Owner Agreement
I, ____________________________________________, have read, understand, and agree to the following:

1. I certify that my dog(s) are in good health, on monthly flea and parasite prevention, and have not been ill with any
communicable condition in the last 30 days. I further certify that my dog(s) have not harmed or shown aggressive or
threatening behavior toward any person or any other dog (unless described in detail on the Pet Information Form) and
would be deemed to be socialized by any reasonable standard.

2. I understand that I am solely responsible for any harm or damage caused by my dog(s) to property, persons or other
dogs on the premises of Barks & Rec while my dog(s) is/are attending Barks & Rec either for day care or boarding
overnight.

3. I further understand and agree that, in admitting my dog(s) to Barks & Rec, that the staff have relied on my
representation of my dog(s) and his/their behaviors, and that my dog(s) is/are in good health and have not harmed or
shown aggressive or threatening behavior towards any person or any other dog not fully described on the Pet Information
Form.

4. I further understand and agree that Barks & Rec, and their staff and volunteers, will not be liable for any problems
which develop, provided reasonable care and precautions are followed, and I hereby release and discharge them of any
and all damages, liability and/or causes of action of any kind of accident, damage or injury whatsoever arising from my
dogs attendance and participation while at Barks & Rec.

5. I further understand, consent and agree that any problem or injury that develops with my dog(s) while under the control
of Barks and Rec will be treated by my own vet. In the event my own vet is not available or too far away, I agree to allow
the staff at Barks and Rec to make decisions as to emergency medical care necessary to treat my dog. I agree to assume
full financial responsibility for any and all expenses involved in such treatment.

6. I recognize that there are inherent risks of illness or injury when dealing with animals. Such risks may include, but are
not limited to, problems resulting from rough play and canine illnesses. I recognize that when older pets are boarded they
are placed under a great deal of stress due to removal from their normal home environment. This stress can cause latent
physical conditions (such as heart, liver and kidney disorders) to become active, which can result in illness or death of my
dog. I agree that Barks & Recs liability shall in no event exceed the lesser of the current chattel value of my dog(s) of the
same species or the sum of $200 per animal boarded.

7. I am aware that my dog will co-mingle with dogs owned by different owners while staying at Barks & Rec. I understand
that just like human children that play on playgrounds in daycare or at school can get hurt from time to time dogs playing
with each other can get hurt too. Dogs play with their mouths and paws and can be very physical. If injuries do occur, I
agree that I, not Barks & Rec, am responsible for any medical expenses for my dog, as I would be for a human child. I am
fully aware of and assume the inherent risk associated with free roam daycare activities and expressly assume all risk of
injury to my dog(s) during the time Barks & Rec has care, custody and control of my dog(s). These risks include, but are
not limited to playing, running, biting, chasing, falling, colliding with other animals or objects, running away, wrestling, and
certain hazards such as surface and subsurface conditions, that may result in injury, harm or possible death of my dog(s).
I further recognize and accept the unpredictability of my dogs reaction to sounds, sudden movement, unfamiliar objects,
persons or other animals.

8. I understand that should Barks & Rec determine that my dog is not an acceptable resident of their facility, or that my
dog may cause injury or harm to another pet or human, that Barks & Rec reserves the right to terminate the care of my

pet and this Agreement, and Barks & Rec agrees to refund any balance remaining unused for the care of my dog. Clearly
the refund will be a pro rata portion of fees paid by me to Barks & Rec.

9. I agree to provide the following notice in the event of the cancellation or early termination of any day care or boarding
arrangements. I agree to the fees listed below, and indemnify Barks & Rec for any costs or loss of profit that may arise,
understanding that Barks & Rec will make any reasonable effort to mitigate their loss.

Daycare: If you do not cancel your daycare reservation at least 24 hours in advance, you will be charged for a full
day ($20).
Overnight care (non-holiday): Must be cancelled at least 48 hours prior to scheduled arrival time. If the
reservation is not cancelled 48 hours prior, a $20 per dog cancellation fee will be charged. If you do not cancel
your overnight reservation and do not show, you will be charged for a full night for each dog ($35).
Holidays: A $50 per dog deposit is required to hold a holiday reservation. Cancellations must be made at least 5
days prior to your scheduled arrival. If the reservation is not cancelled at least 5 days prior to your scheduled
check-in date, you will be charged $50 per dog. If you do not cancel your holiday reservation and do not show,
you will be charged for your original - and full - stay.

10. I agree to pay the rate for boarding in effect on the date my dog(s) is/are checked into Barks & Rec and to pay all
costs and charges for special services requested, and all veterinary costs for the dog(s) during the time he/they is/are in
the care of Barks & Rec.

11. I agree that all money owed by me shall be payable upon drop-off of dog(s), or at the latest when my dog(s) are
picked up should there be a balance owed due to a longer than anticipated stay, extra services, etc. I understand that if I
do not pick up my dog(s) within 15 calendar days after the day my dog(s) was/were due to be picked up, that my dog(s)
shall be deemed to be abandoned. The person into whose custody the pet was placed for care shall first try for a period of
not less than 10 days to find a new owner for the pet, and, if unable to place the pet with a new owner, shall thereafter
humanely destroy the pet so abandoned.

12. I agree that this Contract, subject to the forms and papers to be completed at the time of registration, contains the
entire agreement between the parties and that all terms and conditions of this Contract shall be binding on the heirs,
administrators, personal representatives and assigns of Owner and Kennel. I further agree that any controversy or claim
arising out of or relating to this Contract, or the breach thereof, or as the result of any claim or controversy involving the
alleged negligence by any party to this Contract, shall be settled by arbitration in accordance with the rules of the
American Arbitration Association, and judgment upon the award rendered by an arbitrator may be entered in any Court
having jurisdiction thereof. The arbitrator may, as part of this award, determine an award to the prevailing party of such
costs of such arbitration and reasonable attorney's fees of the prevailing party as Arbitrator finds reasonable.

13. Lastly, I understand that the provisions of this Agreement are severable. The waiver by either Barks & Rec or me of
any breach of any of these provisions shall not be construed as a waiver of any subsequent breach of that or any
provision. I certify that I have read, understood and agree with the policies of the kennel as set forth on the (2) preceding
pages and that I have read, understood and agree with the conditions and statements of this agreement.

14. I understand that if my dog is visibly ill, or has vomiting or diarrhea, that Barks & Rec may transport my dog to a vet
who can quarantine my dog for the safety of both my dog and other guests. I understand that Barks & Rec will make
every effort to reach me prior to transport and/or treatment, but that Barks & Rec reserves the right to take my visibly ill
dog(s) to the veterinarian with or without my consent, with all veterinary expenses to be paid by me as the owner of my
dog.
