decided that his personal knowledge of someone is the foremost consideration when he goes head-hunting. Im sure the presidential hiring policy does little to improve bureaucratic morale. Even if it greatly increases the employment prospects of even the most mediocre of his former classmates. *** I apologize to the people of Butuan City for saying, in yesterdays column, that they were hard hit by typhoon Sendong, just like Cagayan de Oro City. I meant Iligan City, as some eagle-eyed readers have pointed out. Forgive this lifelong Manilenyo his occasional ignorance of Mindanao geography. Mea culpa.

LOS Angeles, CA.In his enduring classic, The English Constitution, Walter Bagehot pays homage to Abraham Lincoln as a prize one could get, though not necessarily expect, from a presidential government. The English essayist argues that the parliamentary system generally produces better leaders than the presidential, even though many prime ministers these days tend to act more like presidents. Occasionally the presidential system begets a Lincoln, but this is like winning in a lottery, and winning in a lottery is no argument in favor of a lottery, he says. In Spielbergs Lincoln, you get to look at that lottery prize at close range. What makes him possible? In an age when the best that a world power could seem to produce is a dedicated pro-abortion and same-sex union campaigner at the White House, and the most that a Christian democratic country like the Philippines could conjure is a small-town politician like Benigno Aquino III, we have to ask, is it still possible to produce a Lincoln? Is he not the product of a bygone age, or can he and his Age ever be recreated for our time? We can only ask the questions. And Lincoln encourages us to ask the questions. As the world grows more complex, and challenges to human dignity intensify, far more enduring qualities of leadership are needed to govern a nation. Lincoln exudes those qualities. But the untrammeled advance of relativism in our century tends to empty society of its transcendent moral and intellectual values, while the globalization of technology and the pervasive use of high-velocity media

in all aspects of human activity tend to narrow down to the barest minimum its tolerance for deep reection on any question, and we are left with nothing but an inexhaustible supply of shallow and inept political leaders. These are individuals heavy with ambition but vacant of vision, full of show but empty of quality or substance, men and women who are (to borrow Bagehots words once more) popular for no other reason than that they are popular, but who have the unnatural inclination and zeal to present themselves as leaders. They thrive best where the moral imagination has vanished, where what is necessary no longer seems necessary nor possible. The challenge not just of the present or next generation but rather of the new millennium is to restore the moral imagination, and make the necessary once again necessary and possible. We need to do the impossible. For the United States, this means going back to its roots and reafrming those Truths which the 1776 American Declaration of Independence solemnly proclaims as self-evident, and which, in the language of Alexi de Tocqueville, made religion Americas rst political institution. America was rst of all a moral power before it became an economic or military power; the abolition of slavery made America the protector of human dignity and equality everywhere, the torch-bearer of morality for all mankind. By making the Negro slave a free man, America consigned to perpetual infamy Chief Justice Roger Taneys view of him (in Dred Scott) as an article of commerce and trafc to be bought and sold whenever prot could be made of him. And America made it possible for a black man to become its president 135 years later. In a sense, Barack Obama owes what he is today to Lincoln. One may therefore ask what Obama has done
to keep alive Lincolns hope and dream that the 13th Amendment, which permanently abolishes slavery and involuntary servitude in the US and any place under its jurisdiction, would free from slavery every black person in America for all time, including the millions yet unborn. The evidence seems to suggest very little. For a new slavery now singles out the unborn, without their having to be black at all, and spreading its practice around the world has become one of the Obama administrations top foreign policy concerns. In 1973 Roe v. Wade would decree that the unborn fetus is less than the Negro slave and is not a human being at all, and that a woman has the right to destroy it inside her womb for any reason whatsoever. Years before that at Nuremberg, an international military tribunal condemned as a war crime the Nazis program of contraception, sterilization and abortion on their captured peoples. Today the most liberal societies have legalized abortion as a human right of, and a service to, women. Popular attitudes in the US may be changing. Time magazines latest cover story (Jan. 14, 2013) says, 40 years ago, abortion-rights activists won an epic victory with Roe v. Wade: Theyve been losing ever since. The New York Times (Jan. 5, 2013) says pregnancy centers in the US now outnumber abortion providers, 2500 to 1800. But the US ofcial abortion campaign is undeterred, even in countries where the constitution, religious belief and practices of the people openly reject and condemn it. In the Philippines, at the behest of his foreign patrons, Aquino has rammed through a Nazi-type reproductive health law, which could tear the nation apart and disgrace his funders. Unfortunately, the members of the PSI board, who were sure had no knowledge of the details of this transaction have been dragged into the case as respondents. The respondents in the case are the President and CEO of PSI, former Health Secretary Alfredo R.A. Bengzon and the vice president of the business division Benito Macalagay. The directors of PSI who are well known businessmen and medical practitioners have also been named respondent including Dr. Augusto Sarmiento (chairman), Jose Xavier Gonzales, Mona Lisa dela Cruz, Oscar Lopez, Arthur de Guia, Dr. Mediaora Saniel, Dr. Rolando Hortaleza, Dr. Herminio Germar, Jorge Lichauco, Fr. Roberto Yap, and Alberto Buenviaje. The case is in the last stage of courtordered mediation but it seems that the prospect of settlement is dim. It might be inevitable that these prominent personalities who are directors of PSI do not look forward to appearing in court to testify in a case that could drag on for years. *** Bureau of Customs Commissioner Ruffy Biazon is caught in a bind. He has taken the position that the revenue target set for his agency by the multi-agency Development Budget Coordination Committee composed of the governments top tax and revenue experts is bloated, unreasonable and unrealistic. The revenue target for the Bureau of Customs for 2012 was P347 billion but as of mid-December, the agencys collection has reached only P278 billion. Biazon has not yet disclosed what the

THE case is commonplace but it is news simply because so many prominent people are involved. At the heart of the civil case is the sale of the more than one hectare property at the heart of the Ortigas business center in Pasig City which used to be occupied by Medical City Hospital before its transfer to its present location. The property is owned by Professional Services, Inc. (PSI) which also owns and runs Medical City. In 2001 PSI engaged the services of Justo M. Ortiz, president of Ziro Real Estate to sell the property and he was given an Authority to Find Buyer by PSI expiring on March 31, 2007. As the authorized agent among those Ortiz had approached was Robinson Land Corporation of the Gokongweis and Ortiz says he has documents to show that RLC has acknowledged that it was evaluating such an offer. Ortiz was shocked to nd out that on March 9, 2007 the sale of the property to RLC for P1 billion was approved by the board of PSI but he was out of the picture because apparently RLC and PSI negotiated for the sale using a yetundisclosed broker. Ortiz, as expected, sued PSI to collect the agreed brokerage fee of P30 million equivalent to the regular 3 percent brokerage fee. He says that authority to sell which BOCs nal revenue collection for 2012 is but it is almost certain that it would be close to P270 billion. Just to put things in perspective, the nearly P70 billion shortfall is equivalent to two years projected collection from the additional sin tax which has generated a lot of acrimonious debate and which is expected to lead to thousands of job losses. Biazons dilemma is that his mantra that the collection target set for the BOC is unreasonable and unreachable is now also the same chant being sung by the Custom collector under him. How can Biazon now impose sanctions on poor performing collectors when they are using the same excuse that he is using to justify his abject failure to even come near the revenue target set BOC? Biazons excuse for his shortfall is now also the excuse of the district collectors who have said that they are all supportive of Biazons appeal to lower the bureaus revenue target for 2013 which have been raised to P397 billion. Echoing Biazon, Clark district collector Edward dela Cuesta said We hope our target will be lowered to make it doable. MICP district collector Ricardo Belmonte, according to an MST news report supported dela Cuestas position saying one reason for the shortfall is the high percentage of increase of our 2012 target compared with the 2011 target. The message of the district collectors to Biazon is clear: Your excuse for your shortfall is our excuse for our shortfall so dont rock the boat and talk of a major revamp because we didnt meet collection targets. What applies to you also applies to us.
THE case of the shootout between Atimonan, Quezon policemen and alleged guns-for-hire gang members, together with members of the Armed Forces of the Philippines, becomes murkier as the days pass. Family members of the 13 killed insist that what happened was not a shootout but a rubout. Santa Banana, even President Noynoy Aquino is getting confused! Recall that the Palace earlier said that the incident was a legitimate shootout by the police. Now the President says he is having doubts because of inconsistencies and contradictions. Now many angles are coming out of the woodwork. We hear illegal drugs, jueteng and even politics. I wonder whether we would really get to know the truth. *** President Aquino is against a total gun ban and rightly so. Dutiful citizens like us would be at the total mercy of lawless elements, what with no less than 600,000 loose rearms going around. I also think that there should be an honest-to-goodness campaign against loose rearms which are mostly in the hands of criminals and private armies. Stricter gun control should be adopted by Congress and Malacaang. My gulay, the country is getting a reputation as a violent nation with so many gun encounters between the police and lawless elements. Its worse when it is reported that even the police themselves are involved in so many crimes. The upsurge of criminality is getting out of hand. With the coming midterm elections, politically related crimes can only worsen. The problem is that President Aquino doesnt seem to realize the need to make the ght against crime a priority. My gulay, when you are no longer safe outside and inside your home, what kind of country do we have? Early on in his administration, the President named his Executive Secretary Paquito Ochoa his crime czar. What has Ochoa done, if at all? Nothing! We have PNP Chief Alan Purisima. But what is he doing? *** It is good to know that state prosecutors have decided to proceed with the Sandiganbayan case of malversation of funds and graft against Comelec Commissioner Grace Padaca. The alleged violation irregularities were done when she was still governor of the province of Isabela. Padaca is now out on bail after the President personally paid P75,000 for her. Her lawyers are now claiming that since the Constitution grants constitutional officers immunity from crime, they can only be removed by impeachment. Thus it would be futile for the Sandiganbayan to proceed with the case against Padaca. I believe however that the case against her at the Sandiganbayan should proceed. Her innocence, or guilt, has to be established. Otherwise, all the President has to do in the case of his KKKs (partymates,

through the conditional cash transfer, social pension and PhilHealth programs and funded out of general revenues. Only a cruel society can exclude from sharing in its afuence those who are uneducated, unhealthy and socially nonconforming. Yet a few among us still attribute their poverty to their laziness. But could ones industry enough to keep him out of poverty? Because we care about and assist our poor, we should prevent others from falling into poverty. Let us keep the productively employed in payrolls, and let government lead the way. It should adopt measures to increase the productivity of public servants, but cautiously and wisely. It cannot rush into adopting the methods employed by a few private and global companies, especially the extremely controversial and unorthodox ones. They could only be trends that would result in irreparable damages. We would only regret we ever adopted them. The forced ranking method is an example. Jack Welch of General Electric popularized it using a 20-70-10 percent forced distribution. Done well, it rewards generously the most productive 20 percent and identies from the bottom 10 percent the undesirables who must be weeded out. Implemented improperly, it brings down employee morale and results in quick employee turn-overs. It promotes individualism but erodes teamwork. But it was required by the Governance Commission for Government-Owned or Controlled Corporations and the Department of Budget and Management as the basis for the grant of a performancebased bonus to all government employees in 2012. All employees had to be ranked from highest to lowest. They were then forced into a 10-60-20-10 percent grouping distribution and categorized as having Exceeded Expectations (Best), Met All Expectations (Better), Met Most Expectations (Good) and for performing Below Expectations (Below Satisfactory).
For those employed by protable corporations, the Best were entitled to a bonus of 2.5 times their salary, the Better 1.5 times, and the Good 1.25 times. By design, 10 percent of 1.4 million public servants were to get nothing. For those who were ranked high enough, the bonus was released just in time for Christmas expenditures, and much appreciated by their ecstatic dependents. But for those who honestly toiled in the bureaucracy but still ended up in the bottom 10 percent it was a calamity before Christmastime. They may have met their work targets and thought that they have earned their bonus but nobody told them that others who performed better would instead get it. They performed tasks of the highest quality of service, the type that endears government to our people. Their outputs, non-quantiable perhaps, supported the performances of the teams Best. Unfortunately, their supervisors had to put names in the bottom of the performance list. Now they worry being labeled as a Below Satisfactory performer, dreading dismissal, which is the companion of the forced ranking method. After all, it is also called the rank-and-yank evaluation system. Does the government have the guts to yank out these 140,000 workers and force them into poverty? Most employees were caught unaware. Forced ranking was no longer seriously discussed in employee forums after it was implemented once and thence discarded decades ago. The undesirables are being purged regularly anyway. Were unions involved in this evaluation? They must have been shell shocked, never realized what hit them, and couldnt react even until now. Or was it a case of I got my reward, why should I rock the boat? My son Jun used to remind me that a happy worker is a productive worker. If previously productive government workers turn unproductive in 2013, it is because they are unhappy about this forced ranking.

OUR notion of justice is that those who commit crimes must be caught, tried, convicted and punished. They should be locked up and kept away from society lest they do more harm to more people. But justice is also ensuring that no man or woman is put behind bars for something he or she did not commit. This is the rationale that drives Innocence Project Philippines, a collaboration various groups that was launched last month at the New Bilibid Prison in Muntinlupa and the Correctional Institute for Women in Mandaluyong. The Innocence Project will seek to exonerate wrongfully convicted people through the strength of DNA evidence. This option was not available until October 2007, when the Supreme Court issued its Rules on DNA Evidence. According to the Rules, even those found guilty through nal and executory decisions may seek to have their case re-examined using DNA technology so long as there are biological samples to be evaluated. Imagine a man convicted of rape.

Pipelaying starts in QC
THE Manila Water Company is currently undertaking a large-scale pipe rehabilitation project at the Libis area along C-5 Road in Quezon City to replace the current pipe network in the area, which is estimated to be more than 15 years old. The pipelaying project, which will cost P48.6 million entails the laying of 1,350 meters of pipes along the stretch of C-5 Road also known as Eulogio Rodriguez Jr. Avenue (Libis area) and the replacement of the existing line along Calle Industria, Manggahan and Mercury streets. The pipelaying and rehabilitation works will be undertaken every day from 10 in the evening until 5 in the morning beginning at C5 southbound fronting Mercury Avenue, crossing to the other side of the road, continuing to C5 northbound lanes. Only one to two lanes will be closed during the pipelaying works while the remaining four lanes of C-5 will remain passable during the day. The project is expected to be completed by the second quarter of 2013 and will serve as an alternate route once the DPWH EDSA road rehabilitation commences this year.

EXPORTS rose 5.5 percent in November from a year ago, but declined by nearly a fth from the previous month, the National Statistics Ofce reported Friday. The NSO said merchandise exports amounted to $3.6 billion in November 2011, up from $3.4 billion during the same month in 2011. The gure, however, was down from $4.4 billion in October. The positive performance can be traced to the observed improvement of business sentiment indicators globally, which may have prompted the increased foreign purchases, Economic Planning Secretary Arsenio Balisacan said in a statement. Electronics, which account for about half of total shipments, increased 13.3 percent to $1.7 billion from $1.5 billion. Exports in the rst 11 months showed an average growth of 7 percent to $48 billion from $44.9 billion posted in the same period of 2011. ITS almost the middle of January and I have not yet even begun to write my 2013 resolutions. A post by one of my friends actually inspired me to begin with this: Find bizarre holidays and celebrate them with your friends and family. Now, this may seem a little odd. But consider this: This week alone, I have the following holidays to choose from: Man Watchers Day (January 8th), Play God Day (9th), Peculiar People Day (10th), Step in a Puddle and Splash your Friend Day (11th) and Feast of Fabulous Wild Men Day (12th). Best of all, this Sunday, the 13th, is Make your Dream come True Day. I suspect I nd some of these silly days appealing because so much of my time is occupied by very serious matters and I have found that the best way to nd time to unwind is to explicitly carve out time for it. Play I suspect that, by now, virtually everyone is convinced that maintaining productivity requires that periods of relaxation be interspersed with work. There are, however, some very logical reasons for supporting the celebration of some of these days within your work force. Lets take the most obvious factorcelebrating some of these bizarre holidays requires the ability to play. The research actually shows that play is intrinsic to innovation. And in todays fast-paced business environment, innovation is crucial to remaining competitive. Dr. Stuart Brown, founder of the National Institute for Health in California, and a pioneer in the research on play, actually stumbled onto the importance of play when he observed its absence in a studied group of homicidal young males. This observation led to research that showed that lack of play is a signicant contributing factor to violent behavior. Browns research shows that play is not only enjoyable and energizing, it is also deeply involved in human development. Browns research shows that that play is important in personal health and in healthy relationships. He asserts that play is a catalyst for learning. In fact, he asserts that play can make you smarter at any age. Brown also believes that play can be a powerful force in corporate innovation. Like many other authors, Daniel H. Pink, author of A Whole New Mind, argues that success in todays fastchanging world requires more than the traditional analytic, sequential left-brain thinking that is the center of traditional approaches to education and work. In A Whole New Mind, he identies an additional six essential aptitudes for success: Design, Story, Symphony, Empathy, Play and Meaning. Innovation In fact, Stanford actually offers an engineering course about the use of play in creative thinking and design. The course, From Play to Innovation (ENGR 280) is designed to help students understand how the principles of play can be used to promote corporate innovation through design thinking. The course is taught by Brendan Boyle, a partner at Ideo, one of the foremost design companies in the world. Boyle heads up Ideos Toy Lab and his job also involves promoting entrepreneurial thinking globally for Ideo. In an interview with Jake Cook, Boyle quotes Stuart Brown, who asserts that the opposite of play is not work, the opposite of play is boredom or depression. Boyle says
that play is anything you enjoy. However, he also says that play is a ton of effort. In the article, Cook quotes Tom Wilcox, toy inventor at Ideo: Try to encourage open-ended behavior. Its not about goals, its about pushing the boundaries and discovering something. At Ideo, were often trying to design around a narrative its less about the object and more about the experience, the story of that objectso were looking for social and environmental cues as to what that experience is or could be. Through playing with different scenarios, through prototyping different possibilities, we get to that narrative. Clearly, this is not about providing time for playing video games or charades at work. Its about an attitude and an approach. And it does, as Boyle explains, require a ton of effort. At Ideo, the physical space is designed to encourage innovation. Rules to preserve the sanctity of play time (such as no email for certain periods of the day) are set up. Play at Ideo is a serious matter. In the book, The Ten Faces of Innovation, Tom Kelley, general manager of Ideo, explains that innovation is not self-starting or self-perpetuating. People make it happen through their imagination, willpower, and perseverance. Why not? In the book, Kelley explains how important people and their behavior are to creating a culture of innovation. It is about the roles people can play, the hats they can put on, the personas they can adopt. He explains how harmful the devils advocate persona can be and how helpful the other personasthe learning personas, the organizing personas and the building personascan be. Kelley juxtaposes this persona with the experimenter persona not the voice who points out what could go wrong but the voice who seeks the possible. In the interview with Cook, Wilcox has this to say: Wed still be living in caves if we relied on the sceptics. This, of course, is nothing new. Managers have always known that it is people who push the boundaries who create the future. What we often forget though is that experimentation requires not just a sense of play but also courage the courage to be different. Those days when we actively choose to do something different. Those days will help us build courage. So Friday this week, Im going to nd me a puddle and nd a friend who will splash water with me. And on Sunday the 13th, I will nd a dream I can make true. Life is about choices. This week I will try to remember that I can choose to be silly on some days, and that can be a perfectly logical choice. This year, I will remember that the world laughed at the most important inventions of our time. The ideas behind them were called silly and their inventors were called foolish. IT WOULD seem that President Noynoy Aquino is getting the hang of being top executive, exhibiting more condence (or gumption, as some Happy Hour old timers described it) judging from his stance on the RH bill, the current gun controversy (total gun ban will only benet criminals, he said) and the green light he recently gave for the completion of the Baguio Circumferential Road project despite the howl of protest from some groups (whose complaint incidentally was junked by a court). PNoys pluck probably stems from the knowledge that people are beginning to appreciate the inroads that his daang matuwid are making, and the fact that he is proving to be the kind of leader who will do things his way if he thinks he is doing the right thing despite strong resistance from groups perceived to be inuential (and just plain relentless). One of the problems in Baguio is trafc congestion particularly at the central business district, and the road project will help ease the congestion since the road system will be developed in such a way that motorists will not have to pass through the CBD, those in the know explained. SM Citys expansion plans also took the trafc congestion into perspective, which is why the malls project integrates the construction of additional parking spaces precisely to ease vehicle congestion on roads leading to the mall and thereby help reduce fuel consumption in the process. Of course, critics will always have something to say against SMdespite the fact that the complaint led by some organizations (one of them allegedly led by a certain individual with self-serving interests) was junked by the Baguio regional trial court in December. Just recently, a certain Mary Anne Alabanza Akers expressed criticism about the planned mall expansion, expressing doubts about the carrying capacity of the area. Thats the trouble with so-called experts, Happy Hour buddies commentedthey freely express opinion based on personal experience and without actually getting factual basis. Apparently, Akers is the rst dean of the School of Architecture and Planning of Morgan State University in Maryland (a traditionally all-black public school in the US, ranked Number 647out of 650 in Forbes 2012 list of Americas Top Colleges based on educational outcomes and other criteria that include postgraduate success and the prestigious scholarships and fellowships awarded to students) and is a favorite resource person of certain environmentalist groups. Sources said Akers is also the same person who suggested limiting the number of viewers to the popular Baguio Flower Festivals street dancing and oat parade by selling tickets. Of course, she gave her expert opinion without having experienced the popular festival itself as she herself has admittedagain invoking what seems to be a favorite sound bite: carrying capacity. And if a Baguio visitor misses the festival because he is unable to buy a ticket to the parade? Akers solution: come back next yearor something to that effect, making it sound as if traveling to Baguio is as easy or as inexpensive as going to the next barangay, Happy Hour observers noted. Sources said SM has already secured an amended environmental compliance certicate after submitting the Engineering Geological and Geo-hazard Assessment Report or EGGAR, clearly stating that the area where the mall expansion will be built is deemed suitable for development, with the design incorporating such critical aspects as allowable carrying capacity and other technical parameters. Apparently, SM has made a very detailed environmental impact assessmentwhich includes the carrying capacity of the area in terms of sustainability in the report it submitted to the DENR. All these, of course, were based not on the personal opinion or baseless evaluation of self-styled experts, but on technical research and studies conducted by geotechnical engineers and geologists, all of which were veried and conrmed by appropriate authorities both from the local government and the DENR, the sources commented. AMMANThe ercest winter storm to hit the Mideast in years brought a rare foot of snow to Jordan on Wednesday, caused fatal accidents in Lebanon and the West Bank, and disrupted trafc on the Suez Canal in Egypt. At least eight people died across the region.
In Lebanon, the Red Cross said storm-related accidents killed six people over the past two days. Several drowned after slipping into rivers from ooded roads, one person froze to death and another died after his car went off a slippery road, according to George Kettaneh, Operations Director for the Lebanese Red Cross. In the West Bank town of Ramallah, a Palestinian ofcial said two women drowned after their car was caught in a ash ood on Tuesday. Nablus Deputy Governor Annan Atirah said the women abandoned their vehicle after it got stuck on a ooded road, and their bodies were apparently swept away by surging waters. Their driver was hospitalized in critical condition. In the Gaza Strip, civil defense spokesman Mohammed al-Haj Yousef said storms cut electricity to thousands of Palestinian homes and rescuers were sent to evacuate dozens of people. Parts of Israel were bracing for snow a day after the military was forced to send helicopters and rubber dinghies to rescue residents stranded by oodwaters in a weather, which Israeli meteorologists said was the stormiest in a decade. The unusual weather over the past few days hit vulnerable Syrian refugees living in tent camps very hard, particularly some 50,000 sheltering in the Zaatari camp in Jordans northern desert. Its been freezing cold and constant rain for the past four days, lamented Ahmad Tobara, 44, who evacuated his tent when its shafts submerged in ood water in Zaatari. A camp spokesman said that by Wednesday, some 1,500 refugees were transferred to mobile homes normally used for schools. Weather ofcials said winds exceeded 70 kilometers per hour and the rain left 70 centimeters of water on the streets. AP
A WATCHDOG group wants the photographs of Osama bin Ladens corpse and burial at sea--ordered condential by President Barack Obam--be made public under the Freedom of Information Act. Judicial Watch Inc., in arguments set Wednesday before a three-judge panel of the US Court of Appeals in Washington, will contend the Central Intelligence Agency has failed to show how images of Bin Ladens body -- specically those showing it cleaned and prepared for burial -- would harm national security or reveal classied intelligence, according to court papers. Defendants would have the court believe that the only images at issue in this case are gruesome, graphic images depicting a bullet wound in Bin Ladens head, Michael Bekesha, a lawyer for Washingtonbased legal-activist group, wrote in his ling. Pakistan stopped carrying NATO supplies Wednesday, and he was reaching out to others throughout the country to get them to join the strike. Haneef Khan Marwat, head of a transportation company in the southern city of Karachi, said some truckers began their strike as early as Jan. 4 and thousands of vehicles are involved. He said the strike would continue until the government reversed its new policy. THE domestic automotive industry got an adrenaline boost last year with the entry of two prize ghters from two of the Worlds most aggressive brands, Toyota and Hyundai. Although Hyundais Sports Coupe has been the performance benchmark for the past couple of years, the hugely popular Genesis Coupe has drawn its sword and is ready to exchange blows with the tail happy Toyota 86.
throughout the Hyundai model range, this gapping front end actually improves engine cooling and greatly compliments the sweeping headlamp design and the stylish fog lamps. As part of the safety element of the Coupe, daytime LED running lights run through the bottom part of the head lamp assembly. The Toyota on the other hand is a design evolution and engineering marvel from the Houses of Fuji Heavy Industries and Toyota Motors Corporation of Japan. It has a more slanted nose reminiscent of the earlier versions of the Toyota MR2 and equipped with ush headlamps that compliment the oversized fenders and character lines. The bone of contention between the Korean and the Japanese Sports Coupe lies in the engine propelling these metal beasts. The 2013 Genesis 2.0T goes to battle with a Multipoint Fuel Injected Dual CCVT with Twin Scroll Turbocharger engine pumping out 274 bhp@6,000 rpms. The Toyota 86 with a robust 2.0 liter-DOHC-4-valves per cylinder VVTi engine capable of pushing 200 bhp@7,000 rpms. Despite having less horses under the hood in comparison with its Korean rival, the Toyota 86 is throatier. Pop the clutch and push the Stop/ Start button and the 86 comes to life like a pit bull about to chase a cat. This Boxer engine was developed by Subaru, with its direct plus fuel injectors designed by Toyota. In terms of whos the better drivers car, The Toyota 86 has a more engaging cockpit starting with the bucket seats, meaty three-spoke steering and red stitching throughout the cabin. The front engine-rear wheel drive Genesis is not about to budge to make space for the latest iteration of the Hachi-roku. The Gods of Speed provided me an opportunity to enjoy these two cars during the Holiday season and driving them is an experience that must be shared by our loyal readers. For 2013, Hyundai introduced a face lifted version of the Genesis Coupe. Visible changes are evident in the angular front fascia, faux hood scoops and the trademark gapping front grille bumpers which seem to smile right at you. A design feature stamped
steering plus the Boxer engine layout makes the Toyota more fun to thrash around. The Genesis on the other hand is more comfortable to drive than the 86 and Hyundai upgraded the interiors with a new set of analog gauges, more ergonomic steering, Bluetooth for the excellent sounding audio system, plus a racing center stack that displays torque, boost and the oils temperature. It even has an ionizer to remove odors inside the cabin. The Genesis is a Coupe that can be driven out of town for a shopping run to Tagaytay for fresh vegetables.
As a journalist who test drive automobiles for a living, this comparison test is a close ght since both cars have the fun factor worth your every centavo. Both the Genesis Coupe and Toyota 86 are priced at the P1.5M mark, with the Toyota having a price difference of P50,000. However, the Toyota 86s superb Subarubuilt at four engine, precise shifting, suspension system and collectability factor makes it the true sports car. I suggest you pay a little more for the A/T version Toyota 86 to have a more extended fun behind the wheel of this future collectible.

WHEREAS, a complaint for Cancellation of Miscellaneous Sales Patent and Original Certificate of Title was filed with this court on June 16, 2011, stating this: 1. Plaintiff is a sovereign entity to whom all lands of the public domain belong. It may be served with judicial processes through the Office of the Solicitor General (OSG) with address at the OSG Building, 134 Amorsolo Street, Legaspi Village, Makati, Metro Manila; Defendant Filipino Mercado is of legal age, with capacity to sue and be sued, and a resident of Barangay Lamao, Limay, Bataan where he may be served with summons and other court processes; Defendant Registrar of Deeds of the Province of Bataan holds office at the Registry of Deeds, Balanga city, Bataan, where he may be served with summons and other processes. He is impleaded as a nominal party, he being the official charged with the duty of registering patents and issuing the corresponding certificates of title over land in the Province of Bataan; The administration, management and ownership of the parcels of land of the public domain surveyed as Lots 1 and 2 of survey plan Swo-000027 and Lots 1 and 2 of survey plan Swo-03-000028 containing a total area of 3,813,161 square meters situated at Barangay Lamao, Limay, Bataan were transferred to the Philippine National Oil Company by virtue of P.D. No. 949 dated June 17, 1976. In accordance with the said P.D. No. 949, a special patent was issued to the PNOC covering the said lots which was registered on March 18, 1977 in the Registry of Deeds of Balanga City, Bataan. Consequently, Original Certificate of Title (OCT) No. 3 was issued in favor of the PNOC, The said title was cancelled subsequently in view of the issuance of Transfer Certificate of Title (TCT) No. T- 67687 in favor of the PNOC covering the same lots. The latest derivative Title of OCT No. 3 is TCT No. T- 167629 registered on September 21, 1994 in favor of the PNOC- Petrochemical Development Corporation, a subsidiary corporation of the PNOC. A photocopy of TCT No. 167629 is hereto attached as Annex A. On November 23, 1993, defendant Filipino Mercado filed his Miscellaneous Sales Application (MSA) No. 030806-71 with the Department of Environment and Natural Resources-Community Environment and Natural Resources Office, Balanga City, Bataan over Lot 4, Block 15 of the subdivision plan Csd- 1422 approved on July 15, 1967, containing area of four hundred seventeen (417) square meters situated at Barangay Lamao, Limay, Bataan. Copies of the said application and subdivision plan Csd- 1422 are hereto attached as Annexes B and C, respectively. On November 29, 1994, an Order: Award and Issuance of Patent was issued covering a Lot 4, Block 15 in favor of defendant Mercado. This resulted in the issuance of Miscellaneous Sales Patent No. 030806-94-170 in the name of herein defendant. A photocopy of the said order is hereto attached as Annex D. The said patent was transmitted to defendant Registrar of Deeds of Balanga City, Bataan who registered the same and issued the corresponding OCT No. 2961 on February 13, 1995 in the name of defendant Mercado. A photocopy of the said title is hereto attached as Annex E. In a subsequent investigation and verification conducted by the DENR Region III Office, it was found out that the land covered by OCT No. 2961 falls within Lot 1 of approved survey plan Swo-03000028, is hereto attached as Annex F. Prior to the issuance of the said OCT No. 2961 in the favor of defendant Mercado, the tract of land covered by the same was already a titled property in the name of PNOC under OCT No. 3 issued several years ahead of defendants OCT No. 2961. In fact, PNOCs TCT No. T- 167629 was already existing at the time defendant Mercados OCT No. 2961 was issued. The verification survey conducted DENR- CENRO Pilar, Bataan reveals that the aforestated area embraced under defendant Mercados OCT No. 2961, as well as the technical description depicted under Csd- 1422, do not conform with the metes and bounds of the lot actually occupied by defendant Mercado. They overlap adjoining Lots 1-A and 1-B of Lot 1 of approved survey plan Swo-03000028 of the PNOC. A certified copy of the result of the ground verification survey conducted by Engr. Florencio Yambao of DENR- CENRO Pilar, Bataan is hereto attached as Annex G. The foregoing findings shows that OCT NO. 2961 was erroneously issued in favor of defendant Mercado as the land covered by the same was no longer alienable and disposable land that could be disposed of by a miscellaneous patent (MSA) under the Public Land Act (Commonwealth Act No. 141). It is a titled property of the PNOC which is outside the jurisdiction of the DENR. Furthermore, the area of the land described on OCT No. 2961 does not conform with the metes and bounds with the area actually occupied by defendant Mercado.
