Mendiskusikan hal ihwal tentang Mediasi di Indonesia adalah hal yang sangat menarik. Di Indonesia Mediasi masih dianggap sebagai salah satu upaya alternatif dalam penyelesaian sengketa . Hal inilah yang membuat menarik, karena, sementara itu jika direnungkan dan dikaji lebih dalam lagi, berdasarkan nilai-nilai yang hidup sejak bangsa Indonesia belum merdeka ini, yaitu salah satunya “Musyawarah Mufakat”, sebagaimana terkandung dalam Pancasila, yang kebenaran nilai-nilai luhurnya sangat Universal, justru merupakan cikal bakal dari Mediasi, maka sudah seyogyanya “Mediasi menjadi upaya utama yang harus didahulukan dalam penyelesaian sengketa”.

A discussion of mediation in Indonesia is an intriguing endeavour. In Indonesia mediation is still regarded as one of the alternative methods of dispute resolution. This point of view is what makes such a discussion so interesting, especially if one contemplates this matter more carefully and digs a little deeper. To begin with consider one of the underlying principles of the Indonesian people: Musyawarah Mufakat (Collective Decision Making). This is a principle that has existed since prior to the country’s independence and is now embodied in the Pancasila . It has in fact been a seed of growth for the mediation we have today. Accordingly mediation is more accommodating towards local values and ought to really be viewed as the main form of dispute resolution, to be placed before other methods (assuming negotiations between the disputing parties have failed).

This study discusses the procedure of divorce settlement through mediation in the Manado Religious Court. This study aims are to know the Procedure of Mediation in the Manado Religious Court and to analyze the Effectiveness of Mediation in the Manado Religious Court. This study was juridical empirical research or sociological legal research. It was qualitative research with the type of descriptive research by using inductive method of thinking and analyze descriptively. This study used the legislative approach, case approach, sociological approach, and conceptual approach. The results show that determination by Mediator in the Manado Religious Court shall not only be determined by the judges, but given the opportunity to the parties to make a selection. Mediation of the marital case in Manado Religious Court has not run effectively. This can be perceptible that the mediation outcomes have decreased every year. In 2015, there were 106 cases which is 6 cases were successfully mediated. In 2016, there were 94 cases that only 3 cases were successfully mediated. Last in 2017, there were 76 cases, which is only 1 case was successfully mediated.

Masa sebelum Penjajahan Sebelum datang peradaban hindu ke Indonesia peradilan yang berlaku di masyarakat peradilan adat adalah Peradilan hindu yangmerupakan persidangan majelis tetua-tetua adat dusun dan desa. Setelah datangnya peradaban hindu timbulahkekaisaran yang disebut Peradilan Perdata. Dengan datangnya Agama Islam di Indonesia terjadilah perubahan. Di Kerajaan Mataram semasa Sultan Agung peradilan perdata kemudian diubah menjadi peradilan Surambi yang bersidng di serambi masjid agung dengan majelis penghulu sebagai Hakim Ketua dengan dampingi para ulama sebagai Hakim Anggota. Karena itu Peradilan Serambi tidak hanya sebagai peradilan umum tetapi juga sebagai penasehat raja. Peradilan Surambi ini juga terletak di Malang yang bertempat di Masjid Agung (Masjid Jami ') yang terletak di sebelah barat alun-alun kota Malang. 2. Masa Penjajahan Belanda sampai dengan Jepang Ketika Belanda berkuasa di luar negeri, mungkin mereka akan tinggal di sini. Hukum Eropa dan Peradilan tidak boleh diabaikan, karena mereka tahu penduduk Indonesia, sebagian besar, beragama, Islam, sampai berakhirnya ke kekuasaan Belanda di Indonesia. Peradilan Agama Islam merupakan bagian dari Peradilan hukum adat atau Peradilan Swapraja, yang diminta Terkait mengatur dalam pasal 134 ayat 2 IS penyimpang dari ketentuan tentang hak mengatur peradilan yang diadakan oleh Negara, jika perkara perdata di antara orang-orang Islam, sesuai sesuai dengan ketentuan Hukum Adat, diadili oleh pengadilan agama tidak ditentukan di undang-undang.
