LEGISLATIVE ENACTMENT

R.A. 3846, as amended, Section 10 The powers vested in and the duties imposed upon the Director of Posts by Act Numbered Thirty-three hundred and ninety-six are hereby transferred to the Secretary of Commerce and Communication, who is hereby empowered to include in the general radio regulations under this Act, regulations governing radio apparatus compulsory required on vessels of Philippine registry by Act Numbered Thirty-three hundred and ninety-six, notwithstanding the fact that such regulations may be different from those specifically provided in said Act Numbered Thirty-three hundred and ninety-six: Provided however, that such regulations shall not be inconsistent with the provisions of the International Convention for the Safety of Life at Sea: Provided further, that this section or any part thereof shall not be construed as in any way affecting the provisions of Act Numbered Thirty-three hundred and ninety-six making compulsory the installation of radio apparatus on certain vessels and penalizing violations thereof.

Requirement: The powers vested to the Director of Posts by RA 3396 are transferred to the Secretary of Commerce and Communication, provided that such regulations shall not be inconsistent with the provisions of the International Convention for the Safety of Life at Sea. Explanation: The transfer of powers to the Secretary of Commerce and Communication is also empowered to include in the general radio regulations under this Act, regulations governing radio apparatus compulsory required on vessels of Philippine registry by RA 3396. Requirement: Provided further, that this section or any part thereof shall not be construed as in any way affecting the provisions of Act Numbered Thirty-three hundred and ninety-six making compulsory the installation of radio apparatus on certain vessels and penalizing violations thereof. Explanation: There shall be a non-interfering effect of the regulations of this Act with that of the provisions in RA 3396

RA 3396 Ship Radio Stations Law Sec. 1 It shall be unlawful for any vessel of Philippine register specified in Section 2 hereof to sail or attempt to sail from any port of the Philippines without being equipped with efficient apparatus, for sending and receiving messages by radio, (As amended by Rep. Act No. 1539, approved June 16,1956) Requirement: It is unlawful for any Philippine vessel to sail or attempt to sail without proper communication equipment. Explanation: No vessel shall be given authority to sail without proper communication devices equipped to the vessel to be used. Sec. 2 Vessels of Philippine register engaged in coastwise trade and authorized to carry passengers and/or freight and cargo vessels of Philippine register of three hundred fifty tons gross or over engaged in coastwise trade, the number of crew complement notwithstanding, except vessels plying exclusively on rivers, lakes, and bays, and on straits when the distance traversed is not greater than sixty miles point to point and its voyage does not last over five hours, shall be equipped with radio apparatus capable of sending and receiving communications over a distance of not less than two hundred nautical miles by day and night. (As amended by Act No. 4072 and by Rep. Act No. 1539, approved June 16, 1956.) Requirement: Philippine Vessels engaged in coastwise trade and authorized to carry passengers and/or freight and cargo vessels (specified as having gross weight of 350 tons or higher, travelling for at least 60 mi. of point to point voyage for not more than 5 hours) shall be equipped with communication equipment. Explanation: Passenger, freight, and cargo-carrying vessels in the coastwise trade industry (specified as having gross weight of 350 tons or higher, travelling for at least 60 na. mi. of point to point voyage for not more than 5 hours) shall have installed proper communications equipment for its travel with a communicable range of not less than 200 na. mi. Sec. 3 Whenever the Secretary of Public Works and Communications may consider it to be necessary on account of the conditions of the installation of the principal plant, vessels, equipped with radio shall also be equipped with an auxiliary dynamo independent from the main electric plant of the vessels which shall make it possible for the sending apparatus to send messages during at least four hours over a minimum distance to two hundred miles by day and night.

Requirement: The Secretary of Public Works and Communications is given the right to order any vessel to be equipped with auxiliary dynamo independent from the main electric plant to enable to send messages during at least four hours over a minimum distance to two hundred miles by day and night. Explanation: It is required by this law that all ships/vessels equipped with communication equipment must have a reserve (auxiliary) power supply (dynamo) to generate power in cases of emergency to enable the ship to continue communications with a range of not less than 200 na. mi. Sec. 4 The radio apparatus shall be operated at all times by an operator holding a first class commercial radio telegraph operators license duly under the Radio Control Law and the regulations promulgated thereunder. The radio apparatus, the operator or operators, the regulation of their hours of duty, the sending or receiving of messages except in so far as regulated by law or international agreement, shall be under the control of the master of the vessel; and any neglect on the part of such master to enforce the provisions of this section shall be subject to the penalty herein prescribed. (As amended by Rep. Act No. 1539, approved June 16, 1956.) Requirement: The radio apparatus shall be operated at all times by a duly licensed (or renewed license) radiotelegraph operator. Explanation: This law regulates that only duly licensed operators are allowed to operate radio apparatus of any vessel provided that he follows the law prescribed by the Radio Control Law. Requirement: The radio apparatus, the operator or operators, the regulation of their hours of duty, the sending or receiving of messages except in so far as regulated by law or international agreement, shall be under the control of the master of the vessel; and any neglect on the part of such master to enforce the provisions of this section shall be subject to the penalty herein prescribed. Explanation: The operators are in full liability for any neglect on the part of the master and respective penalty will be imposed.

Sec. 5 It shall be the duty of the Secretary of Public Works and Communications, in the exercise of the powers conferred upon the Department of Public Works and Communications, to order a technical inspection of the radio apparatus and equipment made at least once in every six months or at any suitable time when the public interest may require it. Requirement: It is the duty of the Secretary of Public Works and Communications to order a technical inspection of the radio apparatus and equipment made at least once in every six months or at any suitable time when the public interest may require it. Explanation: The Secretary of Public Works and Communications is authorized to order a technical inspection of radio apparatus and equipment for at least once in six months or as frequent as needed. Sec. 6 Upon inspection if the radio apparatus installed on the ships above mentioned, an inspection certificate shall be issued if the radio apparatus so inspected are found to fulfill the legal requirements. Any radio apparatus so inspected and certified may be operated during the period stated in the inspection certificate subject to the conditions imposed by the Secretary of Public Works and Communications. Every vessel equipped with radio shall pay to the Secretary of Public Works and Communications, as fee for the inspection of the same, twenty pesos per annum. Requirement: It is the duty of the Commission to authorize vessels a proper inspection if it confers with legal requirements and to issue the certificate for the said inspection. Explanation: After fulfilling legal requirements of a technical inspection, the vessel shall be issued with an inspection certificate. The vessel is allowed to operate under the period stated in the certificate and the vessel is charged with 20 pesos per annum as fee for the inspection. Sec. 7 It shall be the duty of the Commissioner of Customs to supervise the strict enforcement of the provisions of this Act. The violation of any of the provisions hereof shall be punished in accordance with the seriousness of the offense after administrative proceedings before the Commissioner of Customs begun by him or at the instance of the Secretary of Public Works and Communications with a fine of not less than fifty pesos nor more than two thousand pesos imposed upon the ship-owner and the suspension of the license of the master of the vessel concerned. Requirement: The Commissioner of Customs has the full responsibility to supervise the strict enforcement of the provisions of this Act. Explanation: The Commissioner of Customs is responsible for the strict enactment of this law. The Commissioner has the discretion on implementing the fine (not less than P50.00 nor greater than P2000.00) for any violation in this Act, provided that the seriousness of the violation is in fair proportion with the fine to be imposed. Sec. 8 The Secretary of Public Works and Communications, with the approval of the Department Head, shall promulgate such regulations as may be necessary for the efficacious application of this Act and shall fix a schedule of charges to be collected for private messages sent from the ship. Any violation of such regulations shall be punished by a fine of not more than two thousand pesos. Requirement: The Secretary of Public Works and Communications shall promulgate such regulations as may be necessary for the efficient application of this Act and shall fix a schedule of charges to be collected for private messages sent from the ship. Explanation: The Secretary of Public Works and Communications shall implement the regulations of this Act and shall be responsible for fixing schedule of charge collection for private message sent from the ship. Violation would have a fee of not more than P2000.00. Sec. 9 This Act shall take effect six months after its approval: Provided, that the Public Service Commission may extend this period for another six months in case there are in its discretion good reasons thereof. Requirement:

Explanation: This Act shall be implemented after six months of its approval. Another six (6) months shall be given as an extension in case there are legal reasons.

PRESIDENTIAL DECREE (E.O)


Executive Order No. 125, January 30, 1987 REORGANIZING THE MINISTRY OF TRANSPORTATION AND COMMUNICATIONS DEFINING ITS POWERS AND FUNCTIONS AND FOR OTHER PURPOSES. Sec. 14. Maritime Industry Authority. The Maritime Industry Authority is hereby retained and shall have the following functions: (a) Develop and formulate, plans, policies, programs, projects, standards, specifications and guidelines geared toward the promotion and development of the maritime industry, the growth and effective regulation of shipping enterprises, and for the national security objectives of the country; (b) Establish, prescribe and regulate routes, zones and/or areas of operation of particular operators of public water services; (c) Issue Certificates of Public Convenience for the operation of domestic and overseas water carriers; (d) Register vessels as well as issue certificates, licenses or documents necessary or incident thereto; (e) Undertake the safety regulatory functions pertaining to vessel construction and operation including the determination of manning levels and issuance of certificates of competency to seamen; (f) Enforce laws, prescribe and enforce rules and regulations, including penalties for violation thereof, governing water transportation and the Philippine Merchant Marine with the aid of other law enforcement agencies; (g) Undertake the issuance of licenses to qualified seamen and harbor, bay and river pilots; (h) Determine, fix and/or prescribed charges and/or rates pertinent to the operation of public water transport utilities, facilitate all services except in cases where charges or rates are established by international bodies or associations of which the Philippines is a participating member or by bodies or associations recognized by the Philippine Government as the proper arbiter if such charges or rates; (i) Accredit marine surveyors and maritime enterprises engaged in shipbuilding, shiprepair, shipbreaking, domestic and overseas shipping, ship management and agency; (j) Supervise the Philippine Merchant Marine Academy as reorganized herein in accordance with its charter, the provisions hereof and applicable laws, rules and regulations under the chairmanship of the maritime administrator; (k) Issue and register the continuous Discharge Book of Pilipino Seamen; (l) Establish and prescribes rules and regulations, standards and procedures for the efficient and effective discharge of the above functions; (m)Perform such other functions as may now or hereafter be provided by law.

Requirement: Accredit marine surveyors and maritime enterprises engaged in shipbuilding, shiprepair, shipbreaking, domestic and overseas shipping, ship management and agency; Explanation: Certify marine surveyors and maritime enterprises engaged in shipbuilding, shiprepair, shipbreaking, domestic and overseas shipping, ship management and agency.

j. Requirement: Supervise the Philippine Merchant Marine Academy as reorganized herein in accordance with its charter, the provisions hereof and applicable laws, rules and regulations under the chairmanship of the maritime administrator. Explanation: Administer the Philippine Merchant Marine Academy the provisions of applicable laws. k. Requirement: Issue and register the continuous Discharge Book of Pilipino Seamen. Explanation: Record the continuous Discharge Book of Pilipino Seamen. l. Requirement: Establish and prescribes rules and regulations, standards and procedures for the efficient and effective discharge of the above functions; Explanation: Create rules and regulations for efficient application of the provisions. m. DEPARTMENTAL ORDER
Department Order No. 87, s. 1952 Sec. 1. Equipment Requirements. The equipment should be built and installed in accordance with the standards of good engineering practice. The frequency must be crystalcontrolled. The radio transmitting and receiving equipment of a low power ship radiotelephone station must be pre-tuned and should not require any re-setting, aligning or any similar operation by the operator except the turning on and off of the power switch, the adjustment of volume control and the turning of a band switch or the depressing of a push button in order to shift to another authorized frequency. The equipment should be designed that none of the operations necessary to be performed during the course of normal rendition of service may cause off-frequency operation or result in any unauthorized radiation. Requirement: The equipment should be built and installed in accordance with the standards of good engineering practice. The frequency must be crystal-controlled. All technical controls in the equipment must follow basic technical procedures. Sec. 3 All low power ship radiotelephone stations using frequencies in the 2-Mc band must be capable of transmitting and receiving and shall be licenses to transmit and receive the maritime calling and distress radiotelephone frequency of 2182 Kcs. While all low power ship radiotelephone stations using frequencies in the 150 Mc band must be capable of transmitting and receiving and shall be licensed to transmit and receive on the calling, harbor control and safety frequency of 156.8 Mcs. Provided, however, That these frequencies shall be used only for calling and handling distress, urgent and safety traffic, (As amended by Dept. Order No. 104, effective July 15, 1952.)

Requirement: All low power ship radiotelephone stations using frequencies in the 2-Mc band must be capable of transmitting and receiving and shall be licenses to transmit and receive the maritime calling and distress radiotelephone frequency of 2182 Kcs. While all low power ship radiotelephone stations using frequencies in the 150 Mc band must be capable of transmitting and receiving and shall be licensed to transmit and receive on the calling, harbor control and safety frequency of 156.8 Mcs. Provided, however, That these frequencies shall be used only for calling and handling distress, urgent and safety traffic. Explanation: All low power ship radiotelephone stations that are capable of transmitting and receiving under the frequency of 2-Mc band shall be given license to transmit and receive the maritime calling and distress radiotelephone frequency of 2182 Kcs. While those radiotelephone stations capable of transmitting and receiving under the frequency 150 Mc shall be given license to transmit and receive the calling, harbor control and safety frequency of 156.8 Mcs. As long as the frequencies shall be used for calling and handling distress, urgent and safety trafficc. Department Order No. 2001-47, s. 2001 Mandatory Ship Reporting System (MSRS) The Mandatory Ship Reporting System (MSRS) shall serve as means for the promotion of safety of life at sea, safety and efficiency, of navigation, and protection of the marine environment. MSRS shall ensure the constant monitoring of all vessels through the periodic reports that are required to be submitted by vessels to an MSRS Center while they are at sea. Requirement: The MSRS shall serve as means for the promotion of safety of life at sea, safety and efficiency, of navigation, and protection of the marine environment. Explanation: This Department Order serves as a means of promoting safety of life at sea, safety and efficiency of navigation, and protection of the marine environment. MSRS aims to ensure the constant monitoring of all vessels through submission of periodic reports by every vessel to MSRS Center while at sea. This Order covers all vessels engaged in the domestic trade that are covered by NTC Memo Circular No. 04-09-88.

MEMORANDUM CIRCULAR
NTC MC No. 4-09-8 To promote further the safety of navigation, all ship radio stations, duly licensed by the Commission, are hereby required to maintain continuous radio watch during the entire period of navigation of the vessels concerned. Requirement: All ship radio stations are required to maintain continuous radio watch during the entire period of navigation of the vessels concerned. Explanation: Even if vessels navigate less than sixty miles and the voyage is less than five hours, the NTC now requires the installation of radio equipment to enhance the safety of life and property. NTC MC No. 6-4-99, April 12, 1999 In view of the mandatory full compliance to the Global Maritime Distress and Safety System (GMDSS) effective February 1, 1999 as required by the Radio Regulation, the following minimum qualification and number of radio personnel on board Philippine registered vessels are hereby required: 1. Two deck officers (who are not the master) with General Operator Certificate (GOC) or one exclusive radio officer with both GOC and Radio Electronic Certificate (REC). 2. For ships with At-Sea (on board) maintenance capability, two deck officers with GOC who is not the master and one non-exclusive radio officer holding GOC and REC. Requirement: Two deck officers (who are not the master) with GOC or one exclusive radio officer with both GOC and REC is required as qualification for personnel of vessels. Explanation: The personnel required by this law are two (2) deck officers with GOC or one (1) exclusive officer with both GOC and REC.

Requirement: For ships with At-Sea (on board) maintenance capability, two deck officers with GOC who is not the master and one non-exclusive radio officer holding GOC and REC is required as qualification for personnel of vessels. Explanation: For At-Sea maintenance capability, two (2) deck officers with GOC and one (1) non-exclusive radio officer with GOC and REC. RCO Memo. Circular No. 16, Oct. 30, 1972 Radio stations on board vessels or ships shall be issued clearances by the NTC or any of its district offices which shall be effective for a period of ninety (90) days from the date of issuance thereof. However, this is without prejudice for conducting inspection of such radio stations by the representative of the National Telecommunications Commission at any time whenever the Office deems proper and necessary. Requirement: Radio stations on board vessels or ships shall be issued clearances by the NTC or any of its district offices which shall be effective for a period of ninety (90) days from the date of issuance thereof. Explanation: Clearances shall be issued for vessels good for ninety (90) days upon its date of issuance upon passing proper inspections. NTC MC No. 10-7-82, July 13, 1982 Pursuant to the Presidential Instruction LOI no. 1070, dated October 2, 1980, and in order to avoid unnecessary delay in the departure of vessels from ports, Memorandum Circular No. 16 issued by the Radio Control Office on October 30, 1972, requiring all vessels equipped with radio installation to obtain radio ship clearance before leaving ports, is rescinded. Requirement: In order to avoid unnecessary delay in the departure of vessels from ports, it is required that all ships equipped with radio installations to obtain radio ship clearance before leaving ports. Explanation: Radio ship clearance must be obtained by all vessels before leaving ports in order to avoid unnecessary delay in the departure.

NTC MC No. 5-7-80, July 18, 1980 1. All ship stations subject to licensing by the National Telecommunications Commission are hereby required to be equipped with very high frequency (VHF) radiotelephone transceivers that are type-accepted by the Commission for use of radio stations in the maritime mobile service. 2. The NTC shall not grant any new or renewal ship station license or permit to operate a radio station on board any vessel unless such vessel is equipped with the required VHF radiotelephone transceiver. 3. The VHF equipment shall be installed in the upper part of the ship and fitted with a vertically polarized unity gain antenna at normal height of 9.15 meters (30 feet) above water. For small vessels, such as fishing boats, barges, tugboats, etc. the antenna shall be installed on the highest portion of their masts. The antenna shall, in so far as is practicable, have an unobstructed view in all directions. 4. The VHF transceiver must be capable of operation, at least on the following channels: 156.8 MHz for Distress, Safety and Calling 156.3 MHz for Internship and Safety (For safety and coordinated Search and Rescue Operations). 156.6 MHz for non-distress communication with the Philippine Coast Guard or Harbor-master. 5. All ship stations at sea, when within VHF communication distance range and desiring to communicate with each other, shall use the VHF transceiver on board instead of any High Frequency (HF) Morse Code or Single Side Band (SSB) equipment. 6. In order to avoid interference and ensure satisfactory service, it is essential and among others that: a. All stations shall radiate only as much power as necessary. b. Before transmitting, a station shall take precautions to ensure that its emission will not interfere with transmission already in progress. If such interference is likely, the station shall wait for an appropriate break in the communication in progress. c. All transmissions of the stations shall be identified by their respective assigned call signs. 1. Requirement: All ship stations subject to licensing by the National Telecommunications Commission are required to be equipped with VHF radiotelephone transceivers that are accepted by the Commission for use of radio stations in the service. Explanation: All on board ship stations must have VHF radiotelephone transceivers for communication purposes.

2. Requirement: NTC shall not grant any new or renewal ship station license or permit to operate a radio station on board any vessel unless such vessel is equipped with the required VHF radiotelephone transceiver. Explanation: No ship station license will be issued nor renewed for a vessel without the required VHF radiotelephone transceiver. 3. These are the frequencies which the vessels should be capable of

NTC MC No. 4-2-92 Safety of Life at Sea (SOLAS) SUBJECT: Amendments to the 1974 Safety of Life at Sea Convention (M.C. No. 02-2-82) concerning Radio communications for the Global Maritime Distress and Safety System. Pursuant to the provisions of the 1974 Safety of Life at Sea Convention as amended, concerning radio communications for the global maritime Distress and Safety System, the following guidelines and procedures shall be strictly observed by all Philippine registered vessels engaged in the international trade. Issuance of Cargo Ship Safety Radio Certificate General Procedures 1.) Any physical desiring to obtain a Cargo Ship Safety Radio Certificate for his vessel engaged in the international trade shall file in the prescribed application from with the main office of NTC at Quezon City. Requirement: Any physical desiring to obtain a Cargo Ship Safety Radio Certificate for his vessel engaged in the international trade shall file in the prescribed application from with the main office of NTC at Quezon City. Explanation: Those who are planning to have a Cargo Ship Safety Radio Certificate for the vessel to be used must apply at the main office at Quezon City. 2.) The Commission may issue a Cargo Ship Safety Radio Certificate applied for, after inspection of the radio installation which complies with the requirements of the SOLAS Convention, as amended. Requirement:

The inspection of the radio installation of a cargo vessel located in any Philippine port shall be performed by any duly authorized representative of NTC. Letter of request for Temporary Permit to operate the existing radio installation on board vessel and the assignment of a Philippine call sign thereof. Requirement: For vessel located in a foreign port: 1. Copy of the MARINA approval for acquisition on the vessel; 2. 1. The Cargo Ship Safety Radio Certificate and Exemption Certificate shall be issued for a period not exceeding 12 months or 1 year. 2. If a survey/inspection takes place within two months before the expiration of a certificate may be withdrawn and a new certificate may be issued which shall expire 12 months after the end of the withdrawn certificate. 3. A certificate shall cease to be valid upon transfer of the ship to the flag of another government.

NTC MC No. 8-3-2000 FORM OF SAFETY RADIO CERTIFICATE FOR CARGO SHIPS Pursuant to the provisions of the 1974 SOLAS convention, as amended, concerning radio communications for Global Maritime Distress and Safety System (GMDSS), and to comply with the international format standard of the Safety Radio Certificate, it is hereby directed that all NTC accredited/recognized Classification Society must include in the Safety Radio Certificate they issue in behalf of the National Telecommunications Commission and the Philippine Government the following: (1) The NTC Official Seal/Logo must appear on the left portion of the Cargo Ship Safety Radio Certificate title; (2) The official seal or stamp of the issuing Classification Society must be placed below the signature of the authorize official issuing the certificate. This circular takes effect immediately and supersedes any existing NTC order, circular instruction, memorandum or part thereof which is inconsistent herewith. Requirements: (1) The NTC Official Seal/Logo must appear on the left portion of the Cargo Ship Safety Radio Certificate title; (2) The official seal or stamp of the issuing Classification Society must be placed below the signature of the authorize official issuing the certificate. Explanation: The given requirements are the contents of the safety radio certificate for cargo ships. NTC MC No. 2-1-96 Any Philippine registered vessel engaged in the international trade with 1,600 tonnage and upwards is hereby exempted from the installation of a radio direction finder on the condition that the vessel has fully complied with the requirements of the Global Maritime Distress and Safety System (GMDSS) on board facilities and a radionavigation equipment as a Global Posistioning System (GPS) is installed on board the vessel. Requirement: Any Philippine registered vessel engaged in the international trade with 1,600 tonnage and upwards is hereby exempted from the installation of a radio direction finder on the condition that

the vessel has fully complied with the requirements of the Global Maritime Distress and Safety System (GMDSS) on board facilities and a radionavigation equipment as a Global Posistioning System (GPS) is installed on board the vessel. Explanation: Any Philippine vessel with 1,600 tons and above is exempted to install a radio direction finder, but must comply with the GMDSS and must install GPS. NTC MC No. 2-3-99 Pursuant to the provisions of Act 3396 as amended, and the 1974 SOLAS Convention as amended, concerning radio communications for the Global Maritime Distress and Safety System (GMDSS) particularly Chapter IV, Regulation III, any Philippine registered vessel engaged in the international trade which are to be taken permanently out of service before 01 February 2001 may apply for exemption from the mandatory full installation of GMDSS. The application shall be accompanied by a written statement or certification from the shipowner duly approved and endorsed by the Maritime Industry Authority (MARINA) that the vessel is to be taken permanently out of service before 01 February 2001. The exemption shall be subject to the following conditions: 1. The actual operation of the ship station shall be operated on only at all times by a duly qualified radio officer. 2. The vessel should be able to conduct distress and safety radiocommunications using radiotelephony on medium frequency (2182kHz) and VHF in a dead ship situation. This would include provision of a reserve source of electrical energy. 3. The following GMDSS apparatus must be on board: two-way portable VHF radios, Radar Transponders, Satellite EPIRB, NAVTEX, VHF with DSC, Inmarsat C with ECG and X-Band Radar. 4. Requirements: Any Philippine registered vessel engaged in the international trade may apply for exemption from the mandatory full installation of GMDSS. The application shall be accompanied by a written statement or certification from the shipowner duly approved and endorsed by the Maritime Industry Authority (MARINA) that the vessel is to be taken permanently out of service before 01 February 2001. Duplication of Equipment b. Shore-based maintenance c. At-sea electronic maintenance capability d. 1. On ships engaged on voyages on sea areas A1 and A2, the availability shall be ensured by using any one (1) of the above methods. Requirement: Ships engaged on voyages in sea areas A1 and A2, the availability of the functional requirements of radio equipment shall be ensured by using at least one method such as duplication of equipment, shore based maintenance and on board electronic maintenance capability. Explanation: Ships traveling under sea areas A1 and A2 must follow at least one of the methods: duplication of equipment, shore based maintenance and on board electronic maintenance capability . 2. On ships engaged on voyages on sea areas A3 and A4, the availability shall be ensured by using a combination of at least two (2) of the above methods. Testing should be carried out using suitable test equipment capable of performing all the relevant measurements required in these guidelines. 2. The examination of the installed 406 MHz satellite EPIRB should include: 2.1. Checking position and mounting for float-free operation; 2.2. Carrying out visual inspection for defects;

3. A written report to NTC, Radio Regulation and Licensing Department shall be submitted ten (10) days after each annual testing of the 406 MHz satellite EPIRB has been carried out. 1. Requirement: Testing should be carried out using suitable test equipment capable of performing all the relevant measurements required in these guidelines. Explanation: Use only suitable test equipment. 2. NTC MC No. 6-3-2000 Subject: Guidelines for the participation of non-convention ships (less than 300 G.T.) in the Global Maritime Distress and Safety System (GMDSS). Pursuant to R.A. 3846, R.A. 3396, the 1974 Safety of Life at Sea (SOLAS) convention, as amended, and the recommendation of the maritime safety committee (Annex 7-7) under the fiftyfourth session for the participation of non-convention ships in the Global Maritime Distress and Safety System (GMDSS), the following radiocommunication equipment are hereby required and shall be installed on board a Philippine flag vessel of less than 300 G.T. engaged in the international trade for effective participation in the distress and safety communication: 1. A marine type SSB/HF and VHF transceiver capable of providing ship-to-shore and ship-to-ship distress communication. 2. Satellite EPIRB (Emergency Positioning-Indicating Radio Beacon) capable of generating the signals of ship's position and identification code of the ship in distress. 3. A 9 GHz SAR (Search and Rescue) radar transponder capable of transmitting signals to indicate the ship's position in distress and bearing on the radar screen of the rescuing ship. 4. NAVTEX receiver use to receive navigation warnings and marine safety information. 5. At least two (2) units of two-way VHF radio equipment (GMDSS type-approved) used to communicate between ship in distress, survival craft and rescue ship. 1. Requirement: A marine type SSB/HF and VHF transceiver capable of providing ship-to-shore and ship-to-ship distress communication. Explanation: A marine type transceiver capable of providing ship-to-shore and ship-to-ship distress communication is required.

2. Requirement: Satellite EPIRB (Emergency Positioning-Indicating Radio Beacon) capable of generating the signals of ship's position and identification code of the ship in distress. Explanation: Satellite EPIRB is required. 3. NTC MC No. 9-7-98 In compliance with ITU Radio Regulations, Chapter NIX Article 55 and the provisions of Section IV-2, STCW Convention of 1995 on the issuance and use of Global Maritime Distress Safety System (GMDSS) Certificates, the National Telecommunications Commission (NTC) pursuant to the powers vested upon it hereby promulgates the guidelines for training, qualifications, examination and the issuance of a Restricted Operator's Certificate: 1. A holder of a Restricted Operator's Certificate (ROC) shall be one who has qualified and passed the required NTC examination and has shown knowledge and professional competence and qualification in the following aspects: 1.1. Practical knowledge of the operation of the GMDSS sub-systems and equipment which is required while the ship is sailing within the range of VHF coast stations; 1.2. Ability to send and receive correctly by radiotelephone; 1.3. Knowledge of the regulations applying to radiotelephony communications specifically those relating to the safety of life; 1.4. An elementary knowledge of one of the working languages of the ITU. Candidates should be able to express themselves satisfactorily in that language, both orally and in writing. 2. Pursuant to the provisions of the 1974 International Convention on Safety of Life at Sea (SOLAS) and its amendments; and relevant Philippine radiocommunications laws, rules and regulations on maritime communication, specifically that of Department Orders 2001-46 and 2001-47. Requirement: The NTC promulgates the rules and guidelines in the installation of NAVTEX receiver and EPIRB navigational aids.
